"contents": "<ul>\r\n \t<li>Expelled former deputy president of the National Union of Metalworkers of South Africa Ruth Ntlokotse is to approach the Gauteng Division of the High Court to have her expulsion declared unlawful and invalid.</li>\r\n \t<li>Ntlokotse is concerned that her expulsion will mean that she loses her position as president of the South African Federation of Trade Unions.</li>\r\n \t<li>A Numsa spokesperson said the union would oppose the application.</li>\r\n</ul>\r\n<span style=\"font-weight: 400;\">Former deputy president of the National Union of Metalworkers of South Africa (Numsa), Ruth Ntlokotse, is launching an </span><a href=\"https://www.groundup.org.za/media/uploads/documents/july_2023_-_ntl_ntlokotse_v_numsa_and_others_nom.pdf\"><span style=\"font-weight: 400;\">urgent application</span></a><span style=\"font-weight: 400;\"> to the Gauteng Division of the High Court to declare her expulsion from the union unlawful and invalid.</span>\r\n\r\n<span style=\"font-weight: 400;\">Ntlokotse, who is currently president of the South African Federation of Trade Unions (Saftu), says </span><a href=\"https://www.groundup.org.za/media/uploads/documents/july_2023_-_urgent_application_-_ruth_ntlokotse.pdf\"><span style=\"font-weight: 400;\">in her court papers</span></a><span style=\"font-weight: 400;\"> that her “unfair” suspension and expulsion from Numsa means that she could lose her position at Saftu.</span>\r\n\r\n<span style=\"font-weight: 400;\">She says she has been stripped of the ability to be protected by a union while facing retrenchment, and that her “rights to fair labour practice” and “rights in terms of the Numsa constitution to a fair process have all been affected”. </span>\r\n\r\n<span style=\"font-weight: 400;\">She wants to be “reinstated as an ordinary member and thus a shop steward as elected by the workers whose interests are not reflected in the decisions of the Central Committee”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Ntlokotse has been outspoken against the leadership at Numsa, including general secretary Irvin Jim. She </span><a href=\"https://www.groundup.org.za/article/i-was-expelled-by-corrupt-leaders-says-ousted-numsa-member/\"><span style=\"font-weight: 400;\">said</span></a><span style=\"font-weight: 400;\"> during a press conference last month that the current Numsa leadership was corrupt and was not acting in the interest of its members.</span>\r\n\r\n<span style=\"font-weight: 400;\">Jim has been under fire for, among other things, hosting a birthday party paid for by the </span><a href=\"https://www.groundup.org.za/article/irvin-jims-r40k-birthday-paid-for-by-embattled-life-insurer/\"><span style=\"font-weight: 400;\">union-owned funeral insurance company</span></a><span style=\"font-weight: 400;\">, 3Sixty Life. The company has since been placed under </span><a href=\"https://www.groundup.org.za/article/court-confirms-curatorship-for-numsas-funeral-insurer/\"><span style=\"font-weight: 400;\">curatorship</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">In her papers, Ntlokotse says disciplinary proceedings against her took place on 24 April despite her not being in attendance and despite her request for a postponement. The outcome of these proceedings was her expulsion from the union.</span>\r\n\r\n<span style=\"font-weight: 400;\">She says she attended the appeal hearing on 7 July but the hearing was “fatally flawed” and biased, and the members of the special committee “did not apply their mind on the charges constituting the essence of the appeal”.</span>\r\n\r\n<span style=\"font-weight: 400;\">She says she wanted to avoid going to court, but internal remedies were “exhausted” with the internal appeals process.</span>\r\n\r\n<span style=\"font-weight: 400;\">In her urgent application, set for 24 August, Ntlokotse also wants the court to finalise two other matters before the Labour Court and the Labour Appeal Court.</span>\r\n\r\n<span style=\"font-weight: 400;\">Both matters concern the union’s national congress that </span><a href=\"https://www.groundup.org.za/article/numsa-office-bearer-election-goes-ahead-in-spite-of-interdict/\"><span style=\"font-weight: 400;\">took place in July 2022</span></a><span style=\"font-weight: 400;\">. In one matter, Numsa is appealing a Labour Court </span><a href=\"https://www.groundup.org.za/article/numsa-office-bearer-election-goes-ahead-in-spite-of-interdict/%5C\"><span style=\"font-weight: 400;\">decision</span></a><span style=\"font-weight: 400;\"> to interdict the union from going ahead with its congress. In the second, Ntlokotse wants the court to finalise the application she made to the Labour Court to declare all resolutions passed at the congress invalid.</span>\r\n\r\n<span style=\"font-weight: 400;\">Numsa spokesperson Phakamile Majola told GroundUp, “Numsa has noted that the expelled former 2nd Deputy President Ruth Ntlokotse plans to make an application to the high court.
