"contents": "The trial of those accused of killing Cape Town advocate Pete Mihalik four years ago has been set down for Thursday, 19 May.\r\n\r\nSizwe Biyela, Nkosinathi Khumalo — alleged taxi industry hitmen from KwaZulu-Natal — and taxi owner Vuyile Maliti will be asked to plead to charges of murder, attempted murder and the illegal possession of a 9mm firearm.\r\n\r\nThe charges stem from the assassination of advocate Pete Mihalik on 30 October 2018. Mihalik was dropping his daughter at school in Green Point when he was gunned down. His son was wounded, but survived, while his daughter escaped unscathed.\r\n\r\nMihalik was shot at point-blank range. The shooter walked up to his car and fired a shot through the window. It had all the hallmarks of a hit.\r\n\r\nThe charges read: “... on or about 30 October 2018… the accused did wrongfully and intentionally kill Pete Mihalik by shooting him in the head with a firearm.\r\n\r\nThe attempted murder charge relates to injuries sustained by Mihalik’s son.\r\n\r\nLt-Col Charl Kinnear from the Anti-Gang Unit had been investigating the Mihalik murder and the evidence he gathered will form part of the State’s case.\r\n\r\nKinnear was assassinated outside his Bishop Lavis home on 18 September 2020. Suspects in that case are currently on trial.\r\n\r\nThe summary of facts in the Mihalik case indicates that on the day of the murder, the accused, accompanied by a fourth person whose identity is not known to the State, dropped Sizwe Biyela at the corner of Thornhill and Cavalcade roads a few minutes before Mihalik arrived.\r\n\r\n“When he (Mihalik) stopped the vehicle in order for his daughter to alight, Biyela approached the vehicle on foot… and quickly fired two shots at the deceased’s head with a 9mm pistol...\r\n\r\n“The deceased was hit in the head and declared dead on the scene. His young son was injured in the incident and received medical treatment,” the summary of facts reads.\r\n\r\nhttps://www.dailymaverick.co.za/article/2022-05-17-gentlemans-agreement-despite-mining-ban-russia-scours-antarctica-for-massive-fossil-fuel-deposits/\r\n\r\nThe State contends the murder was planned because:\r\n<ol>\r\n \t<li>Vuyile Maliti, on 29 October 2018, is alleged to have rented a VW Polo which was seen at the crime scene the day before as well as on the morning of the murder. Tracker reports used by the State in a bail application by the accused in June 2019 support this.</li>\r\n \t<li>A silver Renault was also seen at the crime scene on the morning of the shooting.</li>\r\n \t<li>Security camera footage shows Biyela shooting Mihalik in the head.</li>\r\n \t<li>Minutes after the shooting, the two vehicles were stopped by traffic officer Boy Makutu in Green Point. He issued a fine to Maliti, the driver of the VW Polo.</li>\r\n \t<li>Nkosinathi Khumalo, the driver of the Renault, was taken to Sea Point police station by Makutu where he was placed under arrest and had his cellphone seized.</li>\r\n \t<li>Biyela was arrested by Charl Kinnear on the day of the shooting at a bus depot in Bellville as he was about to leave the Western Cape.</li>\r\n \t<li>Evidence from Biyela and Khumalo’s cellphones suggest that Maliti hired them from KZN to execute the hit.</li>\r\n</ol>\r\nKinnear’s investigation, and cellphone records pertaining to all three accused, are said to connect the men to one another and place them at the crime scene.\r\n\r\nInvestigations revealed that Maliti had sold 11 Krugerrands for R200,000 in Claremont shortly after the murder. The State contends that this was partial payment for the “job”.\r\n\r\nAmong the reasons this case took so long to get to trial was because the National Prosecuting Authority battled for four years to get legal representation for the accused. Lawyers were understandably reluctant to touch this case.\r\n\r\nGauteng lawyer Jannie Kruger, who initially represented Maliti, pulled out after bail was denied to his client in July 2019. Kruger received anonymous threats that if he set foot in Cape Town he would be killed. Kruger confirmed this to <em>Daily Maverick</em> on Tuesday.\r\n\r\nWhile Mihalik might at least get justice, the killers of three other lawyers remain free.\r\n<ul>\r\n \t<li> Noorudien Hassan was shot and killed in his car outside his home in Lansdowne on 7 November 2016. At the time he was representing alleged gang boss Ralph Stanfield.</li>\r\n \t<li> Advocate Vernon Jantjies was shot multiple times in Lentegeur, Mitchells Plain, in December 2019. He represented Glenda Bird, the late sister of Fadwaan “Vet” Murphy, a suspected drug kingpin.</li>\r\n \t<li>In May 2019, lawyer David Mbazwana was shot dead at a spaza shop in Khayelitsha in what appeared to be a robbery.</li>\r\n</ul>\r\nPolice have confirmed that no arrests have been made in these cases.\r\n\r\nCharl Kinnear may have died, but the evidence he gathered is likely to carry considerable weight once the trial of Mihalik’s alleged killers gets under way on Thursday.\r\n\r\nIncidentally, Kinnear had met Mihalik on opposite sides of a courtroom. Kinnear was the investigating officer in an extortion case involving alleged underworld figures Nafiz Modack, Colin Booysen, Ashley Fields and Jacques Cronje.
