Survé is chairman of the Independent Media group.</span>\r\n\r\n<span style=\"font-weight: 400;\">Survé is claiming damage to his reputation following the publication of a Groundup editorial: </span><a href=\"https://www.groundup.org.za/article/iqbal-surves-newspapers-take-side-lottery-crooks/\"><span style=\"font-weight: 400;\">Iqbal Survé’s newspapers take the side of the Lottery crooks</span></a><span style=\"font-weight: 400;\">. The article was <a href=\"https://www.dailymaverick.co.za/article/2022-08-23-iqbal-surves-publications-appear-to-take-side-of-alleged-lottery-crooks/\">republished in Daily Maverick</a>.</span>\r\n\r\n<span style=\"font-weight: 400;\">GroundUp subsequently published, in full, an energetic </span><a href=\"https://www.groundup.org.za/article/independent-media-responds-to-groundup/\"><span style=\"font-weight: 400;\">response</span></a><span style=\"font-weight: 400;\"> to this editorial by Aziz Hartley, the Editor-in-Chief of Independent Media. </span><span style=\"font-weight: 400;\">This reply was also <a href=\"https://www.dailymaverick.co.za/article/2022-08-25-independent-media-responds-to-groundup-lottery-corruption-article/\">republished in Daily Maverick</a>. </span>\r\n\r\n<span style=\"font-weight: 400;\">Nevertheless, Survé served <em>GroundUp</em> and <em>Daily Maverick</em> with papers.</span>\r\n\r\n<em><span style=\"font-weight: 400;\">Read Survé’s joint summons to both publications and claim </span><a href=\"https://www.groundup.org.za/media/uploads/documents/iqbal_surve_etc_v_groundup.pdf\"><span style=\"font-weight: 400;\">here</span></a><span style=\"font-weight: 400;\">.</span></em>\r\n\r\n<span style=\"font-weight: 400;\"> Groundup now join a comically large club of publishers and journalists who have been served or threatened with defamation papers by Survé or organisations under his control. </span>\r\n\r\n<span style=\"font-weight: 400;\">In this article, we look at Survé’s case against us and the cases he’s brought against other news organisations.</span>\r\n\r\n<span style=\"font-weight: 400;\">Our editorial pointed out that Independent Newspapers — a group of titles owned and controlled by Survé — had displayed a clear bias towards the leadership of the National Lotteries Commission in its publication of a </span><a href=\"https://www.iol.co.za/sunday-tribune/news/nlc-top-boss-charlotte-mampane-reflects-on-her-decade-long-service-704da58e-9df5-4aa5-8112-9f19cfc7d7c4\"><span style=\"font-weight: 400;\">series</span></a><span style=\"font-weight: 400;\"> of </span><a href=\"https://www.iol.co.za/dailynews/news/national-lotteries-commissioner-forced-to-quit-due-to-political-interference-4ddb667a-9d5c-4550-97b4-5d855462a836\"><span style=\"font-weight: 400;\">interviews</span></a><span style=\"font-weight: 400;\"> with disgraced former Commissioner Thabang Mampane in August. These uncritical interviews gave Mampane a platform to defend her record. The month before, </span><a href=\"https://www.groundup.org.za/article/money-for-school-pays-for-lottery-bosss-golf-estate-home/\"><span style=\"font-weight: 400;\">we revealed</span></a><span style=\"font-weight: 400;\"> that a Lottery grant had paid for her home on an elite golf estate. Later in the month </span><i><span style=\"font-weight: 400;\">Independent Online</span></i><span style=\"font-weight: 400;\"> (IOL) published another article: </span><a href=\"https://www.iol.co.za/dailynews/news/coo-dumps-national-lotteries-a-week-after-commissioner-resigned-537c1b24-da8d-46c4-87d8-6ff824384e19\"><span style=\"font-weight: 400;\">COO dumps National Lotteries a week after commissioner resigned</span></a><span style=\"font-weight: 400;\"> — which also lacks balance.</span>\r\n\r\n<span style=\"font-weight: 400;\">In his claim against us, Survé says that </span><i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\">’s editorial was “wrongful and defamatory”. He says that readers would be left with the impression that he and his publications:</span>\r\n<ul>\r\n \t<li>“Are dishonest;</li>\r\n \t<li>Are biased and have political affiliation;</li>\r\n \t<li>Uses Independent Media and Independent Newspapers publications to further their own political and personal agendas to manipulate narratives;</li>\r\n \t<li>Corrupt or hve engaged in corruption;</li>\r\n \t<li>Are unethical;</li>\r\n \t<li>Have acted illegally; and</li>\r\n \t<li>Are propagandists.”</li>\r\n</ul>\r\n<span style=\"font-weight: 400;\">Survé says that </span><i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\"> should pay R5-million for this.</span>\r\n\r\n<i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\">’s operating expenses last year were less than R8-million.</span>\r\n\r\n<span style=\"font-weight: 400;\">The </span><a href=\"http://www.saflii.org/za/cases/ZANCHC/2021/30.html\"><span style=\"font-weight: 400;\">largest defamation award in South African history</span></a><span style=\"font-weight: 400;\"> is R800,000, set by the Northern Cape high court in July 2021.</span>\r\n<h4><b>Litigation fixation</b></h4>\r\n<i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\"> is just the latest in a long line of news outlets and journalists who are being sued by Survé for reporting on the activity of his newspapers or his businesses. At least six news organisations have been sued in 2022 alone, including eMedia Holdings (owner of e.tv); Media24 (publisher of News24); </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\">; and Arena (publisher of the </span><i><span style=\"font-weight: 400;\">Sunday Times</span></i><span style=\"font-weight: 400;\">, </span><i><span style=\"font-weight: 400;\">Business Day</span></i><span style=\"font-weight: 400;\"> and others).</span>\r\n\r\n<span style=\"font-weight: 400;\">The most spectacular threat, and not in a good way, is the R500-million letter of demand against Ann Crotty, Ray Hartley, </span><i><span style=\"font-weight: 400;\">Business Day</span></i><span style=\"font-weight: 400;\"> and </span><i><span style=\"font-weight: 400;\">Business Live</span></i><span style=\"font-weight: 400;\"> by Survé’s </span><i><span style=\"font-weight: 400;\">African News Agency</span></i><span style=\"font-weight: 400;\">, </span><a href=\"https://www.iol.co.za/business-report/companies/african-news-agency-to-sue-times-media-group-8120510\"><span style=\"font-weight: 400;\">announced in March 2017</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">Then in 2019, labour journalist Terry Bell and Media24 were sued by Survé for R100-million for defamation related to a celebrated 2016 article in which </span><a href=\"https://www.news24.com/Fin24/fact-checking-iqbal-surves-bold-bio-leaves-more-questions-20160628\"><span style=\"font-weight: 400;\">Bell revealed</span></a><span style=\"font-weight: 400;\"> that Survé had routinely lied about his past and his claims to fame.</span>\r\n\r\n<span style=\"font-weight: 400;\">Bell discovered, among other things, that</span>\r\n<ul>\r\n \t<li>Survé was not, as he had claimed (and <a href=\"https://www.sekunjalo.com/dr-iqbal-surve/\">continues to claim</a>), a personal doctor or friend to Nelson Mandela;</li>\r\n \t<li>Survé was not, as claimed, mentored by Ahmed Kathrada (“I don’t know the man personally,” said Kathrada to Bell);</li>\r\n \t<li>Survé falsely claimed to be a “Fellow of the Prince of Wales’s Business and Sustainability Programme”;</li>\r\n \t<li>Survé falsely claimed to have received an award from Amnesty International;</li>\r\n \t<li>Survé falsely claimed to have been Bafana Bafana’s “mind coach” for their African Cup of Nations victory in 1996; and</li>\r\n \t<li>Survé falsely claimed to be the Indian cricket team’s “mind coach”.</li>\r\n</ul>\r\n<span style=\"font-weight: 400;\">And there is much more. Bell’s article is a modern classic and deserves to be re-read.</span>\r\n\r\n<span style=\"font-weight: 400;\">The case against him did not proceed, Bell told </span><i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\">. “Much as I was looking forward to it, it was just another empty threat,” he said.</span>\r\n\r\n<span style=\"font-weight: 400;\">Then, in 2022, Survé launched a flurry of defamation suits, seemingly making good on a number of long-standing threats against rival news publications and journalists who had the temerity to look into his affairs.</span>\r\n\r\n<hr />\r\n\r\n<strong>Visit <a href=\"https://www.dailymaverick.co.za?utm_source=direct&utm_medium=in_article_link&utm_campaign=homepage\"><em>Daily Maverick's</em> home page</a> for more news, analysis and investigations</strong>\r\n\r\n<hr />\r\n\r\n<span style=\"font-weight: 400;\">E-SAT TV and eMedia Holdings are facing a suit, launched this year.</span>\r\n\r\n<i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\"> has been served with four such suits, excluding the one that they are cited in with </span><i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\">. In one, pertaining to an article written by amaBhungane journalist Dewald van Rensburg and two by Chris Roper, Survé is suing for R1.5-million (R500,000 over three articles). Another goes after a Tim Cohen article, which Survé says is worth R1-million in damages. The third takes on Pieter-Louis Myburgh for R1-million for two articles. In all three, Branko Brkic, editor of </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\">, and Stylianos Charalambous, its CEO, are also cited. Brkic and Charalambous are also sued by Survé for R4-million, for an article and a LinkedIn post.</span>\r\n\r\n<span style=\"font-weight: 400;\">Arena Holdings is facing three suits launched in 2022</span>\r\n<ul>\r\n \t<li>versus the <i>Sunday Times</i>, <i>TimesLive</i>, S’thembiso Msomi and Bobby Jordan, Survé is claiming R2-million for general damages for alleged defamation;</li>\r\n \t<li>versus <i>Financial Mail</i>, <i>Businesslive</i>, Rob Rose and Ann Crotty, he is claiming R1-million; and</li>\r\n \t<li>versus <i>Business Day</i>, <i>BusinessLive</i>, Lukanyo Mnyanda, Warren Thompson and Nick Hedley, he is claiming R500,000 for each of three articles.