(Photo: Hloni Mokoena)</p>\r\n\r\n<span style=\"font-weight: 400;\">A video taken by an eNCA reporter showed a smiling Phahlane </span><a href=\"https://twitter.com/Sli_Masikane/status/1572515596356710401\"><span style=\"font-weight: 400;\">entering the courtroom</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">According to the National Prosecuting Authority, Phahlane and his five co-accused “face charges of fraud, corruption, theft, and contravention of the Public Finance Management Act pertaining to two police tenders issued in 2016, with an estimated value of R54-million.”</span>\r\n\r\n<span style=\"font-weight: 400;\">The state did not oppose their release on bail and they each paid varying amounts for their release.</span>\r\n\r\n<span style=\"font-weight: 400;\">The group is expected back in the dock next month.</span>\r\n<h4><b>No more impunity</b></h4>\r\n<span style=\"font-weight: 400;\">After their court appearance on Wednesday, Investigating Directorate head advocate Andrea Johnson described the matter as “a seminal case” that endorsed the directorate’s commitment to dealing with corruption.</span>\r\n\r\n<span style=\"font-weight: 400;\">“It is also dealing with the lack of accountability, which to date has undermined the legitimacy of the law and shows that the wheels of justice are turning and impunity is no longer a given,” she said.</span>\r\n\r\n<span style=\"font-weight: 400;\">“On the contrary, the rule of law is the most important protection of the weak against the whims of the powerful, and it is what stands between us and tyranny.”</span>\r\n\r\n<hr />\r\n\r\n<strong>Visit <a href=\"https://www.dailymaverick.co.za?utm_source=direct&utm_medium=in_article_link&utm_campaign=homepage\"><em>Daily Maverick's</em> home page</a> for more news, analysis and investigations</strong>\r\n\r\n<hr />\r\n\r\n<span style=\"font-weight: 400;\">Some of the charges the accused face related to software called Daedalus which “made it impossible for investigators to get call records from cellphone providers”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Earlier on Wednesday, </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\">’s Marianne Thamm reported that the six were detained in connection with a tender that was aimed at encrypting phone calls and spying on individuals on social media during the </span><a href=\"https://www.dailymaverick.co.za/opinionista/2019-04-25-then-and-now-reflections-on-the-feesmustfall-generation/\"><span style=\"font-weight: 400;\">#FeesMustFall</span></a><span style=\"font-weight: 400;\"> protests.</span>\r\n<h4><b>The top cops and the grabber</b></h4>\r\n<span style=\"font-weight: 400;\">Thamm also reported that Kistiah, in an apparently separate issue, was being investigated for Crime Intelligence’s allegedly unlawful attempt to procure a surveillance device known as </span><a href=\"https://www.dailymaverick.co.za/article/2020-12-07-sitole-vs-jacobs-what-lies-behind-the-top-level-rupture-at-the-saps/\"><span style=\"font-weight: 400;\">a grabber</span></a><span style=\"font-weight: 400;\">, for the heavily inflated price of R45-million (the regular price was R7-million), ahead of the ANC’s elective conference at Nasrec in December 2017.</span>\r\n\r\n<span style=\"font-weight: 400;\">At the time, Khehla Sitole was the newly appointed national police commissioner.</span>\r\n\r\n<span style=\"font-weight: 400;\">He subsequently </span><a href=\"https://www.dailymaverick.co.za/article/2022-02-22-r45m-nasrec-grabber-was-fikile-mbalulas-idea-claims-national-police-commissioner-khehla-sitole-in-court-papers/\"><span style=\"font-weight: 400;\">claimed that former police minister Fikile Mbalula</span></a><span style=\"font-weight: 400;\"> had informed him of an alleged “security threat” at the Nasrec conference — which led to the attempted procurement of the grabber.</span>\r\n\r\n<span style=\"font-weight: 400;\">Sitole, like Phahlane, also stepped down from the top job under a cloud. He left at the end of March, with the Presidency saying it was in the country’s best interests.</span>\r\n\r\n<span style=\"font-weight: 400;\">Adding to potential legal issues Sitole faced was the Independent Police Investigative Directorate lodging criminal complaints against him, alleging that he failed to cooperate with its investigation into the September 2020 </span><a href=\"https://www.dailymaverick.co.za/article/2022-09-18-heads-are-yet-to-roll-in-murder-of-top-cop-charl-kinnear/\"><span style=\"font-weight: 400;\">assassination of Western Cape detective Charl Kinnear</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">Sitole denied this.</span>\r\n<h4><b>From police chief to corruption accused</b></h4>\r\n<span style=\"font-weight: 400;\">Back to Phahlane. Former president Jacob Zuma appointed him to act as national police commissioner in October 2015.</span>\r\n\r\n<span style=\"font-weight: 400;\">Two years later, the tables turned. Phahlane was told to step down from the post on 1 June 2017 over corruption claims.