"contents": "<span style=\"font-weight: 400;\">A former police officer who went on to head the City of Cape Town’s controversial Special Investigations Unit (SIU) – and who is still employed in the City’s safety and security directorate – is criminally charged in a case involving alleged docket tweaking linked to a police station in Mpumalanga.</span>\r\n\r\n<i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\"> can reveal that Reynold Talmakkies is accused of fraud in this case, which appears to stem from 2016 and which involves allegations (some stemming from other cops) of effectively seeing to it that some dockets were not prosecuted, which in turn could be seen as manipulating crime statistics.</span>\r\n\r\n<span style=\"font-weight: 400;\">Talmakkies has pleaded not guilty.</span>\r\n\r\n<span style=\"font-weight: 400;\">His legal representative, John Riley, confirmed “a prosecution has been instituted against him.”</span>\r\n\r\n<span style=\"font-weight: 400;\">“The trial has commenced,” he said.</span>\r\n\r\n<span style=\"font-weight: 400;\">It is understood the court proceedings are playing out in </span><span style=\"font-weight: 400;\">Emalahleni</span><span style=\"font-weight: 400;\"> (formerly Witbank) and that the charges relate to dockets effectively being nullified without official and proper processes being followed.</span>\r\n\r\n<span style=\"font-weight: 400;\">The National Prosecuting Authority’s Mpumalanga spokesperson, Monica Nyuswa, confirmed that Talmakkies and a second accused are expected back in a court on 11 May.</span>\r\n\r\n<span style=\"font-weight: 400;\">“They are appearing on several counts of fraud,” she said.</span>\r\n\r\n<span style=\"font-weight: 400;\">This Talmakkies matter overlays several </span><a href=\"https://www.dailymaverick.co.za/article/2021-03-15-cops-or-robbers-corruption-and-infighting-weakening-saps-at-highest-levels/\"><span style=\"font-weight: 400;\">claims and accusations against and among police officers</span></a><span style=\"font-weight: 400;\">, many at a national level.</span>\r\n\r\n<span style=\"font-weight: 400;\">On Friday, the City’s acting executive director for safety and security, Vincent Botto, said Talmakkies was still employed by the safety and security directorate.</span>\r\n\r\n<span style=\"font-weight: 400;\">“Once the court proceedings have been finalised, the situation will be reassessed,” he said.</span>\r\n\r\n<span style=\"font-weight: 400;\">Botto did not reply to </span><i><span style=\"font-weight: 400;\">Daily Maverick’s</span></i><span style=\"font-weight: 400;\"> questions about whether Talmakkies was still heading the SIU and whether the unit was still operational under this name.</span>\r\n\r\n<span style=\"font-weight: 400;\">It is understood Talmakkies was a detective commander at the Witbank police from 2012 until mid-2015 and was appointed head of the City’s SIU in July 2015.</span>\r\n\r\n<span style=\"font-weight: 400;\">Talmakkies was apparently charged in the docket-related fraud case sometime in 2016.</span>\r\n\r\n<span style=\"font-weight: 400;\">At the end of that year he was still in his position with the City and, </span><a href=\"https://www.news24.com/news24/southafrica/news/fears-that-suspect-in-maties-murder-case-may-flee-investigator-20161214\"><span style=\"font-weight: 400;\">in his official capacity as the SIU head, gave comment</span></a><span style=\"font-weight: 400;\"> to the media on a murder that had occurred in Sea Point in December 2016.</span>\r\n\r\n<span style=\"font-weight: 400;\">The City’s SIU was previously the focus of controversy when it was found it was exceeding its mandate and stepping on the toes of the South African Police Service.</span>\r\n\r\n<span style=\"font-weight: 400;\">It fell under the leadership of </span><span style=\"font-weight: 400;\">mayoral committee member for safety and security </span><span style=\"font-weight: 400;\">JP Smith.</span>\r\n\r\n<span style=\"font-weight: 400;\">A previous media report said the unit was </span><a href=\"https://www.news24.com/news24/SouthAfrica/News/exclusive-murder-irregularity-claims-surface-after-de-lille-shuts-down-city-of-cape-town-investigative-unit-20170929\"><span style=\"font-weight: 400;\">involved in investigations</span></a><span style=\"font-weight: 400;\"> relating to gang violence, xenophobia, corruption within the city council, arson in terms of wildfires and illegal protests.</span>\r\n\r\n<span style=\"font-weight: 400;\">In 2017, the SIU made news headlines when then Cape Town mayor Patricia de Lille ordered that it be shut down because she said it was overstepping its mandate.