400;\">unprecedented level of public interest</span></a><span style=\"font-weight: 400;\"> in the NHI Bill: the Portfolio Committee on Health (PCH) received more than 100,000 submissions and more than 130 requests from individuals, organisations and institutions to make oral presentations. </span>\r\n\r\n<span style=\"font-weight: 400;\">This was accompanied by extensive public debate and comment on the issue in the media and social forums.</span><span style=\"font-weight: 400;\"> </span>\r\n\r\n<b>Read more in the Daily Maverick:</b> <a href=\"https://www.dailymaverick.co.za/article/2022-03-23-a-summary-of-views-on-the-proposed-health-funding-model-presented-to-parliament/\">funding model</a>;</li>\r\n \t<li>Enhanced opportunities for <a href=\"https://www.dailymaverick.co.za/article/2022-04-03-nhi-will-stand-or-fall-on-parliaments-approach-to-corruption-say-civil-society-bodies/\">corruption</a>;</li>\r\n \t<li>The lack of separation of the political and operational spheres in the <a href=\"https://www.dailymaverick.co.za/article/2022-04-11-too-much-ministerial-power-for-nhi-challenges-and-options-for-the-portfolio-committee/\">proposed governance structure</a>, and</li>\r\n \t<li>The concentration of power in the minister of health.</li>\r\n</ul>\r\n<span style=\"font-weight: 400;\">Respondents were also concerned that the proposals contravened other legislation, particularly in terms of </span><a href=\"https://www.dailymaverick.co.za/article/2022-04-21-the-controversial-national-health-insurance-bill-has-serious-constitutional-and-human-rights-implications/\"><span style=\"font-weight: 400;\">constitutional and human rights obligations</span></a><span style=\"font-weight: 400;\">, that it would </span><a href=\"https://www.dailymaverick.co.za/article/2022-05-03-concern-about-healthcare-access-for-refugees-rural-children-injured-employees-the-elderly-and-those-living-with-disabilities/\"><span style=\"font-weight: 400;\">restrict access</span></a><span style=\"font-weight: 400;\"> and did not provide sufficient </span><a href=\"https://www.dailymaverick.co.za/article/2022-05-12-the-nhi-will-not-succeed-unless-its-benefits-package-is-accepted-across-the-broad-spectrum-of-society/\"><span style=\"font-weight: 400;\">clarity on the benefits</span></a><span style=\"font-weight: 400;\"> to be offered nor the process by which they would be determined. </span>\r\n\r\n<a href=\"https://www.dailymaverick.co.za/article/2021-09-08-nhi-bill-parliaments-health-committee-faces-range-of-options-after-100000-plus-submissions-received/\"><span style=\"font-weight: 400;\">Three options</span></a><span style=\"font-weight: 400;\"> were open to the PCH after the public inputs: </span>\r\n<ol>\r\n \t<li>Pass the bill without any changes or with only minor amendments;</li>\r\n \t<li>Make substantive amendments to the bill to address concerns raised; and</li>\r\n \t<li>Reject the bill.</li>\r\n</ol>\r\n<span style=\"font-weight: 400;\">The PCH chose option one, making no substantive amendments in response to major public concerns. That being said, some </span><a href=\"https://www.dailymaverick.co.za/article/2023-06-13-we-are-unlikely-to-be-equitably-able-to-access-lifesaving-affordable-medicines-under-nhi/?token=MEdjczVNYUpZeFBuZmN2SkdvQUJXTTZWNXdzVTJ1NldyUkduVWdtMjdOcGoxWjhMZndGNWNHaU5BZTk5MWpiSlY4RXFWOS9UNGhnakdXWlpaS1BlQzBpemF2QkcrTFhOUlFkalZpdkFTNXlqbGs5OUMrWjZkQUsrcTRyOGUxWDN2cU4vVWlidFNOeUpqWkhoQ3dSOVM2ZVZyUHZvWDRTTmNCKzd5dEFUT0ZVPQ==\"><span style=\"font-weight: 400;\">minor amendments</span></a><span style=\"font-weight: 400;\"> were made, largely to try to curtail ministerial discretion and powers, and to expand on definitions, using more precise language. </span>\r\n\r\n<span style=\"font-weight: 400;\">Consequently, potential constitutional infringements arising from designating the NHI fund as the </span><a href=\"https://www.dailymaverick.co.za/article/2022-04-21-the-controversial-national-health-insurance-bill-has-serious-constitutional-and-human-rights-implications/\"><span style=\"font-weight: 400;\">sole funder and purchaser</span></a><span style=\"font-weight: 400;\"> of health services for the country, nor the lack of clarity on </span><a href=\"https://www.dailymaverick.co.za/article/2022-05-12-the-nhi-will-not-succeed-unless-its-benefits-package-is-accepted-across-the-broad-spectrum-of-society/\"><span style=\"font-weight: 400;\">benefits and access</span></a><span style=\"font-weight: 400;\"> concerns, nor the contradiction between the bill and the constitutionally mandated </span><a href=\"https://www.dailymaverick.co.za/article/2022-04-21-the-controversial-national-health-insurance-bill-has-serious-constitutional-and-human-rights-implications/\"><span style=\"font-weight: 400;\">role of provinces</span></a><span