"contents": "<span style=\"font-weight: 400;\">National Lotteries Commission (NLC) Chief Operating Officer <a href=\"https://www.dailymaverick.co.za/article/2022-03-08-lotteries-boss-phillemon-letwaba-back-at-work-after-being-cleared-by-internal-hearing/\">Phillemon Letwaba</a> has gone to court to have a forensic report </span><a href=\"https://drive.google.com/file/d/1M_j_8ixesV0bYXgAmaMN1xb2d9CaLB85/view?usp=sharing\"><span style=\"font-weight: 400;\">into Lottery corruption</span></a><span style=\"font-weight: 400;\"> declared illegal and set aside.</span>\r\n\r\n<span style=\"font-weight: 400;\">This is the second attempt to stop a corruption probe involving alleged NLC corruption.</span>\r\n\r\n<span style=\"font-weight: 400;\">Earlier this year, the Pretoria high court </span><a href=\"https://www.groundup.org.za/article/judge-dismisses-lottery-bid-to-have-corruption-probe-declared-unlawful/\"><span style=\"font-weight: 400;\">dismissed</span></a><span style=\"font-weight: 400;\"> an application by the NLC to set aside the 2020 appointment of independent investigators commissioned by Trade, Industry and Competition Minister Ebrahim Patel to probe corruption involving the NLC.</span>\r\n\r\n<span style=\"font-weight: 400;\">Central to Letwaba’s </span><a href=\"https://www.groundup.org.za/media/uploads/documents/letwaba_summons_and_affidavit.pdf\"><span style=\"font-weight: 400;\">application for a judicial review</span></a><span style=\"font-weight: 400;\"> is a claim that Abel Dlamini, the executive chairman of </span><a href=\"https://skx.co.za/\"><span style=\"font-weight: 400;\">SkX Protiviti (SkX)</span></a><span style=\"font-weight: 400;\">, the company commissioned to do the report, is biased and has a conflict of interest. A non-profit “closely associated” with Dlamini received an almost R15-million grant from the NLC “through the proactive model” soon after SkX was appointed, Letwaba claims in papers submitted to the court. SkX and the NLC are named as respondents in the matter.</span>\r\n\r\n<span style=\"font-weight: 400;\">The matter was to be heard in the Pretoria high court on 3 September 2021 but it was never placed on the court roll. The only document in the file at the Pretoria high court is a </span><a href=\"https://www.groundup.org.za/media/uploads/documents/letwaba_court_document.pdf\"><span style=\"font-weight: 400;\">note</span></a><span style=\"font-weight: 400;\"> signed by a judge, noting that the matter was not on the roll.</span>\r\n\r\n<span style=\"font-weight: 400;\">A source with knowledge of the case told </span><i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\"> it appeared that neither the NLC nor SkX had yet filed responding papers. Dlamini and the NLC were asked for copies of their responses to Letwaba’s application, but neither responded.</span>\r\n<h4><b>Conflict of interest</b></h4>\r\n<span style=\"font-weight: 400;\">In his application, Letwaba said that the conflict was with Dlamini’s relationship with </span><a href=\"https://www.ubuntuinstitute.com/\"><span style=\"font-weight: 400;\">Ubuntu Institute for Young Entrepreneurs</span></a><span style=\"font-weight: 400;\">, a non-profit company of which Dlamini’s apparent relatives Celenhle and Cedza Dlamini, are both directors.</span>\r\n\r\n<i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\"> was previously tipped off about the grant to Ubuntu and Dlamini’s relationship to the directors. But we were unable to confirm this as the NLC is yet to publish its 2020/2021 annual report, where details of the grantees would be listed.</span>\r\n\r\n<span style=\"font-weight: 400;\">Dlamini failed to answer our questions, including what his relationship is to Celenhle and Cedza, who also did not answer our questions. The NLC also ignored questions about the grant.</span>\r\n\r\n<span style=\"font-weight: 400;\">We have since confirmed that Ubuntu was allocated almost R15-million in September 2020, about seven months after SkX was </span><a href=\"https://www.groundup.org.za/media/uploads/documents/nlc-board-appoints-sekela-xabiso-to-investigate-fraud-allegations-1.pdf\"><span style=\"font-weight: 400;\">appointed by the NLC</span></a><span style=\"font-weight: 400;\"> to investigate corruption in the NLC. Ubuntu also received R10-million from the NLC in the 2015/16 financial year for an arts and culture project. It is unclear what these funded projects involved.