"contents": "<span style=\"font-weight: 400;\">Residents of the historic fishing village of Kalk Bay have gone to battle against a local proprietor and businessman to prevent further commercial encroachment on a public beach.</span>\r\n\r\n<span style=\"font-weight: 400;\">The Brass Bell restaurant in Kalk Bay </span><span style=\"font-weight: 400;\">–</span><span style=\"font-weight: 400;\"> located along the railway line and adjacent to the Kalk Bay Train Station </span><span style=\"font-weight: 400;\">–</span><span style=\"font-weight: 400;\"> came under scrutiny after it began construction on the last remaining area of beach surrounding one of the Kalk Bay tidal pools, prompting the City of Cape Town to intervene. </span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-1223079\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/04/9E7A5508.jpg\" alt=\"\" width=\"720\" height=\"480\" /> The entrance to the Brass Bell restaurant and Kalk Bay tidal pools, underneath the Kalk Bay Station on 31 March 2022. (Photo: Daily Maverick/Victoria O’Regan)</p>\r\n\r\n<span style=\"font-weight: 400;\">A small protest was held at the Brass Bell on Wednesday morning, 30 March, where local residents called for an end to the construction, which would see the expansion of a wooden deck over a large area surrounding the children’s tidal pool. </span>\r\n\r\n<span style=\"font-weight: 400;\">This is not the first time that residents have protested against Brass Bell owner Tony White’s expansion into public spaces. The development plans are detailed in a heritage impact assessment which is currently circulating for public comment, the </span><a href=\"https://www.timeslive.co.za/sunday-times/news/2022-03-20-not-cool-by-the-pool-kalk-bay-tycoons-plan-ruffles-worlds-coolest-neighbourhood/\"><i><span style=\"font-weight: 400;\">Sunday Times </span></i></a><span style=\"font-weight: 400;\">reported.</span><span style=\"font-weight: 400;\">\r\n</span>\r\n\r\n<span style=\"font-weight: 400;\">Another protest is planned for Saturday, 2 April, at the establishment.</span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-1223075\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/04/038bbe0b-4eee-403c-91ad-759535e7ac5c.jpg\" alt=\"\" width=\"720\" height=\"720\" /> A protest is planned at the Brass Bell on Wednesday morning, 30 March, against the construction, which would see the expansion of a wooden deck over a large area surrounding the children’s tidal pool.</p>\r\n\r\n<span style=\"font-weight: 400;\">Owner of the Brass Bell, Tony White said the plan was to build a 3 x 7 metre wooden deck to “enhance the experience of patrons to the Brass Bell”. </span>\r\n\r\n<span style=\"font-weight: 400;\">The deck would provide patrons with an area to sunbathe without getting covered in sea sand, and would be on the same level as the sand and the same colour as the sand, according to White. </span>\r\n\r\n<span style=\"font-weight: 400;\">The land is owned by the Passenger Rail Agency of South Africa (Prasa) and is leased to the Brass Bell restaurant for commercial purposes. The City of Cape Town confirmed to </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\"> that it does not have a copy of the lease agreement or the conditions. </span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-1223085\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/04/WhatsApp-Image-2022-03-30-at-4.29.55-PM-2.jpeg\" alt=\"\" width=\"720\" height=\"960\" /> <strong>30 March 2022:</strong> The start of construction of a new 3m x 7m deck over the remaining area of beach at the Kalk Bay tidal pools near the public children’s tidal pool area, at Brass Bell restaurant on 30 March 2022. (Photo: Supplied)</p>\r\n\r\n<span style=\"font-weight: 400;\">The area of the site in which the construction of the deck has begun, consists of a sandy “beach” area with a small children’s pool, which White claims “</span><span style=\"font-weight: 400;\">is part of the restaurant and leased to the Brass Bell by Prasa”. </span>\r\n\r\n<span style=\"font-weight: 400;\">The construction took place within 100 metres of the high water mark, which in terms of the National Environmental Management Act (Nema) requires an Environmental Impact Assessment. The City of Cape Town told </span><a href=\"https://www.groundup.org.za/article/slippery-slope-public-access-kalk-bay-tidal-pools/\"><span style=\"font-weight: 400;\">GroundUp</span></a><span style=\"font-weight: 400;\"> that “although the work is within 100m of the high-water mark, a determination also has to be made as to whether it is a pre-disturbed footprint or not”.