"contents": "<span style=\"font-weight: 400;\">Former SAA chair Dudu Myeni and former Sondolo IT director Trevor Mathenjwa were arrested on Friday and appeared briefly in the Richards Bay Magistrates Court, KwaZulu-Natal. </span>\r\n\r\n<span style=\"font-weight: 400;\">Their passports have been handed over to the investigation authorities for the duration of the investigation.</span>\r\n\r\n<span style=\"font-weight: 400;\">The case stems from alleged gratification that Myeni received during her tenure as SAA board chairperson and relates to security upgrades she received at her home in Richard Bay between May 2014 and March 2015 to the tune of R200,000, according to National Prosecuting Authority’s (NPA) Investigating Directorate (ID) spokesperson Sindisiwe Seboka.</span>\r\n\r\n<span style=\"font-weight: 400;\">“During the tenure of Myeni as chairperson of the SAA, she had a legal duty to disclose her interests in terms of the SAA Conflict of Interest Policy, which we allege she failed to do so,” said</span><span style=\"font-weight: 400;\"> Seboka.</span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-1875140\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2023/09/od-DuduMyeni-bust2.jpg\" alt=\"Dudu Myeni and Trevor Mathenjwa in court\" width=\"720\" height=\"393\" /> <em>Former SAA board chairperson Dudu Myeni (left) appeared in the Richards Bay Magistrates' Court with Trevor Mathenjwa (right), a former Bosasa executive. The State also contends that Myeni benefited from lavish travel arrangements and hotel stays for herself and family members to the tune of over R107,000.</span>\r\n\r\n<span style=\"font-weight: 400;\">Hence, </span><span style=\"font-weight: 400;\">Seboka added,</span><span style=\"font-weight: 400;\"> Myeni stands accused of corruption for receiving gratification from Bosasa subsidiary Sondolo IT, offered by Mathenjwa. </span>\r\n\r\n<span style=\"font-weight: 400;\">“Myeni is accused of having received security upgrades for her Richards Bay premises during May 2014 to March 2015, to the value of R200,000. She is further accused of benefiting from hotel accommodation and travel expenses for her and persons close to her, from Bosasa, facilitated by Blake Travels, between May 2014 and March 2015 for over R107,000,” Seboka said.</span>\r\n\r\n<iframe title=\"YouTube video player\" src=\"https://www.youtube.com/embed/osQsCZqHCnk?si=Fu6-ThcyJDPJpEEC\" width=\"830\" height=\"415\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\"></span></iframe>\r\n<h4><b>Myeni legal quagmire</b></h4>\r\n<span style=\"font-weight: 400;\">Myeni was also implicated during State Capture investigations when former Bosasa chief operating officer Angelo Agrizzi alleged </span><a href=\"https://www.dailymaverick.co.za/article/2019-03-29-newsflash-agrizzi-says-he-met-dudu-myeni-five-times-once-over-saa-catering-deal/\"><span style=\"font-weight: 400;\">he met Myeni on five occasions</span></a><span style=\"font-weight: 400;\"> — including once in a boardroom at the InterContinental at OR Tambo airport in the presence of former SAA acting CEO, Nico Bezuidenhout.</span>\r\n\r\n<span style=\"font-weight: 400;\">Testifying </span><span style=\"font-weight: 400;\">before the State Capture Commission in March 2019, Agrizz also testified that he had accompanied his </span><a href=\"https://www.dailymaverick.co.za/article/2019-08-26-gavin-watson-the-man-who-bought-the-anc-dies-in-horrific-car-crash/\"><span style=\"font-weight: 400;\">former boss, Gavin Watson</span></a><span style=\"font-weight: 400;\">, to a meeting with Myeni during which there was a discussion about Bosasa taking over a security tender as well as a catering contract.