"contents": "<span style=\"font-weight: 400;\">Illegal and unregulated artisanal gold mining on the </span><a href=\"https://www.britannica.com/place/Witwatersrand\"><span style=\"font-weight: 400;\">Witwatersrand Basin</span></a><span style=\"font-weight: 400;\">, located south of Gauteng, is an increasing threat to community, industrial and state security. Reports on </span><a href=\"https://www.iol.co.za/news/zama-zama-turf-war-fears-after-7-bodies-found-in-veld-12727076\"><span style=\"font-weight: 400;\">turf wars between rival gangs</span></a><span style=\"font-weight: 400;\">, or </span><a href=\"https://www.iol.co.za/news/south-africa/gauteng/cops-in-gun-battle-with-zama-zamas-1899792\"><span style=\"font-weight: 400;\">shootouts between illegal miners and security officers</span></a><span style=\"font-weight: 400;\">, are commonplace.</span>\r\n\r\n<span style=\"font-weight: 400;\">But recent incidents point to a spike in the scale of illegal activity, conflict and criminality.</span>\r\n\r\n<span style=\"font-weight: 400;\">In October 2021, about 300 illegal miners, known as “zama zamas”, </span><a href=\"https://www.sowetanlive.co.za/news/south-africa/2021-10-07-six-alleged-zama-zamas-killed-in-shoot-out-more-than-30-arrested-in-orkney/\"><span style=\"font-weight: 400;\">attacked and shot at police and security officers</span></a><span style=\"font-weight: 400;\"> when the officers tried to prevent them from delivering food parcels to underground miners. In June 2022, about 150 illegal miners stormed gold miner Sibanye-Stillwater’s </span><a href=\"https://www.dailymaverick.co.za/article/2022-06-07-electrician-killed-in-shootout-involving-150-zamas-at-moth-balled-sibanye-gold-mine-video-included/\"><span style=\"font-weight: 400;\">mothballed Cooke shaft near Randfontein</span></a><span style=\"font-weight: 400;\"> in an attempt to gain control. And since last week, South Africans have been reeling at the </span><a href=\"https://www.youtube.com/watch?v=nECOmiKgvg4\"><span style=\"font-weight: 400;\">horrific robbery and gang rape</span></a><span style=\"font-weight: 400;\"> of a film crew at a mine dump close to West Village, a multiracial suburb of Krugersdorp on the West Rand.</span>\r\n\r\n<span style=\"font-weight: 400;\">West Village residents have since spoken out about being </span><a href=\"https://www.enca.com/news/crime-sa-krugersdorp-community-living-fear?utm_source=headtopics&utm_medium=news&utm_campaign=2022-07-31\"><span style=\"font-weight: 400;\">“prisoners in their own homes”</span></a><span style=\"font-weight: 400;\">. They attribute rampant crime in the area over the past few years to the influx of illegal mining – a situation that law enforcement officials seem unable or unwilling to control.</span>\r\n\r\n<span style=\"font-weight: 400;\">In the wake of these incidents, the spotlight must turn to the systemic reasons artisanal gold mining has become such a threat to peace and security. These include the state’s decades-long failure to nip an unregulated and illegal artisanal gold-mining industry in the bud. These incidents are also the result of the failure to formalise artisanal mining as a livelihood strategy through appropriate policies and legislative provisions.</span>\r\n<h4>Failed opportunities to formalise artisanal mining</h4>\r\n<span style=\"font-weight: 400;\">Artisanal mining is a labour-intensive form of mining that uses rudimentary tools and technologies. Other </span><a href=\"https://www.sciencedirect.com/science/article/abs/pii/S0016718519302714\"><span style=\"font-weight: 400;\">sub-Saharan African countries</span></a><span style=\"font-weight: 400;\"> recognise artisanal mining as a formal mining category. These include Burkina Faso, Côte d’Ivoire, the Democratic Republic of Congo, Ethiopia and Kenya.</span>\r\n\r\n<span style=\"font-weight: 400;\">Foundational policies in the early years of South Africa’s democracy didn’t support artisanal mining as a permanent livelihood strategy. The </span><a href=\"https://omalley.nelsonmandela.org/omalley/index.php/site/q/03lv02039/04lv02103/05lv02120/06lv02126.htm\"><span style=\"font-weight: 400;\">1994 Reconstruction and Development Programme</span></a><span style=\"font-weight: 400;\"> simply committed the government to encourage “small-scale mining”. This was on the proviso that safety, labour, environment and health conditions could be maintained. The </span><a href=\"https://www.gov.za/sites/default/files/gcis_document/201409/whitepaperminingmineralspolicy2.pdf\"><span style=\"font-weight: 400;\">1998 Minerals Policy</span></a><span style=\"font-weight: 400;\"> identified artisanal with subsistence mining. It flagged the need for the state to employ resources to “control artisanal mining as effectively as possible.”