"contents": "<span style=\"font-weight: 400;\">On Friday, 12 February, the next</span><a href=\"https://www.icc-cpi.int/Pages/item.aspx?name=201211-otp-statement-ukraine\"> <span style=\"font-weight: 400;\">International Criminal Court (ICC)</span></a><a href=\"https://asp.icc-cpi.int/en_menus/asp/elections/prosecutor/Pages/Prosecutor2020.aspx\"> <span style=\"font-weight: 400;\">prosecutor</span></a><span style=\"font-weight: 400;\">, British candidate</span><a href=\"https://www.theafricareport.com/66723/karim-khan-from-rutos-and-charles-taylors-defender-to-icc-prosecutor/\"> <span style=\"font-weight: 400;\">Karim Khan QC</span></a><span style=\"font-weight: 400;\"> was elected. Unfortunately, the election process itself cast a shadow and raised concerns about the ICC’s management oversight and legislative body – the</span><a href=\"https://asp.icc-cpi.int/en_menus/asp/Pages/asp_home.aspx\"> <span style=\"font-weight: 400;\">Assembly of States Parties</span></a><span style=\"font-weight: 400;\"> (ASP) and its leadership.</span>\r\n\r\n<span style=\"font-weight: 400;\">The ICC is the world’s only permanent court with jurisdiction over genocide, war crimes, crimes against humanity and the crime of aggression. It began its operations in 2002 and has faced numerous challenges since its inception. The last thing it needed was a flawed election process for its top job.</span>\r\n\r\n<span style=\"font-weight: 400;\">Being the</span><a href=\"https://www.icc-cpi.int/about/otp\"> <span style=\"font-weight: 400;\">prosecutor</span></a><span style=\"font-weight: 400;\"> comes with great power and responsibility, but it is the responsibility of the ASP to elect a prosecutor. The ASP, led by a</span><a href=\"https://asp.icc-cpi.int/en_menus/asp/bureau/Pages/bureau%20of%20the%20assembly.aspx\"> <span style=\"font-weight: 400;\">bureau</span></a><span style=\"font-weight: 400;\">, a president and two vice-presidents, consists of the 123 ICC member</span><a href=\"https://asp.icc-cpi.int/en_menus/asp/states%20parties/Pages/the%20states%20parties%20to%20the%20rome%20statute.aspx\"> <span style=\"font-weight: 400;\">states</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">The court has had two prosecutors to date and the current prosecutor Fatou Bensouda’s term is due to end in June. Usually, the ASP reaches a consensus, but this year is the first time it failed to do so, resulting in a vote by secret ballot held last Friday. Failure to reach consensus means that the prosecutor-elect will start his term in office without the same political support a consensus candidate might have enjoyed.</span>\r\n<blockquote><span style=\"font-weight: 400;\">The ICC already has a severe problem when it comes to sexual harassment. The September 2020</span><a href=\"https://asp.icc-cpi.int/iccdocs/asp_docs/ASP19/IER-Final-Report-ENG.pdf\"> <span style=\"font-weight: 400;\">report</span></a><span style=\"font-weight: 400;\"> produced by a group of independent experts tasked with assessing the court’s performance, reveals the extent as experts heard accounts of sexual harassment, “notably uninvited and unwanted sexual advances from more senior male staff to their female subordinates”.</span></blockquote>\r\n<span style=\"font-weight: 400;\">The failure to reach consensus is not the most troubling factor; a lack of vetting is. As baffling as it may sound, the ICC does not fully vet it’s judicial or prosecutorial candidates, despite one of the requirements for the job being “high moral character”. Vetting is commonly practised when hiring leaders in the private sector and the ICC should follow suit. The responsibility to ensure vetting falls squarely at the feet of the ASP and its leadership. All candidates should have been properly and thoroughly vetted.</span>\r\n\r\n<span style=\"font-weight: 400;\">The ASP established a</span><a href=\"https://asp.icc-cpi.int/iccdocs/asp_docs/ASP19/ICC-ASP-19-INF2-ENG-CEP.pdf\"> <span style=\"font-weight: 400;\">Committee on the Election of the Prosecutor</span></a><span style=\"font-weight: 400;\">, which did a decent job under difficult circumstances, including engaging the services of an entity able to conduct</span><a href=\"https://asp.icc-cpi.int/iccdocs/asp_docs/ASP19/ICC-ASP-19-INF2-ENG-CEP.pdf\"> <span style=\"font-weight: 400;\">background checks</span></a><span style=\"font-weight: 400;\"> and basic screening. However, that is a far cry from thorough vetting. Thorough vetting includes going further than basic reference checks. It means conducting reputational interviews and seeking views from subordinates, former and current colleagues and supervisors. It means creating a duly constituted, impartial, professionally run mechanism that can (with all the necessary safeguards in place) confidentially hear allegations, investigate and make a finding as to whether the allegations raise concerns about moral character.</span>\r\n\r\n<span style=\"font-weight: 400;\">Since</span><a href=\"https://www.ijmonitor.org/2021/02/continued-concerns-about-the-icc-prosecutor-election-no-election-without-vetting/\"> <span style=\"font-weight: 400;\">November 2019</span></a><span style=\"font-weight: 400;\">,</span><a href=\"https://www.justiceinitiative.org/newsroom/justice-initiative-says-nominees-for-icc-prosecutor-need-additional-vetting\"> <span style=\"font-weight: 400;\">civil society</span></a><span style=\"font-weight: 400;\"> has</span><a href=\"https://www.justiceinitiative.org/newsroom/justice-initiative-continues-to-call-for-fairness-and-transparency-in-icc-prosecutor-election-process\"> <span style=\"font-weight: 400;\">called</span></a><span style=\"font-weight: 400;\"> for vetting but fast-forward to February 2021 and nothing is in place. The buck stops with the ASP and its leaders. Granted, the ASP deliberations are tense and politically charged, but that is no excuse for failing to vet candidates, particularly in the face of serious</span><a href=\"http://opiniojuris.org/2020/04/16/icc-prosecutor-symposium-the-next-icc-prosecutor-must-embody-integrity-in-the-metoo-era/\"> <span style=\"font-weight: 400;\">allegations</span></a><span style=\"font-weight: 400;\"> of misconduct and ethical impropriety surrounding candidates.