"contents": "<span style=\"font-weight: 400;\">Because the former health minister’s son is a married adult, he’s not a close family member as defined in Parliament’s </span><a href=\"https://www.parliament.gov.za/code-conduct\"><span style=\"font-weight: 400;\">code of conduct</span></a><span style=\"font-weight: 400;\"> — that would be a spouse, permanent companion or dependant — therefore the former Cabinet minister and now backbencher Zweli Mkhize</span><span style=\"font-weight: 400;\"> has not breached the code of conduct</span><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">Because the emails for payment of maintenance work at the Mkhize family home in Bryanston, Johannesburg, were sent to [email protected], it was this person who was liable for settling the R6,720 bill, not Zweli Mkhize, the then health minister. </span>\r\n\r\n<span style=\"font-weight: 400;\">Both verdicts that Mkhize “did not breach the code” arise in a letter dated 12 April sent on behalf of the ethics committee by the acting Registrar of Members’ Interests, advocate Anthea Gordon, to DA Deputy Chief Whip Siviwe Gwarube. </span>\r\n\r\n<span style=\"font-weight: 400;\">“In the light of the above, the complaint file in this matter is accordingly closed,” the letter says. </span>\r\n\r\nhttps://www.dailymaverick.co.za/article/2022-04-12-tragedy-in-kzn-as-floods-cause-devastation-mostly-for-the-poor-in-informal-settlements/\r\n\r\n<span style=\"font-weight: 400;\">In June 2021, Gwarube made the complaint to the parliamentary ethics committee under the code’s conflict of interests and business section that stipulates a parliamentarian may </span><span style=\"font-weight: 400;\">“not lobby for any remuneration or receive any reward, benefit or gift for that Member or for the immediate family of that Member or the business partner of that Member or immediate family of that Member, for making such representation as a Member on behalf of any person or body”, according to section 5.2.7. </span>\r\n\r\n<span style=\"font-weight: 400;\">And section 5.2.2 states that a parliamentarian may </span><span style=\"font-weight: 400;\">“not use his or her influence as </span><span style=\"font-weight: 400;\">a public representative in his or her dealings with an organ of state in such a manner as to improperly advantage the direct personal or private financial or business interests of such Member or any immediate family of that Member or any business partner of that Member or the immediate family of that Member…” </span>\r\n\r\n<span style=\"font-weight: 400;\">This is on the back of a series of reports by </span><i><span style=\"font-weight: 400;\">Daily Maverick </span></i><span style=\"font-weight: 400;\">journalist Pieter-Louis Myburgh on how</span> <span style=\"font-weight: 400;\">R150-million was irregularly awarded to the communications company Digital Vibes, run by </span><span style=\"font-weight: 400;\">two close associates of Mkhize</span><span style=\"font-weight: 400;\">. </span>\r\n\r\n<span style=\"font-weight: 400;\">By May 2021 </span><a href=\"https://www.dailymaverick.co.za/article/2021-05-28-exposed-digital-vibes-bankrolled-maintenance-work-at-zweli-mkhize-property-r300k-paid-to-ministers-son/\"><span style=\"font-weight: 400;\">it had emerged</span></a><span style=\"font-weight: 400;\"> that Mkhize’s surname and cellphone number appeared on the contractor’s invoices. </span>\r\n\r\n<span style=\"font-weight: 400;\">“All matters that have related to the upkeep, maintenance etc were always reported to me. Just like any household, we have attended to a few minor maintenance, electrical or plumbing issues over the years, but I have never requested Digital Vibes or any of its representatives to make a single payment towards such upkeep,” said Mkhize’s wife, Dr May Mashego, then of the maintenance work at the family home. </span>\r\n\r\n<span style=\"font-weight: 400;\">Other reports trace benefits </span><a href=\"https://www.dailymaverick.co.za/article/2021-06-01-exposed-digital-vibes-bought-a-land-cruiser-bakkie-for-health-minister-zweli-mkhizes-son/\"><span style=\"font-weight: 400;\">such as a car</span></a><span style=\"font-weight: 400;\"> for Mkhize’s son Dedani Mkhize, and a </span><a href=\"https://www.dailymaverick.co.za/article/2021-08-03-r1m-from-digital-vibes-deal-bankrolled-hair-salon-nail-boutique-for-minister-zweli-mkhizes-son-daughter-in-law/\"><span style=\"font-weight: 400;\">hair salon</span></a><span style=\"font-weight: 400;\">. </span>\r\n\r\nhttps://www.dailymaverick.co.za/article/2021-08-03-r1m-from-digital-vibes-deal-bankrolled-hair-salon-nail-boutique-for-minister-zweli-mkhizes-son-daughter-in-law/\r\n\r\n<span style=\"font-weight: 400;\">After the Special Investigating Unit (S</span><span style=\"font-weight: 400;\">IU) handed its Digital Vibes report to President Cyril Ramaphosa, it went before the </span><a href=\"https://www.dailymaverick.co.za/article/2021-07-25-anatomy-of-a-rigged-contract-digital-vibes-tender-deeply-flawed-unlawful-and-invalid-says-siu/\"><span style=\"font-weight: 400;\">Special Tribunal</span></a><span style=\"font-weight: 400;\"> to recover the monies. </span>\r\n\r\n<span