Most were men (152,889), with women making up 2.6% of inmates.</span></span></span></p>\r\n<p><span ><span ><span><span><span ><span style=\"\">A quarter of prisoners in the 2015/16 financial year were </span></span></span></span></span></span><a href=\"http://www.dcs.gov.za/Publications/Legislation/DCS%2520Act%2520111%2520of%25202008.pdf#page=11\"><span style=\"color: #103cc0;\"><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\">remand detainees</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\">, defined as people awaiting trial or those awaiting extradition. Of these, 7,345 had been sentenced and 4,497 were awaiting trial, with 1,380 being prosecuted for being in the country illegally. The majority were Zimbabweans (41.5%), followed by Mozambicans (24%).</span></span></span></span></span></span></p>\r\n<p><span style=\"color: #1a1a1a;\"><span ><span>Masutha also said that during the 2016/17 financial year it would cost an estimated R133,805.35 to house a prisoner. Considering the inmate population of 157,013 at the end of 2016, this adds up to R21-billion for the year.</span></span></span></p>\r\n<p><span ><span ><span><b>Problems plaguing SA prisons</b></span></span></span></p>\r\n<p><span ><span ><span><b>1. Lack of accurate data</b></span></span></span></p>\r\n<p><span ><span ><span><span><span ><span style=\"\">In his </span></span></span></span></span></span><a href=\"http://www.dcs.gov.za/UploadedFiles/2016%2520Budget%2520Vote%2520Speech%2520delivered%2520by%2520Minister%2520Michael%2520Masutha.pdf\"><span style=\"color: #103cc0;\"><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\">2016 budget vote speech</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\">, correctional services minister Michael Masutha said that the auditor-general “still has serious concerns about the credibility of our records”.</span></span></span></span></span></span></p>\r\n<p><span ><span ><span><span><span ><span style=\"\">The </span></span></span></span></span></span><a href=\"http://www.dcs.gov.za/docs/2016%2520doc/DCS%2520Annual%2520Report%25202015-16.pdf#page=117\"><span style=\"color: #103cc0;\"><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\">auditor-general’s report for 2015/16</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\"> stated that the department’s reported performance information for its incarceration, rehabilitation and care programmes wasn’t reliable “when compared to the evidence provided”. </span></span></span></span></span></span></p>\r\n<p><span ><span ><span>This calls into question several crucial indicators, such as the number of inmates who had escaped, died unnaturally or were injured in an assault.</span></span></span></p>\r\n<p><span ><span><span ><span><span ><b>2.</b></span></span></span><span ><span><span ><span style=\"\"> </span></span></span></span><span ><span><span ><b>Overcrowding</b></span></span></span></span></span></p>\r\n<p><span ><span ><span><span><span ><span style=\"\">At the end of March 2016, South Africa’s prisons only had </span></span></span></span></span></span><a href=\"http://www.dcs.gov.za/docs/2016%2520doc/DCS%2520Annual%2520Report%25202015-16.pdf#page=32\"><span style=\"color: #103cc0;\"><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\">119,134 bedspaces available</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\"> for its 161,984 inmates.</span></span></span></span></span></span><a href=\"http://www.dcs.gov.za/docs/2016%2520doc/DCS%2520Annual%2520Report%25202015-16.pdf#page=32\"><span style=\"color: #103cc0;\"><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\"> </span></span></span></span></span></span></a></p>\r\n<p><span ><span >“<span ><span><span><span style=\"\">The main driving factor behind overcrowding is the remand detainee population,” Clare Ballard from the advocacy organisation </span></span></span></span></span></span><a href=\"http://www.lhr.org.za/\"><span style=\"color: #103cc0;\"><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\">Lawyers for Human Rights</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\"> told Africa Check.</span></span></span></span></span></span></p>\r\n<p><span ><span ><span>Wilna Lambley, the Regional Operations Executive in Gauteng for Legal Aid South Africa, told the Wits Justice Project that 8,000 people who can’t afford bail end up in prison awaiting their trial. Clogged-up court rolls furthermore lead to delays and jam-packed communal cells.</span></span></span></p>\r\n<p><span ><span ><span><span><span ><span style=\"\">Prisons in urban areas have the worst overcrowding rates. In the 2015/16 financial year, Johannesburg Correctional Centre’s Medium B was </span></span></span></span></span></span><a href=\"https://africacheck.org/wp-content/uploads/2017/05/JICS-Annual-Report-2015-2016-as-at-4-October-2016-v-12.pdf#page=49\"><span style=\"color: #103cc0;\"><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\">233% full</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\">, which translates into a shortage of 1,736 beds.