"contents": "<span style=\"font-weight: 400;\">New Chief Justice Raymond Zondo will only have about two years in his role at the helm of the South African judiciary — and at a media briefing on Thursday the judge indicated the need to be “realistic” about what he can achieve during that time frame.</span>\r\n\r\n<span style=\"font-weight: 400;\">His number one priority, Zondo said, is to extend the work already undertaken by former Chief Justices to protect the institutional independence of the South African judiciary.</span>\r\n\r\n<span style=\"font-weight: 400;\">Zondo described this independence as “critical to sustaining our constitutional democracy”.</span>\r\n\r\n<span style=\"font-weight: 400;\">He said that the ongoing allegations of judicial capture — which have been made by prominent public figures including EFF leader Julius Malema and Public Protector Busisiwe Mkhwebane — were “very serious”, and “should not be made lightly by anybody”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Zondo continued: “It is not in the interests of anybody who loves this country to portray the judiciary as captured. If anybody has any evidence… they must come forward.”</span>\r\n\r\n<span style=\"font-weight: 400;\">The incoming Chief Justice said that calls had been made in the past for anybody accusing judges of accepting bribes to approach the Judicial Conduct Committee with their evidence, but: “I’m not aware of anybody who has come forward.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Zondo’s press conference took place in a week when another public challenge to the judiciary by a politician made headlines. On this occasion, </span><a href=\"https://www.dailymaverick.co.za/article/2022-03-23-going-retrograde-zikalalas-questioning-of-concourt-supremacy-opens-a-new-front-in-anc-leadership-battle/\"><span style=\"font-weight: 400;\">KwaZulu-Natal Premier Sihle Zikalala questioned</span></a><span style=\"font-weight: 400;\"> whether the Constitutional Court should have the power to override policies adopted by Parliament. This follows the attack on the integrity of judges launched by Tourism Minister Lindiwe Sisulu earlier this year.</span>\r\n\r\nhttps://www.dailymaverick.co.za/article/2022-03-23-going-retrograde-zikalalas-questioning-of-concourt-supremacy-opens-a-new-front-in-anc-leadership-battle/\r\n\r\n<span style=\"font-weight: 400;\">Zikalala “may be disgruntled about certain decisions”, said Zondo, but “they are in line with the Constitution”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Zondo also defended the Gauteng High Court, which has been accused in recent years — particularly by those aligned with the Radical Economic Transformation faction of the ANC — of routinely favouring the administration of President Cyril Ramaphosa in its rulings.</span>\r\n\r\n<span style=\"font-weight: 400;\">Acknowledging these allegations, the judge said he had “yet to see any of [these critics] who have taken the trouble to look at various judgments, analyse them, and show how it can be said that the decisions that have been arrived at in those judgments… are simply a manifestation of a biased mind on the part of the judges concerned”.</span>\r\n\r\n<span style=\"font-weight: 400;\">A questionable judgment does not mean that the “judge is captured”, Zondo said; it might simply be “a wrong decision arrived at in good faith”. He cautioned that the public “should be slow to impute all kinds of motives when judges perform their duties”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Zondo himself has also faced allegations of bias: in his case, due to his role chairing the State Capture inquiry. Journalists asked him to respond to claims that the State Capture reports released thus far have failed to rigorously scrutinise the conduct of Ramaphosa, and in particular, have failed to investigate Ramaphosa’s funding for his campaign for leadership of the ANC in 2017.</span>\r\n\r\n<span style=\"font-weight: 400;\">It has been implied that Zondo’s perceived omissions in this regard were essentially a </span><i><span style=\"font-weight: 400;\">quid pro quo</span></i><span style=\"font-weight: 400;\"> for the role of Chief Justice.</span>\r\n\r\n<span style=\"font-weight: 400;\">Zondo defended the decision not to look into the CR17 funding as part of the State Capture inquiry because he believed that the Public Protector was investigating the matter, and he saw “no need for us to have processes which duplicate each other”.</span>\r\n\r\n<span style=\"font-weight: 400;\">He reiterated his belief that the judiciary must be “fearlessly independent”, and said this responsibility was heightened when it came to positions of judicial leadership.</span>\r\n\r\n<span style=\"font-weight: 400;\">“I will never not make a finding against someone because of anything other than [the fact that] there is no evidence, or [that] the law doesn’t support that,” Zondo stated.</span>\r\n\r\nhttps://www.dailymaverick.co.za/article/2022-03-25-gautengs-new-r1-2bn-covid-19-icu-hospitals-still-lie-abandoned-unfinished-or-underused/\r\n\r\n<span style=\"font-weight: 400;\">Yet these avowals are unlikely to silence the voices of those who have made their opposition to Zondo’s appointment clear — among them, the EFF, whose leader Malema is a highly vocal member of the Judicial Service Commission (JSC) responsible for making recommendations on the appointment of judges.</span>\r\n\r\n<span style=\"font-weight: 400;\">It was pointed out that the record of voting released by the JSC following its shambolic Chief Justice interviews showed that the body ranked Zondo as the least eligible of four candidates. How does Zondo intend to deal with the increasingly chaotic JSC?