"contents": "<span style=\"font-weight: 400;\">The last time South Africa tightened its gun laws in 2001, </span><a href=\"https://pubmed.ncbi.nlm.nih.gov/24432917/\"><span style=\"font-weight: 400;\">fewer bodies with bullet holes</span></a><span style=\"font-weight: 400;\"> ended up in mortuaries. But now, </span><a href=\"https://static1.squarespace.com/static/5ed512688566f7228006e913/t/62ed15fbfb622063ea781731/1659704832924/small-arms-and-ammunition-in-south-africa+%281%29.pdf\"><span style=\"font-weight: 400;\">gun deaths</span></a><span style=\"font-weight: 400;\"> are on the rise again (killings are up by </span><a href=\"https://static1.squarespace.com/static/5ed512688566f7228006e913/t/62ed15fbfb622063ea781731/1659704832924/small-arms-and-ammunition-in-south-africa+%281%29.pdf\"><span style=\"font-weight: 400;\">up 55%</span></a><span style=\"font-weight: 400;\"> from 2015); the number of women killed by a partner with a gun has </span><a href=\"https://www.samrc.ac.za/sites/default/files/files/2022-03-15/DecreaseFemicideSouthAfricaResearchBrief.pdf\"><span style=\"font-weight: 400;\">stopped declining</span></a><span style=\"font-weight: 400;\">; and in July a series of </span><a href=\"https://www.saps.gov.za/newsroom/selnewsdetails.php?nid=40899\"><span style=\"font-weight: 400;\">shootings</span></a><span style=\"font-weight: 400;\"> across the country left dozens dead. </span>\r\n\r\n<span style=\"font-weight: 400;\">All of this has reignited a fight about whether gun laws should once again be strengthened.</span>\r\n\r\n<span style=\"font-weight: 400;\">According to an </span><a href=\"https://static1.squarespace.com/static/5ed512688566f7228006e913/t/62ed15fbfb622063ea781731/1659704832924/small-arms-and-ammunition-in-south-africa+%281%29.pdf\"><span style=\"font-weight: 400;\">analysis of police data</span></a><span style=\"font-weight: 400;\"> published in August, more than 8,000 people were killed by guns in SA in 2020/21. Among the victims were 100 children. </span>\r\n\r\n<span style=\"font-weight: 400;\">Treating bullet wounds in hospital requires, on average, about three hours of surgery and close to 10 days in hospital. This is according to a </span><a href=\"http://www.scielo.org.za/scielo.php?script=sci_arttext&pid=S0256-95742017000700024\"><span style=\"font-weight: 400;\">2017 analysis</span></a><span style=\"font-weight: 400;\"> of orthopaedic cases (when bone surgery is needed) at Groote Schuur Hospital in Cape Town. At the time when the research cases received surgery (2012), this amounted to hospital costs of R25,000 per patient.</span>\r\n\r\n<span style=\"font-weight: 400;\">At the centre of the debate on whether gun control would save lives is a question that’s long divided the country’s pro- and anti-gun lobbies: where do the firearms used by criminals come from? </span>\r\n\r\n<span style=\"font-weight: 400;\">The answer could lie uncomfortably close to home. </span>\r\n\r\n<span style=\"font-weight: 400;\">There’s </span><a href=\"https://www.researchgate.net/publication/326477862_MURDER_AND_THE_SAPS%27_POLICING_OF_ILLEGAL_FIREARMS_IN_SOUTH_AFRICA\"><span style=\"font-weight: 400;\">evidence</span></a><span style=\"font-weight: 400;\"> most of the guns that end up in the underworld are lost or stolen from licenced civilians (people who aren’t police or military officers) and private security firms.