"contents": "<span style=\"font-weight: 400;\">The Scalabrini Centre of Cape Town has raised concerns over a draft bill that seeks to bar foreign nationals without permanent residency status from opening businesses in certain Gauteng townships. </span>\r\n\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://www.gauteng.gov.za/Departments/DepartmentPublicationDetails/B11B93B2-BAFB-44C9-9227-A549C5DF4A7C?departmentId=CPM-001003\"><span style=\"font-weight: 400;\">Gauteng Township Economic Development Draft Bill</span></a><span style=\"font-weight: 400;\"> was opened for public comment on 30 September and aims to scale up the province’s township economy by amending restrictive by-laws, providing support and funding to SMEs and encouraging government procurement from township-based businesses.</span>\r\n\r\n<span style=\"font-weight: 400;\">The draft bill has come under fire for proposing a ban on foreign nationals without permanent residency status from opening specified enterprises in “designated townships”, which are yet to be finalised. </span>\r\n\r\n<span style=\"font-weight: 400;\">“We are concerned by the exclusionary nature of this draft bill. Rather than harnessing the potential that migration brings, the bill risks stifling such economic growth, which would be to the detriment of all people living in those areas, South Africans and non-South Africans alike,” said Scalabrini’s advocacy communications officer, Charlotte Manicom.</span>\r\n\r\n<span style=\"font-weight: 400;\">However, according to </span><span style=\"font-weight: 400;\">Nondumiso Mabuza, the Gauteng Department of Economic Development spokesperson, the bill’s reservation of opportunities is more about “affirming South Africans in terms of access to support, and does not ban legitimate foreign participation”.</span>\r\n\r\n<span style=\"font-weight: 400;\">She said the bill would clear up regulatory regimes, “which South Africans accuse foreign nationals of violating, and which in turn spur xenophobia”.</span>\r\n\r\n<span style=\"font-weight: 400;\">One of Scalabrini’s concerns is the potential negative impact on foreign-owned spaza shops. According to a press release for a mini documentary called </span><i><span style=\"font-weight: 400;\">Goods </span></i><span style=\"font-weight: 400;\">produced by the NGO, spaza shops played a vital role in ensuring </span><a href=\"https://www.dailymaverick.co.za/article/2020-10-02-reflecting-on-lockdown-losses-tales-from-the-health-frontline-and-plans-for-reopening/\"><span style=\"font-weight: 400;\">food security during the lockdown</span></a><span style=\"font-weight: 400;\"> by providing basic goods to communities. </span>\r\n\r\n<iframe src=\"https://www.youtube.com/embed/e0l1OibuZrs\" width=\"853\" height=\"480\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\"></span></iframe>\r\n\r\n<span style=\"font-weight: 400;\">“It means that many remote or difficult-to-access areas were assured of access to food during the pandemic, and long distances did not need to be covered to access food and other goods,” the release read. </span>\r\n\r\n<span style=\"font-weight: 400;\">The department estimates that the national township economy is worth about </span><a href=\"https://www.polity.org.za/article/invitation-for-public-comments-on-the-draft-gauteng-township-economic-development-2020-10-01\"><span style=\"font-weight: 400;\">R200-billion per year</span></a><span style=\"font-weight: 400;\">, but no sources were found to support this. However, the informal economy is notoriously difficult to measure. A 2016 study by the </span><a href=\"http://livelihoods.org.za/wp-content/uploads/2018/05/South-Africas-Informal-Economy.pdf\"><span style=\"font-weight: 400;\">Sustainable Livelihoods Foundation</span></a><span style=\"font-weight: 400;\"> found that the main township enterprises are spaza shops, ownership of which is dominated by foreign nationals. </span>\r\n\r\n<span style=\"font-weight: 400;\">Abdullahi Ali Hassan, the protagonist of </span><i><span style=\"font-weight: 400;\">Goods – </span></i><span style=\"font-weight: 400;\">who holds a master’s degree in urban studies from UCT, focusing on </span><span style=\"font-weight: 400;\">immigrant entrepreneurship </span><i><span style=\"font-weight: 400;\">– </span></i><span style=\"font-weight: 400;\">says foreign-owned spaza shops invest in the economy by relying on local supply chains.</span>\r\n\r\n<span style=\"font-weight: 400;\">“Spaza shops buy and sell local products,” said Hassan. He added that many of these micro enterprises employ South Africans and rent properties owned by locals for shop premises. </span>\r\n\r\n<span style=\"font-weight: 400;\">Fears are mounting that the bill will stoke xenophobic violence. </span>\r\n\r\n<span style=\"font-weight: 400;\">According to Alana Potter, director of research and advocacy at the Socio-Economic Rights Institute of South Africa (Seri), the bill “feeds into an incendiary rhetoric that foreigners prevent nationals from accessing economic opportunities. The opposite is in fact true.