"contents": "<span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">To commemorate World Homeless Day, the City of Cape Town’s Social and Early Childhood Development Department held a dialogue with the city’s homeless as well as NGOs working with street people.</span></span></span>\r\n\r\n<span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">The event, on Thursday 10 October at the Bellville South Community Centre, was aimed at finding solutions to the social issues faced by people on the street. However, it became a platform for those living rough to air their grievances about the City’s law enforcement officers and the shelter system.</span></span></span>\r\n\r\n<span style=\"color: #000000;\">“</span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span style=\"color: #000000;\">The law enforcement have no respect for us,” shouted a homeless woman from Lansdowne.</span></span></span>\r\n\r\n<span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">She claimed law enforcement officers have, on numerous occasions, sexually harassed her and confiscated her belongings.</span></span></span>\r\n\r\n<span style=\"color: #000000;\">“</span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span style=\"color: #000000;\">They bring a truck and take our IDs; now I can’t look for a job,” she complained.</span></span></span>\r\n\r\n<span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">The</span></span></span><u> </u><a href=\"https://www.dailymaverick.co.za/article/2019-08-01-the-lonesome-lament-of-martin-moses/\"><span style=\"color: #1155cc;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><u>issuing of fines</u></span></span></span></a> <span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">to street dwellers was also a top concern, with some questioning how a penniless person can afford a fine as steep as R1,500.</span></span></span>\r\n\r\n<span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">This ongoing issue was sparked in June this year when the City of Cape Town came under fire for enforcing a</span></span></span><u> </u><a href=\"https://openbylaws.org.za/za-cpt/act/by-law/2007/streets-public-places-noise-nuisances/eng/\"><span style=\"color: #1155cc;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><u>public spaces by-law</u></span></span></span></a> <span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">from 13 years ago, </span></span></span><a href=\"https://www.dailymaverick.co.za/article/2019-07-07-cape-towns-mean-streets-fining-homeless-people-is-not-the-solution/\"><span style=\"color: #1155cc;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><u>enabling street people to be fined</u></span></span></span></a> <span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">for various offences, such as erecting structures on walkways, lighting fires, or making excessive noise.</span></span></span>\r\n\r\n<span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span style=\"color: #000000;\">Community Services and Health Mayco member Zahid Badroodien told </span><span style=\"color: #000000;\"><i>Daily Maverick </i></span><span style=\"color: #000000;\">the by-law is under review.</span></span></span>\r\n\r\n<span style=\"color: #000000;\">“</span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span style=\"color: #000000;\">Before there is a fining process, social development must come in, offer opportunities and connect people to our partners,” said Badroodien, explaining that if this process fails, then law enforcement should be called in to deal with offenders.</span></span></span>\r\n\r\n<span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">He added that the by-law, “applies to everyone” and is not targeting the homeless.</span></span></span>\r\n\r\n<span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif; font-size: large;\">Badroodien said fewer than 1% of the total number of fines issued had</span></span><span style=\"font-family: Georgia, serif; font-size: large; color: #000000;\"> been issued to street people.</span>\r\n\r\n<span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">The Department of Community Services and Health said it could not answer queries about fines and law enforcement as it handled </span></span></span><span style=\"color: #000000; font-family: Georgia, serif; font-size: large;\">only</span><span style=\"color: #000000; font-family: Georgia, serif; font-size: large;\"> </span><span style=\"font-size: large; font-family: Georgia, serif; color: #000000;\">social development issues.</span>\r\n\r\n<span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">But more importantly, the City is still dealing with a fines-related </span></span></span><a href=\"https://www.iol.co.za/capeargus/news/city-of-cape-town-facing-lawsuit-for-fining-homeless-people-31323683\"><span style=\"color: #1155cc;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><u>lawsuit</u></span></span></span></a> <span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">brought against it by seven homeless people. </span></span></span>\r\n\r\n<span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">One homeless woman, who is a transgender sex worker, felt discriminated against by law enforcement and claimed the City’s fieldworkers were complicit in officers’ behaviour.</span></span></span>\r\n\r\n<span style=\"color: #000000;\">“</span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span style=\"color: #000000;\">The fieldworkers come with them when they fine us,” she said.</span></span></span>\r\n\r\n<span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">Badroodien said the </span></span></span><a href=\"http://resource.capetown.gov.za/documentcentre/Documents/Bylaws%20and%20policies/Street%20People%20-%20(Policy%20number%2012398B)%20approved%20on%2004%20December%202013.pdf\"><span style=\"color: #1155cc;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><u>Street People Policy</u></span></span></span></a> <span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">from 2013 was also under review.</span></span></span>\r\n\r\n<span style=\"color: #000000;\">“</span><span style=\"color: #000000;\"><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\">All of our efforts need to address the street person as a whole person,” said Badroodien, explaining that the City’s programmes must assess the reasons why a person becomes homeless, give them opportunities to heal, upskill and eventually get back on their feet.</span></span></span>\r\n\r\n<span style=\"color: #000000;\">“</span><span style=\"font-family: Georgia, serif;\"><span style=\"font-size: large;\"><span style=\"color: #000000;\">We’re giving you a means to then not only sustain yourself, but your family as well.” </span><span style=\"color: #000000;\"><u><b>DM</b></u></span></span></span>",
