"contents": "<span style=\"font-weight: 400;\">Lawyers for Human Rights and the African Diaspora Forum (ADF) will be monitoring the implementation of the Gauteng Township Economic Development Act and are prepared to challenge it in court if it infringes on the rights of non-nationals. </span>\r\n\r\n<span style=\"font-weight: 400;\">The act, </span><a href=\"https://www.gauteng.gov.za/News/NewsDetails/762EB325-53D2-4454-BDB0-B4DC51796AD5\"><span style=\"font-weight: 400;\">signed into law</span></a><span style=\"font-weight: 400;\"> by Gauteng Premier David Makhura on 29 April, is aimed at transforming and funding township-based businesses in Gauteng. </span>\r\n\r\n<span style=\"font-weight: 400;\">The Township Economic Development Bill was passed by a unanimous vote in the Gauteng legislature on 24 March. The law, which came on the back of the Township Economic Revitalisation Campaign in 2015 and 2016, </span><a href=\"https://www.gauteng.gov.za/News/NewsDetails/762EB325-53D2-4454-BDB0-B4DC51796AD5\"><span style=\"font-weight: 400;\">is part of the provincial government’s effort</span></a><span style=\"font-weight: 400;\"> at formalising township businesses and “provides a regulatory framework that makes it possible for entrepreneurs living in townships to establish viable and thriving businesses, small enterprises and co-operatives”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Gauteng MEC for Economic Development, Environment, Agriculture and Rural Development, Parks Tau, said the act is a “developmental legislative framework that addresses economic, geographical and social inequalities” by bringing Gauteng townships closer to mainstream economic opportunities. </span>\r\n\r\n<i><span style=\"font-weight: 400;\">Read in Daily Maverick: </span></i><a href=\"https://www.dailymaverick.co.za/opinionista/2022-04-04-township-economic-development-bill-is-a-game-changer-for-the-economic-geography-of-gauteng/\"><i><span style=\"font-weight: 400;\">Township Economic Development Bill is a game changer for the economic geography of Gauteng</span></i></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">Addressing MECs, business owners and township entrepreneurs at Orlando Community Hall in Soweto, Makhura said: “This act will make it possible and mandatory for provincial and local governments to actively support township businesses, especially the businesses owned by South Africans. Maverick</span></i><span style=\"font-weight: 400;\">, Amir Sheikh, spokesperson for the African Diaspora Forum, said the organisation condemned this “discriminatory, populist rhetoric” by the premier on this and previous occasions. </span>\r\n\r\n<span style=\"font-weight: 400;\">According to Sheikh, Makhura had made similar “exclusionary” remarks towards township-based non-citizens while addressing crowds at Orange Farm on the Township Economic Development Act in early April. </span>\r\n\r\n<span style=\"font-weight: 400;\">“What is more worrying than the act itself, is the reckless, discriminatory statements made by the premier — who is the number one citizen in the province — that we believe can provide a reason for a resurgence of another </span><a href=\"https://www.dailymaverick.co.za/article/2022-04-19-timeline-of-hatred-and-death-xenophobia-and-south-africas-record-of-shame/\"><span style=\"font-weight: 400;\">xenophobic attack</span></a><span style=\"font-weight: 400;\">,” Sheikh told </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\">. </span>\r\n\r\n<span style=\"font-weight: 400;\">Sheikh feared that messages like these could be weaponised by organisations such as </span><a href=\"https://www.dailymaverick.co.za/article/2022-04-16-nhlanhla-lux-exposed-the-disturbing-picture-behind-the-masks-of-the-man-heading-operation-dudula/\"><span style=\"font-weight: 400;\">Operation Dudula</span></a><span style=\"font-weight: 400;\"> and anti-migrant political groups, the South African First party and ActionSA. </span>\r\n\r\n<span style=\"font-weight: 400;\">While visiting Orange Farm, Makhura called on South Africans to “take back” spaza shops — but without fighting foreigners, </span><a href=\"https://www.timeslive.co.za/politics/2022-04-07-township-economy-bill-wont-cater-for-foreign-owned-shops-david-makhura/\"><i><span style=\"font-weight: 400;\">TimesLive</span></i></a><span style=\"font-weight: 400;\"> reported. </span>\r\n\r\n<span style=\"font-weight: 400;\">Makhura’s address in Orange Farm came amid </span><a href=\"https://www.dailymaverick.co.za/article/2022-04-07-police-on-high-alert-after-murders-and-mob-killing-of-a-zimbabwean-national-in-diepsloot/\"><span style=\"font-weight: 400;\">deadly protests</span></a><span style=\"font-weight: 400;\"> in Diepsloot, north of Johannesburg, which were sparked by the murders of six people, high crime rates and inadequate policing. </span><a href=\"https://www.dailymaverick.co.za/article/2022-04-10-bheki-diepsloot-10/\"><i><span