"contents": "<span style=\"font-weight: 400;\">A key challenge faced by laboratories in South Africa and elsewhere is that most of our diagnostic infrastructure requires the use of proprietary test materials - including reagents, consumables and cartridges. This largely prevents laboratories from making their own test materials or procuring test materials from sources other than the diagnostic machine’s manufacturer.</span>\r\n\r\n<span style=\"font-weight: 400;\">South Africa’s National Health Laboratory Service (NHLS) is currently using diagnostic machines produced by several companies to diagnose Covid-19. But the country is facing challenges in securing an adequate supply of reagents and consumables for running these tests.</span>\r\n\r\n<span style=\"font-weight: 400;\">The NHLS has also indicated that it will increase its use of the company Cepheid’s GeneXpert machines for testing as test cartridges become available. Yet, despite being the first country to broadly roll out GeneXpert diagnostic machines, and having been a crucial location for the trialling of the machines, South Africa is struggling to access adequate Covid-19 test cartridges from Cepheid.</span>\r\n\r\n<span style=\"font-weight: 400;\">To address these types of problems, civil society organisations have called for greater transparency regarding the global distribution of test materials by diagnostic manufacturers. These organisations have also called for the creation of a mechanism to pool and share knowledge and rights for health technologies that demonstrate efficacy in preventing, diagnosing and treating Covid-19. Such a mechanism would allow additional manufacturers to make and supply proprietary test materials and could also enable laboratories to prepare their own reagents when facing supply shortages. </span>\r\n\r\n<b>Proprietary machines prevent countries from brewing their own reagents</b>\r\n\r\n<span style=\"font-weight: 400;\">In the early days of the Covid-19 outbreak, before commercial diagnostic tests were available and authorised for sale, the World Health Organisation published a</span><a href=\"https://www.who.int/emergencies/diseases/novel-coronavirus-2019/technical-guidance/laboratory-guidance\"> <span style=\"font-weight: 400;\">recipe</span></a><span style=\"font-weight: 400;\"> outlining how laboratories could develop their own Covid-19 diagnostic tests.</span>\r\n\r\n<span style=\"font-weight: 400;\">While our national laboratories can develop their own ‘home-brewed’ or ‘in-house’ reagents based on WHO guidance, our testing infrastructure does not allow for the use of these reagents at scale. This is because, like in many other countries, the vast majority of South Africa’s diagnostic machines are procured from commercial diagnostic manufacturers whose machines require the use of their own proprietary test materials.</span>\r\n\r\n<span style=\"font-weight: 400;\">The need for laboratories to manually prepare home-brewed reagents also limits their scalability.</span>\r\n\r\n<span style=\"font-weight: 400;\">Dr Marvin Hsiao, an NHLS virologist, explains that commercial diagnostic manufacturers develop their own tests, containing proprietary reagents and unique consumables and packing. As a result, the tests cannot be interchanged between different diagnostic systems. Hsiao adds that “even we don’t know what is in the proprietary reagents”, as the specific formulations are protected as trade secrets.</span>\r\n\r\n<span style=\"font-weight: 400;\">Hsiao explains that under normal circumstances, the use of proprietary commercial reagents is preferable to “home-brewed” reagents, as they are less labour intensive and allow for testing at scale.</span>\r\n\r\n<span style=\"font-weight: 400;\">However, the limitations of proprietary systems are becoming evident, as major international companies concede they cannot meet supply. Roche’s</span><a href=\"https://diagnostics.roche.com/us/en/landing-pages/general-information-cobas-sars-cov-2-coronavirus-test.secure.html\"> <span style=\"font-weight: 400;\">website</span></a><span style=\"font-weight: 400;\">, for example, </span><span style=\"font-weight: 400;\"> states: </span><span style=\"font-weight: 400;\">“</span><span style=\"font-weight: 400;\">We are doing everything possible to produce as many tests as we can. Since this is a global health emergency, demand is outpacing supply.”</span>\r\n\r\n<span style=\"font-weight: 400;\">The South Korean company Seegene has</span><a href=\"https://www.ft.com/content/de3114a2-8b97-4d95-a55c-0a9d72dfa1ea\"> <span style=\"font-weight: 400;\">notably</span></a><span style=\"font-weight: 400;\"> scaled up test kit manufacturing to meet demand, but South Africa has less diagnostic capacity to process Seegene tests than Cepheid and Roche tests.</span><span style=\"font-weight: 400;\"> </span>\r\n\r\n<b>How is Covid-19 diagnosed?