style=\"font-weight: 400;\">Mkhize has denied any wrongdoing and in his 5 August 2o21 letter of resignation from the Cabinet said he’d take the </span><span style=\"font-weight: 400;\">“flawed and unfounded” </span><span style=\"font-weight: 400;\">SIU report on review to the courts. </span>\r\n\r\n<span style=\"font-weight: 400;\">Ramaphosa </span><a href=\"https://www.thepresidency.gov.za/press-statements/president-authorises-release-siu-investigation-digital-vibes-matter\"><span style=\"font-weight: 400;\">publicly released</span></a><span style=\"font-weight: 400;\"> the SIU Digital Vibes report on 29 September 2021. </span>\r\n\r\n<span style=\"font-weight: 400;\">On Tuesday, when contacted for comment, Gwarube said the outcomes of the Hawks investigation now under way would be closely monitored. </span>\r\n\r\n<span style=\"font-weight: 400;\">“It </span><span style=\"font-weight: 400;\">is deeply disappointing that the ethics committee would arrive at the conclusion that the alleged funnelling of money to the former health minister’s son isn’t a violation of the ethics code. The sections of the code were applied so narrowly that it excludes the minister’s son as an undue beneficiary on the basis that he’s an adult and not dependent on Dr Mkhize financially. This finding is seemingly at odds with the spirit of the code and provisions of it by this narrow application.” </span>\r\n\r\n<span style=\"font-weight: 400;\">That parliamentary code of ethics, in its purpose and scope section, emphasises values of selflessness, integrity, honesty, objectivity, openness and leadership. </span>\r\n\r\n<span style=\"font-weight: 400;\">“</span><span style=\"font-weight: 400;\">The purpose of the code is to create public trust and confidence in public representatives and to protect the integrity of Parliament,” the code of conduct says in outlining what it calls “the minimum ethical standards of behaviour that South Africans expect of public representatives, including upholding propriety, integrity and ethical values in their conduct”. </span>\r\n\r\n<span style=\"font-weight: 400;\">When approached for comment, the ANC in Parliament said, “no comment from caucus”. </span>\r\n\r\n<span style=\"font-weight: 400;\">The ethics committee chairpersons could not immediately be reached. </span>\r\n\r\n<span style=\"font-weight: 400;\">The committee had concluded deliberations on Monday, but initially issued a </span><a href=\"https://www.thepresidency.gov.za/press-statements/president-authorises-release-siu-investigation-digital-vibes-matter\"><span style=\"font-weight: 400;\">public statement</span></a><span style=\"font-weight: 400;\"> only about its agreement reached on the same day to publish the 2021 Register of Members’ Interests. The statement that the committee found no breaches of the parliamentary ethics code by Mkhize was issued only after 9pm on Tuesday, several hours after the matter had emerged in the public domain. </span>\r\n\r\n<span style=\"font-weight: 400;\">Effectively a summary of the acting registrar’s letter, the official statement concludes: “</span><span style=\"font-weight: 400;\">The committee considers the matter closed.” </span>\r\n\r\n<span style=\"font-weight: 400;\">It’s not the first time Mkhize has been shielded. On 4 June 2021, ANC MPs on the health committee engaged in verbal somersaults, invoking the defunct sub judice rule, and argued this applied from the moment a case was opened at a police station so as not to deal with the Digital Vibes scandal. </span>\r\n\r\n<span style=\"font-weight: 400;\">Mkhize had written to the committee to say that on legal advice he could not appear before it, according to the then health committee chairperson Sibongiseni Dhlomo, now the deputy health minister.</span>\r\n\r\n<span style=\"font-weight: 400;\"> “The matter is </span><a href=\"https://www.dailymaverick.co.za/opinionista/2021-06-17-when-mps-misuse-sub-judice-to-avoid-exercising-their-oversight-of-ministers/\"><span style=\"font-weight: 400;\">sub judice</span></a><span style=\"font-weight: 400;\">,” said ANC MP Kenneth Jacobs, now the committee chairperson, in support of his party colleague’s statement earlier.</span>\r\n\r\n<span style=\"font-weight: 400;\">“There will be answers given in the future. The president also stated very clearly he’s awaiting the outcomes of the SIU investigation. We must be mindful of the impact it would have if we discuss too many of these issues…”</span>\r\n\r\n<span style=\"font-weight: 400;\">The decision of the Joint Standing Committee on Ethics and Members’ Interests falls in line with such attitudes, even if it stands in conflict with Parliament’s constitutional responsibility of oversight, holding the executive to account and ensuring good governance in their job as elected public representatives. </span>\r\n\r\n<span style=\"font-weight: 400;\">It appears no lessons have been learnt from the State Capture years — or more recently fr0m the acute probing at the State Capture commission, which put it that the high cost of State Capture could have been avoided if Parliament and its committees had acted sooner, and decisively, in the public interest. </span><b>DM</b>",