</span>\r\n\r\n<span style=\"font-weight: 400;\">As a result, the gun control lobby argues that South Africa needs new rules that will result in a smaller pool of legal firearms, resulting in fewer guns </span><a href=\"https://gfsa.org.za/gun-policy-briefs/\"><span style=\"font-weight: 400;\">ending up in the hands of criminals</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">Last year, the police department </span><a href=\"https://www.gov.za/sites/default/files/gcis_document/202105/2a-fca-bill-2021.pdf\"><span style=\"font-weight: 400;\">proposed</span></a><span style=\"font-weight: 400;\"> a slew of changes to South Africa’s firearm regulations that lined up with those demands. It would have made it impossible for ordinary people to apply for a weapon to use in self-defence. </span>\r\n\r\n<span style=\"font-weight: 400;\">The backlash was quick in coming. The police ministry received over </span><a href=\"https://www.parliament.gov.za/press-releases/media-statement-police-committee-resolves-give-civilian-secretariat-police-more-time-consider-comments-firearms-control-bill\"><span style=\"font-weight: 400;\">100,000 comments</span></a><span style=\"font-weight: 400;\"> on the draft laws (</span><a href=\"https://www.sanews.gov.za/south-africa/firearms-control-bill-public-participation-extended\"><span style=\"font-weight: 400;\">mostly from people opposing the bill</span></a><span style=\"font-weight: 400;\">) and they’re obligated to process each one. Subsequently, the </span><a href=\"https://www.gov.za/sites/default/files/gcis_document/202105/2a-fca-bill-2021.pdf\"><span style=\"font-weight: 400;\">bill</span></a><span style=\"font-weight: 400;\"> was </span><a href=\"https://www.parliament.gov.za/press-releases/media-statement-police-committee-resolves-give-civilian-secretariat-police-more-time-consider-comments-firearms-control-bill\"><span style=\"font-weight: 400;\">shelved</span></a><span style=\"font-weight: 400;\"> in November 2021.</span>\r\n\r\n<span style=\"font-weight: 400;\">The pro-gun lobby, which is made up of </span><a href=\"https://www.facebook.com/SASPAlliance/\"><span style=\"font-weight: 400;\">gun-owners</span></a><span style=\"font-weight: 400;\">, </span><a href=\"https://irr.org.za/campaigns/stop-citizen-abuse-banning-firearms-self-defence\"><span style=\"font-weight: 400;\">think tanks </span></a><span style=\"font-weight: 400;\">and </span><a href=\"https://petitions.da.org.za/p/stopgunbill\"><span style=\"font-weight: 400;\">political parties</span></a><span style=\"font-weight: 400;\">, argues that South Africans should have the right to have guns to protect themselves or they’ll be “</span><a href=\"https://www.da.org.za/2021/11/da-welcomes-police-committee-decision-to-postpone-firearms-control-amendment-bill\"><span style=\"font-weight: 400;\">at the mercy of criminals</span></a><span style=\"font-weight: 400;\">”, since the police are a “</span><a href=\"https://www.da.org.za/2021/11/da-welcomes-police-committee-decision-to-postpone-firearms-control-amendment-bill\"><span style=\"font-weight: 400;\">dismal failure</span></a><span style=\"font-weight: 400;\">”. </span>\r\n\r\n<span style=\"font-weight: 400;\">They reject the claim that criminals are getting their weapons from legal gun owners. Instead, they argue that the problem lies with police, who under-report how many guns they’ve lost (which is likely, given that it’s unclear whether the police are able to track </span><a href=\"https://pmg.org.za/tabled-committee-report/4564/\"><span style=\"font-weight: 400;\">how many firearms they lose</span></a><span style=\"font-weight: 400;\">). They argue that the rate at which police guns are stolen is 10 times higher than for ordinary civilians (though Africa Check </span><a href=\"https://africacheck.org/fact-checks/reports/murder-vips-and-theft-fact-checking-five-claims-gun-owners-south-africa\"><span style=\"font-weight: 400;\">found</span></a><span style=\"font-weight: 400;\"> no evidence of this). </span>\r\n\r\n<span style=\"font-weight: 400;\">Both the </span><a href=\"https://africacheck.org/fact-checks/reports/murder-vips-and-theft-fact-checking-five-claims-gun-owners-south-africa\"><span style=\"font-weight: 400;\">pro-</span></a><span style=\"font-weight: 400;\"> and </span><a href=\"https://africacheck.org/fact-checks/reports/no-research-backs-widely-shared-statistic-about-gun-ownership-risk-south-africa\"><span style=\"font-weight: 400;\">anti-gun</span></a><span style=\"font-weight: 400;\"> lobbies have been accused of making false claims, but what do we know about the impact of gun laws on violent crime? We break down the evidence.</span>\r\n<h4><b>Have South Africa’s gun laws worked so far? </b></h4>\r\n<span style=\"font-weight: 400;\">In 2001, then president Thabo Mbeki signed the </span><a href=\"https://www.saps.gov.za/services/flash/firearms/legislation/gov_notice_english.pdf\"><span style=\"font-weight: 400;\">Firearms Control Act</span></a><span style=\"font-weight: 400;\"> (FCA) into law, which introduced tighter gun control measures. This included requiring gun licence applicants to provide detailed motivations for why they needed a gun.</span>\r\n\r\n<a href=\"https://www.saps.gov.za/services/flash/firearms/legislation/gov_notice_english.pdf\"><span style=\"font-weight: 400;\">Strict background checks</span></a><span style=\"font-weight: 400;\"> were rolled out as well. This prevented anyone with a history of violent crimes, substance abuse or a criminal record from getting a permit. It also meant that in some cases, people who applied for a gun licence must be cleared by a psychologist, who had to evaluate whether the person could become violent. </span>\r\n\r\n<span style=\"font-weight: 400;\">These new rules were introduced alongside a number of </span><a href=\"http://www.samj.org.za/index.php/samj/article/view/12800/9068\"><span style=\"font-weight: 400;\">other measures</span></a><span style=\"font-weight: 400;\"> implemented in the early 2000s, including a firearms amnesty which allowed illegal gun owners to hand in their weapons without any repercussions. A series of police operations were designed to locate and destroy illegal weapons.</span>\r\n\r\n<span style=\"font-weight: 400;\">Did it work? Probably, although there’s no evidence to prove that these measures actually caused fewer gun murders — only that the new rules were followed by a drop in gun deaths.</span>\r\n\r\n<span style=\"font-weight: 400;\">In the late 1990s, deaths from gunshot wounds were increasing, but they began to drop immediately </span><a href=\"http://www.samj.org.za/index.php/samj/article/view/10379\"><span style=\"font-weight: 400;\">after the FCA was signed into law</span></a><span style=\"font-weight: 400;\">, and kept dropping for a decade, before ticking up again from 2011.</span>\r\n\r\n<span style=\"font-weight: 400;\">Plus, </span><a href=\"http://www.samj.org.za/index.php/samj/article/view/12220\"><span style=\"font-weight: 400;\">research in Cape Town</span></a><span style=\"font-weight: 400;\"> shows that while gun murders fell dramatically in the years after the FCA was rolled out, murder by other means (such as stabbing) was less affected, leading researchers to credit the 2001 law, and other projects such as the </span><a href=\"http://www.samj.org.za/index.php/samj/article/view/12800/9068\"><span style=\"font-weight: 400;\">firearms amnesty</span></a><span style=\"font-weight: 400;\">, for the decline. </span>\r\n\r\n<span style=\"font-weight: 400;\">Similarly, </span><a href=\"https://www.saferspaces.org.za/uploads/files/2012_Abrahams_everyeighthours.pdf\"><span style=\"font-weight: 400;\">researchers found</span></a><span style=\"font-weight: 400;\"> that not only were fewer women murdered following the introduction of the FCA, but of those murders that occurred, far fewer were caused by guns. </span>\r\n\r\n<span style=\"font-weight: 400;\">And the number of women shot dead by an intimate partner </span><a href=\"https://www.samrc.ac.za/sites/default/files/files/2022-03-15/DecreaseFemicideSouthAfricaResearchBrief.pdf\"><span style=\"font-weight: 400;\">nearly halved between 1999 and 2009</span></a><span style=\"font-weight: 400;\">. </span>\r\n\r\n<span style=\"font-weight: 400;\">But there is one weighty critique to consider: it’s contained in a 178-page </span><a href=\"http://www.policesecretariat.gov.za/downloads/reports/CSPS-WSG_Firearms_Report.pdf\"><span style=\"font-weight: 400;\">report</span></a><span style=\"font-weight: 400;\"> by the Wits University2’s School of Governance, which evaluated the impact of the FCA between 2000 and 2014.