"contents": "<span style=\"font-weight: 400;\">The Nelson Mandela Bay Business Chamber has brought an urgent application at the Gqeberha High Court for an order that the minerals and petroleum resources minister must reconsider a decision to “rezone” the metro as an inland region after the harbour fuel berth was damaged.</span>\r\n\r\n<span style=\"font-weight: 400;\">In June 2024, an accident at Port Elizabeth Harbour caused extensive damage, which led to the decommissioning of the fuel tanker berth.</span>\r\n\r\n<span style=\"font-weight: 400;\">Nelson Mandela Bay has two ports. The Port of Ngqura does not have a facility for tankers to deliver fuel. As a result, fuel wholesalers were compelled to collect fuel 300km away at the East London harbour.</span>\r\n\r\n<span style=\"font-weight: 400;\">The fuel tanker berth is likely to only be ready for recommissioning in December.</span>\r\n\r\n<span style=\"font-weight: 400;\">This month, Mantashe approved an </span><a href=\"https://www.dailymaverick.co.za/article/2024-09-26-gwede-mantashe-considers-application-to-exclude-nelson-mandela-bay-from-fuel-price-drop/\"><span style=\"font-weight: 400;\">application</span></a><span style=\"font-weight: 400;\"> by the Liquid Fuels Wholesalers Association (LFWA) to rezone the metro as an inland region, leading to the region, including adjacent towns, being partially excluded from a more than R1-per-litre drop in the petrol price.</span>\r\n\r\n<b>Read more: </b><a href=\"https://www.dailymaverick.co.za/article/2024-10-01-it-was-either-that-or-no-petrol-department-explains-nelson-mandela-bays-petrol-price-woes/\"><span style=\"font-weight: 400;\">‘It was either that or no petrol’ – department explains Nelson Mandela Bay’s petrol price woes</span></a>\r\n\r\n<span style=\"font-weight: 400;\">The new petrol price in other coastal cities is R19.94 (from R21 in September) for 93 petrol. In Gqeberha it is R20.77. Other coastal cities pay R20.26 for 95 petrol (compared with R21.40 in September), but in Gqeberha the price is now R21.09.</span>\r\n\r\n<span style=\"font-weight: 400;\">Petrol prices are even higher in Kariega and the Sundays River Valley.</span>\r\n<h4><b>Impact of high prices</b></h4>\r\n<span style=\"font-weight: 400;\">In court papers filed on Thursday, the chamber asked the court to urgently hear their application that the decision to rezone the Nelson Mandela Bay district be set aside and remitted to Mantashe so that he can first consult with the metro’s stakeholders.</span>\r\n\r\n<span style=\"font-weight: 400;\">But first, the chamber has asked that all records, internal memorandums, directives, policy documents, studies, minutes of meetings and other documentation used by Mantashe to make this decision be handed over to them within five weekdays.</span>\r\n\r\n<span style=\"font-weight: 400;\">Chamber CEO Denise van Huyssteen said the matter was urgent because the province’s economy was </span><a href=\"https://www.dailymaverick.co.za/article/2024-07-10-its-official-eastern-cape-economy-is-in-the-throes-of-a-recession/\"><span style=\"font-weight: 400;\">already in recession</span></a><span style=\"font-weight: 400;\"> and every person in the area would be negatively affected by the decision.</span>\r\n\r\n<span style=\"font-weight: 400;\">Department of Minerals and Petroleum Resources spokesperson Raaphi Maake said this month the rezoning also affected the price of illuminating paraffin, but not LPG (liquid gas) because the gantry that is under repair is not for gas.</span>\r\n\r\n<span style=\"font-weight: 400;\">In her affidavit filed as part of the chamber’s court papers, Van Huyssteen states: “[Chamber] Members’ businesses, across various industry sectors, rely on fuel to operate their businesses. Given South Africa’s distance to markets and the inefficiencies of ports and rail, logistics costs are among the biggest cost drivers for manufacturers and the local agricultural sector, which has to transport goods to local and export markets.</span>\r\n\r\n<span style=\"font-weight: 400;\">“To this end, these businesses have to ensure that their logistical costs remain competitive, so that they can compete with production plants within their own national and international operations, as well as with those of competitors. </span>\r\n\r\n<span style=\"font-weight: 400;\">“Fuel costs are a major component of members’ pricing structures and movements in fuel prices have a major positive or negative effect on competitiveness. </span>\r\n\r\n<span style=\"font-weight: 400;\">“Members include businesses in the automotive industry, foundries, tyre manufacturers, vehicle components assembly plants, agricultural processing, pharmaceuticals, engineering, wholesale warehousing and distribution in the food and beverage industry, as well as a range of small and medium businesses.</span>\r\n\r\n<span style=\"font-weight: 400;\">“General transportation costs of the businesses, their suppliers and employees, many of whom travel to work via taxi, are impacted by fuel costs. In addition, the workers of many of the [Business Chamber]’s members are dependent upon Liquefied Petroleum Gas for cooking and lighting.