"contents": "<span style=\"font-weight: 400;\">By February 2022 the </span><a href=\"https://en.wikipedia.org/wiki/Portfolio_Committee_on_Health\"><span style=\"font-weight: 400;\">Portfolio Committee on Health</span></a><span style=\"font-weight: 400;\">, a National Assembly committee established to oversee the work of the Department of Health, had heard oral presentations on the </span><a href=\"https://www.gov.za/sites/default/files/gcis_document/201908/national-health-insurance-bill-b-11-2019.pdf%20\"><span style=\"font-weight: 400;\">National Health Insurance Bill</span></a><span style=\"font-weight: 400;\"> (the bill) from 117 individuals, organisations and institutions. Information from the presentations was collated by the </span><a href=\"https://pmg.org.za/committee-meeting/34403/\"><span style=\"font-weight: 400;\">Parliamentary Monitoring Group</span></a><span style=\"font-weight: 400;\">. Researchers from the </span><a href=\"https://www.samrc.ac.za/\"><span style=\"font-weight: 400;\">South African Medical Research Council</span></a><span style=\"font-weight: 400;\">, </span><a href=\"https://www.clintonhealthaccess.org/\"><span style=\"font-weight: 400;\">Clinton Health Access Initiative</span></a><span style=\"font-weight: 400;\"> and universities of the Western Cape and Cape Town analysed this information. </span>\r\n\r\n<span style=\"font-weight: 400;\">This article sets out to determine what the committee could take from these diverse public inputs on corruption and how it could inform its deliberations on the bill before it goes to the National Assembly. </span>\r\n\r\n<span style=\"font-weight: 400;\">All 117 submissions were searched for concerns about corruption, which troubled more than half (56%) of respondents. Forty-three percent were “silent” on corruption, while 2% felt it was not a concern. Every sector mentioned corruption. Only the private provider and state-related sectors had a minority expressing concern. </span>\r\n\r\n<b>‘Safeguards in place’ </b>\r\n\r\n<span style=\"font-weight: 400;\">Few respondents held the view that corruption was not a concern or that sufficient safeguards were in place to manage it. </span>\r\n\r\n<span style=\"font-weight: 400;\">The country’s governing party, the ANC, said “systems and processes that mitigate corruption are in place”. The </span><a href=\"https://www.gems.gov.za/\"><span style=\"font-weight: 400;\">Government Employees Medical Scheme</span></a><span style=\"font-weight: 400;\"> (GEMS) felt confident that corruption would be kept in check because section 20(2)(e) of the bill will establish an investigating unit within the national office of the National Health Insurance (NHI) fund for the purpose of investigating fraud, corruption and other criminal activities. GEMS felt the narrative that state-owned enterprises are always run badly was not true and that GEMS was an example of a well-run state institution.</span>\r\n\r\n<span style=\"font-weight: 400;\">Most respondents said that corruption threatened NHI capacity to meet its stated objectives. The </span><a href=\"https://www.chesai.org/\"><span style=\"font-weight: 400;\">Collaboration for Health Systems Analysis and Innovation</span></a><span style=\"font-weight: 400;\"> argued that “recent experience makes clear that the threat of corruption and misuse of health funds is a very real threat to the NHI and therefore to the health and well-being of everyone”. </span>\r\n\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://pmg.org.za/committee-meeting/34403/\"><span style=\"font-weight: 400;\">Democratic Alliance</span></a><span style=\"font-weight: 400;\"> pointed out that “public healthcare institutions have suffered from a culture of corruption and incompetence which has led to poor management, underfunding, understaffing, a loss of skilled staff and deteriorating infrastructure”. </span>\r\n\r\n<span style=\"font-weight: 400;\">Respondents highlighted five features that put the NHI at risk of corruption: the government’s lack of will and poor track record, lack of detail on prevention measures, increased opportunities for corruption, weak governance arrangements and inadequate safeguards.</span>\r\n\r\nhttps://www.dailymaverick.co.za/article/2022-04-03-ramaphosa-gets-anc-leadership-re-election-boost-as-ally-wins-mpumalanga/\r\n\r\n<b>Lack of political will</b>\r\n\r\n<a href=\"https://en.wikipedia.org/wiki/AfriForum\"><span style=\"font-weight: 400;\">AfriForum</span></a> <a href=\"https://pmg.org.za/committee-meeting/34311/\"><span style=\"font-weight: 400;\">commented</span></a><span style=\"font-weight: 400;\"> that the “government has demonstrated a clear lack of will to put an end to the systemic corruption plaguing all governmental sectors… This rampant culture of corruption will simply bleed the potential NHI fund dry.”