"contents": "<i><span style=\"font-weight: 400;\">First published by </span></i><a href=\"https://www.groundup.org.za/article/lotteries-act-regulations-face-legal-challenge/\"><i><span style=\"font-weight: 400;\">GroundUp</span></i></a>\r\n\r\n<span style=\"font-weight: 400;\">Regulations in the Lotteries Act that the National Lotteries Commission (NLC) has used to hide from accusations of fraud and corruption are to face a </span><a href=\"https://drive.google.com/file/d/1Khxz0B_qEXc_vULKp1-XEdl6Juaf8mk0/view?usp=sharing\"><span style=\"font-weight: 400;\">constitutional challenge</span></a><span style=\"font-weight: 400;\"> in court.</span>\r\n\r\n<span style=\"font-weight: 400;\">GroundUp’s investigation into the Lottery since 2018 has </span><a href=\"https://www.groundup.org.za/topic/lotto/\"><span style=\"font-weight: 400;\">uncovered </span></a><span style=\"font-weight: 400;\">corruption, maladministration and nepotism involving Lottery grants running into hundreds of millions of rands. But the investigation has been marked by the refusal of the National Lotteries Commission (NLC) to disclose details of projects funded by it, citing regulations in the Lotteries Act.</span>\r\n\r\n<span style=\"font-weight: 400;\">Now papers are to </span><a href=\"https://drive.google.com/file/d/1p6jw_Y8enFf-v1Zq1BRYammWkX8VmWtP/view?usp=sharing\"><span style=\"font-weight: 400;\">be served</span></a><span style=\"font-weight: 400;\"> on Trade, Industry and Competition Minister Ebrahim Patel, who has oversight responsibility for the NLC, challenging the constitutionality of these regulations.</span>\r\n\r\n<span style=\"font-weight: 400;\">The application in the Gauteng High Court by the </span><a href=\"https://sanef.org.za/\"><span style=\"font-weight: 400;\">South African Editors Forum (SANEF)</span></a><span style=\"font-weight: 400;\"> and </span><a href=\"https://mediamonitoringafrica.org/\"><span style=\"font-weight: 400;\">Media Monitoring Africa (MMA)</span></a><span style=\"font-weight: 400;\"> seeks to have </span><a href=\"https://drive.google.com/file/d/1ZIJZkW4j7Kh1GFTOVk0Jg7lavIQFnaax/view?usp=sharing\"><span style=\"font-weight: 400;\">a regulation in the Lotteries Act</span></a><span style=\"font-weight: 400;\"> declared unconstitutional and invalid and set aside. Because the matter involves a constitutional issue, lawyers acting for SANEF and MMA, </span><a href=\"https://drive.google.com/file/d/1W_2m739xblNPZ9Ldxo3jzfLCJpjQxHha/view?usp=sharing\"><span style=\"font-weight: 400;\">have filed notice</span></a><span style=\"font-weight: 400;\"> of this with the court.</span>\r\n\r\n<span style=\"font-weight: 400;\">The papers have already been served on the NLC, United Civil Society in Action (UCSA) and GroundUp, who are all named as respondents. The service of the papers on the Minister is “under way”, according to Dario Milo, who is acting for SANEF and MMA. Both UCSA and the NLC claim that these regulations protect the confidentiality of recipients of Lottery grants.</span>\r\n\r\n<span style=\"font-weight: 400;\">But the papers make it clear that “relief” is only being sought from Patel and not from any of the other parties.</span>\r\n\r\n<span style=\"font-weight: 400;\">Three grounds are stated as reasons for challenging the constitutionality of the regulations:</span>\r\n<ul>\r\n \t<li>They are an “unjustifiable” limitation to the right to freedom of expression that is enshrined in <a href=\"https://drive.google.com/file/d/1BVsnw7QugtTMsxkxfNBmw7U6-DdCfNlw/view?usp=sharing\">Section 16 (1)</a> of the South African Constitution;</li>\r\n \t<li>They are “unconstitutionally and impermissibly vague”;</li>\r\n \t<li>And, they are <a href=\"https://www.investopedia.com/terms/u/ultra-vires-acts.asp\">ultra vires</a> - beyond the authority and powers - of the Lotteries Act.</li>\r\n</ul>\r\n<span style=\"font-weight: 400;\">Alternatively, SANEF and MMA are asking for a “publication in the public interest” clause to be inserted into the regulations.</span>\r\n\r\n<span style=\"font-weight: 400;\">Several organisations have joined the SANEF/MMA action as </span><a href=\"http://www.scielo.org.za/scielo.php?script=sci_arttext&pid=S1996-20962016000100012#:~:text=Amicus%20curiae%20is%20a%20well,'friend%20of%20the%20court'.