On 6 April 2022, her husband, Elvis Nyathi, was beaten and burnt to death. He had been chased out of the family home by at least 30 Operation Dudula vigilantes, demanding to see proof that they were legally residing in South Africa.</span>\r\n\r\n<span style=\"font-weight: 400;\">Seven of the attackers have since been arrested and are awaiting trial, which starts this month. In 2010, the South African Human Rights Commission</span><a href=\"https://www.sahrc.org.za/home/21/files/Report%20on%20the%20SAHRC%20Investigation%20into%20Issues%20of%20Rule%20of%20Law,%20Justice%20and%20Impunity%20arising%20out%20of%20the%202008%20Public%20Violence%20against%20Non-Nationals.pdf\"> <span style=\"font-weight: 400;\">report</span></a><span style=\"font-weight: 400;\"> on the 2008 xenophobic violence noted that undocumented immigrants often did not report crimes perpetrated against them to the police, fearing that they would be detained for illegally residing in the country. </span>\r\n\r\n<span style=\"font-weight: 400;\">How many key witnesses to the</span><a href=\"https://www.dailymaverick.co.za/article/2022-04-19-timeline-of-hatred-and-death-xenophobia-and-south-africas-record-of-shame/\"> <span style=\"font-weight: 400;\">84 lives lost directly to xenophobic violence</span></a><span style=\"font-weight: 400;\"> since 2008, have also failed to testify because of this fear? More recent</span><a href=\"https://apcof.org/wp-content/uploads/policing-and-non-nationals-external-police-oversight-accountability-and-xenophobic-violence-in-south-africa-.pdf\"> <span style=\"font-weight: 400;\">work by the African Policing Civilian Oversight Forum</span></a><span style=\"font-weight: 400;\"> (Apcof) suggests that the number could be significant. Drawing on research from the past decade, it suggests under-reporting of both crime and police misconduct by foreign nationals, driven in part by concerns about both the capacity and willingness of SAPS to address their safety and security needs.</span>\r\n\r\n<span style=\"font-weight: 400;\">This situation is incompatible with the constitutional requirement that the police deliver equitable services to all people who live in South Africa, regardless of their national or ethnic origin or immigration status.</span>\r\n\r\n<span style=\"font-weight: 400;\">Addressing systemic issues in policing and policing culture in South Africa is not a quick or easy fix. (Photo: New Frame / Ihsaan Haffejee)</p>\r\n<h4><b>U visas</b></h4>\r\n<span style=\"font-weight: 400;\">To address similar challenges of access to justice, the US introduced the</span><a href=\"https://www.uscis.gov/humanitarian/victims-of-human-trafficking-and-other-crimes/victims-of-criminal-activity-u-nonimmigrant-status#:~:text=The%20U%20nonimmigrant%20status%20(U,or%20prosecution%20of%20criminal%20activity.\"> <span style=\"font-weight: 400;\">U visa facility</span></a><span style=\"font-weight: 400;\">, which enables undocumented non-nationals to report crimes and participate in the criminal justice system without fear of deportation. It guarantees temporary residence and work for four years to an undocumented migrant while their case is finalised. This allows victims to cooperate with police during investigations and enables them to participate in court trials. </span>\r\n\r\n<span style=\"font-weight: 400;\">Since the introduction of the U visa in 2000, it has been instrumental in helping undocumented migrants engage the criminal justice system. The</span><a href=\"https://cis.org/Report/Visas-Victims-Look-U-Visa-Program\"> <span style=\"font-weight: 400;\">USCIS reports</span></a><span style=\"font-weight: 400;\"> that from 2009 to 2018, there were 170,478 U visa petitions approved, of which 96,314 were victims and 74,164 were victims’ family members. This means at least 96,000 undocumented migrants were able to report crime and aid the police in investigation. It also means that more than 170,000 previously undocumented migrants are now accounted for within their system, due to the service provided by the U visa.</span>\r\n\r\n<p><a href=\"https://www.dailymaverick.co.za/ngcobo-briefs-media-on-sa-healthcare-findings-3/\"><img loading=\"lazy\" class=\"size-full wp-image-1310691\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/06/AV_00075137.jpg\" alt=\"minister suzman foundation\" width=\"720\" height=\"360\" /></a> Home Affairs Minister Aaron Motsoaledi. (Photo: Gallo Images / Sunday Times / Alon Skuy)</p>\r\n\r\n<span style=\"font-weight: 400;\">The importance of a U visa to the criminal justice system was illustrated in 2013, when a mother risked deportation</span><a href=\"https://abcnews.go.com/ABC_Univision/visas-problem-victim-visa/story?id=18357347\"> <span style=\"font-weight: 400;\">by reporting her boyfriend</span></a><span style=\"font-weight: 400;\"> to the police for raping her 13-year-old daughter. After reporting the crime, both the mother and daughter were denied government-aided therapy to deal with the trauma of the abuse because they were non-legal. Only once they were granted U visa certification were they able to access these resources and get the help they needed. The mother was also able to apply for work legally, effectively severing her financial dependence on her child’s abuser.</span>\r\n\r\n<span style=\"font-weight: 400;\">This is only one example of how the U visa can help victims come forward, identify and testify against their attackers, and also help victims and family members receive adequate care.</span>\r\n\r\n<span style=\"font-weight: 400;\">A temporary permit similar to the U visa could help reduce the barriers that prevent undocumented migrants in South Africa from reporting crimes and participating in courts because</span><a href=\"https://www.nilc.org/issues/workersrights/how-the-u-visa-can-protect-immigrant-workers/\"> <span style=\"font-weight: 400;\">they are protected and incentivised to do so</span></a><span style=\"font-weight: 400;\">. The mother was also able to apply for work legally, effectively severing her financial dependence on her child’s abuser.</span>\r\n\r\n<span style=\"font-weight: 400;\">This is only one example of how the U visa can help victims come forward, identify and testify against their attackers, and also help victims and family members receive adequate care.</span>\r\n\r\n<span style=\"font-weight: 400;\">A temporary permit similar to the U visa could help reduce the barriers that prevent undocumented migrants in South Africa from reporting crimes and participating in courts because</span><a href=\"https://www.nilc.org/issues/workersrights/how-the-u-visa-can-protect-immigrant-workers/\"> <span style=\"font-weight: 400;\">they are protected and incentivised to do so</span></a><span style=\"font-weight: 400;\">.