</span>\r\n\r\n<span style=\"font-weight: 400;\">One of the report’s findings was that although the law was signed in 2001, its provisions only came into effect in 2004, by which time gun murders were already declining. Therefore, the researchers argue, decreasing gun murders can’t be pinned on new firearm policies. </span>\r\n\r\n<span style=\"font-weight: 400;\">However, in an August </span><a href=\"https://static1.squarespace.com/static/5ed512688566f7228006e913/t/62ed15fbfb622063ea781731/1659704832924/small-arms-and-ammunition-in-south-africa+%281%29.pdf\"><span style=\"font-weight: 400;\">report</span></a><span style=\"font-weight: 400;\"> funded by the European Union, criminologist Guy Lamb shows that the police started to reject gun permits in greater numbers in 2000 and 2001, even though the legislation only formally came into effect three years later. </span>\r\n\r\n<span style=\"font-weight: 400;\">He explains to </span><i><span style=\"font-weight: 400;\">Bhekisisa</span></i><span style=\"font-weight: 400;\"> reporters: “That means it’s still likely that the law played a role in a drop in gun violence in the early 2000s.” </span>\r\n<h4><b>What can South Africa learn from other countries?</b></h4>\r\n<span style=\"font-weight: 400;\">The United States accounts for nearly three-quarters of all mass shooting deaths that were recorded in 36 developed nations in the last two decades, a 2022 </span><a href=\"https://www.tandfonline.com/doi/full/10.1080/01924036.2022.2052126\"><span style=\"font-weight: 400;\">study</span></a><span style=\"font-weight: 400;\"> shows. </span>\r\n\r\n<span style=\"font-weight: 400;\">As a result, America’s gun laws are among the most studied in the world. Unlike in South Africa, research in the US is actually able to show cause and effect — in many cases, more lenient gun laws actually lead to more murders. </span>\r\n\r\n<span style=\"font-weight: 400;\">From 2005 onward, </span><a href=\"https://www.ncsl.org/research/civil-and-criminal-justice/self-defense-and-stand-your-ground.aspx\"><span style=\"font-weight: 400;\">rules</span></a><span style=\"font-weight: 400;\"> were introduced across a number of US states to give people firmer legal grounds to shoot an attacker in self-defence. This was supposed to make criminals more nervous to attack. </span>\r\n\r\n<span style=\"font-weight: 400;\">But research shows the regulations (known as stand-your-ground laws) have </span><a href=\"http://jhr.uwpress.org/content/48/3/821.short\"><span style=\"font-weight: 400;\">done nothing</span></a><span style=\"font-weight: 400;\"> to make people safer or to stop robberies. </span>\r\n\r\n<span style=\"font-weight: 400;\">In fact, a </span><a href=\"http://jhr.uwpress.org/content/52/3/621.short\"><span style=\"font-weight: 400;\">large body</span></a><span style=\"font-weight: 400;\"> of evidence </span><a href=\"https://jamanetwork.com/journals/jamainternalmedicine/article-abstract/2582988\"><span style=\"font-weight: 400;\">shows</span></a><span style=\"font-weight: 400;\"> that in states that passed stand-your-ground laws, murders </span><a href=\"http://jhr.uwpress.org/content/48/3/821.short\"><span style=\"font-weight: 400;\">increased</span></a><span style=\"font-weight: 400;\"> significantly compared to states that maintained stricter rules for using firearms.