"contents": "<span style=\"font-weight: 400;\">Car guards watching over vehicles while the motorist is away are a common sight in South Africa. With persistently high levels of crime and unemployment, </span><a href=\"http://journals.sagepub.com/eprint/DQrXvg35BeuCrQ9feQ2y/full\"><span style=\"font-weight: 400;\">car guarding</span></a><span style=\"font-weight: 400;\"> remains a viable means to earn a meagre living in the informal sector, partly due to low entry barriers.</span>\r\n\r\n<span style=\"font-weight: 400;\">According to </span><a href=\"https://www.statssa.gov.za/?p=15407#:~:text=According%20to%20the%20Quarterly%20Labour,stands%20at%2034%2C5%25\"><span style=\"font-weight: 400;\">StatsSA</span></a><span style=\"font-weight: 400;\">, 7.9 million people are unemployed in South Africa, which has an official unemployment rate of 34.5%. As no registration of car guards exists, there are no accurate numbers available, yet it is undoubtedly the livelihood for very many people. A city such as Durban has seven relatively large malls and many smaller shops and sites where car guards operate. From our observations, we estimate that in Durban alone, the number of car guards may be around 3,000.</span>\r\n<h4><b>Forced to pay bay fees</b></h4>\r\n<span style=\"font-weight: 400;\">What often hampers car guards’ ability to survive on the tips received from well-meaning shoppers and motorists, is that many car guards are forced to pay daily bay fees to car guarding agents. </span><a href=\"https://www.researchgate.net/publication/281981974_A_survey_of_car_guards_in_Tshwane_Implications_for_private_security_policy_and_practice\"><span style=\"font-weight: 400;\">Researchers</span></a><span style=\"font-weight: 400;\"> found that many car guards struggle to survive financially due to these daily “bay fees” that must be paid irrespective of the car guards’ daily income.</span>\r\n\r\n<span style=\"font-weight: 400;\">Our </span><a href=\"https://doi.org/10.1080/0376835X.2021.1891862\"><span style=\"font-weight: 400;\">recent paper</span></a><span style=\"font-weight: 400;\"> notes that agents charge R35 or more simply to allocate a parking bay. As car guards are not employed by the agencies, they receive no salary, paid or sick leave and very few, if any, benefits.</span>\r\n\r\n<span style=\"font-weight: 400;\">Furthermore, the agents may sell or hire branded jackets and security equipment.</span>\r\n<h4><b>Precarious work</b></h4>\r\n<span style=\"font-weight: 400;\">Car guards, by the very nature of their dispersal over many different locations, their vulnerability and the controls imposed on them by agents, cannot easily form or join unions and negotiate a minimum wage.</span>\r\n\r\n<span style=\"font-weight: 400;\">The agents maintain control by ensuring that those who do not pay do not work at the site. In many ways, these agents simply act as no more than unregulated labour brokers.</span>\r\n\r\n<span style=\"font-weight: 400;\">In some rare cases, shopping centre management prohibits agents from charging daily bay fees, and even more rarely, car guards may stand united, and </span><a href=\"https://www.psira.co.za/dmdocuments/research/PSIRA%20Car%20Guards_d8_updated.pdf\"><span style=\"font-weight: 400;\">refuse to pay</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">But most car guards do not speak out against these unfair daily bay fees, due to fear of losing their jobs. Many are also undocumented immigrants, who fear being deported if they speak up.</span>\r\n\r\n<span style=\"font-weight: 400;\">In addition to the low earnings, car guards may experience verbal abuse or may have toxic relationships with the car guard agents or the management of the parking sites.</span>\r\n\r\n<span style=\"font-weight: 400;\">Furthermore, car guarding agents and managers seldom offer any support to the car guards. If any complaints are lodged against a car guard, either by the public or motorists, or if any misconduct is reported, the car guard is often immediately dismissed, irrespective of who was to blame.</span>\r\n\r\n<span style=\"font-weight: 400;\">In the interviews we </span><a href=\"https://doi.org/10.1080/0376835X.2021.1891862\"><span style=\"font-weight: 400;\">conducted</span></a><span style=\"font-weight: 400;\">, a car guard said “paying day fees is cutting our throats”. Another car guard reasoned that “nobody pays to work yet if I do not pay to work, they will just get the next </span><i><span style=\"font-weight: 400;\">ou </span></i><span style=\"font-weight: 400;\">(person)”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Car guard agencies have full control in this asymmetrical relationship, and car guards have no trade union or other recourse.</span>\r\n\r\n<a href=\"http://www.econ3x3.org/article/creating-jobs-reducing-poverty-iii-barriers-entry-andgrowth-informal-sector-%E2%80%93-and-business\"><span style=\"font-weight: 400;\">In theory</span></a><span style=\"font-weight: 400;\">, under South African labour legislation, these individuals should be protected; however, in practice, their unusual employment circumstances prevent the enforcement of any rights.