"contents": "<span style=\"font-weight: 400;\">The axing of nuclear watchdog activist Peter Becker from the National Nuclear Regulatory Board last year was unconstitutional, the Western Cape high court has ruled.</span>\r\n\r\n<span style=\"font-weight: 400;\">The effect of Judge Babalwa Mantame’s ruling is that Becker, who was appointed as a community representative on the board in June 2021 following a public call for nominations, must be reinstated.</span>\r\n\r\n<span style=\"font-weight: 400;\">The Minister of Mineral Resources and Energy, Gwede Mantashe, the National Nuclear Regulator, and the board — who all opposed Becker’s review application — have been ordered to pay costs.</span>\r\n\r\n<span style=\"font-weight: 400;\">Becker, who is the spokesperson for the Koeberg Alert Alliance (KAA), was appointed as a non-executive director of the board to represent communities affected by nuclear activities.</span>\r\n\r\n<span style=\"font-weight: 400;\">Becker was nominated by a number of civil society organisations, including the KAA, which is opposed to further building of reactors at Koeberg Power Station and extending its lifespan.</span>\r\n\r\n<span style=\"font-weight: 400;\">He held the KAA’s views prior to his appointment and, according to Becker, they were known by the minister.</span>\r\n\r\n<span style=\"font-weight: 400;\">However, after he gave an interview (</span><a href=\"https://www.energize.co.za/article/thyspunt-nuclear-hearings-distract-koeberg-problems\"><span style=\"font-weight: 400;\">published in </span><i><span style=\"font-weight: 400;\">Energize</span></i><span style=\"font-weight: 400;\"> magazine</span></a><span style=\"font-weight: 400;\">) in his capacity as KAA spokesperson, and convened a meeting with civil society organisations, he was deemed to be “conflicted” and that he was not complying with his “fiduciary obligations”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Becker was suspended and then fired by Mantashe, who publicly stated at the time of his suspension: “If you resist nuclear and you [are] a board member, I fire you, simple. You can’t be [on] a board of something you’re not advocating for. We want nuclear there in Port Elizabeth”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Mantashe’s decision to fire Becker was backed by legal opinion from law firm MacRobert, which found that Becker was not protecting or promoting the business interests of the regulator or preserving its reputation.</span>\r\n\r\n<span style=\"font-weight: 400;\">Becker, in his court application, argued that the minister had an ulterior motive to get rid of him because of the challenging questions he raised.</span>\r\n\r\n<span style=\"font-weight: 400;\">Read the full judgment </span><a href=\"https://www.groundup.org.za/media/uploads/documents/skm_c65823011912100.pdf\"><span style=\"font-weight: 400;\">here</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">Judge Mantame said that when Becker commented for the </span><i><span style=\"font-weight: 400;\">Energize</span></i><span style=\"font-weight: 400;\"> article, he had done so in his civil society activist role, prior to his formal appointment and his acceptance as a member of the board.</span>\r\n\r\n<span style=\"font-weight: 400;\">Regarding Becker’s meeting with civil society bodies, following his appointment, Judge Mantame said he had advised the board of this.</span>\r\n\r\n<span style=\"font-weight: 400;\">“The goal was to collect the top concerns relating to nuclear safety across organisations … and to bring those concerns to the board, since he was a representative of those communities.</span>\r\n\r\n<hr />\r\n\r\n<strong>Visit <a href=\"https://www.dailymaverick.co.za?utm_source=direct&utm_medium=in_article_link&utm_campaign=homepage\"><em>Daily Maverick's</em> home page</a> for more news, analysis and investigations</strong>\r\n\r\n<hr />\r\n\r\n<span style=\"font-weight: 400;\">“In a situation where he made the agenda of the meeting known to the regulator, it is inconceivable how the allegation of him representing the board (as opposed to being a representative on the board) without authorisation to do so, came about,” the judge said.</span>\r\n\r\n<span style=\"font-weight: 400;\">Judge Mantame said legislation decreed that the 12-member board had to have a representative from communities affected by nuclear activities in order to heighten the level of deliberations and engagement.</span>\r\n\r\n<span style=\"font-weight: 400;\">“It appears Mr Becker’s views became of utmost concern days after he was appointed … it does not appear that there was any constructive engagement between the board and Mr Becker on how to conduct himself in accordance with the prescripts.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Judge Mantame said Becker was never advised that it would not bode well if he wore two hats (a board member and spokesperson for the KAA) and the issue should have been dealt with in a more constructive, pragmatic and professional manner.</span>\r\n\r\n<span style=\"font-weight: 400;\">The judge said there was nothing on record to show that the communities who had nominated Becker to the board were advised of his suspension in January 2022.