</span>\r\n\r\n<span style=\"font-weight: 400;\">He subsequently faced criminal charges in the Palm Ridge Specialised Commercial Crimes Court.</span>\r\n\r\n<span style=\"font-weight: 400;\">Phahlane, along with others, was accused of corruption and fraud in that matter, known as the “blue lights” case. It’s linked to an </span><a href=\"https://www.dailymaverick.co.za/article/2022-05-16-former-police-commissioner-phahlane-fails-to-have-r191m-blue-light-case-struck-off-roll/\"><span style=\"font-weight: 400;\">allegedly fraudulent tender</span></a><span style=\"font-weight: 400;\"> to supply emergency equipment to the SAPS in 2016.</span>\r\n\r\n<span style=\"font-weight: 400;\">It is understood</span> <span style=\"font-weight: 400;\">this case is set to resume in early November.</span>\r\n<h4><b>‘I am innocent’</b></h4>\r\n<i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\"> previously reported that in June this year, </span><a href=\"https://www.dailymaverick.co.za/article/2022-07-27-corruption-accused-ex-top-cop-khomotso-phahlane-tells-public-protector-of-saps-destructive-battle-against-him/\"><span style=\"font-weight: 400;\">Phahlane approached the Public Protector</span></a><span style=\"font-weight: 400;\"> and requested an investigation into how his police career had ground to a halt.</span>\r\n\r\n<span style=\"font-weight: 400;\">In a report to the Public Protector, Phahlane was portrayed as an innocent individual, taking the fall for others in the police service.</span>\r\n\r\n<span style=\"font-weight: 400;\">Part of the report to the Public Protector said: “The 1st of June 2022 brought about a completion of a vicious five-year circle/period of an onslaught, character assassination, assault on one’s integrity, abuse of power and authority including insults experienced in a malicious and destructive battle for the soul and control of the South African Police Service waged against Lieutenant General Johannes Khomotso Phahlane.”</span>\r\n\r\n<span style=\"font-weight: 400;\">There were four other matters, each dating back about five years, under investigation against Phahlane.</span>\r\n\r\n<span style=\"font-weight: 400;\">It is not clear if the #FeesMustFall case, in which he is now also accused, is among those. </span><b>DM</b>\r\n<div style=\"width: 100%; height: 400px;\" data-tf-widget=\"K2ptFXjT\" data-tf-inline-on-mobile=\"\" data-tf-iframe-props=\"title=How are you surviving Stage 6? (Photo: Hloni Mokoena)[/caption]\r\n\r\n<span style=\"font-weight: 400;\">A video taken by an eNCA reporter showed a smiling Phahlane </span><a href=\"https://twitter.com/Sli_Masikane/status/1572515596356710401\"><span style=\"font-weight: 400;\">entering the courtroom</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">According to the National Prosecuting Authority, Phahlane and his five co-accused “face charges of fraud, corruption, theft, and contravention of the Public Finance Management Act pertaining to two police tenders issued in 2016, with an estimated value of R54-million.”</span>\r\n\r\n<span style=\"font-weight: 400;\">The state did not oppose their release on bail and they each paid varying amounts for their release.</span>\r\n\r\n<span style=\"font-weight: 400;\">The group is expected back in the dock next month.</span>\r\n<h4><b>No more impunity</b></h4>\r\n<span style=\"font-weight: 400;\">After their court appearance on Wednesday, Investigating Directorate head advocate Andrea Johnson described the matter as “a seminal case” that endorsed the directorate’s commitment to dealing with corruption.</span>\r\n\r\n<span style=\"font-weight: 400;\">“It is also dealing with the lack of accountability, which to date has undermined the legitimacy of the law and shows that the wheels of justice are turning and impunity is no longer a given,” she said.</span>\r\n\r\n<span style=\"font-weight: 400;\">“On the contrary, the rule of law is the most important protection of the weak against the whims of the powerful, and it is what stands between us and tyranny.”</span>\r\n\r\n<hr />\r\n\r\n<strong>Visit <a href=\"https://www.dailymaverick.co.za?utm_source=direct&utm_medium=in_article_link&utm_campaign=homepage\"><em>Daily Maverick's</em> home page</a> for more news, analysis and investigations</strong>\r\n\r\n<hr />\r\n\r\n<span style=\"font-weight: 400;\">Some of the charges the accused face related to software called Daedalus which “made it impossible for investigators to get call records from cellphone providers”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Earlier on Wednesday, </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\">’s Marianne Thamm reported that the six were detained in connection with a tender that was aimed at encrypting phone calls and spying on individuals on social media during the </span><a href=\"https://www.dailymaverick.co.za/opinionista/2019-04-25-then-and-now-reflections-on-the-feesmustfall-generation/\"><span style=\"font-weight: 400;\">#FeesMustFall</span></a><span style=\"font-weight: 400;\"> protests.