"contents": "<i><span style=\"font-weight: 400;\">Because I was a party girl at university</span></i>\r\n\r\n<i><span style=\"font-weight: 400;\">Because I went home with him</span></i>\r\n\r\n<i><span style=\"font-weight: 400;\">Because I thought everyone would say I asked for it</span></i>\r\n\r\n<i><span style=\"font-weight: 400;\">Because I thought this was just what happened when you partied too hard</span></i>\r\n\r\n<i><span style=\"font-weight: 400;\">Because I thought no one would believe me</span></i>\r\n\r\n<i><span style=\"font-weight: 400;\">I thought I deserved it</span></i>\r\n\r\n<span style=\"font-weight: 400;\">In 2018, Lerato Chondoma </span><a href=\"https://x.com/NotYetUhuru_YQ/status/1043354098496491520\"><span style=\"font-weight: 400;\">posted</span></a><span style=\"font-weight: 400;\"> on Twitter (now X) why, as a university student 17 years earlier, she didn’t report when she was raped. Chondoma was responding to the hashtag </span><a href=\"https://journals.sagepub.com/doi/full/10.1177/17488958241283947\"><span style=\"font-weight: 400;\">#WhyIDidntReport</span></a><span style=\"font-weight: 400;\">, which swept social media not long after the #MeToo movement. </span>\r\n\r\n<span style=\"font-weight: 400;\">The hashtag emerged during the nomination process of US Supreme Court Justice Brett Kavanaugh, who was accused of sexual assault by Stanford University research psychologist Christine Blasey Ford. Ford testified that Kavanaugh assaulted her at a party when they were teenagers in the 1980s – and that was when then US president Donald Trump blasted her on </span><a href=\"https://x.com/realDonaldTrump/status/1043126336473055235\"><span style=\"font-weight: 400;\">social media</span></a><span style=\"font-weight: 400;\">:</span>\r\n\r\n<i><span style=\"font-weight: 400;\">I have no doubt that, if the attack on Dr Ford was as bad as she says, charges would have been immediately filed with local law enforcement authorities by either her or her loving parents.</span></i>\r\n\r\n<span style=\"font-weight: 400;\">Thousands of survivors like Chondoma responded, </span><a href=\"https://x.com/hashtag/WhyIDidntReport?src=hashtag_click\"><span style=\"font-weight: 400;\">telling the world</span></a><span style=\"font-weight: 400;\"> through </span><a href=\"https://www.instagram.com/whyididntreport/?hl=en\"><span style=\"font-weight: 400;\">social media</span></a><span style=\"font-weight: 400;\"> why they hadn’t reported their sexual assaults. </span>\r\n\r\n<span style=\"font-weight: 400;\">A 2023 report in the</span> <a href=\"https://academic.oup.com/bjc/article/63/3/588/6640245\"><span style=\"font-weight: 400;\">British Society of Criminology</span></a><span style=\"font-weight: 400;\"> found those reasons were as complex as they were varied, and included feelings of shame or guilt, being labelled “damaged” and a lack of trust in the legal process. </span>\r\n\r\n<span style=\"font-weight: 400;\">There is a good reason for that.</span>\r\n\r\n<span style=\"font-weight: 400;\">In a large study published by the </span><a href=\"https://www.samrc.ac.za/sites/default/files/attachments/2022-09/RAPSSAreport.pdf\"><span style=\"font-weight: 400;\">South African Medical Research Council</span></a><span style=\"font-weight: 400;\"> in 2017, researchers found that out of nearly 4,000 cases of reported rape in South Africa, only 19% went to trial, with just 9% ending in a guilty verdict. </span>\r\n\r\n<span style=\"font-weight: 400;\">But, as Chondoma told </span><a href=\"https://www.nytimes.com/2018/09/23/us/why-i-didnt-report-assault-stories.html\"><span style=\"font-weight: 400;\">The New York Times</span></a><span style=\"font-weight: 400;\"> not long after she posted, while she felt anxious just talking about it nearly two decades later, “I felt like it was important to do this”.