Ghanaian MPs are considering legislation that is so onerous it beggars belief. Ghana’s proposed legislation takes bad parts from all of these and adds some.</span>\r\n\r\n<span style=\"font-weight: 400;\">The proposed legislation, </span><i><span style=\"font-weight: 400;\">The Promotion of Proper Human Sexual Rights and Ghanaian Family Values Bill 2021</span></i><span style=\"font-weight: 400;\"> is directed against a tiny group in Ghana — people who are different because of their sexual orientation, or gender identity, but could also affect anyone who expresses support or sympathy toward LGBT friends, coworkers, family members or neighbours. The bill represents a witch-hunt against LGBT people in Ghana.</span>\r\n\r\n<span style=\"font-weight: 400;\">Given that the bill’s strongest supporters claim to be doing this in the name of religion, whether</span><a href=\"https://nam02.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.modernghana.com%2Fnews%2F1091058%2Fsam-george-7-other-mps-behind-bill-for-criminaliz.html&data=04%7C01%7Creidg%40hrw.org%7Ca2c976dd3b2e45bcdfcb08d957f74a09%7C2eb79de4d8044273a6e64b3188855f66%7C0%7C0%7C637637541892044852%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&sdata=4ajvX14Yj%2Fh1iRNVCxQd1dq6ixPKIECXSW18m%2BPRiT0%3D&reserved=0\"> <span style=\"font-weight: 400;\">Traditional, Christian or Muslim</span></a><span style=\"font-weight: 400;\">,</span><span style=\"font-weight: 400;\"> let us consider what the provisions would look like if it was applied to, say, Christians. Imagine a law that required anyone who knew a Christian to report them to the police. A Christian who admitted it would face three to five years behind bars. If she said it was okay to be Christian, six years. If she had proselytised in any way, or shared any information about Christianity, five to 10.</span>\r\n\r\n<span style=\"font-weight: 400;\">If she provided a meeting space for her congregation or raised funds to support her church community, five to 10 years. If she allowed a Christian to stay in her house, three to six years. If she sent a tweet with the symbol of the cross, or a Facebook posting with an image of Noah’s Ark, five to 10, for her and the social media platform’s owners. If anyone else, perhaps a Muslim neighbour, publicly said that they supported her Christian denomination, up to 10 years. This is no exaggeration. This is what the</span><a href=\"https://nam02.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.theguardian.com%2Fglobal-development%2F2021%2Fjul%2F23%2Fghana-anti-gay-bill-proposing-10-year-prison-sentences-sparks-outrage&data=04%7C01%7Creidg%40hrw.org%7Ca2c976dd3b2e45bcdfcb08d957f74a09%7C2eb79de4d8044273a6e64b3188855f66%7C0%7C0%7C637637541892044852%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&sdata=Zi3ZWbQB7HGAQqKFXhNDYRC%2FaTaXEPXtFKDqO7euTLc%3D&reserved=0\"> <span style=\"font-weight: 400;\">proposed law</span></a><span style=\"font-weight: 400;\"> says. But it does not apply to Christians, it applies to anyone who does not conform to arbitrary and subjective sexual and gender norms.</span>\r\n\r\n<span style=\"font-weight: 400;\">This proposed law tramples on the most fundamental human rights. It is an affront to dignity, privacy and non-discrimination. It is an assault on freedoms of speech, expression, association, and assembly.</span>\r\n\r\n<span style=\"font-weight: 400;\">President Nana Akufo-Addo has described Ghana as a “</span><a href=\"https://nam02.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.france24.com%2Fen%2Flive-news%2F20201207-ghana-set-for-close-presidential-race-as-old-rivals-face-off&data=04%7C01%7Creidg%40hrw.org%7Ca2c976dd3b2e45bcdfcb08d957f74a09%7C2eb79de4d8044273a6e64b3188855f66%7C0%7C0%7C637637541892054809%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&sdata=JvCoEkzRJSqxOAmGzrvGZm9k80VUuA%2BWa9PUAsD60ic%3D&reserved=0\"><span style=\"font-weight: 400;\">beacon of democracy</span></a><span style=\"font-weight: 400;\">” in the region. And progress has been made in respecting human rights for all. The Criminal Offences Act includes a colonial-era provision outlawing “unlawful carnal knowledge”. At the same time, the police and the Human Rights Commission have taken steps to protect LGBT people from violence and abuse.</span>\r\n\r\n<span style=\"font-weight: 400;\">However, a 2018 Human Rights Watch report found that</span><a href=\"https://nam02.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.hrw.org%2Freport%2F2018%2F01%2F08%2Fno-choice-deny-who-i-am%2Fviolence-and-discrimination-against-lgbt-people-ghana%2313932d&data=04%7C01%7Creidg%40hrw.org%7Ca2c976dd3b2e45bcdfcb08d957f74a09%7C2eb79de4d8044273a6e64b3188855f66%7C0%7C0%7C637637541892054809%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&sdata=PHb0fQV1WbAWxhSk0VWzc9uI9j4M2vEAjLOX%2Brr%2F8tY%3D&reserved=0\"> <span style=\"font-weight: 400;\">LGBT Ghanaians are still frequently victims of physical attacks</span></a><span style=\"font-weight: 400;\"> and have little recourse to justice as many are afraid to approach the police for fear of being exposed.