Family of slain Jerobejin van Wyk (13) wants answers from murder-accused, who plans to plead guilty

Daniel Smit, the man accused of murdering 13-year-old Jerobejin van Wyk and burying his remains in a drain in Klawer, north of Cape Town, in February 2022, intends to plead guilty. Jerobejin’s family wants to know what Smit did and why.

Days after the murder of 13-year-old Jerobejin van Wyk, his mother, Triesa van Wyk, said her only wish was to know her son’s final words. On Monday, 7 October 2024, she might have got a step closer. 

According to a family spokesperson, Triesa was overcome with emotion as she walked into the Vredendal Circuit Court on Monday and faced the man who allegedly butchered her son and dumped his remains in a drain on his property after Jerobejin and his friends trespassed to pick mangoes.

Daniel Smit, who is charged with kidnapping and murdering Jerobejin on 2 February 2022, appeared before Western Cape High Court Judge Hayley Slingers on Monday.

The case had been set for trial but on Monday Smit changed the course of the proceedings, saying he wanted to plead guilty to all charges and enter a plea and sentence agreement with the State.

Western Cape National Prosecuting Authority spokesperson Eric Ntabazalila said the case has been postponed to 21 October for the State to consider Smit’s plea under Section 112 of the Criminal Procedure Act.

The murder of Jerobejin in Klawer, about 240km north of Cape Town, shook the tight-knit, mostly grape-farming community. It also revealed deep underlying social issues driving an increase in crime, drug abuse and teen pregnancy in the area.

The question of Smit’s mental capacity to stand trial led to significant delays in the case after his appearance in the Klawer Magistrates’ Court in 2022.

A psychological examination by Vredendal psychologist CWA van Zyl provided horrifying details of how Smit allegedly murdered Jerobejin, prompting the court to order that the accused be sent for a 30-day mental observation. Due to the long waiting list for beds at Valkenberg Psychiatric Hospital, he was only sent for an evaluation a year later, in August 2023.

In September 2023, more than a year after the murder, Smit was declared fit to stand trial, according to a psychiatric assessment report from Valkenberg.

The summary of facts in the case provided a chilling account of the events that occurred shortly after Jerobejin and his friends trespassed on Smit’s property to pick mangoes on 2 February 2022. They fled the scene and were pursued by the driver of a white Ford Bantam Bakkie.

Remains found


A witness saw the driver of the bakkie knocking over Jerobejin with the vehicle. The injured child was placed inside the bakkie and driven away.

Triesa van Wyk reported to the police that Smit was allegedly the last person seen with her son. On 3 February, a warrant to search the accused’s premises was issued and he was arrested.

On 4 February 2022, police forensic pathology officers discovered human remains in a drain, which were later linked to Jerobejin. His body had been dismembered.

Jerobejin was buried with his arms, legs and part of his head missing. The missing body parts have not been recovered.

Plea deal could bring closure


Mathilda Bains, a spokesperson for the Van Wyk family, said many residents couldn’t afford to attend court in Vredendal, 23km away.

“The deep emotional wound will never fully heal. However, the family will find closure when Smit enters a plea and sentencing agreement. The family simply hopes that Smit will reveal what he did to Jerobejin and why he killed him,” Bains said.

She added that a life sentence equates to 25 years in prison and that residents believe the time does not justify the deed.

Billy Claasen, executive director of the Rural and Farmworkers Development Organisation, said Jerobejin’s mother is still struggling to cope with her son’s death and needs more counselling. DM