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Seri, alongside other civil society organisations, is making a written submission tackling the lawfulness of and lack of evidence for the bill’s proposal. </span>\r\n\r\n<span style=\"font-weight: 400;\">The constitutionality of the bill has also been questioned. A </span><a href=\"https://www.news24.com/news24/analysis/explainer-gauteng-provincial-governments-plan-to-ban-foreigners-from-opening-businesses-in-townships-20200928\"><i><span style=\"font-weight: 400;\">News24</span></i><span style=\"font-weight: 400;\"> article</span></a><span style=\"font-weight: 400;\"> published last week said if the bill is passed, foreign nationals flouting the legislation could face up to six months of jail time. The initial document has since been removed from the provincial government’s </span><a href=\"https://www.gauteng.gov.za/Publications/1C89C330-242B-4A5B-94F5-2D693D3E363A\"><span style=\"font-weight: 400;\">website</span></a><span style=\"font-weight: 400;\">. The current draft makes no mention of imprisonment. </span>\r\n\r\n<span style=\"font-weight: 400;\">Speaking to </span><i><span style=\"font-weight: 400;\">News24</span></i><span style=\"font-weight: 400;\">, University of the Western Cape law lecturer Yvette Basson said the bill may be considered “unfair discrimination on the basis of nationality” when considering section 9 of the Bill of Rights. </span>\r\n\r\n<span style=\"font-weight: 400;\">Potter said that even if the bill is passed, “it will face constitutional review”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Mabuza said: “</span><span style=\"font-weight: 400;\">The proposed bill falls within the Constitutional Legislative Competency of the province specifically as it relates to monitoring performance of local government by virtue of the Constitution of SA (section 155), (6)(a).” </span>\r\n\r\n<a href=\"https://www.justice.gov.za/legislation/constitution/SAConstitution-web-eng.pdf\"><span style=\"font-weight: 400;\">Section 155 (6A)</span></a><span style=\"font-weight: 400;\"> of the Constitution empowers provincial governments to ensure effective performance by municipalities with regards to by-laws, municipal services and other functions. </span>\r\n\r\n<span style=\"font-weight: 400;\">Flare-ups of xenophobic violence are often directed at foreign-owned businesses in townships. A </span><a href=\"https://www.dailymaverick.co.za/article/2020-09-17-government-action-plan-fails-to-curb-xenophobic-violence-in-sa/\"><span style=\"font-weight: 400;\">recent study</span></a><span style=\"font-weight: 400;\"> by Human Rights Watch found that xenophobic violence perpetrated against black and Asian foreign nationals often goes unpunished. </span>\r\n\r\n<a href=\"https://www.dailymaverick.co.za/article/2020-09-24-protest-against-foreign-nationals-a-signal-that-violence-may-follow-say-experts/\"><span style=\"font-weight: 400;\">Recent protests</span></a><span style=\"font-weight: 400;\"> against foreign nationals sparked fears of another wave of xenophobic attacks. </span>\r\n\r\n<span style=\"font-weight: 400;\">As Hassan highlights, foreign nationals are often used as “scapegoats” for social and economic challenges faced by poor South Africans, though he believes that there is more cohesion between South Africans and foreign nationals than is publicised by the media. </span>\r\n\r\n<span style=\"font-weight: 400;\">“I can even say it is good, because if it’s not good, how did the immigrants manage to work in those communities for such a long time and why did the communities support them also?” </span>\r\n\r\n<span style=\"font-weight: 400;\">Hassan is from Somalia and has lived in South Africa for 16 years. He felt immigrant business owners had </span><a href=\"http://www.econ3x3.org/article/why-are-foreign-run-spaza-shops-more-successful-rapidly-changing-spaza-sector-south-africa#:~:text=We%20argue%20that%20foreign%20shop,collective%20purchasing%20and%20market%20domination.\"><span style=\"font-weight: 400;\">skills and knowledge</span></a><span style=\"font-weight: 400;\"> which the government could tap into to help upscale the township economy. </span>\r\n\r\n<span style=\"font-weight: 400;\">Mabuza was asked whether foreign nationals without permanent residency would be forced to close their business. She said the bill “does not render or suggest that we do away with legitimate businesses established through the right channels”. This was regarding businesses with legitimate trading licences.</span>\r\n\r\n<span style=\"font-weight: 400;\">“</span><span style=\"font-weight: 400;\">The bill is about taking deliberate steps to allow townships to become fully fledged commercial zones – both by streamlining the rules on where and how you can run a business, and by providing different kinds of programmatic support to SMMEs operating in townships.</span>\r\n\r\n<span style=\"font-weight: 400;\">“By making it easier to open a business and formalise a business in townships, the bill is designed to create enabling conditions for existing township businesses to expand and hire people, and for new township businesses to start in order to contribute positively to job creation.” </span>\r\n\r\n<span style=\"font-weight: 400;\">The deadline for written submissions is 30 October. </span><b>DM</b>",