style=\"font-weight: 400;\"> were addressed. </span>\r\n\r\n<span style=\"font-weight: 400;\">Moreover, the amendments shorten the timelines for the transitional arrangements from the original five years for phases one and two to three years for each phase – which is unrealistic given the scope of the changes required. </span>\r\n<h4><b>Implications </b></h4>\r\n<span style=\"font-weight: 400;\">By deciding to approve the amended bill with mainly nonsubstantive amendments, the PCH has largely rejected public concerns. The deliberations on and approval of the amended bill took place on a divided party-political basis. The amended bill was </span><a href=\"https://pmg.org.za/committee-meeting/37050/?utm_campaign=minute-alert&utm_source=transactional&utm_medium=email\"><span style=\"font-weight: 400;\">supported</span></a><span style=\"font-weight: 400;\"> in its entirety by the ANC and IFP PCH members, and rejected in its entirety by the DA, Freedom Front Plus and EFF members. </span>\r\n\r\n<span style=\"font-weight: 400;\">The amended bill was approved despite </span><a href=\"https://www.news24.com/fin24/economy/nhi-reaches-landmark-as-parliament-committee-gives-its-approval-20230526\"><span style=\"font-weight: 400;\">warnings</span></a><span style=\"font-weight: 400;\"> from Parliamentary Legal Services that there could be a host of potential constitutional traps in the current composition of the bill. The risk of </span><a href=\"https://www.dailymaverick.co.za/article/2022-04-21-the-controversial-national-health-insurance-bill-has-serious-constitutional-and-human-rights-implications/\"><span style=\"font-weight: 400;\">legal challenges</span></a><span style=\"font-weight: 400;\"> is therefore high, with the DA, the Freedom Front, Solidarity, the Helen Suzman Foundation and the Free Market Foundation having already signalled this intention. </span>\r\n\r\n<span style=\"font-weight: 400;\">The failure of the amended bill to respond to the concerns flagged – by a range of business, funder and provider organisations – risks further eroding broader public support for the NHI, a critical requirement for its successful implementation. </span>\r\n\r\n<span style=\"font-weight: 400;\">In the longer term, if the negative outcomes predicted by those who have expressed concerns regarding the bill materialise, the healthcare system would be weakened rather than strengthened by the reform.</span>\r\n<h4><b>How do we proceed?</b></h4>\r\n<span style=\"font-weight: 400;\">It is difficult to predict the outcome of the likely legal challenges and contestation around the amended bill. It must also still be signed by the President. It is also uncertain how long this will take to resolve. In the circumstances, what approach should be adopted for health services in the interim? </span>\r\n\r\n<span style=\"font-weight: 400;\">The uncertainty and inertia created by the expectation of an imminent, extensive – yet poorly defined – reform has arguably contributed to the </span><a href=\"http://www.samj.org.za/index.php/samj/article/view/13580/10163\"><span style=\"font-weight: 400;\">progressive deterioration</span></a><span style=\"font-weight: 400;\"> of public health services in most parts of the country and increasingly unaffordable and inefficient private health services. </span>\r\n\r\n<span style=\"font-weight: 400;\">Critical reforms necessary to improve and strengthen the healthcare system have not been implemented, in anticipation of the implementation of the NHI “</span><a href=\"https://mg.co.za/article/2012-05-30-nhi-seen-as-catch-all-solution/\"><span style=\"font-weight: 400;\">magic bullet</span></a><span style=\"font-weight: 400;\">”, which –it was hoped – would address all the shortcomings of the health system, including governance, financing, workforce, quality, prioritisation and inequity. </span>\r\n\r\n<span style=\"font-weight: 400;\">Discussion of South Africa’s health reform needs to move beyond the </span><a href=\"https://www.dailymaverick.co.za/article/2022-03-01-mixed-views-and-scepticism-continue-to-obstruct-pathway-of-nhi-bill/\"><span style=\"font-weight: 400;\">simplistic division</span></a><span style=\"font-weight: 400;\"> between those “for” and “against” NHI. The critical reforms required to strengthen the health system should be implemented immediately. These are necessary and overdue: they would improve healthcare immediately and would provide the essential building blocks for the NHI. </span>\r\n\r\n<span style=\"font-weight: 400;\">To illustrate the point, we provide four examples of reforms that need to be implemented immediately. </span>\r\n<h4><b>Legislative reform </b></h4>\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://www.gov.za/sites/default/files/gcis_document/201505/act-56-1974.pdf\"><span