so.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Under </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">s</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">ection 164</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\"> of the Botswana Penal Code</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">, same-sex relations </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">had been</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> criminalised and people could face up to seven years in jail.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Section 164 is a law inherited from colonialism. “With the advent of colonialism, the offence of sodomy was henceforth imported into the British colonies during the 17th and 20th centuries,” reads the judgment.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Botswana is among an increasing number of African countries </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">that</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> are decriminalising same-sex relations</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">, such as</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> Angola, which changed its laws earlier this year.</span></span>\r\n\r\n“<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">We saw it coming</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">.</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> Angola already the set the pace (by decriminalising same-sex relations),” said Shamiso Chijorimbo from the</span></span> <span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Southern Africa Gender Protocol Alliance, a network of organisations that champion gender equality.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">The applicant who challenged </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">s</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">ection 164 </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">was</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> 24-year</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">-</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">old</span></span> <span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Letsweletse Motshidiemang, a gay man who under </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">the law</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> could be imprisoned for having sex with another man.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Motshidiemang felt that his right to dignity and liberty was infringed upon under this law.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">One of the arguments the state made was that </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">s</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">ection 164 was not discriminatory. “Being homosexual is not criminali</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">s</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">ed; rather it is certain sexual acts</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> that are deemed to be against the order of nature,” reads the judgment papers.</span></span>\r\n\r\n“<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">The </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">key thing is if rights are violated, the state needs to explain why and they basically said we don’t want these (pro-gay laws) because of public opinions,” said Anneke Meerkotter, litigating director at the Southern African Litigation Centre.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Section 164 was ruled as unconstitutional. “It’s an important trend that states are realising that these laws aren’t appropriate. These laws don’t work in a constitutional democracy,” said Meerkotter.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><b>Sexual orientation isn’t a fashion statement</b></span></span>\r\n\r\n“<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Sexual orientation is innate to a human being. It is not a fashion statement or posture. It is an important attribute of one’s personality and identity; hence all and sundry are entitled to complete autonomy over the most intimate decisions relating to personal life, including choice of a partner,” reads the ruling by J</span></span><span style=\"color: #0d161a;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">udges Abednego Tafa, Michael Leburu and Jennifer Dube</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">.</span></span>\r\n\r\n<a name=\"_Hlt11263884\"></a><a name=\"_Hlt11263885\"></a> <span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">This is not the first time the discriminatory law has been challenged in Botswana. In 1994</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">,</span></span></span> <a href=\"https://www.icj.org/sogicasebook/kanane-v-state-court-of-appeal-botswana-30-july-2003/\" target=\"_top\"><span style=\"color: #1155cc;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><u>Utjiwa Kanane </u></span></span></span></a><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">was charged with contravening the penal code when the police raided his home and found him having sex with another man.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">He pleaded </span></span><a href=\"https://www.icj.org/wp-content/uploads/2003/07/Kanane-v-State-Court-of-Appeal-Botswana.pdf\" target=\"_top\"><span style=\"color: #1155cc;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><u>not guilty</u></span></span></span></a><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> and argued that the penal code infringed on his constitutional right to privacy</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\"> and </span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">assembly</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">,</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> and his freedom to associate with anyone.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">At the time, the court ruled that the majority of the population was not open to living in a country where same-sex relationships </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">were</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> decriminalised</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">,</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> therefore the law would remain.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">While some African countries are reforming their laws </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">on</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> sexual orientation, </span></span><a href=\"https://www.hrw.org/news/2019/05/24/kenya-court-upholds-archaic-anti-homosexuality-laws-0\" target=\"_top\"><span style=\"color: #1155cc;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><u>Kenya’s High Court</u></span></span></span></a><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> recently upheld laws that criminalise same-sex relations.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Sudan, </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">s</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">outhern Somalia, </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">n</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">orthern Nigeria and Mauritania </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">have</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> the </span></span><a href=\"https://www.amnesty.org.uk/lgbti-lgbt-gay-human-rights-law-africa-uganda-kenya-nigeria-cameroon\" target=\"_top\"><span style=\"color: #1155cc;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><u>death penalty</u></span></span></span></a><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> for same-sex relations.</span></span> <span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">These are among 37 countries on the continent that criminalise same-sex relations.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">South Africa is among the </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">seven</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> SADC countries </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">that</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> have decriminalised same-sex relationships and </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">was </span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">the first to do </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">so</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> on the continent.</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Chijorimbo remains optimistic about further reforms.</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> “We’re waiting f</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">or Kenya </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">[</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">to decriminalise same-sex relations</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">]</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">, they </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">[</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Kenya</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">]</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"> should’ve done it before Botswana.”</span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">In a statement about the ruling, Sonke Gender Justice wrote</span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">: </span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">“It also serves as a reminder that LGBTQ+ rights are not </span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span lang=\"en-ZA\">‘</span></span></span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size:
