But the reality is that in individual households, </span><a href=\"https://www.ncbi.nlm.nih.gov/pmc/articles/PMC10163774/#:~:text=Background,in%20many%20low%2Dincome%20settings\"><span style=\"font-weight: 400;\">both co-exist</span></a><span style=\"font-weight: 400;\">. </span>\r\n\r\n<span style=\"font-weight: 400;\">Low-income households are more likely to purchase </span><a href=\"https://childrenshealthwatch.org/wp-content/uploads/AD_AJCN_2004.pdf\"><span style=\"font-weight: 400;\">energy-dense, nutritionally poor food</span></a><span style=\"font-weight: 400;\"> which contributes to weight gain. The existence of both these phenomena, and their interrelationship, is called the “double burden of malnutrition”. </span>\r\n<h4><b>Does the Constitution have nothing to say about this?</b></h4>\r\n<span style=\"font-weight: 400;\">After the ravages of World War 2, the first modern international instrument setting out human rights was created – </span><a href=\"https://www.un.org/en/udhrbook/pdf/udhr_booklet_en_web.pdf\"><span style=\"font-weight: 400;\">the Universal Declaration of Human Rights</span></a><span style=\"font-weight: 400;\">. In the declaration, another core right was entrenched: that everyone has the right to food. For the purpose of discussing the double burden of malnutrition, </span><a href=\"https://www.fao.org/3/ca3518en/ca3518en.pdf\"><span style=\"font-weight: 400;\">this has two meanings</span></a><span style=\"font-weight: 400;\">: there should be enough food (or calories) so that people are not hungry, and the food should be nutritious so that people can be healthy.</span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-1427326\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/10/MC-Malnutrition-Spotlight_4.jpg\" alt=\"government malnutrition\" width=\"720\" height=\"396\" /> <em>A feeding scheme in Cape Town. (Photo: Gallo Images / Brenton Geach)</em></p>\r\n\r\n<span style=\"font-weight: 400;\">Governments have a duty to respect, protect and fulfil this right, which means they must ensure that people have enough healthy food, stop other parties (such as companies) from interfering with people accessing such food, and must not be the source of any obstacles to people to have access such food. In 1996, our new </span><a href=\"https://www.justice.gov.za/legislation/constitution/saconstitution-web-eng.pdf\"><span style=\"font-weight: 400;\">Constitution</span></a><span style=\"font-weight: 400;\"> brought this protection home by enshrining the right to food in three different sections, most importantly in section 27 where it provides that everyone should have access to sufficient food and water. </span>\r\n\r\n<span style=\"font-weight: 400;\">But we cannot eat our Constitution, nor can we simply go to the closest government building and ask for a meal. Rights like these, termed socioeconomic rights, are rights to food, healthcare and water, and exist in the form of a duty on the government of South Africa to, within available resources, create laws and policies which give access to these rights.</span>\r\n\r\n<span style=\"font-weight: 400;\">It is within this context that the South African government must provide school meals, social grants and food parcels in emergencies and regulate how to guarantee that the food we eat is safe. This is done through a combination of laws and policies.</span>\r\n<h4><b>You can’t eat the Constitution, but you can force the government to action it</b></h4>\r\n<span style=\"font-weight: 400;\">We need two streams of government action to stop South Africa from suffocating under the double burden of malnutrition.</span>\r\n\r\n<span style=\"font-weight: 400;\">First, we need to end food poverty. There are a range of measures important to achieving this, but an </span><a href=\"https://budgetjusticesa.org/media/media-statement-the-budget-justice-coalition-calls-on-treasury-to-reverse-continued-cuts-to-social-spending/\"><span style=\"font-weight: 400;\">immediate step</span></a><span style=\"font-weight: 400;\"> is for the government to extend the Social Relief of Distress Grant introduced during Covid-19 to function as a permanent social safety mechanism and raise it to at least R624 (</span><a href=\"https://www.statssa.gov.za/publications/P03101/P031012021.pdf\"><span style=\"font-weight: 400;\">the food poverty lower limit</span></a><span style=\"font-weight: 400;\">).</span>\r\n\r\n<span style=\"font-weight: 400;\">Providing food subsidies for local, healthy produce, extending the school nutrition programme to include more and better meals and topping up other existing grants are also the most effective interventions.</span>\r\n\r\n<span style=\"font-weight: 400;\">Second, we need policies to help South Africans eat less unhealthy food. Interventions like the proposed </span><a href=\"https://heala.org/wp-content/uploads/2023/06/FoPL-factsheet-June2023.pdf\"><span style=\"font-weight: 400;\">Front-of-Pack Warning Label</span></a><span style=\"font-weight: 400;\">, which will give consumers information if the food they are eating contains too many “bad” ingredients, are cost-effective and empowering ways to change eating habits.</span>\r\n\r\n<span style=\"font-weight: 400;\">Taxes on products such as sodas are a double win – more public funds and less sugar in our already </span><a href=\"https://www.statssa.gov.za/?p=16729#:~:text=In%20South%20Africa%2C%20deaths%20due,males%20and%2069%20for%20females.\"><span style=\"font-weight: 400;\">diabetic-prone society</span></a><span style=\"font-weight: 400;\">. In South Africa, this is called the Health Promotion Levy and evidence suggests that since its inception in 2018, it has already changed </span><a href=\"https://www.cambridge.org/core/journals/public-health-nutrition/article/south-africas-health-promotion-levy-on-pricing-and-acquisition-of-beverages-in-small-stores-and-supermarkets/90EAE7BE8290DCDEE3EBAB33DF097F59\"><span style=\"font-weight: 400;\">buying patterns</span></a><span style=\"font-weight: 400;\"> and </span><a href=\"https://journals.plos.org/plosmedicine/article?id=10.1371/journal.pmed.1003574\"><span style=\"font-weight: 400;\">sugar levels</span></a><span style=\"font-weight: 400;\"> in cool drinks. </span>\r\n\r\n<span style=\"font-weight: 400;\">We can only get these policies if we demand government action. The first words in our Constitution are: “We, the people of South Africa”. The existence of both these phenomena, and their interrelationship, is called the “double burden of malnutrition”. </span>\r\n<h4><b>Does the Constitution have nothing to say about this?</b></h4>\r\n<span style=\"font-weight: 400;\">After the ravages of World War 2, the first modern international instrument setting out human rights was created – </span><a href=\"https://www.un.org/en/udhrbook/pdf/udhr_booklet_en_web.pdf\"><span style=\"font-weight: 400;\">the Universal Declaration of Human Rights</span></a><span style=\"font-weight: 400;\">. In the declaration, another core right was entrenched: that everyone has the right to food. For the purpose of discussing the double burden of malnutrition, </span><a href=\"https://www.fao.org/3/ca3518en/ca3518en.pdf\"><span style=\"font-weight: 400;\">this has two meanings</span></a><span style=\"font-weight: 400;\">: there should be enough food (or calories) so that people are not hungry, and the food should be nutritious so that people can be healthy.</span>\r\n\r\n[caption id=\"attachment_1427326\" align=\"alignnone\" width=\"720\"]<img class=\"size-full wp-image-1427326\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/10/MC-Malnutrition-Spotlight_4.jpg\" alt=\"government malnutrition\" width=\"720\" height=\"396\" /> <em>A feeding scheme in Cape Town. (Photo: Gallo Images / Brenton Geach)</em>[/caption]\r\n\r\n<span style=\"font-weight: 400;\">Governments have a duty to respect, protect and fulfil this right, which means they must ensure that people have enough healthy food, stop other parties (such as companies) from interfering with people accessing such food, and must not be the source of any obstacles to people to have access such food. In 1996, our new </span><a