</span>\r\n\r\n<span style=\"font-weight: 400;\">The reality in the US and South Africa is, however, very different, so it’s hard to compare the two countries. But there is a country in South America with </span><a href=\"https://data.worldbank.org/indicator/NY.GDP.PCAP.CD?locations=ZA-CO\"><span style=\"font-weight: 400;\">similar income levels</span></a><span style=\"font-weight: 400;\"> to South Africa — where the </span><a href=\"https://www.reuters.com/article/us-colombia-police-idUSKCN0Y220A\"><span style=\"font-weight: 400;\">police are often charged with corruption</span></a><span style=\"font-weight: 400;\"> — and where violent gangs dominate parts of the nation. </span>\r\n\r\n<span style=\"font-weight: 400;\">In Colombia, </span><a href=\"https://www.ncbi.nlm.nih.gov/pmc/articles/PMC7047021/pdf/BLT.19.236646.pdf\"><span style=\"font-weight: 400;\">evidence</span></a><span style=\"font-weight: 400;\"> has shown that when civilians are allowed to carry guns, murder and armed violence increase. </span>\r\n\r\n<span style=\"font-weight: 400;\">How do researchers know that such laws actually cause deadly crime? </span>\r\n\r\n<span style=\"font-weight: 400;\">In 2012, two of Colombia’s larger cities, Bogotá and Medellín, </span><a href=\"https://www.unodc.org/pdf/Colombia_Dec06_en.pdf\"><span style=\"font-weight: 400;\">permanently banned people from carrying guns</span></a><span style=\"font-weight: 400;\">, while the right to carry a firearm continued in other cities. </span>\r\n\r\n<a href=\"https://www.ncbi.nlm.nih.gov/pmc/articles/PMC7047021/pdf/BLT.19.236646.pdf\"><span style=\"font-weight: 400;\">A 2020 study showed</span></a><span style=\"font-weight: 400;\"> that although Colombia saw an overall decrease in gun murder after Bogotá and Medellín prohibited people from carrying firearms, the reduction was two times greater in those cities than in other large metropoles. Up until this point, trends in gun violence between these cities and the other big municipalities had been similar. </span>\r\n\r\n<span style=\"font-weight: 400;\">Overall, the authors estimate that in Bogotá and Medellín combined, the restriction on the right to carry a gun saves about 30 lives every month. </span>\r\n\r\n<span style=\"font-weight: 400;\">South Africa’s current laws allow citizens (with a permit) to carry guns on their person as long as the weapon is covered, say, in a rucksack or in a holster. This rule is called “concealed carry”. </span>\r\n\r\n<span style=\"font-weight: 400;\">But in a country where violence is often the first resort for dealing with conflict, a well-armed population is worrying, says Richard Matzopoulos, an epidemiologist and director of a </span><a href=\"https://www.samrc.ac.za/intramural-research-units/BOD\"><span style=\"font-weight: 400;\">team at the South African Medical Research Council that studies the impact of various health problems on the country</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<a href=\"https://www.saps.gov.za/services/downloads/fourth_quarter_presentation_2021_2022.pdf\"><span style=\"font-weight: 400;\">Most murders</span></a><span style=\"font-weight: 400;\"> in South Africa are caused by arguments and misunderstandings between people who don’t live in the same house. Matzopoulos argues that the carrying of guns likely plays a role in how deadly these disputes become.</span>\r\n\r\n<span style=\"font-weight: 400;\">“There will be cases where someone legitimately uses their weapon for self-defence,” he says. “But for every one of those cases, there will be several others where a gun is drawn and an innocent bystander is shot, or a heated dispute that could have been resolved another way becomes fatal.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Matzopoulos is clear: “Taking away people’s guns doesn’t necessarily make them less violent… it just makes them less adept at killing one another.” </span><b>DM/MC</b>\r\n\r\n<i><span style=\"font-weight: 400;\">This story was produced by the</span></i><a href=\"http://bhekisisa.org./\"> <i><span style=\"font-weight: 400;\">Bhekisisa Centre for Health Journalism</span></i></a><i><span style=\"font-weight: 400;\">.