style=\"font-weight: 400;\">Daily Maverick</span></i></a><span style=\"font-weight: 400;\"> previously reported that the murders were fuelling residents’ anger and discontent, especially against migrants. </span>\r\n\r\n<span style=\"font-weight: 400;\">Head of the Refugee and Migrant Rights Programme at Lawyers for Human Rights, Sharon Ekambaram, echoed Sheikh’s remarks on the premier’s statements: “My concern is that the climate within which these policy changes are being made and enforced… it’s allowed for politicians — in the way that they’re speaking about these policies — to then be xenophobic and to put emphasis on the rights of South Africans, pitting South Africans against foreign style=\"font-weight: 400;\">Following the publication of the Gauteng Township Economic Development Draft Bill in September 2020, a wide range of organisations — including the ADF, Lawyers for Human Rights and the Socio-Economic Rights Institute (Seri) — made submissions. </span>\r\n\r\n<span style=\"font-weight: 400;\">The organisations highlighted concerns about the </span><a href=\"https://www.dailymaverick.co.za/article/2020-11-17-gauteng-township-bill-infringes-on-rights-of-foreign-nationals/\"><span style=\"font-weight: 400;\">unconstitutionality of the bill</span></a><span style=\"font-weight: 400;\">, which </span><a href=\"http://www.seri-sa.org/images/GTEDB_Submission_SERI_and_LHR_Final_26_Nov_2020.pdf\"><span style=\"font-weight: 400;\">Lawyers for Human Rights and Seri</span></a><span style=\"font-weight: 400;\"> said “explicitly [deprived] foreign nationals the freedom of self-employment, entrepreneurship or to conduct a business” by reserving “</span><span style=\"font-weight: 400;\">an undisclosed number of economic sectors in Gauteng’s townships for South African citizens and permanent residents”</span><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">Submissions from the ADF, Lawyers for Human Rights and Seri concluded that the draft bill required extensive revision for it to give effect to its intended objectives. </span>\r\n\r\n<span style=\"font-weight: 400;\">In August 2021, an </span><a href=\"https://www.jicp.org.za/wp-content/uploads/2021/07/Gauteng-Township-Economy-Development-Bill-2020.pdf\"><span style=\"font-weight: 400;\">updated version</span></a><span style=\"font-weight: 400;\"> of the Gauteng Township Economic Development Bill had removed the discriminatory provisions, but some </span><a href=\"https://www.icj.org/south-africa-scrapping-of-discriminatory-provisions-against-non-citizens-in-gauteng-bill-a-welcome-step-forward/\"><span style=\"font-weight: 400;\">organisations noted</span></a><span style=\"font-weight: 400;\"> that the new draft bill still required further revision, with the aim of contributing to the transformation of township economies “to allow all those working in Gauteng’s informal sector economies to do so with dignity, opportunity and adequate government support”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Sheikh said that while the act in its present form is “no longer that discriminatory” after certain provisions were removed, he remained concerned over the implementation and interpretation of the policy by law enforcement, and the municipal by-laws which are set to detail the requirements needed to obtain licences and access funds.</span>\r\n\r\n<span style=\"font-weight: 400;\">“As a forum, we are not against any legislation that will improve the lives of the marginalised, black population in townships and informal settlements, but we are against anything that will discriminate based on people’s documentation in the country or their nationality,” said Sheikh. </span>\r\n\r\n<span style=\"font-weight: 400;\">“</span><span style=\"font-weight: 400;\">We still believe that if the act will be inclusive, we will have no problem with it, but if [it] discriminates against the nationality of our members, or impedes the right of non-nationals in any way, the only remedy will be to challenge it in a court of law,” he said. </span>\r\n\r\n<span style=\"font-weight: 400;\">Ekambaram said that Lawyers for Human Rights and Seri “will be monitoring the implementation of this policy, and litigation is one of the options that will be considered if all attempts to engage with law enforcement agents is unsuccessful with respect to infringement of basic human rights and respect for human dignity of vulnerable populations living in townships in Gauteng”.</span>\r\n\r\n<span style=\"font-weight: 400;\">In response to questions from </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\">, Vuyo Mhaga, spokesperson for the Gauteng premier, said: “I don’t see how the act in its entirety will affect the rights of foreign nationals.</span>\r\n\r\n<span style=\"font-weight: 400;\">“Part of the act has [a] Township Partnership Fund which is designated for South African township-based companies.
