"contents": "<span style=\"font-weight: 400;\">On 17 October 2024, on the margins of the African Commission on Human and Peoples’ Rights, Gambia’s solicitor-general, Hussein Thomasi,</span><a href=\"https://www.youtube.com/watch?v=FFLliJGCNcc\"> <span style=\"font-weight: 400;\">told a full room</span></a><span style=\"font-weight: 400;\"> in Banjul, Gambia, that a crimes against humanity treaty “is not just timely, it is absolutely essential. The absence of a dedicated treaty perpetuates a significant gap in the international legal framework, allowing for impunity and depriving vulnerable populations of the protection they desperately need.” </span>\r\n\r\n<span style=\"font-weight: 400;\">This month, African states joined many others in</span><a href=\"https://www.hrw.org/news/2024/10/14/un-debate-shows-growing-momentum-treaty-address-crimes-against-humanity\"> <span style=\"font-weight: 400;\">stepping up support for negotiations</span></a><span style=\"font-weight: 400;\"> for a much-needed crimes against humanity treaty during a UN Sixth Committee debate from 9 to 14 October. They more than</span><a href=\"https://www.dailymaverick.co.za/article/2024-05-12-time-for-africa-to-rally-around-a-global-crimes-against-humanity-treaty/\"> <span style=\"font-weight: 400;\">doubled the number of African states</span></a><span style=\"font-weight: 400;\"> backing the initiative by co-sponsoring a draft resolution for negotiations, orally backing moving ahead to secure a treaty, or both.</span>\r\n\r\n<span style=\"font-weight: 400;\">But many more African state co-sponsors are needed to ensure a positive outcome.</span>\r\n\r\n<span style=\"font-weight: 400;\">Crimes against humanity are recognised as among</span><a href=\"https://cahtreatynow.org/\"> <span style=\"font-weight: 400;\">the most heinous international crimes</span></a><span style=\"font-weight: 400;\">, alongside genocide and war crimes. They include a range of offences when committed as part of a widespread or systematic attack against a civilian population: murder, extermination, enslavement, deportation, torture, rape, sexual slavery, enforced prostitution, forced pregnancy, enforced sterilisation or other comparable forms of sexual violence, persecution, enforced disappearance, apartheid, or other inhumane acts.</span>\r\n\r\n<span style=\"font-weight: 400;\">As daily headlines testify, such crimes continue to be perpetrated in crises around the world today, from Sudan to Myanmar to Gaza. Though treaties define state obligations to prevent and punish genocide and war crimes, no such treaty exists for crimes against humanity.</span>\r\n\r\n<span style=\"font-weight: 400;\">A global campaign for a convention has gained steam over the past five years. The International Law Commission adopted the</span><a href=\"https://legal.un.org/ilc/texts/instruments/english/draft_articles/7_7_2019.pdf\"> <span style=\"font-weight: 400;\">Draft Articles on Prevention and Punishment of Crimes Against Humanity</span></a><span style=\"font-weight: 400;\"> in 2019. A two-year process to consider the articles and discuss the commission’s recommendation for a convention was approved by the UN’s Sixth Committee in 2022 in</span><a href=\"https://documents.un.org/doc/undoc/ltd/n22/691/13/pdf/n2269113.pdf?OpenElement\"> <span style=\"font-weight: 400;\">Resolution 77/249</span></a><span style=\"font-weight: 400;\">. A </span><span style=\"font-weight: 400;\">decision on whether to proceed with negotiations must now be taken by</span><a href=\"https://www.un.org/en/ga/sixth/\"> <span style=\"font-weight: 400;\">22 November 2024</span></a><span style=\"font-weight: 400;\">, </span><span style=\"font-weight: 400;\">when the current UN Sixth Committee session ends.</span>\r\n\r\n<a href=\"https://www.justsecurity.org/104188/justice-delayed-denied-crimes-against-humanity-treaty/\"><span style=\"font-weight: 400;\">Most states</span></a><span style=\"font-weight: 400;\"> support negotiations for a treaty. But the Sixth Committee usually makes decisions based on</span><a href=\"https://press.un.org/en/2023/gal3707.doc.htm\"> <span style=\"font-weight: 400;\">consensus</span></a><span style=\"font-weight: 400;\">. It is thus crucial to have as many states as possible publicly support formal treaty negotiations to help dissuade the</span><a href=\"https://www.justsecurity.org/104188/justice-delayed-denied-crimes-against-humanity-treaty/\"> <span style=\"font-weight: 400;\">small minority of opponents</span></a><span style=\"font-weight: 400;\"> from blocking forward movement.