"contents": "<span style=\"font-weight: 400;\">The confirmation that the United Arab Emirates has turned down our government’s extradition request for Ajay and Tony Gupta, and essentially gifted them freedom, is of immense symbolic importance. It is about much more than the Guptas or even our relations with the UAE. It is about whether anyone will ever be held accountable for what happened during the years of State Capture. Coming as it does, when our murder and overall crime rates are rising so rapidly, it is also a symbol that we are fast becoming a country no longer governed by the rule of law; that no one, inside or outside our frontiers, respects South Africa any more. </span>\r\n\r\n<span style=\"font-weight: 400;\">While it appears impossible to believe that State Capture could have happened in the way it did without former president Jacob Zuma, the Guptas were the other side of that corrupt coin.</span>\r\n\r\n<span style=\"font-weight: 400;\">First, there were investigative journalists’ efforts that lasted a decade and culminated in the </span><a href=\"https://www.gupta-leaks.com/\"><span style=\"font-weight: 400;\">#GuptaLeaks</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">Then there were court records </span><a href=\"https://www.dropbox.com/sh/caqypypdq29ip98/AACMKQVQRa2ZWjwKDla2WH8Oa?dl=0\"><span style=\"font-weight: 400;\">showing how our money was leaving the country</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">This was followed by the entire Zondo Commission and evidence of incredible sums of money </span><a href=\"https://www.dailymaverick.co.za/article/2021-05-24-the-totalish-cost-of-the-guptas-state-capture-r49157323233-68/\"><span style=\"font-weight: 400;\">as the investigator Paul Holden showed</span></a><span style=\"font-weight: 400;\"> where the money came from and where it disappeared to.</span>\r\n\r\n<span style=\"font-weight: 400;\">But there was also the attitude of the Guptas, who knew everyone knew what they were doing — and they didn’t care.</span>\r\n\r\n<span style=\"font-weight: 400;\">They bought the political party Black First Land First (who famously went to </span><a href=\"https://www.timeslive.co.za/politics/2017-04-07-black-first-land-first-disrupt-peaceful-anti-zuma-march-at-gupta-compound/\"><span style=\"font-weight: 400;\">“guard” the Gupta estate in Saxonwold</span></a><span style=\"font-weight: 400;\"> during a Zuma Must Fall protest).</span>\r\n\r\n<span style=\"font-weight: 400;\">They also secured the use of the Waterkloof Air Force Base, when Atul Gupta gave an interview to the journalist Barry Bateman confirming the </span><a href=\"https://ewn.co.za/2013/04/30/Gupta-family-gets-royal-SA-escort\"><span style=\"font-weight: 400;\">landing of his guests from India</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">Our country was sold to the Guptas for virtually nothing — it was given away to a group of people who were </span><a href=\"https://www.news24.com/news24/guptaleaks-emails-offer-further-proof-of-gupta-racist-attitudes-20170609\"><span style=\"font-weight: 400;\">clearly anti-black racists</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">This is why getting some kind of justice for it all mattered so much to South Africans. After the humiliation of the State Capture era, it was important for our self-respect, for a country yearning for proof that in fact, we are not a place where only might is right.</span>\r\n\r\n<span style=\"font-weight: 400;\">Now, that possible redemption of holding the Guptas legally accountable, as hollow as it really might be in any case, has been denied.</span>\r\n\r\n<span style=\"font-weight: 400;\">In the middle of this is the contestation about what actually happened.</span>\r\n\r\n<span style=\"font-weight: 400;\">The UAE says it complied with every step of our extradition treaty with them. Sources in Dirco have told </span><i><span style=\"font-weight: 400;\">Daily Maveric</span></i><span style=\"font-weight: 400;\">k our government will take </span><a href=\"https://www.dailymaverick.co.za/article/2023-04-12-sa-to-demarche-uae-envoy-on-gupta-extradition-failure-sources/\"><span style=\"font-weight: 400;\">diplomatic action against the UAE in the form of a démarche</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">At least two academics, though, have pointed out that this was probably the result of a failure by our government to comply with all of the paperwork.</span>\r\n\r\n<span style=\"font-weight: 400;\">As Professor </span><a href=\"https://www.dailymaverick.co.za/opinionista/2023-04-11-gupta-extradition-bid-was-by-the-book-how-can-we-be-sure/\"><span style=\"font-weight: 400;\">Omphemetse Sibanda has pointed out in </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i></a><span style=\"font-weight: 400;\">, the UAE says South Africa did not submit valid arrest warrants. If that is true, one can hardly blame them for doing what they did.