"contents": "<span style=\"font-weight: 400;\">The Western Cape High Court has refused applications by Mineral Resources and Energy Minister Gwede Mantashe and the National Nuclear Regulator (NNR) for leave to appeal against the same court’s decision on the sacking of anti-nuclear activist Peter Becker. </span>\r\n\r\n<span style=\"font-weight: 400;\">The applications were for leave to appeal against Western Cape High Court </span><span style=\"font-weight: 400;\">Judge Babalwa Mantame’s </span><a href=\"https://www.groundup.org.za/media/uploads/documents/skm_c65823011912100.pdf\"><span style=\"font-weight: 400;\">scathing judgment</span></a><span style=\"font-weight: 400;\"> on 19 January which found Mantashe’s decision to discharge Becker from the </span><span style=\"font-weight: 400;\">NNR</span><span style=\"font-weight: 400;\"> board was “unlawful, unconstitutional and invalid”.</span>\r\n\r\n<b>Read more in Daily Maverick:</b> <a href=\"https://www.dailymaverick.co.za/article/2023-01-20-gwede-mantashe-axing-of-nuclear-watchdog-activist-peter-becker-was-unconstitutional-rules-court/\"><span style=\"font-weight: 400;\">Gwede Mantashe axing of nuclear watchdog activist Peter Becker was unconstitutional, rules court</span></a>\r\n\r\n<span style=\"font-weight: 400;\">On Friday, 26 May, Judge Mantame ruled that Mantashe and the NNR, in their respective applications, had failed to convince the court that there was any reasonable prospect of success in an appeal and that there were compelling reasons why an appeal should be heard.</span>\r\n\r\n<span style=\"font-weight: 400;\">They were ordered to pay the costs of the application. </span>\r\n\r\n<span style=\"font-weight: 400;\">“The test applied in an application for leave to appeal amongst others, suggests that there must be a sound and rational basis for the conclusion that there are prospects of success on appeal. </span>\r\n\r\n<span style=\"font-weight: 400;\">“The respondents have not taken this Court into its confidence and identified the compelling reasons why this matter should be heard by an appeal court, other than to give this Court’s judgment their own meaning. The fact that they preferred their own interpretation to the comments and findings of the Court could not be said to be a justifiable reason/s for the matter to be heard by an appeal court,” concluded Judge Mantame.</span>\r\n<h4><b>A thorough dressing-down</b></h4>\r\n<span style=\"font-weight: 400;\">Both respondents received a thorough dressing-down from the judge, who criticised their apparent decision on reading her initial judgment “selectively. The respondents cannot substitute the Court’s analysis with their own convenient censure,” she said.</span>\r\n\r\n<span style=\"font-weight: 400;\">The judgment coincided with President Cyril Ramaphosa’s move to finally bestow his new minister of electricity, Kgosientsho Ramokgopa, with </span><a href=\"https://www.dailymaverick.co.za/article/2023-05-26-ramaphosa-transfers-responsibility-for-new-power-generation-to-ramokgopa-pulling-plug-on-mantashe/\"><span style=\"font-weight: 400;\">real power</span></a><span style=\"font-weight: 400;\"> — transferring responsibility for procuring new electricity generation to Ramokgopa from Mantashe. At first glance, the loss of such procurement powers appears to be a blow to Mantashe. But Ramokgopa’s new responsibilities are not quite what they seem, as </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\">’s</span><a href=\"https://www.dailymaverick.co.za/article/2023-05-26-the-mirage-of-power-or-how-the-electricity-minister-got-his-functions/\"><span style=\"font-weight: 400;\"> Marianne Merten writes</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<iframe id=\"doc_60894\" class=\"scribd_iframe_embed\" title=\"Judgment - LeaveToAppealRefused\" src=\"https://www.scribd.com/embeds/648879712/content?start_page=1&view_mode=scroll&access_key=key-zl0ybGv3v4SlGtH0ErEa\" width=\"100%\" height=\"600\" frameborder=\"0\" scrolling=\"no\" data-auto-height=\"false\" data-aspect-ratio=\"0.7074509803921568\"></iframe>\r\n\r\n<span style=\"font-weight: 400;\">Becker, the spokesperson of the Koeberg Alert Alliance (KAA) — a civil society organisation opposed to the further building of reactors at Koeberg Power Station and extending its lifespan — was appointed to the NNR board in June 2021, to represent communities affected by nuclear activities. </span>\r\n\r\n<span style=\"font-weight: 400;\">In February 2022, he was fired by Mantashe, who alleged Becker was guilty of “misconduct” and was “conflicted”, after he gave an </span><a href=\"https://www.energize.co.za/article/thyspunt-nuclear-hearings-distract-koeberg-problems\"><span style=\"font-weight: 400;\">interview</span></a><span style=\"font-weight: 400;\"> in his capacity as KAA spokesperson, in which he raised concerns about the use of nuclear power in South Africa, and after he convened a meeting with civil society organisations.</span>\r\n\r\n<span style=\"font-weight: 400;\">Becker’s initial suspension from the board in January 2022 was on the same day that the steam generators in unit two were approved for replacement, which is one of the steps required before any life extension could be granted. Members of civil society have since </span><a href=\"https://www.dailymaverick.co.za/article/2022-01-20-mantashe-boots-civil-society-representative-from-nuclear-regulator-just-as-contentious-koeberg-work-gets-nod/\"><span style=\"font-weight: 400;\">questioned the timing</span></a><span style=\"font-weight: 400;\"> of his suspension. Becker launched a court bid to </span><a href=\"https://www.dailymaverick.co.za/article/2022-04-19-fired-national-nuclear-regulator-board-member-takes-minister-gwede-mantashe-to-court/\"><span style=\"font-weight: 400;\">challenge his axing</span></a><span style=\"font-weight: 400;\"> last year. In his first court application, he argued that Mantashe had an ulterior motive to get rid of him because of the challenging questions he may have raised.