</span></span></span></span></span></span></p>\r\n<p><span ><span ><span><span><span ><span style=\"\">Pollsmoor prison in Cape Town had the biggest shortage of beds (2,448) in 2015/16 financial year</span></span></span></span></span></span><span ><span ><span><i><span ><span style=\"\">. </span></span></i></span></span></span><a href=\"http://www.genderjustice.org.za/news-item/pollsmoor-remand-court-case-response-overcrowding-heard-december-2016/\"><span style=\"color: #103cc0;\"><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\">Following a court challenge</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\"> by </span></span></span></span></span></span><a href=\"http://www.genderjustice.org.za/\"><span style=\"color: #103cc0;\"><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\">Sonke Gender Justice</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\"> and </span></span></span></span></span></span><a href=\"http://www.lhr.org.za/\"><span style=\"color: #103cc0;\"><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\">Lawyers for Human Rights</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\">, the Western Cape High Court held that the conditions in Pollsmoor’s remand detention centre were unconstitutional. Leptospirosis, a disease spread by rats, had by then claimed two lives.</span></span></span></span></span></span></p>\r\n<p><span ><span ><span>The court ordered that government reduce overcrowding to 150% within six months.</span></span></span></p>\r\n<p><span >“<span ><span>Government met the ruling. As of 26 June, their statistics showed that overcrowding levels were 149%,” national prison specialist at Sonke Gender Justice, Ariane Nevin, told Africa Check.</span></span></span></p>\r\n<p><span ><span ><span>In the end, Ballard added, the cause of overcrowding “is a poorly functioning criminal justice system – we’re simply not prosecuting crime at the rate and pace and with the effectiveness we should be.”</span></span></span></p>\r\n<p><span ><span><span ><span><span ><b>3. </b></span></span></span><span ><span><span ><b>Infectious diseases</b></span></span></span></span></span></p>\r\n<p><a href=\"https://www.unodc.org/documents/justice-and-prison-reform/GA-RESOLUTION/E_ebook.pdf#page=10\"><span ><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\">Rule 24</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\"> of the Nelson </span></span></span></span></span></span><a href=\"https://www.unodc.org/documents/justice-and-prison-reform/GA-RESOLUTION/E_ebook.pdf\"><span ><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\">Mandela Rules</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\"> states that the healthcare of prisoners is the government’s responsibility. These healthcare services include the treatment of infectious diseases such as HIV and tuberculosis (TB).</span></span></span></span></span></span></p>\r\n<p><span ><span ><span>In a landmark Constitutional Court case, the state’s responsibility to take care of prisoners’ health was solidified.</span></span></span></p>\r\n<p><span ><span ><span>Dudley Lee contracted TB while he was an awaiting trial inmate at Pollsmoor prison between 1999 and 2004. Lee sued the minister of correctional services for failing to implement the measures required by law to decrease the risk of disease in prisons.</span></span></span></p>\r\n<p><span ><span ><span><span><span ><span style=\"\">After a seven-year court battle, Lee </span></span></span></span></span></span><a href=\"http://www.saflii.org/za/cases/ZACC/2012/30media.pdf\"><span style=\"color: #103cc0;\"><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\">won his case</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\"> and was awarded R270,000 in damages. </span></span></span></span></span></span></p>\r\n<p><span ><span >“<span ><span><span><span style=\"\">The Lee case requires an overhaul of health services and prevention in prisons. There has been an unprecedented influx of international funding from the </span></span></span></span></span></span><a href=\"https://www.theglobalfund.org/en/\"><span style=\"color: #103cc0;\"><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\">Global Fund</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\"> and </span></span></span></span></span></span><a href=\"https://www.pepfar.gov/\"><span style=\"color: #103cc0;\"><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\">PEPFAR</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\"> for TB screening and testing in prisons,” John Stephens told Africa Check. Stephens is a senior legal researcher at the activist organisation, </span></span></span></span></span></span><a href=\"http://section27.org.za/\"><span style=\"color: #103cc0;\"><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\">Section27</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\">.