</span>\r\n\r\n<span style=\"font-weight: 400;\">Proceeding without a proper vetting mechanism was a violation of due process and a disservice to the candidates, many of whom became the subject of rumours on</span><a href=\"https://www.justiceinfo.net/en/73415-last-men-standing-for-the-icc-prosecutor-election.html\"> <span style=\"font-weight: 400;\">social media</span></a><span style=\"font-weight: 400;\">. More importantly, it was a great disservice to those who have experienced conduct unbecoming of an elected official.</span>\r\n\r\n<span style=\"font-weight: 400;\">Reporting misconduct, particularly sexual harassment, is extremely difficult as the barriers to reporting are numerous. The #MeToo movement has shown just how hard it is to bring sexual harassment to light and the legal profession is no exception. According to the</span><a href=\"https://www.ibanet.org/About_the_IBA/About_the_IBA.aspx\"> <span style=\"font-weight: 400;\">International Bar Association</span></a><span style=\"font-weight: 400;\">’s</span> <span style=\"font-weight: 400;\">recent</span><a href=\"https://www.ibanet.org/bullying-and-sexual-harassment.aspx\"> <span style=\"font-weight: 400;\">study</span></a><span style=\"font-weight: 400;\"> on sexual harassment and bullying in the legal profession, a staggering</span><a href=\"https://www.ibanet.org/bullying-and-sexual-harassment.aspx\"> <span style=\"font-weight: 400;\">75 percent</span></a><span style=\"font-weight: 400;\"> do not report incidents of sexual harassment for fear of retaliation. Against this backdrop, some actors’ response to calls for vetting was “go public with the allegation”, which shows a total lack of appreciation for barriers to reporting and the unjust repercussions.</span>\r\n\r\n<span style=\"font-weight: 400;\">The ICC already has a severe problem when it comes to sexual harassment. The September 2020</span><a href=\"https://asp.icc-cpi.int/iccdocs/asp_docs/ASP19/IER-Final-Report-ENG.pdf\"> <span style=\"font-weight: 400;\">report</span></a><span style=\"font-weight: 400;\"> produced by a group of independent experts tasked with assessing the court’s performance, reveals the extent as experts heard accounts of sexual harassment, “notably uninvited and unwanted sexual advances from more senior male staff to their female subordinates”.</span>\r\n\r\n<span style=\"font-weight: 400;\">The glaring failure to establish a vetting mechanism in this climate is unbelievable.</span>\r\n\r\n<span style=\"font-weight: 400;\">In addition to internal challenges, the prosecutor-elect faces resource constraints, and will have to contend with</span><a href=\"https://www.usnews.com/news/world/articles/2020-06-11/pompeo-on-icc-us-wont-be-threated-by-kangaroo-court\"> <span style=\"font-weight: 400;\">US wrath</span></a><span style=\"font-weight: 400;\"> for investigations in</span><a href=\"https://www.icc-cpi.int/afghanistan\"> <span style=\"font-weight: 400;\">Afghanistan</span></a><span style=\"font-weight: 400;\"> and in the</span><a href=\"https://www.icc-cpi.int/palestine\"> <span style=\"font-weight: 400;\">Israel-Palestine</span></a><span style=\"font-weight: 400;\"> situation. To top it all off, the US</span><a href=\"https://www.justsecurity.org/70996/first-they-came-for-me-and-my-colleagues-the-us-attack-on-the-intl-criminal-court/\"> <span style=\"font-weight: 400;\">sanctions</span></a><span style=\"font-weight: 400;\"> against current prosecutor Bensouda and a senior staff member remain in place, also putting people assisting the Office of the Prosecutor at risk of being sanctioned.</span>\r\n\r\n<span style=\"font-weight: 400;\">Other unhappy non-ICC member state global superpowers include Russia, whose conduct in</span><a href=\"https://www.icc-cpi.int/georgia\"> <span style=\"font-weight: 400;\">Georgia</span></a><span style=\"font-weight: 400;\"> and </span><a href=\"https://www.icc-cpi.int/ukraine\"><span style=\"font-weight: 400;\">Ukraine</span></a><span style=\"font-weight: 400;\"> is under scrutiny. The investigation into politically powerful member state</span><a href=\"https://www.icc-cpi.int/nigeria\"> <span style=\"font-weight: 400;\">Nigeria</span></a><span style=\"font-weight: 400;\"> may also present challenges, as the Office of the Prosecutor is looking into alleged crimes committed by Boko Haram and the Nigerian Security Forces.</span>\r\n\r\n<span style=\"font-weight: 400;\">In all of these situations, there are sound legal grounds to proceed with investigations and it is important that the prosecutor does proceed, but the political context is perilous.</span>\r\n\r\n<span style=\"font-weight: 400;\">The lack of vetting will always hang above the Office of the Prosecutor and invite questions about the credibility of the court, making its work more difficult in an already hostile environment. Under new leadership, the ASP should move quickly to create a permanent vetting mechanism for future elections, including judicial elections in two years.