</b>\r\n\r\n<span style=\"font-weight: 400;\">Covid-19 is currently diagnosed using a diagnostic technique called polymerase chain reaction, or PCR for short. PCR is commonly used to diagnose bacterial and viral infections, including tuberculosis, HIV, hepatitis B and C, HPV and others.</span>\r\n\r\n<span style=\"font-weight: 400;\">PCR tests are the most effective way to diagnose Covid-19 as they detect the virus and can therefore determine whether a person has active coronavirus infection, unlike antibody tests which look at immune responses to determine if a person has ever been infected.</span>\r\n\r\n<span style=\"font-weight: 400;\">There are three critical stages involved in collecting and processing samples for PCR diagnosis of Covid-19. The first stage involves the collection of a sputum or phlegm sample from a patient’s nose or throat. This sample is then sent to a laboratory for processing in a sterile tube.</span>\r\n\r\n<span style=\"font-weight: 400;\">The second stage involves the preparation of samples for testing (although this stage is unnecessary when using GeneXpert machines). To prepare samples for testing, laboratory technicians must extract genetic material from samples using an extraction reagent and consumables such as trays and pipettes.</span>\r\n\r\n<span style=\"font-weight: 400;\">The third and final stage involves the processing of the sample to detect Covid-19 genetic material using another specifically formulated reagent solution and a PCR diagnostic machine.</span>\r\n\r\n<span style=\"font-weight: 400;\">Reagents are liquid substances made from a blend of synthetic chemicals and enzymes. While some</span><a href=\"https://www.irishtimes.com/news/health/covid-19-testing-irish-pharma-firms-source-raw-material-to-make-reagent-1.4221266\"> <span style=\"font-weight: 400;\">shortages</span></a><span style=\"font-weight: 400;\"> of raw chemicals needed for reagents have been reported</span><span style=\"font-weight: 400;\">, limitations on the manufacturing capacity of diagnostic manufacturers currently appears to be the main challenge in ramping up supply.</span><span style=\"font-weight: 400;\"> </span>\r\n\r\n<b>What diagnostic machines and tests is South Africa using for Covid-19?</b>\r\n\r\n<span style=\"font-weight: 400;\">South Africa is currently using Covid-19 test kits (which include reagents and consumables or cartridges) from the Swiss company Roche, the U.S. companies Cepheid and Thermofisher and the South Korean company Seegene. Roche and Cepheid tests can only be used on their own diagnostic machines. Seegene tests can be used on Seegene and Bio-Rad diagnostic machines, and Thermofisher tests can be used on </span><span style=\"font-weight: 400;\">Applied Biosystems QuantStudio and Bio-Rad diagnostic machines. Bio-Rad diagnostic machines can also be used to process home-brewed tests.</span>\r\n\r\n<span style=\"font-weight: 400;\">Using several tests and machines has allowed South Africa to avert testing interruptions due to shortages of reagents or cartridges for specific machines. This has however also meant that laboratory technicians at the NHLS must regularly switch between diagnostic machines depending on what test materials are available.</span>\r\n\r\n<span style=\"font-weight: 400;\">Hsiao says that the need to constantly switch between diagnostic platforms is impeding the efficiency of laboratory processes. </span>\r\n\r\n<b>Where are the GeneXpert cartridges?</b>\r\n\r\n<span style=\"font-weight: 400;\">South Africa was the first country to roll out GeneXpert diagnostics at scale after GeneXpert tests were shown to be effective in diagnosing tuberculosis. The country was also a crucial site for the trialling of the diagnostic machines.</span>\r\n\r\n<span style=\"font-weight: 400;\">South Africa began the procurement of GeneXpert machines in 2011 at a cost of around US$ 62,000 (about R 600,000) per machine, excluding the cost of cartridges for processing tests. Today South Africa has over 300 GeneXpert diagnostic machines. The NHLS has indicated that it intends to use 180 of these machines (which can process between 4 and 80 tests simultaneously) for Covid-19 testing, but slow delivery of test cartridges from Cepheid has thwarted scale-up.</span>\r\n\r\n<span style=\"font-weight: 400;\">According to Cepheid’s</span><a href=\"https://www.cepheid.com/coronavirus\"> <span style=\"font-weight: 400;\">website</span></a><span style=\"font-weight: 400;\">, the company began shipping Covid-19 test cartridges on 25 March 2020. NHLS’s Chief Executive Officer, Dr Kamy Chetty,</span><a href=\"https://www.groundup.org.za/article/covid-19-testing-are-we-scaling/\"> <span style=\"font-weight: 400;\">confirmed in a press conference</span></a><span style=\"font-weight: 400;\"> on 16 April that South Africa had received 10 000 cartridges and was expecting another 20 000 cartridges over the next week. The NHLS has not responded to requests for confirmation regarding whether the additional cartridges have arrived in the country, or how many cartridges have been received to date. </span>\r\n\r\n<span style=\"font-weight: 400;\">However, even with additional cartridges, South Africa is still facing shortages, as Chetty has stated that the country is seeking to source enough cartridges from Cepheid to perform 10,000 tests per day.