"contents": "<span style=\"font-weight: 400;\">A number of accusations of violations of international humanitarian law have been levelled against the Israeli government over the past three months, including collective punishment, the execution of surrendered Palestinians, the mass murder and detainment of children, the murder of at least 110 journalists and </span><a href=\"https://www.aljazeera.com/news/2023/12/19/we-have-a-duty-us-based-doctor-says-ceasefire-an-ethical-imperative-in-gaza\"><span style=\"font-weight: 400;\">more than 320 healthcare workers</span></a><span style=\"font-weight: 400;\">, attacks on refugee camps, hospitals, schools, universities and places of worship, and the use of </span><a href=\"https://www.undp.org/sites/g/files/zskgke326/files/2023-12/gaza_war_preliminary_findings_on_the_socio-economic_and_environmental_impact_on_lebanon.pdf\"><span style=\"font-weight: 400;\">white phosphorus</span></a><span style=\"font-weight: 400;\"> in areas with high population densities. Now, </span><a href=\"https://www.hrw.org/news/2023/12/18/israel-starvation-used-weapon-war-gaza\"><span style=\"font-weight: 400;\">the use of starvation as a weapon of war</span></a><span style=\"font-weight: 400;\"> must be added to this list. These charges will be heard by the International Court of Justice (ICJ) at The Hague on 11 and 12 January 2024.</span>\r\n\r\n<span style=\"font-weight: 400;\">On 29 December 2023, South Africa lodged an </span><a href=\"https://www.courthousenews.com/wp-content/uploads/2023/12/South-Africa-v-Israel.pdf\"><span style=\"font-weight: 400;\">application</span></a><span style=\"font-weight: 400;\"> with the ICJ that accuses the State of Israel of breaching the 1948 Genocide Convention, inter alia by “the starvation of civilians as a method of warfare” (paragraph 2) and “failure to provide or ensure essential food… for the besieged and blockaded Palestinian people, which has pushed them to the brink of famine” (paragraph 4). Genocide refers to acts committed in order “to destroy, in whole or in part, a national, ethnic, racial or religious group”, including “</span><a href=\"https://www.un.org/en/genocideprevention/genocide.shtml\"><span style=\"font-weight: 400;\">deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part</span></a><span style=\"font-weight: 400;\">”. In the context of the deliberately created ongoing food crisis in Gaza, the application mentions “food” 79 times, “hunger” 30 times, “starvation” 20 times, and “famine” five times. Specific acts of genocide identified in the application include “causing widespread hunger, dehydration and starvation to besieged Palestinians in Gaza” (paragraph 114(4)). Further, the convention provides that “direct and public incitement to commit genocide” is a crime in its own right.</span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-2008439\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2024/01/11934016.jpg\" alt=\"Gaza starvation\" width=\"720\" height=\"418\" /> <em>Palestinians line up for free food provided by a Palestinian youth group for displaced people in the Khan Younis refugee camp on 9 January 2024. (Photo: EPA-EFE / Haitham Imad)</em></p>\r\n\r\n<span style=\"font-weight: 400;\">Fewer than three months earlier, on 7 October 2023, Palestinian armed groups had launched an attack, targeting Israeli military installations and capturing military and civilian hostages, with a </span><a href=\"https://www.france24.com/en/live-news/20231215-israel-social-security-data-reveals-true-picture-of-oct-7-deaths\"><span style=\"font-weight: 400;\">reported civilian death toll</span></a><span style=\"font-weight: 400;\"> of 695 Israelis and 71 foreigners <em>(the Hamas' attack's total death toll was 1,139 - Ed)</em>. In response, </span><a href=\"https://www.timesofisrael.com/liveblog_entry/defense-minister-announces-complete-siege-of-gaza-no-power-food-or-fuel/\"><span style=\"font-weight: 400;\">Israeli defence minister Yoav Gallant</span></a><span style=\"font-weight: 400;\"> announced a complete and shockingly disproportionate siege on Gaza, cutting off essential supplies such as food, water, electricity and cooking gas.</span>\r\n\r\n<span style=\"font-weight: 400;\">Due to </span><a href=\"https://www.nybooks.com/online/2023/10/30/gazas-blocked-relief/\"><span style=\"font-weight: 400;\">Israel’s refusal to allow adequate humanitarian supplies into Gaza</span></a><span style=\"font-weight: 400;\">, only about 10% of the food the besieged residents need has been trucked in, </span><a href=\"https://www.cnbc.com/2023/11/18/the-un-stops-delivery-of-food-and-supplies-to-gaza.html\"><span style=\"font-weight: 400;\">according to the United Nations</span></a><span style=\"font-weight: 400;\"> (UN). By mid-November, the World Food Programme was already warning that </span><a href=\"https://www.cnbc.com/2023/11/18/the-un-stops-delivery-of-food-and-supplies-to-gaza.html\"><span style=\"font-weight: 400;\">“people are facing the immediate possibility of starvation”</span></a><span style=\"font-weight: 400;\">. By 10 December, it </span><a href=\"https://www.bbc.com/news/world-middle-east-67670679\"><span style=\"font-weight: 400;\">announced</span></a><span style=\"font-weight: 400;\"> that “half of Gaza’s population” (1.2 million people) were starving.</span>\r\n<blockquote><span style=\"font-weight: 400;\">Since the </span><span style=\"font-weight: 400;\">Israeli occupation</span><span style=\"font-weight: 400;\"> began in 1948, the Palestinian food system has been </span><span style=\"font-weight: 400;\">under assault</span><span style=\"font-weight: 400;\">.</span></blockquote>\r\n<span style=\"font-weight: 400;\">As noted by </span><a href=\"https://nymag.com/intelligencer/2023/10/the-u-s-is-giving-israel-permission-for-war-crimes.html\"><span style=\"font-weight: 400;\">Tufts University’s Tom Dannenbaum</span></a><span style=\"font-weight: 400;\">, this is “an abnormally clear-cut instance of starving civilians as a means of war, an unambiguous violation of human rights”.</span>\r\n\r\n<span style=\"font-weight: 400;\">This is compounded by tactics that target Gaza’s water supply, since safe water is a critical component of nutrition security. Despite Israel’s claim that it had resumed water supply to Gaza on 15 October, a number of sources report a </span><a href=\"https://www.theguardian.com/global-development/2023/nov/04/lack-of-clean-drinking-water-for-95-of-people-in-gaza-threatens-health-crisis\"><span style=\"font-weight: 400;\">polluted or only intermittent supply</span></a><span style=\"font-weight: 400;\">. Chemicals emanating from weapons used will or have already entered the water supply, and, </span><a href=\"https://www.haaretz.com/israel-news/2023-12-05/ty-article/israel-debating-using-seawater-to-flood-gaza-tunnels-report-says/0000018c-3909-dc03-a9ec-3d7b120a0000\"><span style=\"font-weight: 400;\">more recently</span></a><span style=\"font-weight: 400;\">, Israel stated its plans to pump seawater into underground tunnels, which would have dire consequences for the already crumbling water infrastructure.</span>\r\n\r\n<span style=\"font-weight: 400;\">Starvation is one of the most barbaric strategies used to wage war. It is wielded to kill slowly, to crush emotionally, and ultimately to obliterate. Limiting people’s access to food and water, and allowing them to teeter on the brink of starvation and famine, ensures dire and irreversible consequences that will endure for generations.</span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-2008438\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2024/01/11933959.jpg\" alt=\"\" width=\"720\" height=\"425\" /> <em>Spent shells litter the ground at the Erez crossing 9 January 2024. (Photo: EPA-EFE / Mohammed Saber)</em></p>\r\n<h4><b>A haunting history</b></h4>\r\n<span style=\"font-weight: 400;\">Before this latest siege, 80% of the population of Gaza already </span><a href=\"https://www.unicef.org/mena/press-releases/fifteen-years-blockade-gaza-strip\"><span style=\"font-weight: 400;\">relied on humanitarian aid</span></a><span style=\"font-weight: 400;\"> as their main source of food and nutrition. Now, as bakeries, community kitchens and food markets are bombed, taps run dry, crops are destroyed and access to international food aid is denied, we are haunted by memories of hunger being used as a weapon of war.</span>\r\n\r\n<span style=\"font-weight: 400;\">More than 2,000 years ago, Sun Tzu wrote in </span><i><span style=\"font-weight: 400;\">The Art of War</span></i><span style=\"font-weight: 400;\"> of the interconnectedness of war and food. Julius Caesar is believed to have used starvation as a weapon of war. In South Africa, Shaka used “scorched earth” tactics in his military campaigns, as did the British during the South African War.</span>\r\n\r\n<span style=\"font-weight: 400;\">During World War 2, Nazi Germany carried out “Der Hungerplan”. By blockading cities such as Leningrad, inhabitants were subjected to prolonged starvation, resulting in the deaths of at least one million civilians. In the Jewish ghettos in Poland, the Nazis controlled and rationed access to food at below-subsistence levels. The Nazi governor in occupied Poland wrote, “that we sentence 1.2 million Jews to die of hunger should be noted only marginally”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Also in World War 2, German occupying forces blockaded part of the Netherlands for several months in 1944, prohibiting all movements of food and directly causing thousands of deaths by starvation during the Dutch Hunger Winter.</span>\r\n\r\n<span style=\"font-weight: 400;\">While the famine in Ethiopia in the 1980s was triggered by drought and harvest failure, it took place during a civil war during which trade was restricted, markets in Tigray were bombed, and humanitarian access to affected areas was denied. More than half a million people died.</span>\r\n\r\n<span style=\"font-weight: 400;\">A 2021 report titled </span><a href=\"https://reliefweb.int/report/yemen/starvation-makers-use-starvation-warring-parties-yemen-method-warfare-enar\"><span style=\"font-weight: 400;\">“Starvation Makers: The use of starvation by warring parties in Yemen”</span></a><span style=\"font-weight: 400;\"> documents systematic violations of the right to food since the war began in 2015, including air strikes that targeted farms and irrigation infrastructure, fishing boats and water facilities, as well as restrictions on humanitarian relief that denied access to food and water to starving civilians. Disruptions to food systems and health services have had </span><a href=\"https://globalizationandhealth.biomedcentral.com/articles/10.1186/s12992-018-0354-9#:~:text=The%20decreasing%20vaccination%20rates%20among,as%20food%20availability%20and%20access\"><span style=\"font-weight: 400;\">devastating impacts on food and nutrition security</span></a><span style=\"font-weight: 400;\">. By 2020, the UN estimated that 131,000 out of 233,000 deaths during the ongoing war in Yemen were due to </span><a href=\"https://news.un.org/en/story/2020/12/1078972\"><span style=\"font-weight: 400;\">“indirect causes such as lack of food”</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-2008436\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2024/01/11925966.jpg\" alt=\"\" width=\"720\" height=\"455\" /> <em>Residents of the Al Nuseirat and Al Bureij refugee camps evacuate during Israeli military operations in the Gaza Strip on 4 January 2024. (Photo: EPA-EFE / Mohammed Saber)</em></p>\r\n<h4><b>Food crimes in Palestine</b></h4>\r\n<span style=\"font-weight: 400;\">Since the </span><a href=\"https://www.un.org/unispal/historical-timeline/\"><span style=\"font-weight: 400;\">Israeli occupation</span></a><span style=\"font-weight: 400;\"> began in 1948, the Palestinian food system has been </span><a href=\"https://pulitzercenter.org/stories/food-first-frontier-israeli-palestinian-conflict\"><span style=\"font-weight: 400;\">under assault</span></a><span style=\"font-weight: 400;\">. In addition to restrictions on marking and mobility, the destruction of crops has been a </span><a href=\"https://conflictandhealth.biomedcentral.com/articles/10.1186/s13031-022-00470-0\"><span style=\"font-weight: 400;\">frequently used</span></a><span style=\"font-weight: 400;\"> and widely criticised method of warfare by the Israeli government.</span>\r\n\r\n<span style=\"font-weight: 400;\">Olive groves, central to Palestinian livelihoods and culture, have been destroyed by Israeli forces, </span><a href=\"https://reliefweb.int/report/occupied-palestinian-territory/incursion-israeli-bulldozers-strip-destroys-crops\"><span style=\"font-weight: 400;\">both in times of conflict and in relative peace</span></a><span style=\"font-weight: 400;\">. In parts of Gaza such as Khan Younis, </span><a href=\"https://www.europarl.europa.eu/meetdocs/2014_2019/documents/dpal/dv/4c_pui_ara_factsheet_final_2016/4c_pui_ara_factsheet_final_2016en.pdf\"><span style=\"font-weight: 400;\">farmers require passes</span></a><span style=\"font-weight: 400;\"> to enter and tend to their land. </span>\r\n<blockquote>Where there is not immediate death and destruction by bombs and bullets, the deliberate use of hunger as a weapon of war is etched into the fabric of affected communities.</blockquote>\r\n<span style=\"font-weight: 400;\">Imports and exports are also strictly controlled by the Israeli regime, through the enforcement of a list of banned or restricted items, including dried fruits, coriander, jam and chocolate. Agricultural essentials such as fertilisers are hard to come by, having been deemed a potential ingredient for bomb-making.</span>\r\n\r\n<span style=\"font-weight: 400;\">In 2019, the UN Office for the Coordination of Humanitarian Affairs </span><a href=\"https://www.ochaopt.org/content/israel-expands-fishing-limits-12-nautical-miles-amidst-rise-protection-concerns\"><span style=\"font-weight: 400;\">noted that the expansion of Gaza’s fishing limits</span></a><span style=\"font-weight: 400;\"> by Israel was a positive development, but remained well below the nautical miles that were agreed at the 1993 Oslo Accords, which were therefore violated. As recently as </span><a href=\"https://www.aljazeera.com/news/2023/8/23/gaza-fisherfolk-can-only-dream-of-fishing-freely-under-israels-blockade\"><span style=\"font-weight: 400;\">August 2023</span></a><span style=\"font-weight: 400;\">, the fishing community in Gaza staged a sit-in to protest against the ongoing arrests of fisherfolk, seizure of boats and being “constantly chased, harassed, intimidated and even killed by Israeli forces”. Less than a month later, </span><a href=\"https://apnews.com/article/israel-gaza-blockade-fishermen-ban-ae136ae038da45b4bd6c175147a0c48f\"><span style=\"font-weight: 400;\">Israel closed Kerem Shalom</span></a><span style=\"font-weight: 400;\">, the main commercial crossing in Gaza, a further blow to fisherfolk and an already ailing economy.</span>\r\n\r\n<span style=\"font-weight: 400;\">The current conflict continues this pattern: During the harvest season in October and November 2023, many Palestinian farmers could not tend to their farms and livestock. Constant bombardment displaced farming families, cutting off their financial lifeline and main source of food. </span><a href=\"https://www.aljazeera.com/features/2023/11/6/our-hearts-burn-gazas-olive-farmers-say-israel-war-destroys-harvest\"><span style=\"font-weight: 400;\">According to reports</span></a><span style=\"font-weight: 400;\"> in early November, nearly 20 Palestinian farmers near Khan Younis had been killed.</span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-2008434\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2024/01/11849367-1-1.jpg\" alt=\"Gaza starvation\" width=\"720\" height=\"419\" /> <em>Health staff at the Emirates Crescent Hospital in Rafah in southern Gaza prepare premature babies for transfer to Egypt after they were evacuated from Gaza's Al-Shifa hospital on 20 November 2023. (Photo: EPA-EFE / Haitham Imad)</em></p>\r\n<h4><b>Slow, long-lasting violence</b></h4>\r\n<span style=\"font-weight: 400;\">In 2003, the </span><a href=\"https://www.un.org/unispal/document/auto-insert-186610/\"><span style=\"font-weight: 400;\">UN Special Rapporteur on the Right to Food</span></a><span style=\"font-weight: 400;\"> found a “terrible situation of malnutrition” in the Occupied Palestinian Territories, and concluded that, “although the Government of Israel, as the Occupying Power in the Territories, has the legal obligation under international law to ensure the right to food of the civilian Palestinian population, it is failing to meet this responsibility”. </span><a href=\"https://www.theguardian.com/world/2006/apr/16/israel\"><span style=\"font-weight: 400;\">Three years later</span></a><span style=\"font-weight: 400;\">, Dov Weisglass, an adviser to then prime minister Ehud Olmert, declared that, “the idea is to put the Palestinians on a diet, but not to make them die of hunger”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Throughout the 75-year occupation, international bodies and human rights watchdogs, among others including the </span><a href=\"https://www.haaretz.com/2012-10-17/ty-article/.premium/israels-gaza-quota-2-279-calories-a-day/0000017f-e0f2-d7b2-a77f-e3f755550000\"><span style=\"font-weight: 400;\">Israeli press</span></a><span style=\"font-weight: 400;\">, have voiced concern about the Israeli regime’s use of hunger as a weapon. In 2018, the UN Children’s Fund (</span><a href=\"https://www.unicef.org/sop/media/1091/file/Nutrition%20Assessment.pdf\"><span style=\"font-weight: 400;\">Unicef</span></a><span style=\"font-weight: 400;\">) reported an urgent need for strategic action to address child and maternal malnutrition in Gaza.