Nevhutanda’s 11-year tenure, which </span><a href=\"https://www.groundup.org.za/article/scandal-ridden-lottery-board-chairman-to-leave-in-november/\"><span style=\"font-weight: 400;\">ends next month</span></a><span style=\"font-weight: 400;\">, has been marked by controversy over </span><a href=\"https://www.groundup.org.za/topic/lotto/\"><span style=\"font-weight: 400;\">dodgy Lottery grants</span></a><span style=\"font-weight: 400;\">. His successor is due to start on 1 December, according to an </span><a href=\"https://drive.google.com/file/d/1mGUErACifbGxxG-1hy29jSZ_JACjF63y/viewadvertisement\"><span style=\"font-weight: 400;\">advertisement</span></a><span style=\"font-weight: 400;\"> published in the Government Gazette early in September.</span>\r\n\r\n<span style=\"font-weight: 400;\">Meanwhile, watchdog organisation Corruption Watch has called on Trade, Industry and Competition Minister Ebrahim Patel to ensure that the appointment of a new board chairman is “open and transparent” and “apolitical”.</span>\r\n\r\n<span style=\"font-weight: 400;\">On Wednesday, the committee, which has been holding virtual meetings since the first Covid-19 lockdown began in March, agreed that candidates for the job would be interviewed in person in Parliament on 28 October.</span>\r\n\r\n<span style=\"font-weight: 400;\">Corruption Watch has </span><a href=\"https://drive.google.com/file/d/1KQZElSA5gSwaSaY0ILH1560O5gynu5Cp/view?usp=sharing\"><span style=\"font-weight: 400;\">written</span></a><span style=\"font-weight: 400;\"> to Patel, who has oversight responsibility for the NLC, recommending procedures to follow in appointing Nevhutanda’s successor.</span>\r\n\r\n<span style=\"font-weight: 400;\">The organisation has </span><a href=\"https://drive.google.com/file/d/1Rpwq5R70sUYg1yIQ3uS9K7sspCYJcpWO/view?usp=sharing\"><span style=\"font-weight: 400;\">also written</span></a><span style=\"font-weight: 400;\"> to Duma Nkosi, the chairman of the portfolio committee and MPs serving on the committee, outlining its recommendations.</span>\r\n\r\n<span style=\"font-weight: 400;\">In its letter to Patel, Corruption Watch said: “We note with concern that allegations of fraud, corruption and nepotism have been made in relation to the National Lotteries Commission, and welcome </span><a href=\"https://www.groundup.org.za/article/evidence-lottery-probe-handed-police/\"><span style=\"font-weight: 400;\">investigations</span></a><span style=\"font-weight: 400;\"> into these matters instituted by the Department of Trade and Industry.</span>\r\n\r\n<span style=\"font-weight: 400;\">“The NLC, like other public institutions, is vulnerable to corruption. We believe that part of combating corruption, as well as its prevention, is ensuring ethical, qualified leadership and oversight. </span>\r\n\r\n<span style=\"font-weight: 400;\">“It is therefore essential that the new chairperson and board members of the NLC are individuals of high calibre, in their skills, knowledge and integrity.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Referring to evidence led during three judicial commissions of inquiry established by President Cyril Ramaphosa over the past 24 months, Corruption Watch said that “the public has heard evidence of how leadership positions across various criminal justice agencies and state institutions were manipulated and influenced in order to safeguard networks of political patronage”.</span>\r\n\r\n<span style=\"font-weight: 400;\">With this in mind, Judge Robert Nugent – in his </span><a href=\"http://www.inqcomm.co.za/\"><span style=\"font-weight: 400;\">final report</span></a><span style=\"font-weight: 400;\"> of the Commission of Inquiry into Tax Administration and Governance by the South African Revenue Service (SARS) – had proposed “a possible recruitment process” for the SARS commissioner to ensure that the best possible candidate is selected, Corruption Watch said.</span>\r\n\r\n<span style=\"font-weight: 400;\">Nugent had outlined a process that should be “open and transparent” and “apolitical”. He proposed that an independent panel composed of members “not answerable to any constituency” be appointed to conduct the recruitment proceedings.</span>\r\n\r\n<span style=\"font-weight: 400;\">Corruption Watch told Patel that it was “pleased with the steps taken by Ramaphosa to ensure that stringent two-stream recruitment processes were put in place to appoint the National Director of Public Prosecutions in 2018, and the commissioner of SARS in 2019. These interventions are consistent with values of fairness and accountability, and set a positive precedent for future appointments to positions not only within the criminal justice system, but can also be extended to senior appointments across state institutions.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Corruption Watch has made several proposals:</span>\r\n<ul>\r\n \t<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Avenues for public participation in the appointment proceedings should be ensured;</span></li>\r\n \t<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">An independent selection panel should “undertake a transparent and merit-based shortlisting process”;</span></li>\r\n \t<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">While the Lotteries Act should be used for “base “ shortlisting criteria, the panel should develop additional criteria and guidelines to ensure that only the strongest candidates are identified for the interview process;</span></li>\r\n \t<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Shortlisted candidates should possess the necessary experience, expertise and qualifications, and be vetted for financial and security risks.</span></li>\r\n \t<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Patel should submit a detailed report to Parliament including a summary of the appointment process; the names of everyone who applied; the criteria used for shortlisting; the methodology used to assess the skills and competencies of candidates; and the results of financial and security vetting conducted on shortlisted candidates and character references and qualification checks.</span></li>\r\n</ul>\r\n<span style=\"font-weight: 400;\">Dean Macpherson, the Democratic Alliance’s shadow minister for trade, industry and competition, said he had requested information on how candidates had been shortlisted, and asked that the portfolio committee develop its own criteria and interview process. </span>\r\n\r\n<span style=\"font-weight: 400;\">“The chair has agreed to look at how that discussion is going to take place,” he said. </span><b>DM</b>\r\n\r\n ",