</span>\r\n\r\n<hr />\r\n\r\n<strong>Visit <a href=\"https://www.dailymaverick.co.za?utm_source=direct&utm_medium=in_article_link&utm_campaign=homepage\"><em>Daily Maverick's</em> home page</a> for more news, analysis and investigations</strong>\r\n\r\n<hr />\r\n\r\n<h4><b>Moves to regulate dodged</b></h4>\r\n<span style=\"font-weight: 400;\">Over the years there has been a lot of commentary regarding car guards in the media, much of it negative. For example, </span><a href=\"https://www.news24.com/News24/Car-guards-a-parking-headache-for-motorists-20150615\"><i><span style=\"font-weight: 400;\">News24</span></i></a><span style=\"font-weight: 400;\"> reported that in Observatory, Cape Town, some car guards may be aggressive or threatening towards motorists; car guards were said to have </span><a href=\"https://www.news24.com/news24/southafrica/local/maritzburg-fever/hostile-car-guards-an-issue-in-town-20190115\"><span style=\"font-weight: 400;\">demanded </span></a><span style=\"font-weight: 400;\">R10 to watch over cars in Pietermaritzburg; a car guard was reported to have </span><a href=\"https://ewn.co.za/2018/09/09/joburg-car-guards-urged-to-refrain-from-forcing-motorists-to-pay-for-parking\"><span style=\"font-weight: 400;\">stabbed</span></a><span style=\"font-weight: 400;\"> a motorist in the street for not paying a tip.</span>\r\n\r\n<span style=\"font-weight: 400;\">The Private Security Industry Regulatory Association (Psira) has been lobbying to register car guards and ensure that they complete minimum security training.</span>\r\n\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://www.gov.za/sites/default/files/gcis_document/201509/39156gon786.pdf\"><span style=\"font-weight: 400;\">Basic Conditions of Employment Act</span></a><span style=\"font-weight: 400;\"> was amended in 2015 to include car guarding under the sectoral determination of private security. This was </span><a href=\"http://www.timeslive.co.za/thetimes/2015/06/18/Call-for-car-guards-to-get-training-and-an-official-ticket\"><span style=\"font-weight: 400;\">to force car guards</span></a><span style=\"font-weight: 400;\"> to obtain a grade E security certificate. Car guards would need to pay to attend a week-long training programme and pay a monthly membership fee to Psira.</span>\r\n\r\n<span style=\"font-weight: 400;\">Psira’s attempt to regulate car guards reached a turning point in December 2018, when </span><a href=\"https://www.iol.co.za/thepost/news/spotlight-on-durbans-illegal-car-guard-trade-18362956\"><i><span style=\"font-weight: 400;\">The Mercury</span></i></a><span style=\"font-weight: 400;\"> reported that car guards not registered with Psira had been arrested at several shopping centres in Durban. Most of them were immigrants, and none of those arrested had any personal identification on them at the time of arrest.</span>\r\n\r\n<span style=\"font-weight: 400;\">In response to the arrests, and to reduce the risk of agents also being arrested, the car guarding agents side-stepped the law by renaming the job Customer Trolley Assistants, though these workers still guard cars, and the process has not changed at all.</span>\r\n\r\n<span style=\"font-weight: 400;\">Furthermore, the South African Police Services (SAPS) has also started to vet car guards, by taking fingerprints and ensuring that car guards are registered.</span>\r\n\r\n<span style=\"font-weight: 400;\">The drive by Psira to regulate and ultimately formalise car guarding may be well-intended. But attempts to formalise the informal economy without the participation of the workers themselves, may in fact jeopardise lives and livelihoods. In addition to paying for the Psira training, who would pay the monthly Psira membership fees?</span>\r\n<h4><b>Better alternative models</b></h4>\r\n<span style=\"font-weight: 400;\">Throughout South Africa, there are examples of initiatives to better regulate car guards. For example, Kalk Bay municipality is in a </span><a href=\"https://www.falsebayecho.co.za/news/image-make-over-for-car-guards\"><span style=\"font-weight: 400;\">process of formalising</span></a><span style=\"font-weight: 400;\"> car guards, spearheaded by local businesses, with the intention of reducing potential crime associated with unregulated car guards. The Simon’s Town Community Policing Forum has taken the initiative further by </span><a href=\"https://www.news24.com/News24/homeless-set-up-as-car-guards-20170626\"><span style=\"font-weight: 400;\">launching a project</span></a><span style=\"font-weight: 400;\"> to train and then hire car attendants in collaboration with law enforcement agencies.</span>\r\n\r\n<span style=\"font-weight: 400;\">Our interviews with car guards in 2015 and 2019 provide evidence of a deterioration in the incomes of car guards due to factors such as the slump in the economy, the daily bay fees, and automation such as boom gates at many shopping centres and businesses.</span>\r\n\r\n<span style=\"font-weight: 400;\">Studies that focus on informal economic activities such as car guarding will enhance our understanding of the labour market challenges faced by so many in their quest to earn a living and provide a future for their children and the next generation.