</span>\r\n\r\n<span style=\"font-weight: 400;\">The urgency of this strategic action is grounded in the widely documented, irreversible impact of </span><a href=\"https://www.thelancet.com/journals/lancet/article/PIIS0140-6736(19)32472-9/fulltext\"><span style=\"font-weight: 400;\">malnourishment on a child’s health</span></a><span style=\"font-weight: 400;\"> and development. Children younger than five years and unborn children are particularly at risk, and the nutritional shock of the current hunger in Gaza can permanently constrain their physical and cognitive development. The low birth weights that are likely to result from maternal malnutrition will also increase the risk of infant mortality or disability. Polluted water supplies, the collapse of solid waste removal systems and poor sanitation increase the risk of child diarrhoea, further </span><a href=\"https://www.sciencedirect.com/science/article/abs/pii/S0043135419310188\"><span style=\"font-weight: 400;\">heightening the risk of chronic malnutrition</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<b>Read more in Daily Maverick: </b><a href=\"https://www.dailymaverick.co.za/middle-east-crisis-news-hub/\"><span style=\"font-weight: 400;\">Israel-Palestine War</span></a>\r\n\r\n<span style=\"font-weight: 400;\">The implications of weaponising starvation extend beyond immediate suffering and long-term malnutrition. Where there is not immediate death and destruction by bombs and bullets, the deliberate use of hunger as a weapon of war is etched into the fabric of affected communities, resulting in a lifetime of trauma and undermining the prospects for peace and reconciliation, possibly for generations.</span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-2008432\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2024/01/11849348.jpg\" alt=\"\" width=\"720\" height=\"469\" /> <em>Children hold placards and a toy baby covered in mock blood during a protest against child deaths in Palestine, to mark World Children's Day, in Istanbul, Turkey, on 20 November 2023. (Photo: EPA-EFE / Haitham Imad)</em></p>\r\n<h4><b>Call to action</b></h4>\r\n<span style=\"font-weight: 400;\">One of the most concerning aspects of Israel’s indiscriminate bombing of the people of Gaza is the role of its allies, especially the US, in endorsing and enabling this attack. The inability of the UN Security Council (UNSC) to uphold its humanitarian mandate was thrown into sharp focus when the US used its veto to prevent condemnation of Israel and protect civilian lives in Gaza, by calling for a ceasefire. Citizens across the world should demand an overhaul of the UNSC and its outdated and paralysing voting rules.</span>\r\n\r\n<span style=\"font-weight: 400;\">The right to adequate food is protected by the </span><a href=\"https://treaties.un.org/doc/treaties/1976/01/19760103%2009-57%20pm/ch_iv_03.pdf\"><span style=\"font-weight: 400;\">International Covenant on Economic, Social and Cultural Rights</span></a><span style=\"font-weight: 400;\">, which has been signed and ratified by 171 countries, including Israel. The intentional starvation of civilians is listed as a war crime in the </span><a href=\"https://www.icc-cpi.int/sites/default/files/RS-Eng.pdf\"><span style=\"font-weight: 400;\">Rome Statute of the International Criminal Court</span></a><span style=\"font-weight: 400;\">. The Israeli government should be investigated for war crimes in Gaza, and perpetrators should be prosecuted, as should those who have advocated the use of starvation. The South African government’s application to the ICJ, currently supported only by Turkey, Jordan, Malaysia and Bolivia, should be supported by other governments and by international agencies that are concerned with human rights, especially the rights of children to adequate nutrition.</span>\r\n\r\n<span style=\"font-weight: 400;\">If the permanent effects of chronic malnutrition are to be avoided, humanitarian assistance for Gaza is required at a large scale, immediately and without interference by the Israel Defense Forces. The low levels of child malnutrition following the siege of Sarajevo in the early 1990s were a </span><a href=\"https://opendocs.ids.ac.uk/opendocs/bitstream/handle/20.500.12413/8633/IDSB_33_4_10.1111-j.1759-5436.2002.tb00042.x.pdf?sequence=1\"><span style=\"font-weight: 400;\">result</span></a><span style=\"font-weight: 400;\"> of favourable food security conditions prior to the conflict, and the huge international response in terms of food aid. The first does not apply in Gaza, and the second is not yet forthcoming, making the need for food aid to Gaza all the more urgent.</span>\r\n\r\n<span style=\"font-weight: 400;\">Finally, a stronger response is needed from the university sector. Whatever our nationality, ethnicity, religion or politics, academics and academic institutions should unite to condemn violations of international law, wherever they occur and whoever perpetrates them. Rarely has the cliché been more apposite: This is not about politics, it is about our common humanity. </span><b>DM</b>\r\n\r\n<i><span style=\"font-weight: 400;\">Professor Stephen Devereux is a development economist working on food security, famine, rural livelihoods, social protection and poverty reduction issues. The conflict is complex and multifaceted, but at its core, it is a dispute over land and sovereignty.</p>\r\n<p data-sourcepos=\"3:1-3:348\">The conflict began in 1948, when Israel was declared a state on land that had been previously inhabited by Palestinians. The Palestinians were displaced from their homes, and many became refugees. Since then, there have been numerous wars and conflicts between Israel and Palestine, and the Palestinians have continued to seek a state of their own.