</span>\r\n\r\n<span style=\"font-weight: 400;\">“I have absolutely no doubt in my mind that now that the President has made his [Chief Justice] decision, all members of the JSC will work very well with me,” Zondo said.</span>\r\n\r\n<span style=\"font-weight: 400;\">He noted that when he chaired the proceedings of the JSC in October 2021 he enjoyed “absolute cooperation and respect” from all members — including Malema.</span>\r\n\r\n<span style=\"font-weight: 400;\">The ever-diplomatic judge would not be drawn into criticism of the JSC, but said that there is already a meeting scheduled for commissioners on 4 April to discuss the mandate of the body, and “issues that may be of concern to some members of the public and some members of the JSC”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Zondo said he was confident that the JSC would “intensely discuss its entire mandate” at this meeting.</span>\r\n\r\n<span style=\"font-weight: 400;\">Zondo formally takes office as Chief Justice on 1 April, and for his first month will still be engaged with the finalisation of the State Capture reports. The penultimate batch is due at the end of March, and the final deadline is the end of April.</span>\r\n\r\n<span style=\"font-weight: 400;\">At least two of the implicated figures in the already published State Capture reports — Mineral Resources Minister Gwede Mantashe and former SAA chairperson Dudu Myeni — have already signalled their intention to take the reports on legal review.</span>\r\n\r\n<span style=\"font-weight: 400;\">Zondo said he did not expect the post-State Capture litigation to consume his time drastically. He explained that the reports were deliberately drafted in a detailed way to present the relevant evidence comprehensively and show that the inquiry’s conclusions “are not just findings it makes just out of nowhere”.</span>\r\n\r\n<span style=\"font-weight: 400;\">He added that during the month in which his two roles — as chair of the State Capture inquiry and Chief Justice — will overlap, he was confident that he could count on the support of his colleagues in judicial leadership to assist him.</span>\r\n\r\n<span style=\"font-weight: 400;\">The State Capture inquiry has meant four years of gruelling work for Zondo, who told the JSC in his Chief Justice interview that at some points he had to go without any sleep.</span>\r\n\r\n<span style=\"font-weight: 400;\">Asked by </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\"> on Thursday what he does to relax, the new Chief Justice laughed heartily.</span>\r\n\r\n<span style=\"font-weight: 400;\">“When did I last have fun?” Zondo wondered out loud. </span><b>DM</b>\r\n\r\n \r\n\r\n<i><span style=\"font-weight: 400;\">[hearken id=\"daily-maverick/9303\"]</span></i>",

"description": "<span style=\"font-weight: 400\">Gwede Mantashe is a South African politician and the current Minister of Mineral Resources and Energy within the African National Congress (ANC). </span>\r\n\r\n<span style=\"font-weight: 400\">The portfolio was called the Ministry of Minerals and Energy until May 2009, when President Jacob Zuma split it into two separate portfolios under the Ministry of Mining (later the Ministry of Mineral Resources) and the Ministry of Energy. Ten years later, in May 2019, his successor President Cyril Ramaphosa reunited the portfolios as the Ministry of Mineral Resources and Energy. </span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe</span><span style=\"font-weight: 400\"> was born in 1955 in the Eastern Cape province, and began his working life at Western Deep Levels mine in 1975 as a Recreation Officer and, in the same year, moved to Prieska Copper Mines where he was Welfare Officer until 1982.</span>\r\n\r\n<span style=\"font-weight: 400\">He then joined Matla Colliery and co-founded the Witbank branch of the National Union of Mine Workers (NUM), becoming its Chairperson. He held the position of NUM Regional Secretary in 1985. Mantashe showcased his skills and leadership within the NUM, serving as the National Organiser from 1988 to 1993 and as the Regional Coordinator from 1993 to 1994.</span>\r\n\r\n<span style=\"font-weight: 400\">From 1994 to 1998, Mantashe held the role of Assistant General Secretary of the NUM and was later elected General Secretary in 1998.</span>\r\n\r\n<span style=\"font-weight: 400\">During his initial tenure in government, Mantashe served as a Councillor in the Ekurhuleni Municipality from 1995 to 1999. Notably, he made history by becoming the first trade unionist appointed to the Board of Directors of a Johannesburg Stock Exchange-listed company, Samancor.</span>\r\n\r\n<span style=\"font-weight: 400\">In May 2006, Mantashe stepped down as the General Secretary of the NUM and took on the role of Executive Director at the Development Bank of Southern Africa for a two-year period. He also chaired the Technical Working Group of the Joint Initiative for Priority Skills Acquisition.</span>\r\n\r\n<span style=\"font-weight: 400\">In 2007, Mantashe became the Chairperson of the South African Communist Party and a member of its Central Committee. He was elected Secretary-General of the African National Congress (ANC) at the party's 52nd National Conference in December 2007. Mantashe was re-elected to the same position in 2012. Additionally, at the ANC's 54th National Conference in 2017, he was elected as the National Chairperson.</span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe is a complex and controversial figure. He has been accused of being too close to the ANC's corrupt leadership, and of being a hardliner who is opposed to reform. </span>\r\n\r\n<span style=\"font-weight: 400\">His actions and statements have sparked controversy and allegations of protecting corruption, undermining democratic principles, and prioritising party loyalty over the interests of the country.</span>",