style=\"font-weight: 400;\">Health Professions Act of 1974</span></a><span style=\"font-weight: 400;\"> needs to be reformed to allow for alternative reimbursement models, group practices, etc. </span>\r\n\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://www.gov.za/sites/default/files/gcis_document/201409/a61-03.pdf\"><span style=\"font-weight: 400;\">National Health Act</span></a><span style=\"font-weight: 400;\"> needs to be reviewed to address issues including control of central hospitals. </span>\r\n\r\n<span style=\"font-weight: 400;\">The regulations related to the Office of Health Standard Compliance (OHSC) need to be reviewed, to allow the OHSC to play a foundational role in ensuring that our health facilities provide, and keep providing, safe and quality care to all in South Africa. </span>\r\n\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://www.gov.za/sites/default/files/gcis_document/201409/a131-98.pdf\"><span style=\"font-weight: 400;\">Medical Schemes Act</span></a><span style=\"font-weight: 400;\"> needs to be reviewed to address the extensive recommendations of the </span><a href=\"https://www.compcom.co.za/wp-content/uploads/2020/01/Final-Findings-and-recommendations-report-Health-Market-Inquiry.pdf\"><span style=\"font-weight: 400;\">Health Market Inquiry</span></a><span style=\"font-weight: 400;\">, which to date have had limited implementation. </span>\r\n<h4><b>Sound and competent management, administrative and clinical oversight and governance</b><span style=\"font-weight: 400;\"> </span></h4>\r\n<span style=\"font-weight: 400;\">Changes take a long time to effect and we need to start the process by addressing the </span><b>lack of separation between the political and operational spheres</b><span style=\"font-weight: 400;\">. While policy determination is inevitably a political process, technical competence should be the overriding concern in the operational spheres, including all appointments.</span>\r\n\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://www.health.gov.za/wp-content/uploads/2020/11/national-digital-strategy-for-south-africa-2019-2024-b.pdf\"><span style=\"font-weight: 400;\">National Digital Health Strategy</span></a><span style=\"font-weight: 400;\">, including the implementation of a common health patient registration system and health patient registration number for all residents (both public and private sector users), needs to be fast-tracked. Only through the establishment of an integrated IT platform can we start capturing the data necessary to plan for the health and healthcare needs of the country. </span>\r\n\r\n<span style=\"font-weight: 400;\">A comprehensive, pragmatic and accountable </span><b>health prioritisation process</b><span style=\"font-weight: 400;\"> should be funded and implemented to help the health service determine what services, interventions and technologies will be offered, to whom, and under what conditions and medical indications.</span>\r\n\r\n<span style=\"font-weight: 400;\">This can build on existing good practice in South Africa related to development of our </span><a href=\"https://www.gov.za/sites/default/files/gcis_document/201409/standardtreatmentguidelinesandessentialmedicineslist2012s.pdf\"><span style=\"font-weight: 400;\">National Essential Medicines List and Standard Treatment Guidelines</span></a><span style=\"font-weight: 400;\">. The concept of a “health services package” (i.e. lists, schedules, protocols and guidelines) is a critical element of the NHI, and indeed essential for any health system seeking to plan for and provide equitable, efficient and sustainable care. </span>\r\n\r\n<span style=\"font-weight: 400;\">International experience indicates that health prioritisation systems take many years to develop procedural and technical skills and knowledge, so the development of this capacity should be initiated as soon as possible. </span>\r\n<h4><b>Enable, don’t detract or delay</b></h4>\r\n<span style=\"font-weight: 400;\">These examples could all be implemented as part of the ongoing strengthening of the health system, while at the same time creating an enabling environment for the implementation of the NHI.</span>\r\n\r\n<span style=\"font-weight: 400;\">The ongoing debate around the NHI journey is likely to attract significant attention from the public and health service actors, but it should not detract from or delay the specific, practical and uncontroversial actions that can be taken to improve health system performance and the health of the people of South Africa today. </span><b>DM</b>\r\n\r\n<i><span style=\"font-weight: 400;\">This is the seventh and last article in our series about different issues dealt with in public submissions to Parliament on the NHI Bill.