</span>\r\n<h4><b>The top cops and the grabber</b></h4>\r\n<span style=\"font-weight: 400;\">Thamm also reported that Kistiah, in an apparently separate issue, was being investigated for Crime Intelligence’s allegedly unlawful attempt to procure a surveillance device known as </span><a href=\"https://www.dailymaverick.co.za/article/2020-12-07-sitole-vs-jacobs-what-lies-behind-the-top-level-rupture-at-the-saps/\"><span style=\"font-weight: 400;\">a grabber</span></a><span style=\"font-weight: 400;\">, for the heavily inflated price of R45-million (the regular price was R7-million), ahead of the ANC’s elective conference at Nasrec in December 2017.</span>\r\n\r\n<span style=\"font-weight: 400;\">At the time, Khehla Sitole was the newly appointed national police commissioner.</span>\r\n\r\n<span style=\"font-weight: 400;\">He subsequently </span><a href=\"https://www.dailymaverick.co.za/article/2022-02-22-r45m-nasrec-grabber-was-fikile-mbalulas-idea-claims-national-police-commissioner-khehla-sitole-in-court-papers/\"><span style=\"font-weight: 400;\">claimed that former police minister Fikile Mbalula</span></a><span style=\"font-weight: 400;\"> had informed him of an alleged “security threat” at the Nasrec conference — which led to the attempted procurement of the grabber.</span>\r\n\r\n<span style=\"font-weight: 400;\">Sitole, like Phahlane, also stepped down from the top job under a cloud. He left at the end of March, with the Presidency saying it was in the country’s best interests.</span>\r\n\r\n<span style=\"font-weight: 400;\">Adding to potential legal issues Sitole faced was the Independent Police Investigative Directorate lodging criminal complaints against him, alleging that he failed to cooperate with its investigation into the September 2020 </span><a href=\"https://www.dailymaverick.co.za/article/2022-09-18-heads-are-yet-to-roll-in-murder-of-top-cop-charl-kinnear/\"><span style=\"font-weight: 400;\">assassination of Western Cape detective Charl Kinnear</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">Sitole denied this.</span>\r\n<h4><b>From police chief to corruption accused</b></h4>\r\n<span style=\"font-weight: 400;\">Back to Phahlane. Former president Jacob Zuma appointed him to act as national police commissioner in October 2015.</span>\r\n\r\n<span style=\"font-weight: 400;\">Two years later, the tables turned. Phahlane was told to step down from the post on 1 June 2017 over corruption claims.</span>\r\n\r\n<span style=\"font-weight: 400;\">He subsequently faced criminal charges in the Palm Ridge Specialised Commercial Crimes Court.</span>\r\n\r\n<span style=\"font-weight: 400;\">Phahlane, along with others, was accused of corruption and fraud in that matter, known as the “blue lights” case. It’s linked to an </span><a href=\"https://www.dailymaverick.co.za/article/2022-05-16-former-police-commissioner-phahlane-fails-to-have-r191m-blue-light-case-struck-off-roll/\"><span style=\"font-weight: 400;\">allegedly fraudulent tender</span></a><span style=\"font-weight: 400;\"> to supply emergency equipment to the SAPS in 2016.</span>\r\n\r\n<span style=\"font-weight: 400;\">It is understood</span> <span style=\"font-weight: 400;\">this case is set to resume in early November.</span>\r\n<h4><b>‘I am innocent’</b></h4>\r\n<i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\"> previously reported that in June this year, </span><a href=\"https://www.dailymaverick.co.za/article/2022-07-27-corruption-accused-ex-top-cop-khomotso-phahlane-tells-public-protector-of-saps-destructive-battle-against-him/\"><span style=\"font-weight: 400;\">Phahlane approached the Public Protector</span></a><span style=\"font-weight: 400;\"> and requested an investigation into how his police career had ground to a halt.</span>\r\n\r\n<span style=\"font-weight: 400;\">In a report to the Public Protector, Phahlane was portrayed as an innocent individual, taking the fall for others in the police service.</span>\r\n\r\n<span style=\"font-weight: 400;\">Part of the report to the Public Protector said: “The 1st of June 2022 brought about a completion of a vicious five-year circle/period of an onslaught, character assassination, assault on one’s integrity, abuse of power and authority including insults experienced in a malicious and destructive battle for the soul and control of the South African Police Service waged against Lieutenant General Johannes Khomotso Phahlane.”</span>\r\n\r\n<span style=\"font-weight: 400;\">There were four other matters, each dating back about five years, under investigation against Phahlane.</span>\r\n\r\n<span style=\"font-weight: 400;\">It is not clear if the #FeesMustFall case, in which he is now also accused, is among those. </span><b>DM</b>\r\n<div style=\"width: 100%; height: 400px;\" data-tf-widget=\"K2ptFXjT\" data-tf-inline-on-mobile=\"\" data-tf-iframe-props=\"title=How are you surviving Stage 6?
