"contents": "<span style=\"font-weight: 400;\">The pension of former National Lotteries Commission chief operating officer Phillemon Letwaba has been frozen by the Special Tribunal.</span>\r\n\r\n<span style=\"font-weight: 400;\">This followed an application for a preservation order by the Special Investigating Unit (SIU). The order was granted after a secret hearing before a judge on 16 September.</span>\r\n\r\n<span style=\"font-weight: 400;\">Letwaba </span><a href=\"https://www.groundup.org.za/article/lottery-coo-phillemon-letwaba-has-resigned/\"><span style=\"font-weight: 400;\">resigned with immediate effect</span></a><span style=\"font-weight: 400;\"> late last month, just weeks before he was due to appear before a disciplinary hearing.</span>\r\n\r\n<span style=\"font-weight: 400;\">In terms of the order, the Liberty Group, named as a respondent in the application, may not pay out pension benefits of R2.8-million due to Letwaba, pending a final decision on an application that must be brought within 60 days.</span>\r\n\r\n<span style=\"font-weight: 400;\">In a media release revealing </span><a href=\"https://drive.google.com/file/d/1dEleV9R3lQFcUEeoZK5u6_AC6RPfgl52/view?usp=sharing\"><span style=\"font-weight: 400;\">the order</span></a><span style=\"font-weight: 400;\">, the SIU said it had approached the Special Tribunal on an urgent basis to freeze Letwaba’s pension benefits after he resigned pending the disciplinary hearing into his role in the distribution of Lottery funds “to several non-profit organisations (NPO)”.</span>\r\n\r\n<span style=\"font-weight: 400;\">The SIU has been investigating corruption involving Lottery funds since President Cyril Rampahosa </span><a href=\"https://www.groundup.org.za/article/president-gives-siu-green-light-probe-lottery-corruption/\"><span style=\"font-weight: 400;\">signed a proclamation</span></a><span style=\"font-weight: 400;\"> in November 2020 authorising the unit to investigate the NLC. The SIU’s investigations, as well as </span><a href=\"https://www.groundup.org.za/topic/lotto/\"><i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\">’s own reporting</span></a><span style=\"font-weight: 400;\"> over more than four years, have placed Letwaba at the heart of NLC corruption running into hundreds of millions of rands.</span>\r\n\r\n<span style=\"font-weight: 400;\">The SIU said its probe had revealed that “Mr Letwaba allegedly benefited personally from monies received by NPOs” from the National Lotteries Commission. “The SIU investigation had revealed that Mr Letwaba allegedly used friends and family businesses, and trusts to receive money from NPOs for his benefit and that of his family,” the SIU said.</span>\r\n\r\n<span style=\"font-weight: 400;\">The SIU said it had identified several companies and two trusts linked to Letwaba involved in looting Lottery funds: </span><a href=\"https://www.dailymaverick.co.za/article/2022-07-28-money-earmarked-for-school-pays-for-lottery-boss-thabang-mampanes-golf-estate-home/\"><span style=\"font-weight: 400;\">Upbrand Properties</span></a><span style=\"font-weight: 400;\">, Mosokodi Water Solutions and Drilling, Mosokodi Farming Project, </span><a href=\"https://www.dailymaverick.co.za/article/2019-08-07-the-lottery-funded-library-with-empty-shelves/\"><span style=\"font-weight: 400;\">Kaone Wethu</span></a><span style=\"font-weight: 400;\">, Redtag and the Mosokodi Letwaba Family trusts.</span>\r\n\r\n<hr />\r\n\r\n<strong>Visit <a href=\"https://www.dailymaverick.co.za?utm_source=direct&utm_medium=in_article_link&utm_campaign=homepage\"><em>Daily Maverick's</em> home page</a> for more news, analysis and investigations</strong>\r\n\r\n<hr />\r\n\r\n<span style=\"font-weight: 400;\">The SIU said its Investigation had revealed that a Limpopo-based NPO - Simba Community Development Foundation — had received about R25-million to rebuild Vhafamadi Secondary School, and had transferred about R4-million to Upbrand Properties 12 days later, “without evidence of work being done and in violation of the funding agreement”. Simba received R28.3-million in total.</span>\r\n\r\n<span style=\"font-weight: 400;\">The SIU statement confirmed </span><a href=\"https://www.groundup.org.za/article/money-for-school-pays-for-lottery-bosss-golf-estate-home/\"><span style=\"font-weight: 400;\">an investigation by </span><i><span style=\"font-weight: 400;\">GroundUp</span></i></a><span style=\"font-weight: 400;\">, which </span><a href=\"https://www.groundup.org.za/article/money-for-school-pays-for-lottery-bosss-golf-estate-home/\"><span style=\"font-weight: 400;\">revealed</span></a><span style=\"font-weight: 400;\"> that Upbrand in turn, paid R3.6-million to attorneys handling the purchase of a luxury home on a golf estate for former NLC Commissioner Thabang Mampane. The house is registered in the name of a trust in which Mampane, her husband and their two adult children are all beneficiaries. Mampane </span><a href=\"https://www.groundup.org.za/article/lottery-boss-resigns-with-immediate-effect/\"><span style=\"font-weight: 400;\">resigned with immediate effect</span></a><span style=\"font-weight: 400;\"> shortly after </span><i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\"> reported on how the house had been paid for.</span>\r\n\r\n<i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\"> also </span><a href=\"https://www.groundup.org.za/article/leaked-report-sheds-more-light-on-rot-at-lottery-funded-school/\"><span style=\"font-weight: 400;\">reported</span></a><span style=\"font-weight: 400;\"> that audit firm SkX, which the NLC hired to investigate allegations of corruption against it, had recommended that a criminal complaint be lodged against Simba and its directors. SkX found that Simba had submitted fraudulent documents and had never finished the school project and that the Lottery funds could not be accounted for. Unregistered contractors had been used to build the school.</span>\r\n\r\n<span style=\"font-weight: 400;\">In the case of Vhafamadi, SkX found that the NLC disregarded its own control mechanisms, that a family business linked to Letwaba had benefitted, and that poor work had been done without the provincial Department of Education raising the necessary red flags.</span>\r\n\r\n<span style=\"font-weight: 400;\">Millions from the Vhafamadi grant were also paid out to several individuals and companies including Iron Bridge Travelling Agency, of which Letwaba’s cousin Karabo Sithole, was sole director at the time and of which his wife, Rebotile Malomane, is now sole director.