</span>\r\n\r\n<span style=\"font-weight: 400;\">In every society, across time and place, some people gravitate toward members of the same sex, and some people do not conform to prevailing gender norms. How we understand these differences, and the meaning we give to them, are infinitely variable. But they are part and parcel of human experience. For instance, in</span><a href=\"https://nam02.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.tandfonline.com%2Fdoi%2Fabs%2F10.1080%2F08038740903117208&data=04%7C01%7Creidg%40hrw.org%7Ca2c976dd3b2e45bcdfcb08d957f74a09%7C2eb79de4d8044273a6e64b3188855f66%7C0%7C0%7C637637541892174289%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&sdata=mpFzXnlrmmjbY9fuQb1ADC55f7oD8jHybCzKjN9TwTE%3D&reserved=0\"> <span style=\"font-weight: 400;\">southern Ghana, the term </span><i><span style=\"font-weight: 400;\">supi</span></i></a><span style=\"font-weight: 400;\"> refers to intimate relations between women, though cloaked in secrecy.</span>\r\n\r\n<span style=\"font-weight: 400;\">Some say that a generation of activists, not content to live their lives in the shadows, have broken unwritten laws of silence and discretion. </span>\r\n\r\n<span style=\"font-weight: 400;\">Significantly, the bill bewails globalisation and seeks to restrict communication on social media, in a futile attempt to stop the global circulation of images, ideas and information that lawmakers say embolden LGBT activists while ignoring the role of global organisations such as the</span><a href=\"https://nam02.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.hrw.org%2Fnews%2F2019%2F10%2F31%2Fghana-should-resist-world-congress-families-anti-lgbt-message&data=04%7C01%7Creidg%40hrw.org%7Ca2c976dd3b2e45bcdfcb08d957f74a09%7C2eb79de4d8044273a6e64b3188855f66%7C0%7C0%7C637637541892174289%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&sdata=a2pCoWj%2BJPj5LxBWEpONK%2BDgngOawQgGyuqv2OJi9xA%3D&reserved=0\"> <span style=\"font-weight: 400;\">World Council of Families</span></a><span style=\"font-weight: 400;\"> (WCF), which made its presence felt in Ghana, by meeting in Accra in October 2019.</span>\r\n\r\n<span style=\"font-weight: 400;\">This group’s leaders have </span><a href=\"https://nam02.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.rightwingwatch.org%2Fpost%2Fworld-congress-of-families-preps-for-african-conference-with-supporters-of-anti-gay-laws-opponents-of-sex-ed%2F&data=04%7C01%7Creidg%40hrw.org%7Ca2c976dd3b2e45bcdfcb08d957f74a09%7C2eb79de4d8044273a6e64b3188855f66%7C0%7C0%7C637637541892184241%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&sdata=A02icNj5fVq6Adj6zHM8bN4sSJsgJ6wL%2F8gZKEpKPBU%3D&reserved=0\"><span style=\"font-weight: 400;\">promoted discriminatory laws</span></a><span style=\"font-weight: 400;\"> and policies around the world, including a</span><a href=\"https://nam02.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.hrw.org%2Fnews%2F2016%2F10%2F20%2Fnigeria-harsh-laws-severe-impact-lgbt-community&data=04%7C01%7Creidg%40hrw.org%7Ca2c976dd3b2e45bcdfcb08d957f74a09%7C2eb79de4d8044273a6e64b3188855f66%7C0%7C0%7C637637541892184241%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&sdata=%2BXccp4ajsq6y3%2F8eGSLwJlRyZrYuJSE%2FJc6IaFgFMK8%3D&reserved=0\"> <span style=\"font-weight: 400;\">Nigerian law</span></a><span style=\"font-weight: 400;\"> that punishes “displays of affection” between same-sex couples and support for gay organisations. Distasteful bedfellows, indeed.</span>\r\n\r\n<span style=\"font-weight: 400;\">There is political currency in this bill — for the lawmakers who proposed it. All but one of the bill’s sponsors are from the opposition National Democratic Congress party. It is a familiar tactic — scapegoating a minority, basking in the publicity, and using the ensuing moral panic to enhance political stature. Anyone opposed to the bill is cast as morally suspect.</span>\r\n\r\n<span style=\"font-weight: 400;\">But the bill will only tarnish Ghana’s reputation as a “beacon of democracy” in the region. In an unusual step, citing “human rights concerns”, Sidie Mohamed Tunis, Speaker of Parliament for the Economic Community of West African States,</span><a href=\"https://nam02.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.ghanaweb.com%2FGhanaHomePage%2FNewsArchive%2FSpeaker-of-ECOWAS-parliament-cautions-Ghana-against-anti-Gay-bill-1318795&data=04%7C01%7Creidg%40hrw.org%7Ca2c976dd3b2e45bcdfcb08d957f74a09%7C2eb79de4d8044273a6e64b3188855f66%7C0%7C0%7C637637541892194196%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&sdata=KUx%2BYl48zejErtxqO0wu%2FJDHuDGour%2BcTp7v9yAaJ1Q%3D&reserved=0\"> <span style=\"font-weight: 400;\">urged caution on the bill</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">Proponents of this law are positioning themselves as moral warriors. But these are no warriors. These are self-serving politicians, attacking the weakest and most vulnerable for short-term political gain. They ought to be pariahs. </span><b>MC/DM</b>",