</span>\r\n\r\n<a href=\"https://cpsychsa.org/\"><span style=\"font-weight: 400;\">Counselling Psychology South Africa</span></a> <a href=\"https://pmg.org.za/committee-meeting/33227/\"><span style=\"font-weight: 400;\">pointed out</span></a><span style=\"font-weight: 400;\"> that “whilst the president has indicated that NHI funds will be closely guarded, the Auditor-General’s findings into the Department of Health, among others, potentially suggest otherwise... the loss of funds [to corruption] also seems to be accompanied by a lack of accountability. Where qualified audits are issued little disciplinary, criminal investigation or sanction seems to follow.”</span><b> </b>\r\n\r\n<a href=\"https://section27.org.za/\"><span style=\"font-weight: 400;\">Section 27</span></a><span style=\"font-weight: 400;\"> and the</span> <a href=\"https://www.tac.org.za/\"><span style=\"font-weight: 400;\">Treatment Action Campaign</span></a> <span style=\"font-weight: 400;\">said the bill “lacks detail on the prevention of corruption [which] renders health more vulnerable to corruption”. </span>\r\n\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://www.sada.co.za/\"><span style=\"font-weight: 400;\">South African Dental Association</span></a> <span style=\"font-weight: 400;\">said “the NHI will essentially become a state-owned entity with an annual budget that could top R450- billion. These wide-ranging powers will create a ‘capturable’ governance structure. To date, no minister has been held to account for State Capture. What will be different here?” </span>\r\n\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://irr.org.za/\"><span style=\"font-weight: 400;\">Institute of Race Relations</span></a> <span style=\"font-weight: 400;\">thought the “NHI will bring increased fraud and corruption”. </span>\r\n\r\n<span style=\"font-weight: 400;\">The DA was concerned that “over R200-billion will be vulnerable to theft, lack of oversight and accountability”. The Western Cape government</span> <span style=\"font-weight: 400;\">argued that vesting so much strategic purchasing power in one entity would make the NHI fund a target for corruption. </span>\r\n\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://www.bhfglobal.com/\"><span style=\"font-weight: 400;\">Board of Healthcare Funders</span></a><span style=\"font-weight: 400;\"> observed that “the bill is weak on corporate governance... sound corporate governance is critical for preventing mismanagement of assets, corruption, inefficiency, illegality, unethical conduct, abuse of the fund’s resources and the collapse of the fund”. </span>\r\n\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://www.sahrc.org.za/\"><span style=\"font-weight: 400;\">South African Human Rights Council</span></a><span style=\"font-weight: 400;\"> argued that “the NHI in its current form is complex and offers myriad opportunities for corruption and looting, particularly in areas where contracts are entered into”. </span>\r\n\r\n<span style=\"font-weight: 400;\">Section 27</span> <span style=\"font-weight: 400;\">and </span><a href=\"https://www.concentricalliance.com/\"><span style=\"font-weight: 400;\">Concentric Alliance</span></a><span style=\"font-weight: 400;\"> were concerned about how existing and proposed governance systems would engage, saying that the bill “concentrates too much power in the hands of the minister of health without providing the necessary oversight over the planned massive resources of the NHI”. </span>\r\n\r\n<span style=\"font-weight: 400;\">This concern was shared by UCT’s Faculty of Health Science, the </span><a href=\"https://phmovement.org/\"><span style=\"font-weight: 400;\">People’s Health Movement</span></a><span style=\"font-weight: 400;\">, the </span><a href=\"https://www.hfassociation.co.za/\"><span style=\"font-weight: 400;\">Health Funders Association</span></a><span style=\"font-weight: 400;\"> and the </span><a href=\"https://hsf.org.za/\"><span style=\"font-weight: 400;\">Helen Suzman Foundation</span></a><span style=\"font-weight: 400;\">. </span>\r\n\r\n<b>Inadequate protection </b>\r\n\r\n<span style=\"font-weight: 400;\">Cosatu said “the biggest contentious issue around the NHI is around the capability of the state to manage the NHI fund as well as the protection of the fund from unethical and unlawful practices in relation to the fund”. The DA, the </span><a href=\"https://en.wikipedia.org/wiki/FW_de_Klerk_Foundation\"><span style=\"font-weight: 400;\">FW de Klerk Foundation</span></a><span style=\"font-weight: 400;\"> and the </span><a href=\"https://www.samedical.org/\"><span style=\"font-weight: 400;\">South African Medical