</span>\r\n\r\n<span style=\"font-weight: 400;\">The Dlamini siblings, Celenhle and Cedza, are grandchildren of the late King Sobhuza II of Swaziland. Celenhle, who is </span><a href=\"https://www.nac.org.za/council-member/hrh-princess-celenhle-dlamini-chairperson/\"><span style=\"font-weight: 400;\">chairperson</span></a><span style=\"font-weight: 400;\"> of the National Arts Council </span><a href=\"https://www.nac.org.za/council-member/hrh-princess-celenhle-dlamini-chairperson/\"><span style=\"font-weight: 400;\">uses the title “Princess” and “HRH”</span></a><span style=\"font-weight: 400;\">, while Cedza </span><a href=\"https://www.ubuntuinstitute.com/index.php/news/article/ubuntu_institute_guest_of_honour_at_pre_grammys_charity_event/\"><span style=\"font-weight: 400;\">refers</span></a><span style=\"font-weight: 400;\"> to himself as “Prince”.</span>\r\n<h4><b>Undermining investigations</b></h4>\r\n<span style=\"font-weight: 400;\">Letwaba, in papers, said he believed that “a personal relationship” between Abel Dlamini and former NLC board member William Huma “will undermine the result of any investigation”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Huma </span><a href=\"https://www.groundup.org.za/article/national-lotteries-commission-board-no-longer-quorate/\"><span style=\"font-weight: 400;\">resigned</span></a><span style=\"font-weight: 400;\"> as an NLC board member late last year after he was confronted with evidence of his alleged corruption uncovered by the Special Investigating Unit (SIU). </span><i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\"> had earlier </span><a href=\"https://www.groundup.org.za/article/nlc-board-member-received-millions-linked-to-lottery-grants/\"><span style=\"font-weight: 400;\">revealed</span></a><span style=\"font-weight: 400;\"> how millions of rands were paid into Huma’s home loan by Lottery grant recipients.</span>\r\n\r\n<span style=\"font-weight: 400;\">That grant that was meant to uplift women in Marikana was instead used to pay for a state-of-the-art poultry facility in the North West owned by one of Huma’s companies. Millions from a grant meant for an old age home in Mpumalanga were also used to </span><a href=\"https://www.groundup.org.za/article/lottery-millions-used-for-nlc-board-members-luxury-home/\"><span style=\"font-weight: 400;\">help pay for</span></a><span style=\"font-weight: 400;\"> a luxury estate for Huma in North West.</span>\r\n\r\n<span style=\"font-weight: 400;\">Letwaba said he was “deeply concerned that [a] personal relationship” between Huma, who was still an NLC board member at the time of the application, and Dlamini would “undermine the result of an investigation”. He said this was a “clear conflict” in the appointment of SkX.</span>\r\n\r\n<span style=\"font-weight: 400;\">Letwaba said he was “concerned” that “the conspectus of the facts … will undermine the result of the investigation” by SkX.</span>\r\n\r\n<span style=\"font-weight: 400;\">Letwaba also claimed that there was “impugned administrative action” in the appointment of SkX as there had been “no competitive bidding as was required for services above R1-million”. He said the SkX contract was valued at R8-million. However, a May 2021 </span><a href=\"https://www.groundup.org.za/media/uploads/documents/skx_investigation_costs.pdf\"><span style=\"font-weight: 400;\">answer to a parliamentary question</span></a><span style=\"font-weight: 400;\"> by NLC Commissioner Thabang Mampane stated that SkX had been paid R9.65-million “to date”.</span>\r\n\r\n<span style=\"font-weight: 400;\">He claimed that SkX’s appointment was unlawful in terms of the Promotion of Administrative Justice Act because it was “made for an ulterior purpose” on the “unauthorised or unwarranted dictates of another person” and “was made in bad faith” and/or “arbitrarily or capriciously”. Huma did not respond to our questions.</span>\r\n<h4><b>Millions paid but still no report</b></h4>\r\n<span style=\"font-weight: 400;\">Despite almost R10-million being paid for the investigation, SkX’s report — </span><a href=\"https://www.citizen.co.za/news/2237014/lotteries-commission-appoints-investigator-to-look-into-its-own-alleged-corruption/\"><span style=\"font-weight: 400;\">commissioned in February 2020</span></a><span style=\"font-weight: 400;\"> — is yet to be released. </span><i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\"> reliably understands that Minister Ebrahim Patel, who has oversight of the Lottery, is yet to get a copy of the report.