</span>\r\n\r\n<span style=\"font-weight: 400;\">The 2002 </span><a href=\"https://www.gov.za/documents/mineral-and-petroleum-resources-development-act\"><span style=\"font-weight: 400;\">Mineral and Petroleum Resources Development Act</span></a><span style=\"font-weight: 400;\"> only recognises large- and small-scale mining. It criminalises all mining outside these categories.</span>\r\n\r\n<span style=\"font-weight: 400;\">In addition, the </span><a href=\"https://www.gov.za/documents/precious-metals-act#:%7E:text=The%20Precious%20Metals%20Act%2037,provide%20for%20matters%20connected%20therewith.\"><span style=\"font-weight: 400;\">2005 Precious Metals Act</span></a><span style=\"font-weight: 400;\"> empowered the South African Diamonds and Precious Metals Regulator to regulate the acquisition, smelting, refining and beneficiation of gold. This removed the prior involvement of the South African Police Service and has been a key enabling factor for the unregulated gold-mining industry.</span>\r\n<h4>An illegal artisanal gold-mining industry takes root</h4>\r\n<span style=\"font-weight: 400;\">The Witwatersrand goldfields </span><a href=\"https://www.tandfonline.com/doi/full/10.1179/1743275812Y.0000000005?casa_token=labuKB9tyLYAAAAA%3AQE0wLVnTj-QkHydggUurdCz5eFvItSD9pj01-vwQtXJqwWosXYu17NM-PfP3byAwnUJjyms48J0\"><span style=\"font-weight: 400;\">have produced more than 30% of all the gold ever mined</span></a><span style=\"font-weight: 400;\">. But in recent decades, large-scale gold-mining has declined precipitously. Between 2012 and 2019 </span><a href=\"https://mg.co.za/business/2021-09-14-gold%E2%80%8C-%E2%80%8Cis%E2%80%8C-%E2%80%8Cminings%E2%80%8C-%E2%80%8Cbiggest%E2%80%8C-%E2%80%8Cjobs%E2%80%8C-%E2%80%8Closer%E2%80%8C-%E2%80%8Cas%E2%80%8C-%E2%80%8Cplatinum%E2%80%8C/\"><span style=\"font-weight: 400;\">the industry shed 42,000 jobs</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">In this context, an illegal and unregulated gold-mining industry, among the most lucrative and violent </span><a href=\"https://enact-africa.s3.amazonaws.com/site/uploads/2019-04-23-zama-zama-policy-brief%20022.pdf\"><span style=\"font-weight: 400;\">on the African continent</span></a><span style=\"font-weight: 400;\">, has taken root.</span>\r\n\r\n<span style=\"font-weight: 400;\">The Minerals Council of South Africa and police have identified a </span><a href=\"https://www.iol.co.za/news/opinion/driven-underground-by-poverty-1927803\"><span style=\"font-weight: 400;\">five-tier hierarchy</span></a><span style=\"font-weight: 400;\"> in the illegal and unregulated gold-mining industry. Illegal miners are on the bottom tier. Gangs and </span><a href=\"https://www.news24.com/news24/SouthAfrica/News/notorious-zama-zama-kingpin-david-one-eye-and-accomplices-sentenced-to-life-in-jail-20201022\"><span style=\"font-weight: 400;\">illegal mining bosses</span></a><span style=\"font-weight: 400;\">, licensed bulk buyers (scrap metal dealers and pawnbrokers) at national or regional level, front company exporters, and international intermediary buyers and companies are the more significant criminal actors.</span>\r\n\r\n<span style=\"font-weight: 400;\">The Institute of Security Studies estimates that about 30,000 illegal miners produce R14-billion worth </span><a href=\"https://enactafrica.org/research/policy-briefs/uncovered-the-dark-world-of-the-zama-zamas\"><span style=\"font-weight: 400;\">of gold per annum</span></a><span style=\"font-weight: 400;\">. From the state’s perspective this is “lost production”. The </span><a href=\"https://enact-africa.s3.amazonaws.com/site/uploads/2019-04-23-zama-zama-policy-brief%20022.pdf#page=5\"><span style=\"font-weight: 400;\">United Arab Emirates and Switzerland</span></a><span style=\"font-weight: 400;\"> have been identified as the primary export destinations.