</p>\r\n<p data-sourcepos=\"5:1-5:237\">Gaza is a Palestinian coastal enclave that is bordered by Israel and Egypt. Hamas is a Palestinian Islamist militant group that has controlled Gaza since 2006. Hamas is considered a terrorist organisation by Israel and the United States.</p>\r\n<p data-sourcepos=\"7:1-7:333\">The current Middle East conflict between Israel and Palestine began on October 7, 2023, when Hamas launched a surprise attack on Israel. Hamas fired rockets into Israel and stormed southern Israeli cities and towns across the border of the Gaza strip. The attack killed and injured hundreds of soldiers and civilians and took dozens of hostages.</p>\r\n<p data-sourcepos=\"9:1-9:227\">The attack took Israel by surprise, though the state quickly mounted a deadly retaliatory operation. The Israeli Defense Forces (IDF) launched airstrikes against Hamas targets in Gaza. The IDF also sent ground troops into Gaza.</p>\r\n<p data-sourcepos=\"11:1-11:218\">The conflict has been devastating for both sides. Thousands have died or have been injured.</p>\r\n<p data-sourcepos=\"13:1-13:238\">The conflict has also had a devastating impact on the infrastructure in Gaza. The IDF has destroyed hospitals, schools, and power plants. The United Nations estimates that more than 72,000 Palestinians have been displaced by the fighting.</p>\r\n<p data-sourcepos=\"15:1-15:261\">The international community has called for a cease-fire between Israel and Palestine to end the latest crisis in the Middle East. However, both sides have so far refused to agree to a cease-fire. The conflict is likely to continue for some time, and the humanitarian situation in Gaza is likely to worsen.</p>",

"description": "<span style=\"font-weight: 400;\">A number of accusations of violations of international humanitarian law have been levelled against the Israeli government over the past three months, including collective punishment, the execution of surrendered Palestinians, the mass murder and detainment of children, the murder of at least 110 journalists and </span><a href=\"https://www.aljazeera.com/news/2023/12/19/we-have-a-duty-us-based-doctor-says-ceasefire-an-ethical-imperative-in-gaza\"><span style=\"font-weight: 400;\">more than 320 healthcare workers</span></a><span style=\"font-weight: 400;\">, attacks on refugee camps, hospitals, schools, universities and places of worship, and the use of </span><a href=\"https://www.undp.org/sites/g/files/zskgke326/files/2023-12/gaza_war_preliminary_findings_on_the_socio-economic_and_environmental_impact_on_lebanon.pdf\"><span style=\"font-weight: 400;\">white phosphorus</span></a><span style=\"font-weight: 400;\"> in areas with high population densities. Now, </span><a href=\"https://www.hrw.org/news/2023/12/18/israel-starvation-used-weapon-war-gaza\"><span style=\"font-weight: 400;\">the use of starvation as a weapon of war</span></a><span style=\"font-weight: 400;\"> must be added to this list. These charges will be heard by the International Court of Justice (ICJ) at The Hague on 11 and 12 January 2024.</span>\r\n\r\n<span style=\"font-weight: 400;\">On 29 December 2023, South Africa lodged an </span><a href=\"https://www.courthousenews.com/wp-content/uploads/2023/12/South-Africa-v-Israel.pdf\"><span style=\"font-weight: 400;\">application</span></a><span style=\"font-weight: 400;\"> with the ICJ that accuses the State of Israel of breaching the 1948 Genocide Convention, inter alia by “the starvation of civilians as a method of warfare” (paragraph 2) and “failure to provide or ensure essential food… for the besieged and blockaded Palestinian people, which has pushed them to the brink of famine” (paragraph 4). Genocide refers to acts committed in order “to destroy, in whole or in part, a national, ethnic, racial or religious group”, including “</span><a href=\"https://www.un.org/en/genocideprevention/genocide.shtml\"><span style=\"font-weight: 400;\">deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part</span></a><span style=\"font-weight: 400;\">”. In the context of the deliberately created ongoing food crisis in Gaza, the application mentions “food” 79 times, “hunger” 30 times, “starvation” 20 times, and “famine” five times. Specific acts of genocide identified in the application include “causing widespread hunger, dehydration and starvation to besieged Palestinians in Gaza” (paragraph 114(4)). (Photo: EPA-EFE / Haitham Imad)</em>[/caption]\r\n\r\n<span style=\"font-weight: 400;\">Fewer than three months earlier, on 7 October 2023, Palestinian armed groups had launched an attack, targeting Israeli military installations and capturing military and civilian hostages, with a </span><a href=\"https://www.france24.com/en/live-news/20231215-israel-social-security-data-reveals-true-picture-of-oct-7-deaths\"><span style=\"font-weight: 400;\">reported civilian death toll</span></a><span style=\"font-weight: 400;\"> of 695 Israelis and 71 foreigners <em>(the Hamas' attack's total death toll was 1,139 - Ed)</em>. In response, </span><a href=\"https://www.timesofisrael.com/liveblog_entry/defense-minister-announces-complete-siege-of-gaza-no-power-food-or-fuel/\"><span style=\"font-weight: 400;\">Israeli defence minister Yoav Gallant</span></a><span style=\"font-weight: 400;\"> announced a complete and shockingly disproportionate siege on Gaza, cutting off essential supplies such as food, water, electricity and cooking gas.