</span>\r\n\r\n<span style=\"font-weight: 400;\">“I had no idea that an unobtrusive deck that size would need formal approval by Prasa. (Photo: Supplied)</p>\r\n\r\n<span style=\"font-weight: 400;\">The City of Cape Town’s coastal management branch was alerted to the new construction activities at Brass Bell on Tuesday evening, 29 March, according to the City of Cape Town’s deputy mayor and Mayco Member for Spatial Planning and Environment, Alderman Eddie Andrews. </span>\r\n\r\n<span style=\"font-weight: 400;\">“We immediately engaged with Prasa on the matter and went on site on Wednesday morning, 30 March, with a representative from the National Department of Forestry, Fisheries and the Environment (DFFE) Oceans and Coasts Environmental Compliance. </span>\r\n\r\n<span style=\"font-weight: 400;\">On Wednesday morning, the City’s coastal management branch requested the Brass Bell to cease all construction activities. On our request, Prasa CRES [Corporate Real Estate Solutions] then also provided written instruction to the Brass Bell to cease all construction activities,” Andrews told </span><i><span style=\"font-weight: 400;\">Daily Maverick.</span></i>\r\n\r\n<span style=\"font-weight: 400;\">A meeting between the City, Prasa and the DFFE Oceans and Coasts Environmental Compliance has been scheduled for next week. </span>\r\n\r\n<span style=\"font-weight: 400;\">“All issues and aspects will be discussed at this meeting, as well as the way forward,” said Andrews. </span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-1223081\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/04/9E7A5498.jpg\" alt=\"\" width=\"720\" height=\"480\" /> Brass Bell restaurant in Kalk Bay is located along the railway line and adjacent to the Kalk Bay Train Station, and surrounds the Kalk Bay tidal pools. (Photo: Daily Maverick/Victoria O’Regan)</p>\r\n\r\n<span style=\"font-weight: 400;\">The land on which the Kalk Bay tidal pools </span><span style=\"font-weight: 400;\">–</span><span style=\"font-weight: 400;\"> which include two adjoining pools and a smaller children’s pool </span><span style=\"font-weight: 400;\">–</span><span style=\"font-weight: 400;\"> and the Brass Bell restaurant are located, is “steeped in heritage and historical importance”, said </span><span style=\"font-weight: 400;\">fifth-generation fisherman in Kalk Bay and representative of the small-scale fishing community, Faez Poggenpoel. </span>\r\n\r\n<span style=\"font-weight: 400;\">The Kalk Bay tidal pools attract thousands of visitors at Christmas and New Year, mostly from the Kalk Bay fishing community.</span>\r\n\r\n<span style=\"font-weight: 400;\">However, to get to the pools, swimmers must go through the Brass Bell restaurant, which has expanded substantially over the years, and now forms a large area around the pools.</span>\r\n\r\n<span style=\"font-weight: 400;\">“Effectively what [Brass Bell] has done is they’ve privatised a public amenity with deep historical value and importance to the local community. The area is steeped in heritage but Prasa, [White] and the City really don’t care about that </span><span style=\"font-weight: 400;\">–</span><span style=\"font-weight: 400;\"> it’s about commercialisation of the property and it’s through the detriment and the exclusion of the fishing community and locals who want to use those tidal pools,” </span><span style=\"font-weight: 400;\">Poggenpoel told </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\">.</span><span style=\"font-weight: 400;\"> </span>\r\n\r\n<span style=\"font-weight: 400;\">According to the chairman of the Kalk Bay and St James Residents and Ratepayers Association, Tony Trimmel, “the public amenity has been taken away from the public incrementally over the years and used for commercial purposes” and public attempts to thwart previous construction have been unsuccessful. </span>\r\n\r\n<span style=\"font-weight: 400;\">Back in December, 2012, Kalk Bay residents complained after White extended another deck onto the beach near the tidal pool in December 2012 without public participation. </span>\r\n\r\n<span style=\"font-weight: 400;\">Following an investigation by the provincial Department of Environmental Affairs and Development Planning which found that he had contravened the National Environmental Management Act (Nema) by building the decks, White was ordered to adjust the deck extensions in compliance with Nema, in 2013. </span>\r\n\r\n<span style=\"font-weight: 400;\">“The decks were never demolished and remain there to this day providing patrons with a very popular and well-loved amenity,” White told </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\">.