Association</span></a><span style=\"font-weight: 400;\"> agreed that, although they “endorse the envisaged corruption-fighting investigating unit [clause 20(2)e], it will be ineffective if the corruption develops within the NHI fund itself, as the unit will be unable to confront corruption from within”. </span>\r\n\r\n<span style=\"font-weight: 400;\">Mutual financial services company </span><a href=\"https://www.pps.co.za/our-story\"><span style=\"font-weight: 400;\">PPS</span></a><span style=\"font-weight: 400;\"> and several other bodies felt that “without fixing the issue of corruption no system will be sustainable”, implying that the NHI should not be considered until corruption and other concerns are addressed.</span>\r\n\r\n<span style=\"font-weight: 400;\">There were broad recommendations for managing corruption. The South African Communist Party argued that “the</span> <span style=\"font-weight: 400;\">NHI fund must have inbuilt mechanisms to fight corruption. This should include efforts to ensure greater transparency and accountability, including in the use of public funds and ensuring they are directed to those who need them most”. </span>\r\n\r\n<span style=\"font-weight: 400;\">Calls for stronger governance structures, better management, greater accountability and greater enforcement of controls over corruption were made by the </span><a href=\"https://phasa.org.za/\"><span style=\"font-weight: 400;\">Public Health Association of South Africa</span></a><span style=\"font-weight: 400;\">, the Health Funders Association, PPS, the </span><a href=\"https://www.sahrc.org.za/\"><span style=\"font-weight: 400;\">South African Human Rights Commission</span></a><span style=\"font-weight: 400;\">, the </span><a href=\"https://cansa.org.za/\"><span style=\"font-weight: 400;\">Cancer Association of South Africa</span></a><span style=\"font-weight: 400;\"> and others. </span>\r\n\r\n<span style=\"font-weight: 400;\">Greater clarity was requested. The </span><a href=\"https://www.psyssa.com/\"><span style=\"font-weight: 400;\">Psychological Society of South Africa</span></a> <span style=\"font-weight: 400;\">called for clarification on</span> <span style=\"font-weight: 400;\">the</span> <span style=\"font-weight: 400;\">role of provincial departments relative to the Health Ministry, mechanisms the minister would use for NHI expenditure control, and the </span><a href=\"https://healthombud.org.za/\"><span style=\"font-weight: 400;\">Health Ombud</span></a><span style=\"font-weight: 400;\">’s role.</span>\r\n\r\n<span style=\"font-weight: 400;\">Stellenbosch University</span> <span style=\"font-weight: 400;\">sought clarity on the “fit and proper person” requirement for board members. </span>\r\n\r\n<b>Accountability to Parliament, not minister</b>\r\n\r\n<span style=\"font-weight: 400;\">There were some specific recommendations. The South African Medical Research Council, UCT’s Faculty of Health, </span><a href=\"https://iconsa.co.za/\"><span style=\"font-weight: 400;\">Icon Oncology</span></a><span style=\"font-weight: 400;\"> and others proposed that the fund should be accountable to Parliament, not the minister, and the minister’s powers should be reduced. The </span><a href=\"https://www.hpasa.co.za\"><span style=\"font-weight: 400;\">Health Products Association of Southern Africa</span></a><span style=\"font-weight: 400;\"> recommended that “Parliament should play an oversight role like it does with other Chapter 9 institutions”. The issues related to direct government oversight and the role of the Minister of Health are complex and have been examined </span><a href=\"https://doi.org/10.7196/SAMJ.2022.v112i5.16414\"><span style=\"font-weight: 400;\">elsewhere</span></a><span style=\"font-weight: 400;\">. </span>\r\n\r\n<span style=\"font-weight: 400;\">On the appointment of the board,</span> <a href=\"https://momentummedicalscheme.co.za/\"><span style=\"font-weight: 400;\">Momentum</span></a><span style=\"font-weight: 400;\"> medical scheme recommended using a judicial panel,</span> <span style=\"font-weight: 400;\">while </span><a href=\"https://www.busa.org.za\"><span style=\"font-weight: 400;\">Business Unity South Africa</span></a><span style=\"font-weight: 400;\"> advocated a parliamentary process, rather than ministerial discretion.