</span>\r\n\r\n<b>Read more in Daily Maverick:</b> <a href=\"https://www.dailymaverick.co.za/article/2023-02-07-the-bull-in-a-china-shop-gwede-mantashe/\"><span style=\"font-weight: 400;\">The Bull in a china shop – Gwede Mantashe</span></a>\r\n\r\n<span style=\"font-weight: 400;\">In her judgment on 19 January, Judge Mantame concluded that Becker’s public statements, his requests for information and the meeting with members of his constituency could not be construed as misconduct. Additionally, even if there was a perception of conflict of interest, it was capable of being mitigated.</span>\r\n\r\n<span style=\"font-weight: 400;\">In Friday’s judgment, Judge Mantame reiterated: “Similarly, in this matter, in light of the finding that there was no evidence of misconduct on the part of the applicant, it then follows that there is no rational or sound basis for his discharge. In the circumstances, the conclusion that there are prospects of success on appeal or that there are compelling reasons for the appeal to be heard is without merit.”</span>\r\n\r\n<span style=\"font-weight: 400;\">This raises the question of what the minister’s motivation had been to axe Becker. The reasons and decision of Mantashe to discharge Becker from his office as a director of the board, Judge Mantame ordered in January, were reviewed and set aside. However, Becker is currently in limbo and is excluded from the NNR board and board processes.</span>\r\n\r\n<span style=\"font-weight: 400;\">The Western Cape High Court’s refusal to grant leave to appeal to Mantashe and the NNR doesn’t mean it’s the end of the road, as they can still petition the Supreme Court of Appeal directly for leave to appeal.</span>\r\n\r\n<i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\"> contacted the Department of Mineral Resources and Energy’s ministerial liaison officer, Natie Shabangu, for comment, but had not received a response by the time of publication.</span>\r\n\r\n<i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\"> also contacted NNR spokesperson Gino Moonsamy for comment. "description": "<span style=\"font-weight: 400\">Gwede Mantashe is a South African politician and the current Minister of Mineral Resources and Energy within the African National Congress (ANC). </span>\r\n\r\n<span style=\"font-weight: 400\">The portfolio was called the Ministry of Minerals and Energy until May 2009, when President Jacob Zuma split it into two separate portfolios under the Ministry of Mining (later the Ministry of Mineral Resources) and the Ministry of Energy. Ten years later, in May 2019, his successor President Cyril Ramaphosa reunited the portfolios as the Ministry of Mineral Resources and Energy. </span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe</span><span style=\"font-weight: 400\"> was born in 1955 in the Eastern Cape province, and began his working life at Western Deep Levels mine in 1975 as a Recreation Officer and, in the same year, moved to Prieska Copper Mines where he was Welfare Officer until 1982.</span>\r\n\r\n<span style=\"font-weight: 400\">He then joined Matla Colliery and co-founded the Witbank branch of the National Union of Mine Workers (NUM), becoming its Chairperson. He held the position of NUM Regional Secretary in 1985. Mantashe showcased his skills and leadership within the NUM, serving as the National Organiser from 1988 to 1993 and as the Regional Coordinator from 1993 to 1994.</span>\r\n\r\n<span style=\"font-weight: 400\">From 1994 to 1998, Mantashe held the role of Assistant General Secretary of the NUM and was later elected General Secretary in 1998.</span>\r\n\r\n<span style=\"font-weight: 400\">During his initial tenure in government, Mantashe served as a Councillor in the Ekurhuleni Municipality from 1995 to 1999. Notably, he made history by becoming the first trade unionist appointed to the Board of Directors of a Johannesburg Stock Exchange-listed company, Samancor.</span>\r\n\r\n<span style=\"font-weight: 400\">In May 2006, Mantashe stepped down as the General Secretary of the NUM and took on the role of Executive Director at the Development Bank of Southern Africa for a two-year period. He also chaired the Technical Working Group of the Joint Initiative for Priority Skills Acquisition.</span>\r\n\r\n<span style=\"font-weight: 400\">In 2007, Mantashe became the Chairperson of the South African Communist Party and a member of its Central Committee. He was elected Secretary-General of the African National Congress (ANC) at the party's 52nd National Conference in December 2007. Mantashe was re-elected to the same position in 2012. Additionally, at the ANC's 54th National Conference in 2017, he was elected as the National Chairperson.</span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe is a complex and controversial figure. He has been accused of being too close to the ANC's corrupt leadership, and of being a hardliner who is opposed to reform. </span>\r\n\r\n<span style=\"font-weight: 400\">His actions and statements have sparked controversy and allegations of protecting corruption, undermining democratic principles, and prioritising party loyalty over the interests of the country.</span>",