</span>\r\n\r\n<span style=\"font-weight: 400;\">Also, Unisa’s Professor Emeritus of International Law, André Thomashausen, has pointed out that the UAE is involved in extradition requests fairly often, and often grants the extradition. He has mentioned the case of an Italian national implicated in Mafia-related activity who was extradited from there in recent months. </span>\r\n\r\n<span style=\"font-weight: 400;\">However, in her </span><span style=\"font-weight: 400;\">exposé</span><span style=\"font-weight: 400;\">, </span><i><span style=\"font-weight: 400;\">Daily Maverick’s</span></i><span style=\"font-weight: 400;\"> Ferial Haffajee threw a cat amongst the pigeons when she revealed that the Dubai prosecutors confirmed in writing that the South African submission was in order.</span>\r\n\r\nhttps://www.dailymaverick.co.za/article/2023-04-12-dubai-prosecutors-confirmed-in-writing-that-the-gupta-extradition-documents-were-in-order/\r\n<h4><b>A flailing criminal justice system</b></h4>\r\n<span style=\"font-weight: 400;\">Still, way too many times in the past the problem was with ourselves. And this is where the real power of the dark symbolism lies.</span>\r\n\r\n<span style=\"font-weight: 400;\">It is extremely easy, again, to see clearly that our criminal justice system does not work.</span>\r\n\r\n<span style=\"font-weight: 400;\">There is now so much evidence for this, whether it be </span><a href=\"https://www.dailymaverick.co.za/article/2023-02-17-murder-and-sexual-offences-spike-sharply-as-police-minister-reveals-extent-of-sa-criminality/\"><span style=\"font-weight: 400;\">the incredible increase in murders</span></a><span style=\"font-weight: 400;\">, the shocking </span><a href=\"https://issafrica.org/iss-today/soaring-murder-rates-underline-the-lack-of-sound-direction-for-policing\"><span style=\"font-weight: 400;\">decrease in successful convictions</span></a><span style=\"font-weight: 400;\">, a jail system which cannot keep people inside it, and the general fear </span><a href=\"https://www.dailymaverick.co.za/article/2023-04-11-murders-most-foul-south-africa-needs-a-citizens-accord-for-peace/\"><span style=\"font-weight: 400;\">so many South Africans live in</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">There are now so many examples of a lack of accountability and the resulting fear emanating from this fundamental failure.</span>\r\n\r\n<span style=\"font-weight: 400;\">In the days before the EFF’s “National Shutdown” march, many believed there would be widescale public violence. One of the </span><a href=\"https://www.dailymaverick.co.za/article/2023-03-16-march-20th-effs-day-of-thunder-slumber-is-approaching-and-sa-is-still-nonplussed/\"><span style=\"font-weight: 400;\">major reasons for this fear</span></a><span style=\"font-weight: 400;\"> was the fact that so few have been held accountable for the deliberate violence in KwaZulu-Natal and Gauteng in July 2021 that vanished almost 400 lives and caused billions of rands in damage.</span>\r\n\r\n<span style=\"font-weight: 400;\">Even highly public figures who openly incited the violence, such as Duduzile and Duduzane Zuma, have not even been charged for what they said.</span>\r\n\r\n<span style=\"font-weight: 400;\">For people living in a community where they are routinely threatened with personal harm, who know that reporting these threats to the police is a waste of time at best, this is another slap in the face.</span>\r\n\r\n<span style=\"font-weight: 400;\">Meanwhile, there is yet another case which is currently at the forefront of the public domain, which is also putting our criminal justice system on trial.</span>\r\n\r\n<span style=\"font-weight: 400;\">Thabo Bester’s amazing jailbreak and the fact it clearly involved corruption has shown how easy it is for those with resources to leave prison. The fact he held conferences from inside a prison is a national embarrassment.</span>\r\n\r\n<span style=\"font-weight: 400;\">Added to this are the crimes that he pleaded guilty to. He raped several women and killed one of his victims.</span>\r\n\r\n<span style=\"font-weight: 400;\">In a country with such a high rate of gender-based violence, and with such a low conviction rate for it, this gives it even more power.</span>\r\n\r\n<span style=\"font-weight: 400;\">As the DA’s justice spokesperson, Glynnis Breytenbach, put it in at least one interview, imagine being the victim of Bester, a person he raped, and bumping into him in a supermarket, having presumed he was in prison or dead.</span>\r\n\r\n<span style=\"font-weight: 400;\">Imagine the unbelievable trauma of that.</span>\r\n\r\n<span style=\"font-weight: 400;\">However, the fact that he has been detained in Tanzania may offer some hope for redemption. If he is extradited, despite the technicalities of the process, and if he is then jailed (again) this may restore some hope, that in some cases at least, justice will be served.