</span>\r\n\r\n<span style=\"font-weight: 400;\">Myeni, he previously testified, was the recipient of a Louis Vuitton handbag courtesy of Bosasa, </span><a href=\"https://www.dailymaverick.co.za/article/2019-02-05-dudu-myenis-bosasa-woes-stack-up-beyond-a-louis-vuitton-handbag/\"><span style=\"font-weight: 400;\">stuffed with monthly payments of R300,000 in cash.</span></a>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-1875212\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2023/09/947A3866.jpg\" alt=\"Dudu Myeni\" width=\"720\" height=\"451\" /> <em>Former SAA board chairperson Dudu Myeni, with her lawyer Nqabayethu Buthelezi, appeared in the Richards Bay Magistrates' Court. She was further ordered to </span><a href=\"https://www.dailymaverick.co.za/article/2020-12-22-judge-backs-enforcement-order-that-will-see-dudu-myeni-abandon-her-directorships-including-that-of-the-jacob-g-zuma-foundation/\"><span style=\"font-weight: 400;\">abandon</span></a><span style=\"font-weight: 400;\"> all her directorships, including her roles as SAA chairperson, executive chairperson of the Jacob Zuma Foundation and deputy chairperson of Free State electricity distribution company Centlec. </span><a href=\"https://www.dailymaverick.co.za/article/2021-04-12-supreme-court-of-appeal-deals-a-crushing-blow-to-former-saa-chair-dudu-myeni/#:~:text=Supreme%20Court%20of%20Appeal%20dismisses,life%20Dudu%20Myeni's%20two%20appeals.&text=The%20Supreme%20Court%20of%20Appeal,life%20ruling%20made%20against%20her.\"><span style=\"font-weight: 400;\">In April 2021</span></a><span style=\"font-weight: 400;\">, the Supreme Court of Appeal dismissed one of her two appeals against the delinquent-for-life ruling.</span>\r\n<h4><b>Agrizzi psychiatric observation</b></h4>\r\n<span style=\"font-weight: 400;\">The arrest and release on bail of </span><span style=\"font-weight: 400;\">Myeni and Mathenjwa</span><span style=\"font-weight: 400;\"> pair came 24 hours after Pretoria high court Judge David Makhoba ruled that Agrizzi be </span><a href=\"https://www.news24.com/news24/southafrica/news/angelo-agrizzi-referred-for-mental-evaluation-to-determine-fitness-to-stand-trial-20230928\"><span style=\"font-weight: 400;\">referred for mental observation</span></a><span style=\"font-weight: 400;\"> to determine his fitness to stand trial in the R1.8-billion Bosasa and Correctional Services Department (DCS) matter.</span>\r\n\r\n<span style=\"font-weight: 400;\">Agrizzi appeared virtually before Makhoba. Handing down this ruling, Makhoba said that it was not for the court to decide whether a person is mentally fit to stand trial or not, instead, it is for the professionals to decide. </span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-1268258\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/05/Vince-AgrizziLatest1.jpeg\" alt=\"\" width=\"720\" height=\"384\" /> <em>Former Bosasa COO Angelo Agrizzi gestures during his testimony at the State Capture Commission in Johannesburg on 22 January 2019. (Photo: Gallo Images / Sowetan / Alon Skuy)</em></p>\r\n\r\n<span style=\"font-weight: 400;\">Furthermore, the judge declared that it is the state’s responsibility to ensure that Agrizzi is safely taken to a psychiatric institution and that he takes his medication.</span>\r\n\r\n<span style=\"font-weight: 400;\">Agrizzi was diagnosed with diabetes, hypertension, obesity, acute renal failure, and liver dysfunction by pulmonologist Dr Muhammad Chohan. Agrizzi is </span><a href=\"https://www.dailymaverick.co.za/article/2023-03-09-ailing-former-bosasa-coo-angelo-agrizzis-chances-of-survival-less-than-30-40-court-told/\"><span style=\"font-weight: 400;\">mechanically ventilated and sedated</span></a><span style=\"font-weight: 400;\">, but he is conscious and on continuous dialysis. The results of Agrizzi’s mental fitness have been postponed until 31 October.</span>\r\n\r\n<span style=\"font-weight: 400;\">This matter relates to four tenders awarded to Bosasa and its subsidiaries between August 2004 and 2007. The tender was for rendering catering and training services, installation of CCTV cameras, installing perimeter fencing and supplying a television system and monitoring equipment. </span>\r\n\r\n<span style=\"font-weight: 400;\">Myeni and Mathenjwa will be back in court on 17 November. At this point, the State will make an application to have the case transferred to Gauteng as the majority of the case’s witnesses live in the province. </span><b>DM</b>",