</span>\r\n\r\n<span style=\"font-weight: 400;\">That sense of regaining control is why some women do end up reporting, </span><a href=\"https://issafrica.org/research/policy-brief/rape-and-other-forms-of-sexual-violence-in-south-africa\"><span style=\"font-weight: 400;\">noted</span></a><span style=\"font-weight: 400;\"> leading South African sexual violence researcher Lisa Vetten. They also do it to protect their own safety, to stop the offender from hurting others and to get justice. </span>\r\n<h4><b>Defining rape</b></h4>\r\n<span style=\"font-weight: 400;\">Sometimes people don’t report rape because they don’t know what its exact definition is. </span>\r\n\r\n<span style=\"font-weight: 400;\">In South Africa, rape is </span><a href=\"https://www.saps.gov.za/resource_centre/acts/downloads/sexual_offences/sexual_offences_act32_2007_eng.pdf\"><span style=\"font-weight: 400;\">defined</span></a><span style=\"font-weight: 400;\"> as “any person who unlawfully and intentionally commits an act of sexual penetration without consent”. This means that rape is committed when someone forces sexual penetration – including with a body part or object into the mouth, anus or vagina of another – without permission on another person by overpowering them, threatening them, or intimidating them. That includes when someone is too drunk or has taken too many drugs to say “yes” to sex. </span>\r\n\r\n<a href=\"https://www.mariestopes.org.za/consensual-sex-rape-know-difference/\"><span style=\"font-weight: 400;\">Marie Stopes</span></a><span style=\"font-weight: 400;\"> has a simple definition: if ever you’re having sex, or you’re engaged in sexual activity, and you don’t want to be doing it, it’s rape.</span>\r\n\r\n<iframe title=\"YouTube video player\" src=\"https://www.youtube.com/embed/oQbei5JGiT8?si=bJXkT8WSEwAl4QtJ\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\" data-mce-fragment=\"1\"></iframe>\r\n\r\n<a href=\"https://www.gov.za/sites/default/files/gcis_document/201412/b18-2014criminallaw141205.pdf\"><span style=\"font-weight: 400;\">The law</span></a><span style=\"font-weight: 400;\"> also says that adults can’t have sex with children under the age of 16 or mentally disabled people, even with their permission. This is because, legally speaking, they don’t have the capacity to say yes to sex. </span>\r\n<h4><b>How to report a rape</b></h4>\r\n<span style=\"font-weight: 400;\">If you do decide to report, here’s how to do it.</span>\r\n<h4><b>1 Go to the police station or a </b><a href=\"https://www.gov.za/TCC\"><b>Thuthuzela Care Centre (TCC)</b></a></h4>\r\n<span style=\"font-weight: 400;\">You can make a statement at your closest police station or at </span><a href=\"https://www.gov.za/sites/default/files/gcis_speech/THUTHUZELA%20Care%20Centres.pdf\"><span style=\"font-weight: 400;\">one of the 54 TCCs</span></a><span style=\"font-weight: 400;\"> around the country. The TCC staff will help with medical and emotional support and, if you want, to open a case and help you prepare for it, if it does go to trial. </span>\r\n\r\n<span style=\"font-weight: 400;\">You can also call the police on 10111 so they can pick you up or, if you are badly injured, call an ambulance and go directly to hospital. </span>\r\n\r\n<span style=\"font-weight: 400;\">At the </span><a href=\"https://www.saps.gov.za/resource_centre/women_children/sexual_offences.php\"><span style=\"font-weight: 400;\">police station</span></a><span style=\"font-weight: 400;\"> an officer will take your statement. It’s important that you try to be as detailed as possible. If, later on, you feel the statement is wrong or incomplete, you can make another. </span>\r\n\r\n<span style=\"font-weight: 400;\">You may also bring a friend or family member for support when you make your statement, as long as that person is not a potential witness in the case. Also, you have the right to make your statement in your own language. Once done, you can ask for a copy of it. The police officer will give you a case number once you decide to officially open a case. </span>\r\n\r\n<span style=\"font-weight: 400;\">Generally, you’re expected to report the rape to the station closest to where the crime took place. But if it is far from where you live, you can report near your home and police officers are not allowed to turn you away. They have to take your statement, open the case for you, get you the medical exam and then hand the case over to the correct police station afterwards.