"contents": "<span style=\"font-weight: 400;\">The National Lotteries Commission spent almost R1.5-million in two financial years to litigate against the minister responsible for the lottery when he attempted to stem the </span><a href=\"https://groundup.org.za/topic/lotto/\"><span style=\"font-weight: 400;\">rampant corruption</span></a><span style=\"font-weight: 400;\"> that had overwhelmed the organisation.</span>\r\n\r\n<span style=\"font-weight: 400;\">New Minister of Trade, Industry and Competition, Parks Tau, revealed the expenditure on litigation against his predecessor, Ebrahim Patel, in a response to written questions from DA MP Toby Chance.</span>\r\n\r\n<span style=\"font-weight: 400;\">Chance had asked for details of (the National Lotteries Commission’s) legal and consultants’ costs “relating directly or indirectly to the ministry, any media house or journalist and parliamentarian”.</span>\r\n\r\n<span style=\"font-weight: 400;\">The “lawfare” revealed in Tau’s response was incurred during the 2019/20 and 2021/22 financial years.</span>\r\n\r\n<span style=\"font-weight: 400;\">Tau </span><a href=\"https://groundup.org.za/media/uploads/documents/lawfare_cases.pdf\"><span style=\"font-weight: 400;\">listed</span></a><span style=\"font-weight: 400;\"> several matters in which the National Lotteries Commission had litigated against Patel.</span>\r\n\r\n<span style=\"font-weight: 400;\">Patel </span><a href=\"https://groundup.org.za/media/uploads/documents/20220927_-_nlc_the_dtic_presentation_owIN7kp.pdf\"><span style=\"font-weight: 400;\">told Parliament</span></a><span style=\"font-weight: 400;\"> in 2022 how “lawfare” and a “fightback campaign” were launched against him when he tried to address National Lotteries Commission governance issues and hold its board and executive to account.</span>\r\n<h4><b>‘Cynically and brazenly stolen’</b></h4>\r\n<span style=\"font-weight: 400;\">Patel said that “funds of the National Lotteries Commission meant for the most vulnerable communities and projects (old-age homes, drug rehab centres and centres for young children), were cynically and brazenly stolen by an organised syndicate of persons”.</span>\r\n\r\n<span style=\"font-weight: 400;\">“Syndicates responsible for looting public funds were able to rely on a network of professional firms that enabled the monies to be redirected, and these syndicates had sophisticated methods to cover up their actions and deflect attention,” he said.</span>\r\n\r\n<span style=\"font-weight: 400;\">“Courageous individuals, ranging from whistle-blowers to journalists and investigators, were essential to uncovering wrongdoing and showing the channels through which monies flowed between the National Lotteries Commission and recipients, bypassing the intended community beneficiaries.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Patel listed nine legal actions as examples of the commission’s strategy of costly and sustained litigation against him that was funded by public money.</span>\r\n\r\n<span style=\"font-weight: 400;\">He said: “When it was apparent that the department was serious about acting against corruption, various measures were put in place by third parties and individuals in the National Lotteries Commission to frustrate the department.”</span>\r\n\r\n<span style=\"font-weight: 400;\">These included:</span>\r\n<ul>\r\n \t<li>In March 2020, a large number of people were “bussed in at great expense” to protest outside his office against <a href=\"https://groundup.org.za/article/national-lotteries-commission-refuses-release-list-beneficiaries/\">the disclosure of information</a> about the identity of individual beneficiaries. (The commission finally relented when the portfolio committee <a href=\"https://groundup.org.za/article/parliament-order-national-lotteries-commission-hand-over-details-all-its-grants/\">ordered</a> that the details of its beneficiaries be disclosed.)</li>\r\n \t<li>Threats of legal action and letters from attorneys “which appeared to be orchestrated and required detailed responses to be formulated”.</li>\r\n \t<li>Cases launched at the high court and in one matter, a petition to the Supreme Court of Appeal.</li>\r\n \t<li>Reports of arson, tampering with vehicles and action against whistle-blowers.</li>\r\n \t<li>Numerous “anonymous and libellous attacks in the print and social media against an investigative journalist (this reporter) and the Ministry” and its “motives for seeking to investigate the allegations of corruption”.</li>\r\n</ul>\r\n<span style=\"font-weight: 400;\">Patel eventually prevailed. A new National Lotteries Commission board and commissioner were appointed, and it appears that they have made a concerted effort to improve the institution’s governance.</span>\r\n<h4><b>Litigation against the minister</b></h4>\r\n<span style=\"font-weight: 400;\">Litigation against Patel included an application by former National Lotteries Commission commissioner </span><a href=\"https://groundup.org.za/article/lottery-boss-resigns-with-immediate-effect/\"><span style=\"font-weight: 400;\">Thabang Mampane</span></a><span style=\"font-weight: 400;\"> to force him to appoint a new commission board. Her application was launched just days after Patel had told Parliament that he had </span><a href=\"https://www.groundup.org.za/article/patel-takes-aim-at-failed-nlc-board/\"><span style=\"font-weight: 400;\">instructed</span></a><span style=\"font-weight: 400;\"> his lawyers to end the terms of the three remaining members of the commission’s board and soon after applications and nominations </span><a href=\"https://www.groundup.org.za/article/deadline-nominations-national-lotteries-commission-board/\"><span style=\"font-weight: 400;\">closed</span></a><span style=\"font-weight: 400;\"> for new commission board members.