href=\"https://www.justice.gov.za/legislation/constitution/saconstitution-web-eng.pdf\"><span style=\"font-weight: 400;\">Constitution</span></a><span style=\"font-weight: 400;\"> brought this protection home by enshrining the right to food in three different sections, most importantly in section 27 where it provides that everyone should have access to sufficient food and water. </span>\r\n\r\n<span style=\"font-weight: 400;\">But we cannot eat our Constitution, nor can we simply go to the closest government building and ask for a meal. Rights like these, termed socioeconomic rights, are rights to food, healthcare and water, and exist in the form of a duty on the government of South Africa to, within available resources, create laws and policies which give access to these rights.</span>\r\n\r\n<span style=\"font-weight: 400;\">It is within this context that the South African government must provide school meals, social grants and food parcels in emergencies and regulate how to guarantee that the food we eat is safe. This is done through a combination of laws and policies.</span>\r\n<h4><b>You can’t eat the Constitution, but you can force the government to action it</b></h4>\r\n<span style=\"font-weight: 400;\">We need two streams of government action to stop South Africa from suffocating under the double burden of malnutrition.</span>\r\n\r\n<span style=\"font-weight: 400;\">First, we need to end food poverty. There are a range of measures important to achieving this, but an </span><a href=\"https://budgetjusticesa.org/media/media-statement-the-budget-justice-coalition-calls-on-treasury-to-reverse-continued-cuts-to-social-spending/\"><span style=\"font-weight: 400;\">immediate step</span></a><span style=\"font-weight: 400;\"> is for the government to extend the Social Relief of Distress Grant introduced during Covid-19 to function as a permanent social safety mechanism and raise it to at least R624 (</span><a href=\"https://www.statssa.gov.za/publications/P03101/P031012021.pdf\"><span style=\"font-weight: 400;\">the food poverty lower limit</span></a><span style=\"font-weight: 400;\">).</span>\r\n\r\n<span style=\"font-weight: 400;\">Providing food subsidies for local, healthy produce, extending the school nutrition programme to include more and better meals and topping up other existing grants are also the most effective interventions.</span>\r\n\r\n<span style=\"font-weight: 400;\">Second, we need policies to help South Africans eat less unhealthy food. Interventions like the proposed </span><a href=\"https://heala.org/wp-content/uploads/2023/06/FoPL-factsheet-June2023.pdf\"><span style=\"font-weight: 400;\">Front-of-Pack Warning Label</span></a><span style=\"font-weight: 400;\">, which will give consumers information if the food they are eating contains too many “bad” ingredients, are cost-effective and empowering ways to change eating habits.</span>\r\n\r\n<span style=\"font-weight: 400;\">Taxes on products such as sodas are a double win – more public funds and less sugar in our already </span><a href=\"https://www.statssa.gov.za/?p=16729#:~:text=In%20South%20Africa%2C%20deaths%20due,males%20and%2069%20for%20females.\"><span style=\"font-weight: 400;\">diabetic-prone society</span></a><span style=\"font-weight: 400;\">. In South Africa, this is called the Health Promotion Levy and evidence suggests that since its inception in 2018, it has already changed </span><a href=\"https://www.cambridge.org/core/journals/public-health-nutrition/article/south-africas-health-promotion-levy-on-pricing-and-acquisition-of-beverages-in-small-stores-and-supermarkets/90EAE7BE8290DCDEE3EBAB33DF097F59\"><span style=\"font-weight: 400;\">buying patterns</span></a><span style=\"font-weight: 400;\"> and </span><a href=\"https://journals.plos.org/plosmedicine/article?id=10.1371/journal.pmed.1003574\"><span style=\"font-weight: 400;\">sugar levels</span></a><span style=\"font-weight: 400;\"> in cool drinks. </span>\r\n\r\n<span style=\"font-weight: 400;\">We can only get these policies if we demand government action. The first words in our Constitution are: “We, the people of South Africa”.