</span>\r\n\r\n<a href=\"https://mg.co.za/article/2018-05-23-cape-town-investigation-unit-reinstated-following-shut-down-by-de-lille/\"><span style=\"font-weight: 400;\">De Lille was</span></a><span style=\"font-weight: 400;\"> previously quoted as saying</span><span style=\"font-weight: 400;\">: “Alderman Smith used the SIU contrary to the purpose that it was created for. Moreover, he acted with the intent to undermine his political opponents and this amounts to a serious abuse for his own political gain.”</span>\r\n\r\n<span style=\"font-weight: 400;\">In September 2017, in a statement that </span><a href=\"https://www.news24.com/news24/SouthAfrica/News/city-of-cape-town-says-its-internal-investigations-unit-went-rogue-20170929\"><i><span style=\"font-weight: 400;\">News24</span></i><span style=\"font-weight: 400;\"> reported on</span></a><span style=\"font-weight: 400;\">, the City conceded that its internal investigations unit “was exceeding its mandate in that it was investigating councillors, which is a function of the speaker of the council as set out in law”.</span>\r\n\r\n<span style=\"font-weight: 400;\">“It had also come to light that the unit was investigating criminal matters, which is the mandate of the SAPS in terms of the SAPS Act.”</span>\r\n\r\n<span style=\"font-weight: 400;\">The City had reiterated: “We are not the police force.”</span>\r\n\r\n<span style=\"font-weight: 400;\">As squabbles over the SIU played out, Talmakkies’s name was rarely publicised in this arena.</span>\r\n\r\n<span style=\"font-weight: 400;\">One of the rare instances involved an October 2017 </span><a href=\"https://www.pressreader.com/south-africa/weekend-argus-saturday-edition/20171028/281685435099196\"><i><span style=\"font-weight: 400;\">Weekend Argus</span></i><span style=\"font-weight: 400;\"> article</span></a><span style=\"font-weight: 400;\"> that said an affidavit by Talmakkies – whom the article described as “a special adviser in the City’s law enforcement department” – and other colleagues said they had been told the SIU’s name would be changed and its mandate tweaked.</span>\r\n\r\n<span style=\"font-weight: 400;\">Nearly a year later, in May 2018, </span><a href=\"https://webcache.googleusercontent.com/search?q=cache:AKaqaMAr50oJ:https://mg.co.za/article/2018-05-23-cape-town-investigation-unit-reinstated-following-shut-down-by-de-lille/+&cd=1&hl=en&ct=clnk&gl=za\"><span style=\"font-weight: 400;\">the unit was reinstated</span></a><span style=\"font-weight: 400;\"> – it was reported that the National Council of Provinces accepted a motion to see that this took place.</span>\r\n\r\n<span style=\"font-weight: 400;\">A few months later, in October that year, and after intense infighting among DA figures, De Lille resigned from the party.</span>\r\n\r\n<span style=\"font-weight: 400;\">Meanwhile, Talmakkies, while facing fraud charges, seems to have represented the City of Cape Town in the US.</span>\r\n\r\n<span style=\"font-weight: 400;\">In January 2020, the Cambridge Police Department </span><a href=\"https://twitter.com/cambridgepolice/status/1223000074084651014?lang=en\"><span style=\"font-weight: 400;\">tweeted that</span></a><span style=\"font-weight: 400;\"> its members “had a unique opportunity to share best practices with Reynold Talmakkies, Chief of the City of Cape Town’s Safety and Security Division”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Photographs accompanying the tweet included ones of Talmakkies and suggested he had travelled to the US as a City of Cape Town representative.</span>\r\n\r\n<span style=\"font-weight: 400;\">That same day in January 2020 the US Drug Enforcement Administration’s (DEA) New England Division </span><a href=\"https://twitter.com/DEANEWENGLAND/status/1222939962473054208\"><span style=\"font-weight: 400;\">tweeted that</span></a><span style=\"font-weight: 400;\"> its “leadership welcomed & briefed Cape Town South Africa Chief of Special Operations Reynold Talmakkies on the current opioid crisis facing New England & DEA’s enforcement & demand reduction strategies to combat the crisis”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Talmakkies, in earlier years when he was still a police officer, was involved in high-level investigations.</span>\r\n\r\n<span style=\"font-weight: 400;\">He was among the officers involved in the probe into </span><a href=\"https://www.iol.co.za/news/south-africa/top-cape-detectives-to-probe-judges-death-446327\"><span style=\"font-weight: 400;\">the 2009 death</span></a><span style=\"font-weight: 400;\"> of Patrick Maqubela, who had been an acting judge in the Western Cape High Court. </span><b>DM</b>",