</span>\r\n\r\n<span style=\"font-weight: 400;\">At present, 91 states are co-sponsors of the draft resolution which would move the process to treaty negotiations, including 18 African states: Botswana, Cabo Verde, Comoros, Republic of Congo-Brazzaville, Democratic Republic of Congo, Djibouti, Gambia, Ghana, Lesotho, Liberia, Malawi, Mauritius, Mozambique, Senegal, Sierra Leone, South Africa, Tunisia and Zambia.</span>\r\n\r\n<span style=\"font-weight: 400;\">Another 15</span><a href=\"https://www.un.org/en/ga/sixth/79/summaries.shtml\"> <span style=\"font-weight: 400;\">spoke positively</span></a><span style=\"font-weight: 400;\"> at the October UN Sixth Committee debate on advancing a treaty in some capacity: Burkina Faso, Burundi, Côte d’Ivoire, Guinea, Kenya, Namibia, Niger, Nigeria, Rwanda, Togo and Uganda, as well as Angola, Equatorial Guinea, Guinea Bissau and </span><span style=\"font-weight: 400;\">São Tomé and Príncipe</span><span style=\"font-weight: 400;\">, as part of an intervention by the Portuguese-speaking community.</span>\r\n\r\n<span style=\"font-weight: 400;\">An additional eight African states have a history of backing accountability efforts, particularly as members of the International Criminal Court: Benin, Chad, Central African Republic, Gabon, Madagascar, Mali, Seychelles and Tanzania.</span>\r\n\r\n<span style=\"font-weight: 400;\">So far, these 23 states have yet to commit to co-sponsor the draft resolution that would advance the treaty. Through co-sponsorship, these states could tip the balance for negotiations.</span>\r\n\r\n<span style=\"font-weight: 400;\">Elaborating a treaty</span><a href=\"https://cahtreatynow.org/#faqs\"> <span style=\"font-weight: 400;\">would offer</span></a><span style=\"font-weight: 400;\"> new tools to prevent and punish crimes against humanity, including improved frameworks for mutual legal assistance and capacity-building. It would also offer crucial opportunities to more fully address international crimes involving</span><a href=\"https://www.globaljusticecenter.net/wp-content/uploads/2023/10/Letter-to-UN-Member-States-Re_-Gender-Justice-Approach-to-Crimes-Against-Humanity-Treaty.pdf\"> <span style=\"font-weight: 400;\">gendered harms</span></a><span style=\"font-weight: 400;\">, including codification of the crime of the slave trade, which is backed by the</span><a href=\"https://www.un.org/en/ga/sixth/79/pdfs/statements/cah/08mtg_african_group.pdf\"> <span style=\"font-weight: 400;\">African Group</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">As Simitie Lavally, a commissioner with the Sierra Leone Human Rights Commission,</span><a href=\"https://www.youtube.com/live/FFLliJGCNcc?feature=shared\"> <span style=\"font-weight: 400;\">told</span></a><span style=\"font-weight: 400;\"> the audience in Banjul that “we have an obligation to draw the attention of our governments to propose treaties that would enhance the enjoyment of human rights nationally or internationally”.</span>\r\n\r\n<span style=\"font-weight: 400;\">African civil society has done so, widely supporting a global</span><a href=\"https://cahtreatynow.org/joint-statement-in-support-of-progress-toward-a-crimes-against-humanity-treaty/\"> <span style=\"font-weight: 400;\">joint statement in support of negotiations</span></a><span style=\"font-weight: 400;\"> endorsed by more than 650 organisations and experts. The pre-eminent</span><a href=\"https://www.wayamo.com/archives/agja-statement-crimes-against-humanity/\"> <span style=\"font-weight: 400;\">African Group on Justice and Accountability</span></a><span style=\"font-weight: 400;\"> and African human rights commissions also have urged their governments to support forward movement. </span>\r\n\r\n<span style=\"font-weight: 400;\">With a decision less than a month away, African states should heed the call by taking the decision to co-sponsor the resolution for negotiations without further delay, thereby helping to combat widespread or systematic attacks on civilians everywhere. </span><b>DM</b>\r\n\r\n<i><span style=\"font-weight: 400;\">Elise Keppler is executive director of the Global Justice Center, an organisation dedicated to using international law to advance gender equality.