</span>\r\n\r\n<span style=\"font-weight: 400;\">Due to </span><a href=\"https://www.nybooks.com/online/2023/10/30/gazas-blocked-relief/\"><span style=\"font-weight: 400;\">Israel’s refusal to allow adequate humanitarian supplies into Gaza</span></a><span style=\"font-weight: 400;\">, only about 10% of the food the besieged residents need has been trucked in, </span><a href=\"https://www.cnbc.com/2023/11/18/the-un-stops-delivery-of-food-and-supplies-to-gaza.html\"><span style=\"font-weight: 400;\">according to the United Nations</span></a><span style=\"font-weight: 400;\"> (UN). By mid-November, the World Food Programme was already warning that </span><a href=\"https://www.cnbc.com/2023/11/18/the-un-stops-delivery-of-food-and-supplies-to-gaza.html\"><span style=\"font-weight: 400;\">“people are facing the immediate possibility of starvation”</span></a><span style=\"font-weight: 400;\">. By 10 December, it </span><a href=\"https://www.bbc.com/news/world-middle-east-67670679\"><span style=\"font-weight: 400;\">announced</span></a><span style=\"font-weight: 400;\"> that “half of Gaza’s population” (1.2 million people) were starving.</span>\r\n<blockquote><span style=\"font-weight: 400;\">Since the </span><span style=\"font-weight: 400;\">Israeli occupation</span><span style=\"font-weight: 400;\"> began in 1948, the Palestinian food system has been </span><span style=\"font-weight: 400;\">under assault</span><span style=\"font-weight: 400;\">.</span></blockquote>\r\n<span style=\"font-weight: 400;\">As noted by </span><a href=\"https://nymag.com/intelligencer/2023/10/the-u-s-is-giving-israel-permission-for-war-crimes.html\"><span style=\"font-weight: 400;\">Tufts University’s Tom Dannenbaum</span></a><span style=\"font-weight: 400;\">, this is “an abnormally clear-cut instance of starving civilians as a means of war, an unambiguous violation of human rights”.</span>\r\n\r\n<span style=\"font-weight: 400;\">This is compounded by tactics that target Gaza’s water supply, since safe water is a critical component of nutrition security. Despite Israel’s claim that it had resumed water supply to Gaza on 15 October, a number of sources report a </span><a href=\"https://www.theguardian.com/global-development/2023/nov/04/lack-of-clean-drinking-water-for-95-of-people-in-gaza-threatens-health-crisis\"><span style=\"font-weight: 400;\">polluted or only intermittent supply</span></a><span style=\"font-weight: 400;\">. Chemicals emanating from weapons used will or have already entered the water supply, and, </span><a href=\"https://www.haaretz.com/israel-news/2023-12-05/ty-article/israel-debating-using-seawater-to-flood-gaza-tunnels-report-says/0000018c-3909-dc03-a9ec-3d7b120a0000\"><span style=\"font-weight: 400;\">more recently</span></a><span style=\"font-weight: 400;\">, Israel stated its plans to pump seawater into underground tunnels, which would have dire consequences for the already crumbling water infrastructure.</span>\r\n\r\n<span style=\"font-weight: 400;\">Starvation is one of the most barbaric strategies used to wage war. It is wielded to kill slowly, to crush emotionally, and ultimately to obliterate. Limiting people’s access to food and water, and allowing them to teeter on the brink of starvation and famine, ensures dire and irreversible consequences that will endure for generations.</span>\r\n\r\n[caption id=\"attachment_2008438\" align=\"alignnone\" width=\"720\"]<img class=\"size-full wp-image-2008438\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2024/01/11933959.jpg\" alt=\"\" width=\"720\" height=\"425\" /> <em>Spent shells litter the ground at the Erez crossing 9 January 2024. (Photo: EPA-EFE / Mohammed Saber)</em>[/caption]\r\n<h4><b>A haunting history</b></h4>\r\n<span style=\"font-weight: 400;\">Before this latest siege, 80% of the population of Gaza already </span><a href=\"https://www.unicef.org/mena/press-releases/fifteen-years-blockade-gaza-strip\"><span style=\"font-weight: 400;\">relied on humanitarian aid</span></a><span style=\"font-weight: 400;\"> as their main source of food and nutrition. Now, as bakeries, community kitchens and food markets are bombed, taps run dry, crops are destroyed and access to international food aid is denied, we are haunted by memories of hunger being used as a weapon of war.</span>\r\n\r\n<span style=\"font-weight: 400;\">More than 2,000 years ago, Sun Tzu wrote in </span><i><span style=\"font-weight: 400;\">The Art of War</span></i><span style=\"font-weight: 400;\"> of the interconnectedness of war and food. Julius Caesar is believed to have used starvation as a weapon of war. In South Africa, Shaka used “scorched earth” tactics in his military campaigns, as did the British during the South African War.</span>\r\n\r\n<span style=\"font-weight: 400;\">During World War 2, Nazi Germany carried out “Der Hungerplan”. By blockading cities such as Leningrad, inhabitants were subjected to prolonged starvation, resulting in the deaths of at least one million civilians. In the Jewish ghettos in Poland, the Nazis controlled and rationed access to food at below-subsistence levels. The Nazi governor in occupied Poland wrote, “that we sentence 1.2 million Jews to die of hunger should be noted only marginally”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Also in World War 2, German occupying forces blockaded part of the Netherlands for several months in 1944, prohibiting all movements of food and directly causing thousands of deaths by starvation during the Dutch Hunger Winter.</span>\r\n\r\n<span style=\"font-weight: 400;\">While the famine in Ethiopia in the 1980s was triggered by drought and harvest failure, it took place during a civil war during which trade was restricted, markets in Tigray were bombed, and humanitarian access to affected areas was denied. More than half a million people died.