</span> <span style=\"font-weight: 400;\">The</span> <a href=\"https://sacohsd.co.za/\"><span style=\"font-weight: 400;\">South African Committee of Health Sciences Deans</span></a> <span style=\"font-weight: 400;\">proposed that “the person [board member] should not have a criminal record and should not have been convicted for fraud or corruption”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Others suggested the inclusion of penalties to prevent abuse. The</span> <a href=\"https://hasa.co.za/\"><span style=\"font-weight: 400;\">Hospital Association of South Africa</span></a> <span style=\"font-weight: 400;\">felt the bill should “articulate sanctions that can be taken against board members for not ensuring the sustainability of the fund or engaging in fraudulent and corrupt activities”. The </span><a href=\"https://www.sanc.co.za/\"><span style=\"font-weight: 400;\">SA Nursing Council</span></a><span style=\"font-weight: 400;\"> proposed that the committee should be empowered to award a cost order to prevent abuse.</span>\r\n\r\n<span style=\"font-weight: 400;\">With regard to the bill’s proposal regarding an anti-corruption unit for the NHI fund, the </span><a href=\"https://nhcpa.org.za/\"><span style=\"font-weight: 400;\">National Health Care Professionals Association</span></a><span style=\"font-weight: 400;\"> and the Psychological Society of South Africa agreed that “the fund cannot investigate itself and must be subject to external scrutiny”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Greater civil society representation was sought. Cosatu called for “broader representation of key stakeholders on the fund, including organised labour”. The People’s Health Movement held that participation was a key element of the right to health and argued for incorporation of the participatory structures of the National Health Act. Section 27, Concentric Alliance and the Khayelitsha and Klipfontein health forums</span> <span style=\"font-weight: 400;\">argued for provision in the legislation for civil society representation in the NHI board, and other structures, to hold the government accountable. </span>\r\n\r\n<b>Whistle-blowing recommendation </b>\r\n\r\n<span style=\"font-weight: 400;\">The FW de Klerk Foundation suggested the </span><a href=\"https://www.uhc2030.org/blog-news-events/uhc2030-news/south-africas-path-to-universal-health-coverage-a-new-presidential-health-compact-555310/\"><span style=\"font-weight: 400;\">Presidential Health Summit Compact</span></a><span style=\"font-weight: 400;\"> recommendation on whistle-blowing be incorporated. This would ensure ease of reporting and consider political interference a corrupt activity.</span>\r\n\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://psam.org.za/\"><span style=\"font-weight: 400;\">Public Service Accountability Monitor</span></a><span style=\"font-weight: 400;\"> called for adherence to the </span><a href=\"https://fiscaltransparency.net/public-participation-principles-and-guide/\"><span style=\"font-weight: 400;\">Global Initiative for Fiscal Transparency</span></a><span style=\"font-weight: 400;\">’s principles of public participation, especially when considering access to information. It argued that “good governance and accountability are supported through increased levels of transparency, whereas corruption and maladministration thrive where access to information is restricted”. </span>\r\n\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://samed.org.za/wp-content/uploads/2020/12/SAMED-the-SA-medtech-industry.pdf\"><span style=\"font-weight: 400;\">South African Medical Technology Industry Association</span></a><span style=\"font-weight: 400;\"> and the </span><a href=\"https://web.facebook.com/ActiveCitizensMovement/?_rdc=1&_rdr\"><span style=\"font-weight: 400;\">Active Citizen’s Movement</span></a><span style=\"font-weight: 400;\"> made similar calls.</span>\r\n\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://blackbusinesscouncil.africa/\"><span style=\"font-weight: 400;\">Black Business Council</span></a> <span style=\"font-weight: 400;\">recommended National Treasury’s provision of transversal contracts as a procurement model, as it was “a very transparent process — everyone knew who the players were, and the pricing structures”. This “balanced the need to prioritise black-owned companies and mitigate the risk of abuse”.</span>\r\n\r\n<span style=\"font-weight: 400;\">The Western Cape government</span> <span style=\"font-weight: 400;\">argued for the decentralisation of the strategic purchaser role to the provinces, saying this role was critical to achieving universal access to quality healthcare and the purchasing of services to meet people’s needs and expectations was best done regionally. </span>\r\n\r\n<b>Make or break</b>\r\n\r\n<span style=\"font-weight: 400;\">A high level of concern about corruption was expressed by respondents across all sectors, with many providing suggestions for its management. </span>\r\n\r\n<span style=\"font-weight: 400;\">The portfolio committee must consider whether the threats posed by corruption are of such a nature that the NHI would be unable to deliver on its stated objectives.