</span>\r\n\r\n<span style=\"font-weight: 400;\">There’s </span><a href=\"https://www.gov.za/sites/default/files/gcis_document/201912/prescriptionb22-2019.pdf\"><span style=\"font-weight: 400;\">no time limit</span></a><span style=\"font-weight: 400;\"> to opening a rape case, but it is important to get a medical exam as soon as possible after the offence. </span>\r\n<h4><b>2 </b><b>Get a medical exam</b></h4>\r\n<span style=\"font-weight: 400;\">While you may want to wash yourself immediately after a sexual assault, it is </span><a href=\"https://www.mariestopes.org.za/5-steps-to-take-if-you-have-been-raped/\"><span style=\"font-weight: 400;\">important not to bathe, shower or clean up</span></a><span style=\"font-weight: 400;\">, including brushing your teeth. This can wash away critical evidence needed to convict the rapist. Eating and drinking can also wash away evidence of </span><a href=\"https://www.ncbi.nlm.nih.gov/pmc/articles/PMC6491537/\"><span style=\"font-weight: 400;\">sexual violence committed orally</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">If you’ve changed clothes before going to the hospital, make sure not to wash them. Take the clothes with you as they may contain evidence. </span><a href=\"https://www.ncbi.nlm.nih.gov/pmc/articles/PMC4637504/#sec5.3\"><span style=\"font-weight: 400;\">Try to avoid plastic bags</span></a><span style=\"font-weight: 400;\"> to carry the clothing – a paper bag will better protect the evidence.</span>\r\n\r\n<span style=\"font-weight: 400;\">When you go for the medical examination, a government doctor will – with your consent – use a so-called </span><a href=\"https://www.ncbi.nlm.nih.gov/books/NBK554497/\"><span style=\"font-weight: 400;\">rape kit</span></a><span style=\"font-weight: 400;\"> to examine you and collect evidence of sexual assault, such as semen, hair, blood or fibres from the clothing of the attacker, evidence that can be </span><a href=\"https://academic.oup.com/bjc/article/63/3/588/6640245\"><span style=\"font-weight: 400;\">critical</span></a><span style=\"font-weight: 400;\"> in proving your case. The doctor will also treat any injuries and fill out a </span><a href=\"https://www.justice.gov.za/forms/other/J088.pdf\"><span style=\"font-weight: 400;\">J88 form</span></a><span style=\"font-weight: 400;\"> to document the exam. </span>\r\n\r\n<span style=\"font-weight: 400;\">They can also give you medication to prevent HIV infection (</span><a href=\"https://hivinfo.nih.gov/understanding-hiv/fact-sheets/post-exposure-prophylaxis-pep\"><span style=\"font-weight: 400;\">post-exposure prophylaxis or PEP</span></a><span style=\"font-weight: 400;\">) and the </span><a href=\"https://www.mayoclinic.org/tests-procedures/morning-after-pill/about/pac-20394730\"><span style=\"font-weight: 400;\">“morning-after” pill</span></a><span style=\"font-weight: 400;\">, which will stop you from getting pregnant; both need to be taken within 72 hours of the rape.</span>\r\n<h4><b>3 The investigation process</b></h4>\r\n<span style=\"font-weight: 400;\">Once you’ve opened a case the police </span><a href=\"https://www.saps.gov.za/resource_centre/women_children/sexual_offences.php#:~:text=If%20you%20later%20feel%20that,you%20will%20get%20it%20later.\"><span style=\"font-weight: 400;\">will investigate</span></a><span style=\"font-weight: 400;\"> and try to find your attacker. They must let you know when a suspect has been arrested. If they need your help to identify a suspect, you will go into the station to do that behind a one-way mirror. The police must also let you know should the suspect be released on bail and when the trial starts. </span>\r\n\r\n<span style=\"font-weight: 400;\">If the rapist was violent, knows where you live or threatened you, let the police know before the bail hearing. This will help the judge decide whether they should get bail. If they have already received bail, they’re not allowed to contact you, talk to you or threaten you. If they do, contact the detective dealing with your case immediately. </span>\r\n<h4><b>4 Preparing for trial</b></h4>\r\n<span style=\"font-weight: 400;\">Once the suspect is found the police will contact a prosecutor. Based on the evidence available the </span><a href=\"https://www.samrc.ac.za/sites/default/files/attachments/2022-09/RAPSSAreport.pdf\"><span style=\"font-weight: 400;\">prosecutor will decide whether the case goes to trial</span></a><span style=\"font-weight: 400;\">. </span>\r\n\r\n<span style=\"font-weight: 400;\">Unfortunately, this process can take months or years, and it can be difficult for a survivor to endure. It’s important to ensure you have emotional support to get you through.
