However, in August this year, it was revealed at the impeachment inquiry into the suspended Public Protector that it was the EFF’s Floyd Shivambu who had attached it to an email complaint to the Public Protector in 2019. </span>\r\n\r\nhttps://www.dailymaverick.co.za/article/2022-08-26-effs-floyd-shivambu-gave-mkhwebane-classified-sars-rogue-unit-report-hearing-told/\r\n\r\n<span style=\"font-weight: 400;\">In 2014, the SARS so-called intelligence unit hit headlines first in </span><i><span style=\"font-weight: 400;\">Sunday Times</span></i><span style=\"font-weight: 400;\">, with claims that the “rogue unit” was set up as an illegal spying unit under former commissioner Gordhan. Three years later, in April 2016, </span><i><span style=\"font-weight: 400;\">Sunday Times</span></i><span style=\"font-weight: 400;\"> retracted its series of articles on the “rogue unit” in line with a ruling by the Press Ombud. </span>\r\n<h4>Sanef inquiry</h4>\r\n<span style=\"font-weight: 400;\">The South African National Editors’ Forum (Sanef) launched an inquiry, led by retired judge Kathleen Satchwell in October 2018, following the newspaper retraction and apologies for its reports on the “rogue unit” and also the so-called “Cato Manor Death Squad”.</span>\r\n\r\n<i><span style=\"font-weight: 400;\">Read more in</span></i><span style=\"font-weight: 400;\"> Daily Maverick: <a href=\"http://www.dailymaverick.co.za/article/2020-01-31-former-sars-executive-slams-press-over-rogue-unit-stories/\">Former Sars executive slams press over rogue unit stories</a></span>\r\n\r\n<span style=\"font-weight: 400;\">In December 2020, Gordhan </span><a href=\"https://www.dailymaverick.co.za/article/2020-12-07-biased-public-protectors-conduct-reprehensible-high-court-finds-hands-gordhan-comprehensive-victory/\"><span style=\"font-weight: 400;\">successfully challenged</span></a> <span style=\"font-weight: 400;\">Mkhwebane’s SARS </span><span style=\"font-weight: 400;\">“rogue unit” report in the Gauteng High Court in Pretoria, where judges Selby Baqwa, Annali Basson and Leonie Windell ruled that her report could not stand “and must be set aside”.</span>\r\n\r\n<span style=\"font-weight: 400;\">The court </span><a href=\"https://www.dailymaverick.co.za/article/2020-12-10-sars-rogue-unit-court-outcome-is-a-milestone-says-ivan-pillay/\"><span style=\"font-weight: 400;\">found her report was without foundation</span></a><span style=\"font-weight: 400;\"> and based on “discredited reports and unsubstantiated facts” and was “the product of a wholly irrational process, bereft of any sound legal or factual basis”.</span>\r\n\r\n[embed]https://youtu.be/sK6nyPqZoKo[/embed]\r\n\r\n<span style=\"font-weight: 400;\">Despite </span><a href=\"https://www.dailymaverick.co.za/article/2019-08-15-public-protectors-legal-bills-mount-with-another-gross-negligence-finding-against-her/\"><span style=\"font-weight: 400;\">mounting personal cost orders</span></a><span style=\"font-weight: 400;\">, Mkhwebane remained undeterred by the Pretoria High Court’s findings, and approached the Supreme Court of Appeal (SCA) in October 2021.