</span>\r\n\r\n<span style=\"font-weight: 400;\">A 2021 report titled </span><a href=\"https://reliefweb.int/report/yemen/starvation-makers-use-starvation-warring-parties-yemen-method-warfare-enar\"><span style=\"font-weight: 400;\">“Starvation Makers: The use of starvation by warring parties in Yemen”</span></a><span style=\"font-weight: 400;\"> documents systematic violations of the right to food since the war began in 2015, including air strikes that targeted farms and irrigation infrastructure, fishing boats and water facilities, as well as restrictions on humanitarian relief that denied access to food and water to starving civilians. Disruptions to food systems and health services have had </span><a href=\"https://globalizationandhealth.biomedcentral.com/articles/10.1186/s12992-018-0354-9#:~:text=The%20decreasing%20vaccination%20rates%20among,as%20food%20availability%20and%20access\"><span style=\"font-weight: 400;\">devastating impacts on food and nutrition security</span></a><span style=\"font-weight: 400;\">. By 2020, the UN estimated that 131,000 out of 233,000 deaths during the ongoing war in Yemen were due to </span><a href=\"https://news.un.org/en/story/2020/12/1078972\"><span style=\"font-weight: 400;\">“indirect causes such as lack of food”</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n[caption id=\"attachment_2008436\" align=\"alignnone\" width=\"720\"]<img class=\"size-full wp-image-2008436\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2024/01/11925966.jpg\" alt=\"\" width=\"720\" height=\"455\" /> <em>Residents of the Al Nuseirat and Al Bureij refugee camps evacuate during Israeli military operations in the Gaza Strip on 4 January 2024. (Photo: EPA-EFE / Mohammed Saber)</em>[/caption]\r\n<h4><b>Food crimes in Palestine</b></h4>\r\n<span style=\"font-weight: 400;\">Since the </span><a href=\"https://www.un.org/unispal/historical-timeline/\"><span style=\"font-weight: 400;\">Israeli occupation</span></a><span style=\"font-weight: 400;\"> began in 1948, the Palestinian food system has been </span><a href=\"https://pulitzercenter.org/stories/food-first-frontier-israeli-palestinian-conflict\"><span style=\"font-weight: 400;\">under assault</span></a><span style=\"font-weight: 400;\">. In addition to restrictions on marking and mobility, the destruction of crops has been a </span><a href=\"https://conflictandhealth.biomedcentral.com/articles/10.1186/s13031-022-00470-0\"><span style=\"font-weight: 400;\">frequently used</span></a><span style=\"font-weight: 400;\"> and widely criticised method of warfare by the Israeli government.</span>\r\n\r\n<span style=\"font-weight: 400;\">Olive groves, central to Palestinian livelihoods and culture, have been destroyed by Israeli forces, </span><a href=\"https://reliefweb.int/report/occupied-palestinian-territory/incursion-israeli-bulldozers-strip-destroys-crops\"><span style=\"font-weight: 400;\">both in times of conflict and in relative peace</span></a><span style=\"font-weight: 400;\">. In parts of Gaza such as Khan Younis, </span><a href=\"https://www.europarl.europa.eu/meetdocs/2014_2019/documents/dpal/dv/4c_pui_ara_factsheet_final_2016/4c_pui_ara_factsheet_final_2016en.pdf\"><span style=\"font-weight: 400;\">farmers require passes</span></a><span style=\"font-weight: 400;\"> to enter and tend to their land. </span>\r\n<blockquote>Where there is not immediate death and destruction by bombs and bullets, the deliberate use of hunger as a weapon of war is etched into the fabric of affected communities.</blockquote>\r\n<span style=\"font-weight: 400;\">Imports and exports are also strictly controlled by the Israeli regime, through the enforcement of a list of banned or restricted items, including dried fruits, coriander, jam and chocolate. Agricultural essentials such as fertilisers are hard to come by, having been deemed a potential ingredient for bomb-making.</span>\r\n\r\n<span style=\"font-weight: 400;\">In 2019, the UN Office for the Coordination of Humanitarian Affairs </span><a href=\"https://www.ochaopt.org/content/israel-expands-fishing-limits-12-nautical-miles-amidst-rise-protection-concerns\"><span style=\"font-weight: 400;\">noted that the expansion of Gaza’s fishing limits</span></a><span style=\"font-weight: 400;\"> by Israel was a positive development, but remained well below the nautical miles that were agreed at the 1993 Oslo Accords, which were therefore violated. As recently as </span><a href=\"https://www.aljazeera.com/news/2023/8/23/gaza-fisherfolk-can-only-dream-of-fishing-freely-under-israels-blockade\"><span style=\"font-weight: 400;\">August 2023</span></a><span style=\"font-weight: 400;\">, the fishing community in Gaza staged a sit-in to protest against the ongoing arrests of fisherfolk, seizure of boats and being “constantly chased, harassed, intimidated and even killed by Israeli forces”. Less than a month later, </span><a href=\"https://apnews.com/article/israel-gaza-blockade-fishermen-ban-ae136ae038da45b4bd6c175147a0c48f\"><span style=\"font-weight: 400;\">Israel closed Kerem Shalom</span></a><span style=\"font-weight: 400;\">, the main commercial crossing in Gaza, a further blow to fisherfolk and an already ailing economy.</span>\r\n\r\n<span style=\"font-weight: 400;\">The current conflict continues this pattern: During the harvest season in October and November 2023, many Palestinian farmers could not tend to their farms and livestock. Constant bombardment displaced farming families, cutting off their financial lifeline and main source of food. </span><a href=\"https://www.aljazeera.com/features/2023/11/6/our-hearts-burn-gazas-olive-farmers-say-israel-war-destroys-harvest\"><span style=\"font-weight: 400;\">According to reports</span></a><span style=\"font-weight: 400;\"> in early November, nearly 20 Palestinian farmers near Khan Younis had been killed.