"contents": "<ul>\r\n \t<li><strong>Cleverly fails to provide direct answers to 14 written questions by MPs</strong></li>\r\n \t<li><strong>Parliament not informed about possible use of UK military equipment against Palestinians</strong></li>\r\n \t<li><strong>Ministerial Code requires ministers to ‘be as open as possible with parliament’</strong></li>\r\n</ul>\r\nJames Cleverly has been accused of breaking the UK’s Ministerial Code and of “obfuscation” in refusing to properly answer questions put to him in the House of Commons.\r\n\r\n<em>Declassified</em> has found 14 recent cases where the foreign minister has failed to provide direct answers to written questions by MPs.\r\n\r\nCleverly, who is also a <a href=\"https://www.cleverly4braintree.com/about\">reserve officer</a> in the British army’s royal artillery regiment, has been particularly evasive when asked if UK arms were used by Israel during its latest bombardment of Gaza, which saw 66 Palestinian children killed in May.\r\n\r\nThe UK has <a href=\"https://www.dailymaverick.co.za/article/2021-05-15-how-the-uk-military-supports-israels-combat-operations-against-palestinians/\">sold</a> over £400-million worth of military equipment to Israel since 2015 and applies no restrictions on how these supplies might be used.\r\n\r\nUnder the <a href=\"https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/826920/August-2019-MINISTERIAL-CODE-FINAL-FORMATTED-2.pdf\">Ministerial Code</a>, ministers have a duty to “be as open as possible with parliament” and to “give accurate and truthful information”. A House of Commons guide <a href=\"https://www.parliament.uk/globalassets/documents/commons-information-office/Brief-Guides/Parliamentary-Questions.pdf\">states</a> that “this requirement governs the answers ministers provide to parliamentary questions”.\r\n\r\nWhile ministers routinely provide minimal information to parliament, it is not normal for them to refuse entirely to directly address specific questions.\r\n\r\nLiberal Democrat foreign affairs spokesperson Layla Moran has asked Cleverly three times whether <a href=\"https://questions-statements.parliament.uk/written-questions/detail/2021-05-27/900776\">British arms</a> or <a href=\"https://questions-statements.parliament.uk/written-questions/detail/2021-05-19/3134\">Land Rover</a> <a href=\"https://questions-statements.parliament.uk/written-questions/detail/2021-05-26/7933\">vehicles</a> have been used by Israel against Palestinians.\r\n\r\nCleverly’s response has been to say that the UK “takes its export control responsibilities very seriously” and that arms export applications are considered “thoroughly against a strict risk assessment framework”, but without attempting to directly answer the questions.\r\n\r\nMoran, who is the first MP of Palestinian descent, received the same rebuff from Cleverly when she asked if the government will “<a href=\"https://questions-statements.parliament.uk/written-questions/detail/2021-05-24/6444\">investigate</a>” whether UK arms have been used by Israel.\r\n\r\n<p><img loading=\"lazy\" class=\"wp-image-962265 size-full\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2021/06/Declassified-CleverlyCode-inset.jpg\" alt=\"gaza\" width=\"1024\" height=\"683\" /> Palestinians take part in the funeral of the Abu Hatab family in Gaza on 15 May 2021. (Photo: Fatima Shbair / Getty Images)</p>\r\n\r\nWhen Labour MP Stephen Timms put a similar <a href=\"https://questions-statements.parliament.uk/written-questions/detail/2021-06-11/14132\">question</a> to Cleverly earlier this month, the minister responded using the same wording about the UK’s arms export “responsibilities”.\r\n\r\nCleverly has also failed to answer two questions from Green MP Caroline Lucas, who <a href=\"https://questions-statements.parliament.uk/written-questions/detail/2021-05-12/678\">asked</a> last month whether Britain collects data on the UK-funded aid structures demolished by Israel in the occupied West Bank.\r\n\r\nCleverly did not attempt to answer the question, noting only that the UK “regularly raises the demolition of Palestinian property with the Government of Israel”.\r\n\r\nAnother question by Lucas, <a href=\"https://questions-statements.parliament.uk/written-questions/detail/2021-05-12/679\">asking</a> what assessment the government has made of the effectiveness of its statements criticising Israel’s settlement expansion, was similarly not directly answered.\r\n\r\nBen Jamal, the director of the Palestine Solidarity Campaign, said: “This failure by the government to answer questions about arms exports to Israel is shamefully consistent with its systematic disregard of its own regulatory guidelines regarding arms exports, and its broader unwillingness to hold Israel to account for its violations of international law and the rights of the Palestinian people.”\r\n\r\nHe added: “It also shows a contempt for Parliament’s role in holding it to account. It is shameful and it is incumbent on all MPs to pressure the government to provide the answers it has failed to.”\r\n\r\nCleverly is not the only minister in Boris Johnson’s government to fail to answer parliamentary questions. The Department for International Trade was recently <a href=\"https://questions-statements.parliament.uk/written-questions/detail/2021-05-19/4043\">asked</a> by Alba MP Kenny MacAskill what assessment it had made of “similarities” between current UK arms exports to Israel and 12 licences that were temporarily suspended in 2014.\r\n\r\nThose licences included components for tanks, combat aircraft, targeting equipment, military radars and munition launching equipment that were halted due to their potential use to the Israeli military in an attack on Gaza.\r\n\r\nIn response to the question, trade minister <a href=\"https://questions-statements.parliament.uk/written-questions/detail/2021-06-14/15430\">Ranil Jayawardena</a> failed to comment on any similarities and repeated the government’s arms exports policy.\r\n\r\nAnother senior official, foreign minister <a href=\"https://questions-statements.parliament.uk/written-questions/detail/2021-06-07/hl766\">Lord Ahmad, has</a> also failed to recently <a href=\"https://questions-statements.parliament.uk/written-questions/detail/2021-06-14/hl1066\">answer</a> parliamentary <a href=\"https://questions-statements.parliament.uk/written-questions/detail/2021-06-14/hl1067\">questions</a>, although not on the scale of Cleverly.\r\n\r\n<strong>Openness and transparency</strong>\r\n\r\nMacAskill told us: “It’s just not good enough. Ministers are required to adhere to the Ministerial Code. It’s not optional but obligatory to be as open as possible. This is far from that. Tory sleaze may be all over papers, but sadly military relations with Israel are denied even to elected members”.\r\n\r\nHe added: “Openness and transparency are essential in government. Even more so when it relates to the military and in areas where conflict is occurring. However, Israel continues to control Gaza's borders, airspace, and maritime territory.</p>\r\n<p data-sourcepos=\"5:1-5:281\">The political situation in Gaza is complex and volatile. The territory is governed by Hamas, an Islamist militant group that won the Palestinian parliamentary elections in 2006. Hamas is considered a terrorist organization by Israel, the United States, and other Western countries.</p>\r\n<p data-sourcepos=\"7:1-7:289\">The Israeli-Palestinian conflict has had a devastating impact on Gaza. The territory has been under a blockade by Israel and Egypt since 2007, which has severely restricted the movement of people and goods. The blockade has also crippled the Gazan economy and led to a humanitarian crisis.</p>\r\n<p data-sourcepos=\"9:1-9:225\">In recent years, there have been several rounds of fighting between Hamas and Israel. The most recent conflict, in October 2023, was the deadliest since 2014 with thousands killed on both sides.</p>\r\n<p data-sourcepos=\"11:1-11:237\">The political situation in Gaza is further complicated by the rivalry between Hamas and Fatah, the dominant political party in the West Bank. The two parties have failed to reconcile, despite numerous attempts to form a unity government.</p>",