</span>\r\n\r\n<span style=\"font-weight: 400;\">In response to the same parliamentary question in May 2021, NLC Commissioner Mampane said the SkX investigation was expected to be completed a year earlier but was delayed by “Covid-19 restrictions”.</span>\r\n\r\n<span style=\"font-weight: 400;\">“The investigation process is underway and final outcomes of the investigation [are] pending. The board will make available the final outcomes of the investigation upon conclusion and adoption by the board as previously undertaken to the [Trade and Industry] portfolio committee,” she said.</span>\r\n\r\n<span style=\"font-weight: 400;\">Dlamini and the NLC did not answer us on whether the SkX investigation had been completed or whether SkX was owed any more than the R9.6-million it had already been paid.</span>\r\n<h4><b>Lottery millions for Letwaba’s wife</b></h4>\r\n<span style=\"font-weight: 400;\">In his application, Letwaba refers to a </span><i><span style=\"font-weight: 400;\">GroundUp</span></i><span style=\"font-weight: 400;\"> story </span><a href=\"https://www.groundup.org.za/article/lottery-paid-millions-rands-coos-wifes-company/\"><span style=\"font-weight: 400;\">revealing</span></a><span style=\"font-weight: 400;\"> how a company in which his second wife, Rebotile Malomane, was a director and had received a R5-million Lottery grant. It was paid within months of Malomane becoming a director.</span>\r\n\r\n<span style=\"font-weight: 400;\">Letwaba said he and Malomane’s marriage was solemnised in November 2020. Malomane, the mother of three of his children, was Letwaba’s long-time girlfriend before he paid </span><a href=\"https://www.collinsdictionary.com/dictionary/english/lobola\"><span style=\"font-weight: 400;\">lobola</span></a><span style=\"font-weight: 400;\"> to her family in 2018. By cultural tradition, they were then referred to as husband and wife. “These allegations are untrue and I have no doubt that with the fullness of time the name will be cleared from the sting of the allegation,” Letwaba said.</span>\r\n\r\n<span style=\"font-weight: 400;\">Letwaba also denied that he was involved in the awarding of the grant, which he said is “the absolute preserve of the Distribution Agency established in terms of Section 26A of the Lotteries Act, comprising of persons appointed by the Minister of Trade, Industry and Competition”.</span>\r\n<h4><b>Where did the millions paid to Ubuntu go?</b></h4>\r\n<span style=\"font-weight: 400;\">Ubuntu Institute for Young Entrepreneurs was first registered as a non-profit company in July 2006, with siblings Celenhle and Cedza as its directors, according to the </span><a href=\"http://www.cipc.co.za/za/\"><span style=\"font-weight: 400;\">Companies and Intellectual Property Commission (CIPC)</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">Despite having received grants from the NLC, this is not acknowledged on Ubuntu’s </span><a href=\"https://web.archive.org/web/20220407113944/https://www.ubuntuinstitute.com/index.php\"><span style=\"font-weight: 400;\">website</span></a><span style=\"font-weight: 400;\"> and it is not clear what project the grants funded. This is in contravention of a condition that all NLC grants be acknowledged.</span>\r\n\r\n<span style=\"font-weight: 400;\">Ubuntu describes itself as “an international non-profit development organisation focused on achieving the United Nations’ Millennium Development Goals in Africa.”</span>\r\n\r\n<span style=\"font-weight: 400;\">It also claims to support a wide range of projects “in youth development, poverty eradication, women empowerment initiatives, international student exchange programmes, HIV/Aids prevention, culture and heritage, and education and sustainable development in Africa”. The last post on its </span><a href=\"https://www.ubuntuinstitute.com/index.php/news/P5/\"><span style=\"font-weight: 400;\">news page</span></a><span style=\"font-weight: 400;\"> was in 2012, with the earliest post dating back to 2008 when the site was launched.</span>\r\n\r\n<span style=\"font-weight: 400;\">Ubuntu’s </span><a href=\"https://www.facebook.com/ubuntu01/?ref=page_internal\"><span style=\"font-weight: 400;\">Facebook page</span></a><span style=\"font-weight: 400;\">, set up in 2019, is more informative.