</span>\r\n\r\n<span style=\"font-weight: 400;\">In 2020 lawyers acting for the National Lotteries Commission </span><a href=\"https://groundup.org.za/media/uploads/documents/letter_of_demand_1.pdf\"><span style=\"font-weight: 400;\">wrote to Patel</span></a><span style=\"font-weight: 400;\"> to demand that he hand over a </span><a href=\"https://www.groundup.org.za/article/evidence-lottery-probe-handed-police/\"><span style=\"font-weight: 400;\">dossier</span></a><span style=\"font-weight: 400;\"> into alleged corruption involving several dodgy Lottery-funded projects that had been handed to the Hawks to investigate. The projects were linked to Pretoria lawyer </span><a href=\"https://groundup.org.za/article/lawyer-lottery-and-millions-dodgy-grants/\"><span style=\"font-weight: 400;\">Lesley Ramulifho</span></a><span style=\"font-weight: 400;\"> and </span><a href=\"https://groundup.org.za/article/lottery-coo-phillemon-letwaba-has-resigned/\"><span style=\"font-weight: 400;\">Phillemon Letwaba</span></a><span style=\"font-weight: 400;\">, the commission’s former chief operating officer.</span>\r\n\r\n<span style=\"font-weight: 400;\">The Pretoria Division of the High Court had </span><a href=\"https://groundup.org.za/article/judge-dismisses-lottery-bid-to-have-corruption-probe-declared-unlawful/\"><span style=\"font-weight: 400;\">dismissed an application</span></a><span style=\"font-weight: 400;\"> by the commission early in 2022 to set aside the appointment two years earlier of independent investigators commissioned by Patel to probe corruption involving the commission.</span>\r\n\r\n<span style=\"font-weight: 400;\">Patel </span><a href=\"https://drive.google.com/file/d/1OR0WpuCF9bd0JsaY9c-keheWWq58x0Ld/view?usp=sharing\"><span style=\"font-weight: 400;\">named</span></a><span style=\"font-weight: 400;\"> three organisations – United Civil Society in Action, </span><a href=\"https://groundup.org.za/media/uploads/documents/urgent_application_against_nlc_and_patel.pdf\"><span style=\"font-weight: 400;\">Zakheni Ma Afrika</span></a><span style=\"font-weight: 400;\"> and </span><a href=\"https://groundup.org.za/media/uploads/documents/30_october_2020_-_court_application_from_afican_liberty_movement.pdf\"><span style=\"font-weight: 400;\">African Liberty Movement</span></a><span style=\"font-weight: 400;\"> – that had litigated against him.</span>\r\n\r\n<span style=\"font-weight: 400;\">Although the National Lotteries Commission was listed as one of the respondents in all these matters, all three organisations put forward arguments similar to those the commission has used to claim that it would be illegal for details of grants to be made public.</span>\r\n<h4><b>Legal costs</b></h4>\r\n<span style=\"font-weight: 400;\">United Civil Society in Action also attempted to </span><a href=\"https://groundup.org.za/article/united-civil-society-action-sues-groundup-and-national-lotteries-commission/\"><span style=\"font-weight: 400;\">sue GroundUp</span></a><span style=\"font-weight: 400;\">, but </span><a href=\"https://www.groundup.org.za/article/groundup-wins-lottery-court-battle/\"><span style=\"font-weight: 400;\">withdrew the matter</span></a><span style=\"font-weight: 400;\"> and agreed to pay the news agency’s legal costs (which it has not done).</span>\r\n\r\n<span style=\"font-weight: 400;\">United Civil Society in Action, headed up by </span><a href=\"https://www.groundup.news/article/threat-journalist-investigating-lottery-corruption/\"><span style=\"font-weight: 400;\">Tebogo Sithathu</span></a><span style=\"font-weight: 400;\">, who was close to the National Lotteries Commission’s previous administration, sent a lawyer’s letter to Patel demanding that he not release details of organisations that had received Lottery grants.</span>\r\n\r\n<span style=\"font-weight: 400;\">GroundUp </span><a href=\"https://groundup.org.za/article/the-men-behind-attack-on-lottery/\"><span style=\"font-weight: 400;\">reported</span></a><span style=\"font-weight: 400;\"> earlier this month how Sithathu is involved in a new fightback to dislodge the current commission board and commissioner.</span>\r\n\r\n<span style=\"font-weight: 400;\">Zakheni Ma Afrika and the African Liberty Movement both unsuccessfully tried to stop the publication of details of grants and sued Patel. Zakheni received a total of R1.2-million in Lottery grants between 2020/21 and 2021/22.</span>\r\n\r\n<span style=\"font-weight: 400;\">In a 2021 response to a written parliamentary question by DA MP Mat Cuthbert about the cost of </span><a href=\"https://groundup.org.za/media/uploads/documents/pq-830.pdf\"><span style=\"font-weight: 400;\">litigation</span></a><span style=\"font-weight: 400;\">, the commission said it had spent R380,000 on the Zakheni and R370,000 on the African Liberty Movement matters.
