"contents": "<span style=\"font-weight: 400;\">The finance world’s powerbrokers are meeting at the World Economic Forum in Davos this week, and they must seize this opportunity to shut down an unchecked industry that’s bad for their reputations and disastrous for human rights. </span>\r\n\r\n<span style=\"font-weight: 400;\">We need a moratorium limiting the sale, transfer and use of these cyber weapons until people’s rights are safeguarded under international human rights law backed by Davos leaders.</span>\r\n\r\n<span style=\"font-weight: 400;\">The surveillance tech industry has long facilitated gross violations of human rights in darkness — no accountability, no checks and balances. </span>\r\n\r\n<span style=\"font-weight: 400;\">But in recent years, as civil society systematically shone a light on the sector’s harmful impact, companies are facing a colossal blowback. </span>\r\n\r\n<span style=\"font-weight: 400;\">With each </span><a href=\"https://forbiddenstories.org/case/the-pegasus-project/\"><span style=\"font-weight: 400;\">new revelation</span></a><span style=\"font-weight: 400;\"> of invasive, warrantless spying — on everyone from journalists and activists to </span><a href=\"https://citizenlab.ca/2017/02/bittersweet-nso-mexico-spyware/\"><span style=\"font-weight: 400;\">public health</span></a><span style=\"font-weight: 400;\"> advocates, to </span><a href=\"https://www.bbc.com/news/world-europe-57937867\"><span style=\"font-weight: 400;\">heads of state</span></a><span style=\"font-weight: 400;\"> — the surveillance industry’s malpractice is thrust into the public realm. This may be just the start of the industry’s end. </span>\r\n<h4><b>The consequences of ignoring human rights </b></h4>\r\n<span style=\"font-weight: 400;\">Activists, journalists and human rights defenders, often the first targets of regimes equipped by spyware firms, are gaining traction in the battle to hold their persecutors to account. </span>\r\n\r\n<span style=\"font-weight: 400;\">Their actions are snowballing damage to the status of these companies, and, no doubt, catalysing irreparable harm to their bottom lines. </span>\r\n\r\n<span style=\"font-weight: 400;\">We saw NGOs convince the European Ombudsman to </span><a href=\"https://www.ombudsman.europa.eu/en/case/en/60368\"><span style=\"font-weight: 400;\">open an investigation</span></a><span style=\"font-weight: 400;\"> into the EU’s role in </span><a href=\"https://www.accessnow.org/cms/assets/uploads/2021/10/21.10.08_EU_Ombudsman_Complaint_Final.pdf\"><span style=\"font-weight: 400;\">developing surveillance</span></a><span style=\"font-weight: 400;\"> capabilities outside its borders. </span>\r\n\r\n<span style=\"font-weight: 400;\">Civil society pushed for stronger </span><a href=\"https://www.accessnow.org/eu-dual-use-export-control-rules-room-for-improvement/\"><span style=\"font-weight: 400;\">EU dual use export rules</span></a><span style=\"font-weight: 400;\"> and pressured the US to add </span><a href=\"https://www.accessnow.org/u-s-blacklist-nso-candiru/\"><span style=\"font-weight: 400;\">NSO Group and Candiru to its blocked Entity List</span></a><span style=\"font-weight: 400;\">. </span>\r\n\r\n<span style=\"font-weight: 400;\">The Biden administration responded by launching the multilateral </span><a href=\"https://www.whitehouse.gov/briefing-room/statements-releases/2021/12/10/fact-sheet-export-controls-and-human-rights-initiative-launched-at-the-summit-for-democracy/\"><span style=\"font-weight: 400;\">Export Controls and Human Rights Initiative</span></a><span style=\"font-weight: 400;\"> with allies, while US lawmakers are </span><a href=\"https://www.reuters.com/world/us/exclusive-us-lawmakers-call-sanctions-against-israels-nso-other-spyware-firms-2021-12-15/\"><span style=\"font-weight: 400;\">calling for targeted sanctions</span></a><span style=\"font-weight: 400;\">. </span>\r\n\r\n<span style=\"font-weight: 400;\">Who will be spyware’s future customers if the industry is being edged out of the biggest markets in the world?</span>\r\n\r\n<span style=\"font-weight: 400;\">These actions follow calls by UN human rights experts — </span><a href=\"https://www.youtube.com/watch?v=fzQtZL-stqU\"><span style=\"font-weight: 400;\">echoed by Costa Rica</span></a><span style=\"font-weight: 400;\"> — for a global </span><a href=\"https://news.un.org/en/story/2020/01/1055771\"><span style=\"font-weight: 400;\">moratorium</span></a><span style=\"font-weight: 400;\"> on the sale, transfer and use of private surveillance technologies until human rights-compliant laws and regulatory frameworks are in place.