</span>\r\n<h4>Artisanal mining as a permanent livelihood strategy</h4>\r\n<span style=\"font-weight: 400;\">Thousands of illegal miners pursue artisanal mining </span><a href=\"https://www.dailymaverick.co.za/article/2022-02-02-the-zama-zama-informal-mining-unlike-anything-else-in-the-world/\"><span style=\"font-weight: 400;\">as a permanent, though precarious, livelihood strategy</span></a><span style=\"font-weight: 400;\">. Recent PhD graduate </span><a href=\"https://www.linkedin.com/in/maxwell-chuma-1ab45aa8/?originalSubdomain=za\"><span style=\"font-weight: 400;\">Maxwell Chuma</span></a> <a href=\"https://docs.google.com/document/d/e/2PACX-1vTkmjGuLza0eYlsK7M3i0oO1q2WtEY5zfpSLehAYs4xVlAKxIiIkR-ptST2Y5tZ8Q/pub\"><span style=\"font-weight: 400;\">explored</span></a><span style=\"font-weight: 400;\"> this. The pull factors include the ease of accessing mineralised land, social capital provided by national and ethnic groups in control of illegal mining and the relatively stable income.</span>\r\n\r\n<span style=\"font-weight: 400;\">The risks and illegality of the work itself, trespassing, the rampant use of mercury and </span><a href=\"https://www.sciencedirect.com/science/article/abs/pii/S2214790X14000501\"><span style=\"font-weight: 400;\">the criminality of the sector</span></a><span style=\"font-weight: 400;\"> make this dangerous and volatile work.</span>\r\n<h4>Solutions</h4>\r\n<span style=\"font-weight: 400;\">In 2014 the South African Human Rights Commission conducted </span><a href=\"https://www.sahrc.org.za/home/21/files/Unregulated%20Artisanal%20Underground%20and%20Surface%20Mining%20Activities%20electronic%20version.pdf\"><span style=\"font-weight: 400;\">investigative hearings into unregulated artisanal mining</span></a><span style=\"font-weight: 400;\">. The commission called for the state to institute an appropriate policy and regulatory framework to facilitate and manage artisanal mining as a livelihood strategy.</span>\r\n\r\n<span style=\"font-weight: 400;\">In March 2022, Minister of Mineral Resources and Energy Gwede Mantashe </span><a href=\"https://www.gov.za/sites/default/files/gcis_document/202203/46124gon1938.pdf\"><span style=\"font-weight: 400;\">published the Artisanal and Small-scale Mining Policy</span></a><span style=\"font-weight: 400;\">. The policy recognises the potential of artisanal mining as a livelihood strategy. But it reserves the permit system for South Africans. It tasks a National Coordination and Strategic Management Team to “halt” illegal mining.</span>\r\n\r\n<span style=\"font-weight: 400;\">The policy has been criticised for its failure to take public comments into account. It has also been criticised for its fantastical assumption that “platoons of illegal miners will </span><a href=\"https://www.miningmx.com/news/markets/49819-sa-govts-artisanal-mining-policy-is-sheer-fantasy-start-by-stopping-the-criminals/#:%7E:text=The%20policy%20is%20a%20fantasy,miners%20from%20attracting%20environmental%20liabilities\"><span style=\"font-weight: 400;\">miraculously stop their illegal activities overnight</span></a><span style=\"font-weight: 400;\">.” Implementing the policy will also require legislative amendments, which may take years to finalise.</span>\r\n\r\n<span style=\"font-weight: 400;\">Mantashe, as well as the department, must urgently speed up attempts to formalise artisanal mining as a livelihood strategy. The department should properly engage the mining industry and civil society in this process.</span>\r\n\r\n<span style=\"font-weight: 400;\">At the same time, a coordinated transnational effort to break the strangle-hold of the criminal syndicates must continue.</span>\r\n\r\n<span style=\"font-weight: 400;\">Applying a </span><a href=\"https://www.oecd.org/corporate/oecd-due-diligence-guidance-for-responsible-supply-chains-of-minerals-from-conflict-affected-and-high-risk-areas-9789264252479-en.htm#:%7E:text=The%20OECD%20Due%20Diligence%20Guidance%20for%20Responsible%20Supply,their%20mineral%20or%20metal%20purchasing%20decisions%20and%20practices\"><span style=\"font-weight: 400;\">set of principles</span></a><span style=\"font-weight: 400;\"> agreed by OECD countries on managing supply chains in conflict and high risk areas could also help manage the problem.</span>\r\n\r\n<span style=\"font-weight: 400;\">Finally, the powers conferred on the precious metals regulator need to be revisited. The changes need to ensure that property security checks on sellers can be conducted and patterns in the supply of gold can be determined.
