"contents": "<div>\r\n\r\n<span style=\"font-weight: 400;\">The national congress of the National Union of Metalworkers of South Africa (Numsa), set to begin on Monday, has been interdicted and restrained from going ahead, until the union complies with its constitution. Numsa’s national office bearers are elected at their national congress, which was last held in 2016. (</span><a href=\"https://www.groundup.org.za/media/uploads/documents/j885-22__ntlokose_v_numsa.pdf\"><span style=\"font-weight: 400;\">Read the ruling here</span></a><span style=\"font-weight: 400;\">)</span>\r\n\r\n<span style=\"font-weight: 400;\">On Saturday, Judge Graham Moshoana in the Johannesburg Labour Court ruled that decisions of the union’s central committee to suspend a slew of members, including the union’s second deputy president, Ruth Ntlokotse, and to place the Mpumalanga Regional Council, Numsa’s largest region, under “administration\" were “unconstitutional, invalid and unenforceable in law”.</span>\r\n\r\n<span style=\"font-weight: 400;\">On 18 July 2022, Ntlokotse launched an urgent application in the labour court, seeking to have her suspension and those of other members overturned, and to interdict the national congress until the union complies with its constitution.</span>\r\n\r\n<span style=\"font-weight: 400;\">Earlier this year, GroundUp broke a </span><a href=\"https://www.groundup.org.za/topic/numsa-3sixty/\"><span style=\"font-weight: 400;\">series of stories</span></a><span style=\"font-weight: 400;\"> about Numsa’s leadership and its investment arm, in particular its funeral insurance scheme 3Sixty Life. We revealed reports that suggested improper dealings, including that 3Sixty Life paid for Numsa general secretary </span><a href=\"https://www.groundup.org.za/article/irvin-jims-r40k-birthday-paid-for-by-embattled-life-insurer/\"><span style=\"font-weight: 400;\">Irvin Jim’s birthday party</span></a><span style=\"font-weight: 400;\">. amaBhungane also </span><a href=\"https://amabhungane.org/stories/220303-numsa-at-war-with-itself/\"><span style=\"font-weight: 400;\">published</span></a><span style=\"font-weight: 400;\"> a detailed report on possible malfeasance at the union.</span>\r\n\r\n<span style=\"font-weight: 400;\">A number of union leaders voiced their concerns following these reports. In the ensuing months Irvin Jim and the central committee subsequently suspended over 25 union leaders, including shop stewards, office bearers and officials. The suspensions have been perceived as an attempt to squash criticism of Jim.</span>\r\n\r\n<span style=\"font-weight: 400;\">The suspensions included Vuyo Lufele, regional secretary of the Western Cape; Andile Bloko, the Eastern Cape region’s Regional Deputy Chairperson; Mziyanda Twani, its Regional Secretary; and Xolisa Posiso, the Mpumalanga Regional Council’s Regional Chairperson.</span>\r\n\r\n<span style=\"font-weight: 400;\">Then in the past week, 30 further suspensions were handed down by the central committee.</span>\r\n\r\n<span style=\"font-weight: 400;\">The entire Mpumalanga Region was placed under administration by the central committee. This is the union’s largest region, and placing it under administration disabled the region from participating in the national elective congress.</span>\r\n\r\n<span style=\"font-weight: 400;\">On 14 July 2022, the central committee announced the suspension of Ruth Ntlokotse, Numsa’s second deputy president and the newly elected president of the South African Federation of Trade Unions (Saftu). This decision was apparently due to Ntlokotse's decision to run for Saftu’s presidency.</span>\r\n\r\n<span style=\"font-weight: 400;\">Ntlokotse, however, </span><a href=\"https://www.news24.com/fin24/economy/numsa-deputy-ntlokotse-says-suspension-was-a-bid-to-silence-her-on-3sixtylife-scandal-20220715\"><span style=\"font-weight: 400;\">said that she was suspended</span></a><span style=\"font-weight: 400;\"> for demanding accountability for the 3Sixty Life debacle.</span>\r\n\r\n<span style=\"font-weight: 400;\">Judge Moshoana ruled that the suspensions of Ntlokotse and others by the central committee were not within its powers, as defined by the union’s constitution. As such, Ntlokotse's suspension and the suspensions of the other Numsa members were “unconstitutional and unenforceable in law”.</span>\r\n\r\n<span style=\"font-weight: 400;\">The judge also ruled that the central committee did not have the authority under Numsa’s constitution to place the Mpumalanga Regional Council under “administration\", which would have ruled out the region’s participation in the national congress.</span>\r\n\r\n<span style=\"font-weight: 400;\">“How can a national congress … proceed without the views of the biggest region, the MRC [Mpumalanga Regional Council]?” wrote Judge Moshoana.</span>\r\n\r\n<span style=\"font-weight: 400;\">The judge found that the participation of delegates in the national congress must be determined by a credentials committee, but none was appointed. Instead, the central committee acted as a credentials committee, which Moshoana ruled was unconstitutional.</span>\r\n\r\n<span style=\"font-weight: 400;\">The court would “be failing in its duties if it were to allow this glaringly unlawful conduct to continue”, and let the national congress proceed, wrote Moshoana.