</span>\r\n\r\n<span style=\"font-weight: 400;\">It is unclear how cartridge stock received in South Africa compares to other countries, given a lack of transparency related to global distribution. However, there are concerns that developing countries are losing out to wealthier countries with deeper pockets and greater negotiating power in accessing test materials.</span>\r\n\r\n<span style=\"font-weight: 400;\">The</span><i><span style=\"font-weight: 400;\"> New York Times</span></i><a href=\"https://www.nytimes.com/2020/04/09/world/coronavirus-equipment-rich-poor.html\"> <span style=\"font-weight: 400;\">reported</span></a><span style=\"font-weight: 400;\"> on 9 April that “Scientists in Africa and Latin America have been told by manufacturers that orders for vital testing kits cannot be filled for months, because the supply chain is in upheaval and almost everything they produce is going to America or Europe”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Treatment Action Group’s (TAG) David Branigan says that, besides affordable diagnostic pricing, “there is [an] urgent need for greater transparency and accountability of the criteria and mechanisms used by global health actors and by diagnostics companies for allocating available supply of tests”.</span>\r\n\r\n<span style=\"font-weight: 400;\">He added that TAG, together with the Treatment Action Campaign and six other civil society groups, sent a</span><a href=\"http://tbonline.info/posts/2020/5/2/civil-society-call-equitable-and-affordable-access/\"><span style=\"font-weight: 400;\"> letter</span></a><span style=\"font-weight: 400;\"> on 24 April to the recently formed WHO-led Diagnostics Supply Consortium calling on the consortium to use its procurement and funding clout to negotiate affordable test prices based on cost-of-goods, and ensure equitable and transparent distribution of Covid-19 tests and materials. The letter also called on the consortium to promote technology transfer to qualified manufactures to increase manufacturing and supply of diagnostic tests.</span><span style=\"font-weight: 400;\"> </span>\r\n\r\n<b>Technology transfer, trade secrets and patents</b>\r\n\r\n<span style=\"font-weight: 400;\">As major diagnostic manufacturers struggle to meet demand for Covid-19 test materials, it may be necessary for governments and companies to enable the manufacturing of proprietary test materials by laboratories and competitors – as recently seen in the Netherlands where shortages of Roche’s extraction reagents created bottlenecks in the country’s efforts to scale-up Covid-19 testing.</span>\r\n\r\n<span style=\"font-weight: 400;\">In response to shortages, Dutch law makers</span><a href=\"https://www.ftm.nl/artikelen/roche-releases-recipe-after-public-pressure-while-european-commission-considers-intervention-due-to-coronavirus-test\"> <span style=\"font-weight: 400;\">demanded</span></a><span style=\"font-weight: 400;\"> that Roche release the recipe for its proprietary reagents. Following referral of the issue to the Dutch competition authority and the European Commission, Roche agreed to share its proprietary recipe with Dutch laboratories that requested it.</span>\r\n\r\n<span style=\"font-weight: 400;\">The same reagent could conceivably be produced by South African laboratories who are using Roche diagnostics as part of their arsenal against Covid-19. It is also conceivable that, as in the Netherlands, South Africa’s competition authorities may be called upon. The country’s competition authorities previously played an important role in allowing more generic ARVs on to the market (most notably in the</span><a href=\"http://i-base.info/htb/12424\"> <span style=\"font-weight: 400;\">Hazel Tau case</span></a><span style=\"font-weight: 400;\">).</span>\r\n\r\n<span style=\"font-weight: 400;\">Besides sharing knowledge and pressuring companies to reveal access to inhibiting trade secrets, governments and industry can use licensing, technology transfer and patent pooling mechanisms to enable manufacturing of proprietary test materials by competitors and public manufacturers.</span>\r\n\r\n<span style=\"font-weight: 400;\">Patrick Durisch from the Swiss advocacy group, Public Eye, notes that over 70 civil society groups have called on the WHO and its member groups to create mechanisms for companies to pool and share rights and knowledge related to Covid-19 health technologies, as proposed by the Costa Rican government.