</span>\r\n\r\n<span style=\"font-weight: 400;\">It may be important to remember that in the past at least two other people in SA have openly challenged the justice system and were then held accountable.</span>\r\n\r\n<span style=\"font-weight: 400;\">The first is Radovan Krejčíř, who many believed simply had too much money and was too able to use violence, to be convicted and jailed. He had, after all, managed to escape from the Czech Republic.</span>\r\n\r\n<span style=\"font-weight: 400;\">He is now serving his eighth year behind bars.</span>\r\n\r\n<span style=\"font-weight: 400;\">The other, perhaps more importantly, is Richard Mdluli. He rose to the position of head of the Crime Intelligence Unit of the SAPS and was close to Zuma.</span>\r\n\r\n<span style=\"font-weight: 400;\">Despite that, he was eventually convicted of assault and kidnapping, and jailed (he has now been released on parole).</span>\r\n\r\n<span style=\"font-weight: 400;\">These are examples of people who were thought to be “untouchable” being jailed. Bester may prove to be another, which would be a symbol in the fight against gender-based violence.</span>\r\n<h4><b>A lesson from the State Capture era</b></h4>\r\n<span style=\"font-weight: 400;\">But in the meantime, there are other symbols which suggest that as a country we are making no progress.</span>\r\n\r\n<span style=\"font-weight: 400;\">Surely the most important is the fact that despite all of the testimony, all of the evidence, and all of the findings of the Zondo Commission, hardly anyone has been charged.</span>\r\n\r\n<span style=\"font-weight: 400;\">In fact, several people against whom findings were made are still </span><a href=\"https://www.dailymaverick.co.za/article/2022-10-25-ramaphosas-response-to-zondo-an-act-of-contradiction-stop-future-corruption-but-suspend-a-current-crackdown/).%20Some%20have%20even%20been%20elected%20to%20top%20positions%20(https://www.dailymaverick.co.za/article/2022-10-10-when-corruption-and-incompetence-are-not-disqualifying-enough-nomvula-mokonyanes-puzzling-staying-power/\"><span style=\"font-weight: 400;\">serving in the executive in the ANC</span></a><span style=\"font-weight: 400;\">. This lack of action presents a clear lesson from the State Capture era: </span>\r\n\r\n<span style=\"font-weight: 400;\">Those who take part in State Capture, have nothing to fear.</span>\r\n\r\n<span style=\"font-weight: 400;\">In fact, our current state of South Africa is looking more and more like the Zuma state that allowed State Capture to thrive. Our President, who claims to be fighting corruption (as did his predecessor), now has to rely on the ANC’s parliamentary majority to avoid a full inquiry into what happened on his farm.</span>\r\n\r\n<span style=\"font-weight: 400;\">It is unlikely that this story has a happy ending for many of us. But it probably will be a happy ending for the Guptas. They are likely to be photographed, somewhere in the world, living large and successful.</span>\r\n\r\n<span style=\"font-weight: 400;\">There will be nothing we can do about it, and it appears there will be nothing we can do about ever seeing justice prevail in South Africa. </span><b>DM</b>",

"description": "Convicted murderer and rapist Thabo Bester and his accomplice Nandipha Magudumana were extradited to South Africa from Tanzania on 13 April 2023. They were on the run for almost a year.\r\n\r\nIn October 2022, the Inspecting Judge for Correctional Services, Justice Edwin Cameron wrote to Minister of Correctional Services Ronald Lamola:\r\n\r\n“There are indications that, with the collusion of G4S employees and others, a fire was staged in the single cell of one Thabo Bester (the notoriously named so-called ‘Facebook rapist’) and a corpse was smuggled into the cell with the objective of faking inmate Bester’s death and facilitating his escape.”\r\n\r\nBester was arrested in Tanzania along with his associate Nandipha Magudumana on 7 April, eleven months after his escape. But it appears that efforts to apprehend him only started on 24 March.\r\n\r\nThis was after details of Bester’s escape were uncovered by GroundUp.\r\n\r\nAccording to a source who worked at the prison at the time of Bester’s escape, the cell where Bester was kept was on the second floor of the prison. Next to this cell, there is a door that leads down to the exit. “It seems that he would have been able to escape through those doors,” the source said.\r\n\r\nThese doors can only be opened by the control room, the source explained.\r\n\r\nBester has been widely dubbed the \"Facebook rapist\" by the media. He used the social media platform to lure women with claims that international modelling scouts were interested in them.\r\n\r\nHe would then rape them and rob them using a knife. He also murdered at least one of his victims.\r\n\r\nIn 2012, he was sentenced to life imprisonment for these crimes.",