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Van Huyssteen said the unintended consequence of Mantashe’s decision “is that households will have to make tough decisions between sufficient food on the one hand and adequate fuel on the other”. </span>\r\n\r\n<span style=\"font-weight: 400;\">She said they were also bringing the application in the interest of the citizens of Nelson Mandela Bay, “who do not have the means and ability to bring proceedings and to challenge the minister’s decision”.</span>\r\n<h4><b>No response</b></h4>\r\n<span style=\"font-weight: 400;\">Van Huyssteen said she had addressed a letter to Mantashe on 27 September to request that they, as a major stakeholder in the metro, be consulted on the decision to rezone the metro.</span>\r\n\r\n<span style=\"font-weight: 400;\">In this letter, she wrote: “While we appreciate the negative impact of this situation on the businesses of the LFWA’s members, we believe it is unfair to transfer this negative impact onto the businesses and consumers of Nelson Mandela Bay. </span>\r\n\r\n<span style=\"font-weight: 400;\">“We accordingly request that you reject the LFWA’s application and instead seek a workable, equitable solution that addresses their concerns but does not disadvantage the citizens of Nelson Mandela Bay.”</span>\r\n\r\n<span style=\"font-weight: 400;\">The minister did not respond to this letter. Van Huyssteen said they were also not consulted on what a workable solution for the problem would be. </span>\r\n\r\n<span style=\"font-weight: 400;\">“Instead, on 30 September 2024 the minister issued the press release in respect of the October 2024 fuel price adjustments.”</span>\r\n\r\n<span style=\"font-weight: 400;\">More correspondence from Van Huyssteen followed. "description": "<span style=\"font-weight: 400\">Gwede Mantashe is a South African politician and the current Minister of Mineral Resources and Energy within the African National Congress (ANC). </span>\r\n\r\n<span style=\"font-weight: 400\">The portfolio was called the Ministry of Minerals and Energy until May 2009, when President Jacob Zuma split it into two separate portfolios under the Ministry of Mining (later the Ministry of Mineral Resources) and the Ministry of Energy. Ten years later, in May 2019, his successor President Cyril Ramaphosa reunited the portfolios as the Ministry of Mineral Resources and Energy. </span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe</span><span style=\"font-weight: 400\"> was born in 1955 in the Eastern Cape province, and began his working life at Western Deep Levels mine in 1975 as a Recreation Officer and, in the same year, moved to Prieska Copper Mines where he was Welfare Officer until 1982.</span>\r\n\r\n<span style=\"font-weight: 400\">He then joined Matla Colliery and co-founded the Witbank branch of the National Union of Mine Workers (NUM), becoming its Chairperson. He held the position of NUM Regional Secretary in 1985. Mantashe showcased his skills and leadership within the NUM, serving as the National Organiser from 1988 to 1993 and as the Regional Coordinator from 1993 to 1994.</span>\r\n\r\n<span style=\"font-weight: 400\">From 1994 to 1998, Mantashe held the role of Assistant General Secretary of the NUM and was later elected General Secretary in 1998.</span>\r\n\r\n<span style=\"font-weight: 400\">During his initial tenure in government, Mantashe served as a Councillor in the Ekurhuleni Municipality from 1995 to 1999. Notably, he made history by becoming the first trade unionist appointed to the Board of Directors of a Johannesburg Stock Exchange-listed company, Samancor.</span>\r\n\r\n<span style=\"font-weight: 400\">In May 2006, Mantashe stepped down as the General Secretary of the NUM and took on the role of Executive Director at the Development Bank of Southern Africa for a two-year period. He also chaired the Technical Working Group of the Joint Initiative for Priority Skills Acquisition.</span>\r\n\r\n<span style=\"font-weight: 400\">In 2007, Mantashe became the Chairperson of the South African Communist Party and a member of its Central Committee. He was elected Secretary-General of the African National Congress (ANC) at the party's 52nd National Conference in December 2007. Mantashe was re-elected to the same position in 2012. Additionally, at the ANC's 54th National Conference in 2017, he was elected as the National Chairperson.</span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe is a complex and controversial figure. He has been accused of being too close to the ANC's corrupt leadership, and of being a hardliner who is opposed to reform. </span>\r\n\r\n<span style=\"font-weight: 400\">His actions and statements have sparked controversy and allegations of protecting corruption, undermining democratic principles, and prioritising party loyalty over the interests of the country.</span>",