</span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-1223083\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/04/9E7A5500.jpg\" alt=\"\" width=\"720\" height=\"480\" /> Brass Bell restaurant in Kalk Bay (left) surrounds the historic Kalk Bay tidal pools, on 31 March 2022. (Photo: Daily Maverick/Victoria O’Regan)</p>\r\n\r\n<span style=\"font-weight: 400;\">Following the incident, the City of Cape Town signed a memorandum of agreement with the Brass Bell and Prasa in September 2014, which ended the impasse over public access to the coastline and construction in the tidal pool vicinity. However, the memorandum of agreement expired in December 2020. </span>\r\n\r\n<span style=\"font-weight: 400;\">Andrews said the City adopted a coastal by-law in 2020 which ensures the right of public access to the entire coastline and coastal amenities.</span>\r\n\r\n<span style=\"font-weight: 400;\">“The by-law is a more effective instrument to protect public rights than the original memorandum of agreement. The City protects public access to the tidal pools, shoreline and harbour area at Kalk Bay by enforcing the provisions of this by-law,” said Andrews, adding the Brass Bell had been “formally informed that should they prevent public access they will be served with a legal notice in terms of the Coastal by-law”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Prasa had not responded to </span><i><span style=\"font-weight: 400;\">Daily Maverick’s</span></i><span style=\"font-weight: 400;\"> queries at the time of publication. </span><b>DM</b>",

The development plans are detailed in a heritage impact assessment which is currently circulating for public comment, the </span><a href=\"https://www.timeslive.co.za/sunday-times/news/2022-03-20-not-cool-by-the-pool-kalk-bay-tycoons-plan-ruffles-worlds-coolest-neighbourhood/\"><i><span style=\"font-weight: 400;\">Sunday Times </span></i></a><span style=\"font-weight: 400;\">reported.</span><span style=\"font-weight: 400;\">\r\n</span>\r\n\r\n<span style=\"font-weight: 400;\">Another protest is planned for Saturday, 2 April, at the establishment.</span>\r\n\r\n[caption id=\"attachment_1223075\" align=\"alignnone\" width=\"720\"]<img class=\"size-full wp-image-1223075\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/04/038bbe0b-4eee-403c-91ad-759535e7ac5c.jpg\" alt=\"\" width=\"720\" height=\"720\" /> A protest is planned at the Brass Bell on Wednesday morning, 30 March, against the construction, which would see the expansion of a wooden deck over a large area surrounding the children’s tidal pool.[/caption]\r\n\r\n<span style=\"font-weight: 400;\">Owner of the Brass Bell, Tony White said the plan was to build a 3 x 7 metre wooden deck to “enhance the experience of patrons to the Brass Bell”. </span>\r\n\r\n<span style=\"font-weight: 400;\">The deck would provide patrons with an area to sunbathe without getting covered in sea sand, and would be on the same level as the sand and the same colour as the sand, according to White. </span>\r\n\r\n<span style=\"font-weight: 400;\">The land is owned by the Passenger Rail Agency of South Africa (Prasa) and is leased to the Brass Bell restaurant for commercial purposes. (Photo: Supplied)[/caption]\r\n\r\n<span style=\"font-weight: 400;\">The area of the site in which the construction of the deck has begun, consists of a sandy “beach” area with a small children’s pool, which White claims “</span><span style=\"font-weight: 400;\">is part of the restaurant and leased to the Brass Bell by Prasa”. </span>\r\n\r\n<span style=\"font-weight: 400;\">The construction took place within 100 metres of the high water mark, which in terms of the National Environmental Management Act (Nema) requires an Environmental Impact Assessment. The City of Cape Town told </span><a href=\"https://www.groundup.org.za/article/slippery-slope-public-access-kalk-bay-tidal-pools/\"><span style=\"font-weight: 400;\">GroundUp</span></a><span style=\"font-weight: 400;\"> that “although the work is within 100m of the high-water mark, a determination also has to be made as to whether it is a pre-disturbed footprint or not”.</span>\r\n\r\n<span style=\"font-weight: 400;\">“I had no idea that an unobtrusive deck that size would need formal approval by Prasa. (Photo: Supplied)[/caption]\r\n\r\n<span style=\"font-weight: 400;\">The City of Cape Town’s coastal management branch was alerted to the new construction activities at Brass Bell on Tuesday evening, 29 March, according to the City of Cape Town’s deputy mayor and Mayco Member for Spatial Planning and Environment, Alderman Eddie Andrews. </span>\r\n\r\n<span style=\"font-weight: 400;\">“We immediately engaged with Prasa on the matter and went on site on Wednesday morning, 30 March, with a representative from the National Department of Forestry, Fisheries and the Environment (DFFE) Oceans and Coasts Environmental Compliance. </span>\r\n\r\n<span style=\"font-weight: 400;\">On Wednesday morning, the City’s coastal management branch requested the Brass Bell to cease all construction activities. (Photo: Daily Maverick/Victoria O’Regan)[/caption]\r\n\r\n<span style=\"font-weight: 400;\">The land on which the Kalk Bay tidal pools </span><span style=\"font-weight: 400;\">–</span><span style=\"font-weight: 400;\"> which include two adjoining pools and a smaller children’s pool </span><span style=\"font-weight: 400;\">–</span><span style=\"font-weight: 400;\"> and the Brass Bell restaurant are located, is “steeped in heritage and historical importance”, said </span><span style=\"font-weight: 400;\">fifth-generation fisherman in Kalk Bay and representative of the small-scale fishing community, Faez Poggenpoel. </span>\r\n\r\n<span style=\"font-weight: 400;\">The Kalk Bay tidal pools attract thousands of visitors at Christmas and New Year, mostly from the Kalk Bay fishing community.</span>\r\n\r\n<span style=\"font-weight: 400;\">However, to get to the pools, swimmers must go through the Brass Bell restaurant, which has expanded substantially over the years, and now forms a large area around the pools.</span>\r\n\r\n<span style=\"font-weight: 400;\">“Effectively what [Brass Bell] has done is they’ve privatised a public amenity with deep historical value and importance to the local community. The area is steeped in heritage but Prasa, [White] and the City really don’t care about that </span><span style=\"font-weight: 400;\">–</span><span style=\"font-weight: 400;\"> it’s about commercialisation of the property and it’s through the detriment and the exclusion of the fishing community and locals who want to use those tidal pools,” </span><span style=\"font-weight: 400;\">Poggenpoel told </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\">.</span><span style=\"font-weight: 400;\"> </span>\r\n\r\n<span style=\"font-weight: 400;\">According to the chairman of the Kalk Bay and St James Residents and Ratepayers Association, Tony Trimmel, “the public amenity has been taken away from the public incrementally over the years and used for commercial purposes” and public attempts to thwart previous construction have been unsuccessful. </span>\r\n\r\n<span style=\"font-weight: 400;\">Back in December, 2012, Kalk Bay residents complained after White extended another deck onto the beach near the tidal pool in December 2012 without public participation. </span>\r\n\r\n<span style=\"font-weight: 400;\">Following an investigation by the provincial Department of Environmental Affairs and Development Planning which found that he had contravened the National Environmental Management Act (Nema) by building the decks, White was ordered to adjust the deck extensions in compliance with Nema, in 2013. </span>\r\n\r\n<span style=\"font-weight: 400;\">“The decks were never demolished and remain there to this day providing patrons with a very popular and well-loved amenity,” White told </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\">.</span>\r\n\r\n[caption id=\"attachment_1223083\" align=\"alignnone\" width=\"720\"]<img class=\"size-full wp-image-1223083\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/04/9E7A5500.jpg\" alt=\"\" width=\"720\" height=\"480\" /> Brass Bell restaurant in Kalk Bay (left) surrounds the historic Kalk Bay tidal pools, on 31 March 2022. (Photo: Daily Maverick/Victoria O’Regan)[/caption]\r\n\r\n<span style=\"font-weight: 400;\">Following the incident, the City of Cape Town signed a memorandum of agreement with the Brass Bell and Prasa in September 2014, which ended the impasse over public access to the coastline and construction in the tidal pool vicinity. However, the memorandum of agreement expired in December 2020. </span>\r\n\r\n<span style=\"font-weight: 400;\">Andrews said the City adopted a coastal by-law in 2020 which ensures the right of public access to the entire coastline and coastal amenities.</span>\r\n\r\n<span style=\"font-weight: 400;\">“The by-law is a more effective instrument to protect public rights than the original memorandum of agreement. The City protects public access to the tidal pools, shoreline and harbour area at Kalk Bay by enforcing the provisions of this by-law,” said Andrews, adding the Brass Bell had been “formally informed that should they prevent public access they will be served with a legal notice in terms of the Coastal by-law”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Prasa had not responded to </span><i><span style=\"font-weight: 400;\">Daily Maverick’s</span></i><span style=\"font-weight: 400;\"> queries at the time of publication. </span><b>DM</b>",
