In February, 13 judgments had been reserved for more than six months. In four cases, the judge had still not issued a ruling more than a year later. As of 22 August, only four judgments have been outstanding for more than six months.</span></span></span></p>\r\n<p class=\"western\" align=\"LEFT\"><a name=\"docs-internal-guid-6b229104-7fff-5be2-430b-54367253a751\"></a> <span style=\"color: #333333;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">According to the </span></span></span><a href=\"http://www.justice.gov.za/legislation/notices/2014/2014-02-28-gg37390_gon147-supcourts.pdf\"><span style=\"color: #26aae2;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">norms and standards for the judiciary</span></span></span></a><span style=\"color: #333333;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> laid out by Chief Justice Mogoeng Mogoeng in 2014, judges are supposed to deliver judgment within three months of the last hearing. But according to judicial spokesperson Nathi Mncube this policy has changed. In February GroundUp reported that </span></span></span><a href=\"https://www.groundup.org.za/article/case-not-closed-cape-high-court-backlog-showing-no-signs-improving/\"><span style=\"color: #26aae2;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Engers was responsible for five of the 13 overdue judgments</span></span></span></a><span style=\"color: #333333;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">. In April Judge President John Hlophe stated that Engers had been reported to the Bar Council, and would not be invited back to act in the Division.</span></span></span></p>\r\n<p class=\"western\" align=\"LEFT\"><span style=\"color: #333333;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Judge Siraj Desai has one outstanding judgment, an improvement from April when he had three outstanding judgments totalling four years overdue. Desai was one of </span></span></span><a href=\"https://www.groundup.org.za/article/three-judges-reported-judicial-service-commission/\"><span style=\"color: #26aae2;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">three judges reported to the Judicial Service Commission</span></span></span></a><span style=\"color: #333333;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> in April this year for late judgments.</span></span></span></p>\r\n<p class=\"western\" align=\"LEFT\"><span style=\"color: #333333;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Judge Mokgoatji Dolamo has one outstanding judgment but it is only a month past the six-month deadline.</span></span></span></p>\r\n<p class=\"western\" align=\"LEFT\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span style=\"color: #333333;\">It is important to note that the list of reserved judgments provided to GroundUp is based on an honour system. Although judges are expected to report their outstanding judgments to their judge presidents, there is no mechanism in place to make sure they do so.