&text=Of%20equal%20importance%20has%20been,the%20South%20African%20legal%20system.\"><span style=\"font-weight: 400;\">amicus curiae</span></a><span style=\"font-weight: 400;\"> (Friends of the Court). They are </span><a href=\"https://www.corruptionwatch.org.za/?gclid=EAIaIQobChMIu_bixeH36gIVjO3tCh3ZZwuREAAYASAAEgJsAvD_BwE\"><span style=\"font-weight: 400;\">Corruption Watch</span></a><span style=\"font-weight: 400;\">, </span><a href=\"https://www.corruptionwatch.org.za/?gclid=EAIaIQobChMIu_bixeH36gIVjO3tCh3ZZwuREAAYASAAEgJsAvD_BwE\"><span style=\"font-weight: 400;\">Child Welfare SA</span></a><span style=\"font-weight: 400;\">, </span><a href=\"https://www.corruptionwatch.org.za/?gclid=EAIaIQobChMIu_bixeH36gIVjO3tCh3ZZwuREAAYASAAEgJsAvD_BwE\"><span style=\"font-weight: 400;\">Epilepsy SA, SA Federation for Mental Health,</span></a> <a href=\"https://www.corruptionwatch.org.za/?gclid=EAIaIQobChMIu_bixeH36gIVjO3tCh3ZZwuREAAYASAAEgJsAvD_BwE\"><span style=\"font-weight: 400;\">SAVF,</span></a> <a href=\"https://www.corruptionwatch.org.za/?gclid=EAIaIQobChMIu_bixeH36gIVjO3tCh3ZZwuREAAYASAAEgJsAvD_BwE\"><span style=\"font-weight: 400;\">RATA Social Services,</span></a> <a href=\"https://www.corruptionwatch.org.za/?gclid=EAIaIQobChMIu_bixeH36gIVjO3tCh3ZZwuREAAYASAAEgJsAvD_BwE\"><span style=\"font-weight: 400;\">Give a Child a Family,</span></a> <a href=\"https://www.corruptionwatch.org.za/?gclid=EAIaIQobChMIu_bixeH36gIVjO3tCh3ZZwuREAAYASAAEgJsAvD_BwE\"><span style=\"font-weight: 400;\">Sinani KZN Programme for Survivors of Violence and </span></a><a href=\"http://ttbc.org.za/\"><span style=\"font-weight: 400;\">The Teddy Bear Clinic for Abused Children</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">In a legal opinion last month, Chief Parliamentary Legal Adviser Advocate Z Adhikarie found that the regulation being used by the NLC to withhold information about grants would not “</span><a href=\"https://www.groundup.org.za/article/parliament-order-national-lotteries-commission-hand-over-details-all-its-grants/\"><span style=\"font-weight: 400;\">withstand constitutional scrutiny</span></a><span style=\"font-weight: 400;\">”.</span>\r\n\r\n<span style=\"font-weight: 400;\">And under growing pressure from Parliament’s Trade, Industry and Competitions Portfolio Committee, the NLC finally </span><a href=\"https://www.groundup.org.za/article/lottery-bows-pressure-and-releases-grant-details/\"><span style=\"font-weight: 400;\">released the grant details</span></a><span style=\"font-weight: 400;\"> that it had withheld.</span>\r\n\r\n<span style=\"font-weight: 400;\">Kate Skinner, SANEF Executive Director, said the matter was important because the constitutional principle of access to information was “critical for democracy”. “We believe it is essential that public institutions are as transparent as possible.” She said the prohibitions in the regulations extended even to situations “in which the disclosure or publication of information would be in the public interest – for instance, in order to bring to light allegations of corruption or maladministration regarding the manner in which public funds are being spent.”</span>\r\n\r\n<span style=\"font-weight: 400;\">“This is unacceptable. Journalists must have the right to uncover corruption and mismanagement of these very important public funds.”</span>\r\n\r\n<span style=\"font-weight: 400;\">William Bird, director of Media Monitoring Africa, said that the regulation was “patently unconstitutional.”</span>\r\n\r\n<span style=\"font-weight: 400;\">“A failure to act against this regulation wouldn’t only allow some to try to use it again to hide their misdeeds, it would also signal to others in and outside of the state that the public doesn’t have a problem with corruption.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Another “key reason” for challenging the regulations was the protection of “our basic rights”, Bird said. “Freedom of expression matters not just because it means the media can help hold the powerful accountable, it matters because it is central to democracy. Each time one of our journalists is threatened, our democracy is undermined.