</span>\r\n\r\n[caption id=\"attachment_2008434\" align=\"alignnone\" width=\"720\"]<img class=\"size-full wp-image-2008434\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2024/01/11849367-1-1.jpg\" alt=\"Gaza starvation\" width=\"720\" height=\"419\" /> <em>Health staff at the Emirates Crescent Hospital in Rafah in southern Gaza prepare premature babies for transfer to Egypt after they were evacuated from Gaza's Al-Shifa hospital on 20 November 2023. (Photo: EPA-EFE / Haitham Imad)</em>[/caption]\r\n<h4><b>Slow, long-lasting violence</b></h4>\r\n<span style=\"font-weight: 400;\">In 2003, the </span><a href=\"https://www.un.org/unispal/document/auto-insert-186610/\"><span style=\"font-weight: 400;\">UN Special Rapporteur on the Right to Food</span></a><span style=\"font-weight: 400;\"> found a “terrible situation of malnutrition” in the Occupied Palestinian Territories, and concluded that, “although the Government of Israel, as the Occupying Power in the Territories, has the legal obligation under international law to ensure the right to food of the civilian Palestinian population, it is failing to meet this responsibility”. </span><a href=\"https://www.theguardian.com/world/2006/apr/16/israel\"><span style=\"font-weight: 400;\">Three years later</span></a><span style=\"font-weight: 400;\">, Dov Weisglass, an adviser to then prime minister Ehud Olmert, declared that, “the idea is to put the Palestinians on a diet, but not to make them die of hunger”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Throughout the 75-year occupation, international bodies and human rights watchdogs, among others including the </span><a href=\"https://www.haaretz.com/2012-10-17/ty-article/.premium/israels-gaza-quota-2-279-calories-a-day/0000017f-e0f2-d7b2-a77f-e3f755550000\"><span style=\"font-weight: 400;\">Israeli press</span></a><span style=\"font-weight: 400;\">, have voiced concern about the Israeli regime’s use of hunger as a weapon. In 2018, the UN Children’s Fund (</span><a href=\"https://www.unicef.org/sop/media/1091/file/Nutrition%20Assessment.pdf\"><span style=\"font-weight: 400;\">Unicef</span></a><span style=\"font-weight: 400;\">) reported an urgent need for strategic action to address child and maternal malnutrition in Gaza.</span>\r\n\r\n<span style=\"font-weight: 400;\">The urgency of this strategic action is grounded in the widely documented, irreversible impact of </span><a href=\"https://www.thelancet.com/journals/lancet/article/PIIS0140-6736(19)32472-9/fulltext\"><span style=\"font-weight: 400;\">malnourishment on a child’s health</span></a><span style=\"font-weight: 400;\"> and development. Children younger than five years and unborn children are particularly at risk, and the nutritional shock of the current hunger in Gaza can permanently constrain their physical and cognitive development. The low birth weights that are likely to result from maternal malnutrition will also increase the risk of infant mortality or disability. Polluted water supplies, the collapse of solid waste removal systems and poor sanitation increase the risk of child diarrhoea, further </span><a href=\"https://www.sciencedirect.com/science/article/abs/pii/S0043135419310188\"><span style=\"font-weight: 400;\">heightening the risk of chronic malnutrition</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<b>Read more in Daily Maverick: </b><a href=\"https://www.dailymaverick.co.za/middle-east-crisis-news-hub/\"><span style=\"font-weight: 400;\">Israel-Palestine War</span></a>\r\n\r\n<span style=\"font-weight: 400;\">The implications of weaponising starvation extend beyond immediate suffering and long-term malnutrition. (Photo: EPA-EFE / Haitham Imad)</em>[/caption]\r\n<h4><b>Call to action</b></h4>\r\n<span style=\"font-weight: 400;\">One of the most concerning aspects of Israel’s indiscriminate bombing of the people of Gaza is the role of its allies, especially the US, in endorsing and enabling this attack. The inability of the UN Security Council (UNSC) to uphold its humanitarian mandate was thrown into sharp focus when the US used its veto to prevent condemnation of Israel and protect civilian lives in Gaza, by calling for a ceasefire. Citizens across the world should demand an overhaul of the UNSC and its outdated and paralysing voting rules.</span>\r\n\r\n<span style=\"font-weight: 400;\">The right to adequate food is protected by the </span><a href=\"https://treaties.un.org/doc/treaties/1976/01/19760103%2009-57%20pm/ch_iv_03.pdf\"><span style=\"font-weight: 400;\">International Covenant on Economic, Social and Cultural Rights</span></a><span style=\"font-weight: 400;\">, which has been signed and ratified by 171 countries, including Israel. The intentional starvation of civilians is listed as a war crime in the </span><a href=\"https://www.icc-cpi.int/sites/default/files/RS-Eng.pdf\"><span style=\"font-weight: 400;\">Rome Statute of the International Criminal Court</span></a><span style=\"font-weight: 400;\">. The Israeli government should be investigated for war crimes in Gaza, and perpetrators should be prosecuted, as should those who have advocated the use of starvation. The South African government’s application to the ICJ, currently supported only by Turkey, Jordan, Malaysia and Bolivia, should be supported by other governments and by international agencies that are concerned with human rights, especially the rights of children to adequate nutrition.</span>\r\n\r\n<span style=\"font-weight: 400;\">If the permanent effects of chronic malnutrition are to be avoided, humanitarian assistance for Gaza is required at a large scale, immediately and without interference by the Israel Defense Forces. The low levels of child malnutrition following the siege of Sarajevo in the early 1990s were a </span><a href=\"https://opendocs.ids.ac.uk/opendocs/bitstream/handle/20.500.12413/8633/IDSB_33_4_10.1111-j.1759-5436.2002.tb00042.x.pdf?sequence=1\"><span style=\"font-weight: 400;\">result</span></a><span style=\"font-weight: 400;\"> of favourable food security conditions prior to the conflict, and the huge international response in terms of food aid. The first does not apply in Gaza, and the second is not yet forthcoming, making the need for food aid to Gaza all the more urgent.</span>\r\n\r\n<span style=\"font-weight: 400;\">Finally, a stronger response is needed from the university sector. Whatever our nationality, ethnicity, religion or politics, academics and academic institutions should unite to condemn violations of international law, wherever they occur and whoever perpetrates them.