She was further ordered to </span><a href=\"https://www.dailymaverick.co.za/article/2020-12-22-judge-backs-enforcement-order-that-will-see-dudu-myeni-abandon-her-directorships-including-that-of-the-jacob-g-zuma-foundation/\"><span style=\"font-weight: 400;\">abandon</span></a><span style=\"font-weight: 400;\"> all her directorships, including her roles as SAA chairperson, executive chairperson of the Jacob Zuma Foundation and deputy chairperson of Free State electricity distribution company Centlec. </span><a href=\"https://www.dailymaverick.co.za/article/2021-04-12-supreme-court-of-appeal-deals-a-crushing-blow-to-former-saa-chair-dudu-myeni/#:~:text=Supreme%20Court%20of%20Appeal%20dismisses,life%20Dudu%20Myeni's%20two%20appeals.&text=The%20Supreme%20Court%20of%20Appeal,life%20ruling%20made%20against%20her.\"><span style=\"font-weight: 400;\">In April 2021</span></a><span style=\"font-weight: 400;\">, the Supreme Court of Appeal dismissed one of her two appeals against the delinquent-for-life ruling.</span>\r\n<h4><b>Agrizzi psychiatric observation</b></h4>\r\n<span style=\"font-weight: 400;\">The arrest and release on bail of </span><span style=\"font-weight: 400;\">Myeni and Mathenjwa</span><span style=\"font-weight: 400;\"> pair came 24 hours after Pretoria high court Judge David Makhoba ruled that Agrizzi be </span><a href=\"https://www.news24.com/news24/southafrica/news/angelo-agrizzi-referred-for-mental-evaluation-to-determine-fitness-to-stand-trial-20230928\"><span style=\"font-weight: 400;\">referred for mental observation</span></a><span style=\"font-weight: 400;\"> to determine his fitness to stand trial in the R1.8-billion Bosasa and Correctional Services Department (DCS) matter.</span>\r\n\r\n<span style=\"font-weight: 400;\">Agrizzi appeared virtually before Makhoba. (Photo: Gallo Images / Sowetan / Alon Skuy)</em>[/caption]\r\n\r\n<span style=\"font-weight: 400;\">Furthermore, the judge declared that it is the state’s responsibility to ensure that Agrizzi is safely taken to a psychiatric institution and that he takes his medication.</span>\r\n\r\n<span style=\"font-weight: 400;\">Agrizzi was diagnosed with diabetes, hypertension, obesity, acute renal failure, and liver dysfunction by pulmonologist Dr Muhammad Chohan. Agrizzi is </span><a href=\"https://www.dailymaverick.co.za/article/2023-03-09-ailing-former-bosasa-coo-angelo-agrizzis-chances-of-survival-less-than-30-40-court-told/\"><span style=\"font-weight: 400;\">mechanically ventilated and sedated</span></a><span style=\"font-weight: 400;\">, but he is conscious and on continuous dialysis. The results of Agrizzi’s mental fitness have been postponed until 31 October.</span>\r\n\r\n<span style=\"font-weight: 400;\">This matter relates to four tenders awarded to Bosasa and its subsidiaries between August 2004 and 2007. The tender was for rendering catering and training services, installation of CCTV cameras, installing perimeter fencing and supplying a television system and monitoring equipment. </span>\r\n\r\n<span style=\"font-weight: 400;\">Myeni and Mathenjwa will be back in court on 17 November. At this point, the State will make an application to have the case transferred to Gauteng as the majority of the case’s witnesses live in the province. </span><b>DM</b>",