</span>\r\n\r\n<span style=\"font-weight: 400;\">Not even the tech industry wants surveillance tech in its ranks, and companies that are impacted by spyware are reacting. </span>\r\n\r\n<a href=\"https://www.theguardian.com/us-news/2021/nov/08/nso-israeli-spyware-company-whatsapp-lawsuit-ruling\"><span style=\"font-weight: 400;\">WhatsApp</span></a><span style=\"font-weight: 400;\"> and </span><a href=\"https://www.accessnow.org/apple-nso-sue/\"><span style=\"font-weight: 400;\">Apple</span></a><span style=\"font-weight: 400;\"> are suing NSO Group in separate cases, Amazon </span><a href=\"https://www.reuters.com/technology/amazon-shuts-down-cloud-infrastructure-linked-israeli-firm-nso-report-2021-07-19/\"><span style=\"font-weight: 400;\">shut down</span></a><span style=\"font-weight: 400;\"> infrastructure and accounts linked to NSO Group, and Meta </span><a href=\"https://www.cyberscoop.com/meta-takes-down-7-hacking-for-hire-operations-that-targeted-50000-users/\"><span style=\"font-weight: 400;\">removed seven “surveillance-for-hire” operations</span></a><span style=\"font-weight: 400;\"> that targeted more than 50,000 Facebook users. </span>\r\n\r\n<span style=\"font-weight: 400;\">Google spoke up, dropping a </span><a href=\"https://googleprojectzero.blogspot.com/2021/12/a-deep-dive-into-nso-zero-click.html?m=1\"><span style=\"font-weight: 400;\">meticulous report</span></a><span style=\"font-weight: 400;\"> on a recent NSO Group attack.</span>\r\n\r\n<span style=\"font-weight: 400;\">Companies are feeling the burn, with infamous German spyware trader FinFisher going </span><a href=\"https://netzpolitik.org/2022/nach-pfaendung-staatstrojaner-hersteller-finfisher-ist-geschlossen-und-bleibt-es-auch/\"><span style=\"font-weight: 400;\">belly-up</span></a><span style=\"font-weight: 400;\"> and closing its offices amid a criminal investigation, while NSO Group </span><a href=\"https://www.middleeasteye.net/news/nso-group-pegasus-israel-risk-default\"><span style=\"font-weight: 400;\">is reportedly on the brink of financial collapse</span></a><span style=\"font-weight: 400;\">, </span><a href=\"https://www.bloomberg.com/news/articles/2021-12-13/spyware-firm-nso-mulls-shutdown-of-pegasus-unit-sale-of-company\"><span style=\"font-weight: 400;\">considering shutting down Pegasus and selling the company</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">NSO Group’s clear disregard for human rights has undoubtedly increased public animus and distrust toward the tech sector. </span>\r\n\r\n<span style=\"font-weight: 400;\">Its downfall should serve as a warning to the industry as a whole: it’s time to get your act together. Our message? What’s bad for human rights is bad for business. </span>\r\n\r\n<span style=\"font-weight: 400;\">If you don’t listen to civil society and centre people within your corporate practices, your profits will not survive.</span>\r\n<h4><b>Tech industry: Step up your game</b></h4>\r\n<span style=\"font-weight: 400;\">Tech sector leaders should not wait for a moratorium before taking action. </span>\r\n\r\n<span style=\"font-weight: 400;\">Davos is a face-to-face opportunity to solidify actions and implement change. They can join the companies already standing up against spyware abuse, and work to integrate human rights-based principles and practices in their own businesses. </span>\r\n\r\n<span style=\"font-weight: 400;\">For example, companies can take immediate steps such as terminating any direct contractual relationships with </span><a href=\"https://citizenlab.ca/category/research/targeted-threats/\"><span style=\"font-weight: 400;\">spyware vendors</span></a><span style=\"font-weight: 400;\"> and implement concrete measures to avoid directly or indirectly supporting spyware tools and related technologies — and ensure investors, suppliers, clients and customers do the same — through robust pre-contractual due diligence and monitoring.</span>\r\n\r\n<span style=\"font-weight: 400;\">Civil society wants a public pledge — jointly as through the corporate </span><a href=\"https://cybertechaccord.org/\"><span style=\"font-weight: 400;\">Tech Accord</span></a><span style=\"font-weight: 400;\"> — to sweep the spyware sector off your platforms, your vendor and client lists and your investment portfolios, implemented through binding agreements. </span>\r\n\r\n<span style=\"font-weight: 400;\">At the same time, you should embed human rights protections in your missions, and develop, monitor and regularly update human rights policies and practices — with teeth — via cross-functional and empowered human rights teams. </span>\r\n\r\n<span style=\"font-weight: 400;\">It’s also time to protect strong encryption and deploy end-to-end encrypted services wherever possible.