</li>\r\n</ul>\r\n<span style=\"font-weight: 400;\">Wits University is also being sued for defamation. In 2021, Wits hosted the African Investigative Journalism Conference. A panel featuring amaBhungane journalists discussed Survé — and then everyone involved got served with a Survé defamation suit. Watch the offending video </span><a href=\"https://www.youtube.com/watch?v=w4B37rTcFH4\"><span style=\"font-weight: 400;\">here</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">Shirona Patel, Wits spokesperson, told </span><i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\"> that, “Dr Survé and associated entities/individuals are claiming R5-million each from the university. The university is opposing this claim.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Anton Harber, Professor of Journalism at Wits University, said, “In this case, Dr Survé is attacking speakers for things said at a university conference. This is a direct and unprecedented attack on academic freedom. It is a case that is likely to set legal precedent — hopefully, to shore up the university’s freedom to explore ideas and knowledge without such harassment.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Survé has also issued dozens of threats of litigation.</span>\r\n\r\n<i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\">’s publisher Styli Charalambous says in a </span><a href=\"https://www.dailymaverick.co.za/opinionista/2022-03-09-iols-actions-are-a-slapp-in-the-face-of-free-speech-and-the-press-code-of-ethics/\"><span style=\"font-weight: 400;\">March 2022 opinion piece</span></a><span style=\"font-weight: 400;\"> that the news house has been issued with 15 such threats. Even cartoonist Zapiro has received one.</span>\r\n\r\n<span style=\"font-weight: 400;\">In May this year, NB Publishers, who in October 2019 published </span><i><span style=\"font-weight: 400;\">Paper Tiger</span></i><span style=\"font-weight: 400;\">, an account by Alide Dasnois* and Chris Whitfield of Survé’s takeover of Independent Newspapers, received a letter of demand from Survé. News organisations that published extracts of the book were also served with letters.</span>\r\n\r\n<span style=\"font-weight: 400;\">This, said Gys Visser from NB Publishers, was “a clear attempt at intimidation”. He told </span><i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\"> that the company hadn’t heard anything from Survé’s attorneys “in quite some time”.</span>\r\n<h4><b>Slapp in the face</b></h4>\r\n<span style=\"font-weight: 400;\">Charalambous argues that the letters of demand and lawsuits brought against </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\"> at Survé’s command are not designed to address a legitimate grievance, but just to drain money and time from a rival publication in an attempt to dissuade critical reporting. He diagnoses this as Strategic Litigation Against Public Participation (Slapp) suits.</span>\r\n\r\n<span style=\"font-weight: 400;\">In February, the </span><a href=\"https://www.groundup.org.za/article/concourt-reserves-judgment-on-appeals-slapp-defamation-case/\"><span style=\"font-weight: 400;\">Constitutional Court heard</span></a><span style=\"font-weight: 400;\"> a matter that relates to the use of litigation to silence dissenting voices - Mineral Sands Resource Pty Ltd v Rendell & Others. Judgment is yet to be delivered</span>\r\n\r\n<span style=\"font-weight: 400;\">Willem De Klerk, an attorney representing Arena, </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\"> and amaBhungane against Survé, says they have filed a special plea that Survé’s suits are effectively Slapp suits, “an abuse of process, namely a campaign against the media”. Action in Survé’s suits has been suspended pending the outcome of the Constitutional Court matter.</span>\r\n\r\n<span style=\"font-weight: 400;\">“The amounts claimed by Survé are patently exorbitant which Survé knows he would not realistically or even remotely be awarded by the courts, which in our view underscores the abusiveness of the campaign,” said De Klerk.</span>\r\n\r\n<span style=\"font-weight: 400;\">It is difficult to understand how Survé or his lawyers come to the amounts claimed in their various summons. All his claims are in excess of the largest-ever defamation claim, but even then, it is difficult to understand why the “damage” done by </span><i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\"> is set at R5-million, while </span><i><span style=\"font-weight: 400;\">Business Day</span></i><span style=\"font-weight: 400;\">, </span><i><span style=\"font-weight: 400;\">BusinessLive</span></i><span style=\"font-weight: 400;\">, Lukanyo Mnyanda, Warren Thompson and Nick Hedley, are being sued for R500,000 for each of three articles. Why is Ann Crotty being sued for R1-million in 2022, when in 2019 a suit against her was worth R500-million?</span>\r\n\r\n<i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\"> sent Survé detailed questions about the status of his defamation litigation. We asked about cases going back to 2015.