</span>\r\n\r\n<span style=\"font-weight: 400;\">While the minister claimed this had “nothing to do with the public”, the judge said, to the contrary, “public interest is of utmost importance in this matter”.</span>\r\n\r\n<span style=\"font-weight: 400;\">“If the communities have a right to representations on the board, equally they have a right to be formally advised that such a right is about to be terminated and they should make representations so that their views could be considered.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Judge Mantame said the board should have considered themselves fortunate to have Becker, who represented these communities, as a member whose input would have been enlightening and which brought a different perspective to the discussions other than government policy.</span>\r\n\r\n<span style=\"font-weight: 400;\">“Much to this court’s dismay, in a board consisting of 12 members, it is not clear how Mr Becker’s only opinion could have swayed all the other members. Also, the allegations that his public views concerning desirability of nuclear energy are said to be ‘contagion’ that would ‘infect’ the board’s decisions, is fanciful.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Judge Mantame said “most shocking” were the utterances made by Minister Mantashe after Becker had been suspended but prior to his dismissal.</span>\r\n\r\n<span style=\"font-weight: 400;\">These suggested that the minister had prejudged the issue and had acted in bad faith and with an ulterior motive.</span>\r\n\r\n<span style=\"font-weight: 400;\">She said while Becker should have relinquished his position as spokesperson for KAA after his appointment, his conduct could have been resolved without him being fired and the process was clearly unfair.</span>\r\n\r\n<span style=\"font-weight: 400;\">“In conclusion, the statements (Becker) made, his request for information from the regulator’s employees and the meeting with members of his constituency cannot be construed as misconduct. Even if there was a perception of conflict of interest, in my view, it was capable of being mitigated. "description": "<span style=\"font-weight: 400\">Gwede Mantashe is a South African politician and the current Minister of Mineral Resources and Energy within the African National Congress (ANC). </span>\r\n\r\n<span style=\"font-weight: 400\">The portfolio was called the Ministry of Minerals and Energy until May 2009, when President Jacob Zuma split it into two separate portfolios under the Ministry of Mining (later the Ministry of Mineral Resources) and the Ministry of Energy. Ten years later, in May 2019, his successor President Cyril Ramaphosa reunited the portfolios as the Ministry of Mineral Resources and Energy. </span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe</span><span style=\"font-weight: 400\"> was born in 1955 in the Eastern Cape province, and began his working life at Western Deep Levels mine in 1975 as a Recreation Officer and, in the same year, moved to Prieska Copper Mines where he was Welfare Officer until 1982.</span>\r\n\r\n<span style=\"font-weight: 400\">He then joined Matla Colliery and co-founded the Witbank branch of the National Union of Mine Workers (NUM), becoming its Chairperson. He held the position of NUM Regional Secretary in 1985. Mantashe showcased his skills and leadership within the NUM, serving as the National Organiser from 1988 to 1993 and as the Regional Coordinator from 1993 to 1994.</span>\r\n\r\n<span style=\"font-weight: 400\">From 1994 to 1998, Mantashe held the role of Assistant General Secretary of the NUM and was later elected General Secretary in 1998.</span>\r\n\r\n<span style=\"font-weight: 400\">During his initial tenure in government, Mantashe served as a Councillor in the Ekurhuleni Municipality from 1995 to 1999. Notably, he made history by becoming the first trade unionist appointed to the Board of Directors of a Johannesburg Stock Exchange-listed company, Samancor.</span>\r\n\r\n<span style=\"font-weight: 400\">In May 2006, Mantashe stepped down as the General Secretary of the NUM and took on the role of Executive Director at the Development Bank of Southern Africa for a two-year period. He also chaired the Technical Working Group of the Joint Initiative for Priority Skills Acquisition.</span>\r\n\r\n<span style=\"font-weight: 400\">In 2007, Mantashe became the Chairperson of the South African Communist Party and a member of its Central Committee. He was elected Secretary-General of the African National Congress (ANC) at the party's 52nd National Conference in December 2007. Mantashe was re-elected to the same position in 2012. Additionally, at the ANC's 54th National Conference in 2017, he was elected as the National Chairperson.</span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe is a complex and controversial figure. He has been accused of being too close to the ANC's corrupt leadership, and of being a hardliner who is opposed to reform. </span>\r\n\r\n<span style=\"font-weight: 400\">His actions and statements have sparked controversy and allegations of protecting corruption, undermining democratic principles, and prioritising party loyalty over the interests of the country.</span>",