</span></span></span></span></span></span></p>\r\n<p><span ><span ><span><span><span ><span style=\"\">The department’s 2015/16 annual report claimed that 1,239 of the 1,485 prisoners with TB in that year were cured, a rate of 83.4%. (</span></span></span></span></span></span><span ><span ><span><i><span ><span style=\"\">Note: As for HIV, the department </span></span></i></span></span></span><a href=\"http://www.dcs.gov.za/docs/2016%2520doc/DCS%2520Annual%2520Report%25202015-16.pdf#page=12\"><span style=\"color: #103cc0;\"><span ><span><i><span style=\"text-decoration: underline;\"><span style=\"\">reported</span></span></i></span></span></span></a><span ><span ><span><i><span ><span style=\"\"> that 21,722 of the 22,142 prisoners who tested positive for HIV were on antiretroviral therapy</span></span></i></span></span></span><span ><span ><span><span><span ><span style=\"\">,</span></span></span></span></span></span><span ><span ><span><i><span ><span style=\"\"> a rate of 98%</span></span></i></span></span></span><span ><span ><span><span><span ><span style=\"\">.)</span></span></span></span></span></span></p>\r\n<p><span >“<span ><span>Screening, testing and treatment are critical, but unless we deal with the issues of overcrowding and ventilation we are throwing money away,’’ says Stephens.</span></span></span></p>\r\n<p><span ><span ><span><b>4. Human rights violations</b></span></span></span></p>\r\n<p><span ><span ><span><span><span ><span style=\"\">The first of the Mandela Rules </span></span></span></span></span></span><a torture in South Africa. He focused on cases reported in the annual reports of the Independent Police Investigative Directorate (IPID) and the Judicial Inspectorate for Correctional Services (JICS) between 2007 and 2011. </span></span></span></span></span></span></p>\r\n<p><span ><span ><span>Langa found that assault by prison officials was one of the most common complaints reported to the JICS (6,000 cases) and IPID, which received 1,778 complaints of assault and 89 of torture in the same time frame. According to Langa’s analysis, more than 200 inmates died of unnatural causes such as suicide and assault in the period. </span></span></span></p>\r\n<p><span ><span ><span><span><span ><span style=\"\">In 2013, the </span></span></span></span></span></span><a href=\"http://www.justice.gov.za/legislation/acts/2013-013.pdf\"><span style=\"color: #103cc0;\"><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\">Prevention and Combating of Torture of Persons Act</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\"> was introduced, which criminalised torture in South Africa. </span></span></span></span></span></span><a href=\"http://www.justice.gov.za/legislation/acts/2013-013.pdf#page=3\"><span style=\"color: #103cc0;\"><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\">The Act</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\">’s definition of torture includes any act that causes severe mental or physical pain or suffering with the aim of extracting information or a confession from a person; or as a form of punishment or coercion.</span></span></span></span></span></span></p>\r\n<p><span ><span ><span><span><span ><span style=\"\">Langa said that the introduction of the act has not “changed anything in the prosecution of officials who torture inmates”. IPID’s</span></span></span></span></span></span><a href=\"http://www.icd.gov.za/sites/default/files/documents/IPID%2520AR%25202015%252016%2520WEB.pdf\"><span style=\"color: #103cc0;\"><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\"> 2015/2016 annual report</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\"> listed three police officials prosecuted for torture under the new act. </span></span></span></span></span></span></p>\r\n<p><span ><span ><span><span><span ><span style=\"\">Despite JICS documenting 15 complaints of torture </span></span></span></span></span></span><a href=\"https://africacheck.org/wp-content/uploads/2017/05/JICS-Annual-Report-2015-2016-as-at-4-October-2016-v-12.pdf#page=82\"><span style=\"color: #103cc0;\"><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\">in its latest annual report</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\">, Luvuyo Mfaku, spokesperson for the National Prosecuting Authority (NPA), couldn’t provide the </span></span></span></span></span></span><a href=\"http://www.witsjusticeproject.co.za/\"><span style=\"color: #103cc0;\"><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\">Wits Justice Project</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\"> with the number of torture cases that has been prosecuted since the introduction of the act.</span></span></span></span></span></span></p>\r\n<p><span >“<span ><span>We don’t categorise crimes in a specific database if they fall under general prosecutions,” he said.</span></span></span></p>\r\n<p><span ><span ><span><b>Segregation</b></span></span></span></p>\r\n<p><span ><span ><span>Apart from assault, segregation – formerly known as solitary confinement or isolation – is one of the most common methods of torture used in prisons, according to Langa. </span></span></span></p>\r\n<p><span ><span ><span><span><span ><span style=\"\">The</span></span></span></span></span></span><a href=\"http://www.dcs.gov.za/Publications/Legislation/DCS%2520Act%2520111%2520of%25202008.pdf#page=12\"><span style=\"color: #103cc0;\"><span ><span><span><span style=\"text-decoration: underline;\"><span style=\"\"> Correctional Services Act</span></span></span></span></span></span></a><span ><span ><span><span><span ><span style=\"\"> defines solitary confinement as “being held in a single cell with loss of all amenities” which “may be for part of or the whole day”.
