"contents": "<span style=\"font-weight: 400;\">About </span><a href=\"https://www.who.int/news/item/09-09-2019-suicide-one-person-dies-every-40-seconds\"><span style=\"font-weight: 400;\">79% of suicides</span></a><span style=\"font-weight: 400;\"> occur in low- and middle-income countries although suicide rates are highest in high income countries.</span>\r\n\r\n<span style=\"font-weight: 400;\">In </span><a href=\"https://www.theguardian.com/global-development/2021/sep/09/suicide-still-treated-as-a-in-at-least-20-countries-report-finds\"><span style=\"font-weight: 400;\">no fewer than 20 countries</span></a><span style=\"font-weight: 400;\">, </span><a href=\"https://www.who.int/news-room/fact-sheets/detail/suicide\"><span style=\"font-weight: 400;\">suicide</span></a><span style=\"font-weight: 400;\"> is a crime. But that has never succeeded in </span><a href=\"http://apps.who.int/iris/bitstream/handle/10665/131056/9789241564779_eng.pdf?sequence=1\"><span style=\"font-weight: 400;\">eliminating it</span></a><span style=\"font-weight: 400;\">. </span><a href=\"https://nsrf.ie/wp-content/uploads/journals/98/ReligiousSanctions&RatesofSuicide.pdf;%20https://onlinelibrary.wiley.com/doi/epdf/10.1111/j.1600-0447.1996.tb09857.x\"><span style=\"font-weight: 400;\">Research findings</span></a><span style=\"font-weight: 400;\"> show reservations as to whether legal or religious sanctions can actually serve to prevent suicides. While </span><a href=\"https://www.ncbi.nlm.nih.gov/pmc/articles/PMC3785100/pdf/nihms511120.pdf\"><span style=\"font-weight: 400;\">moral and religious objections</span></a><span style=\"font-weight: 400;\"> to suicide may reduce suicidal behaviour, legal sanctions hardly have any discernible effect. For instance, in the UK, suicide rates did not </span><a href=\"https://onlinelibrary.wiley.com/doi/epdf/10.1111/j.1600-0447.1996.tb09857.x.\"><span style=\"font-weight: 400;\">increase</span></a><span style=\"font-weight: 400;\"> after it was decriminalised.</span>\r\n\r\n<span style=\"font-weight: 400;\">In Nigeria, the legal position is that suicide is not a crime but attempted suicide is. </span><a href=\"https://legalnaija.com/what-is-penalty-for-attempted-suicide/02900951941647681314/#:%7E:text=Section%20327%20of%20the%20Criminal,to%20imprisonment%20for%20one%20year.\"><span style=\"font-weight: 400;\">Section 327 in the Criminal Code Act</span></a><span style=\"font-weight: 400;\"> (which applies to southern Nigeria) states that:</span>\r\n\r\n<i><span style=\"font-weight: 400;\">Any person who attempts to kill himself is guilty of a misdemeanour, and is liable to imprisonment for one year.</span></i>\r\n\r\n<span style=\"font-weight: 400;\">Similarly, section 231 of the penal code (applicable to northern Nigeria) asserts that:</span>\r\n\r\n<i><span style=\"font-weight: 400;\">Whoever attempts to commit suicide and does any act towards the commission of such offence, shall be punished with imprisonment for a term which may extend to one year or with fine or with both.</span></i>\r\n\r\n<span style=\"font-weight: 400;\">Despite the criminalisation of attempted suicide in Nigeria, the rate of suicide is still considerably high at </span><a href=\"https://www.who.int/publications/i/item/9789240026643\"><span style=\"font-weight: 400;\">6.9 per 100,000</span></a><span style=\"font-weight: 400;\"> of the population in 2019. This translates to roughly 7,019 people a year. The current rate is less than the average global rate of 9.0 per 100,000. While the suicide rate in Africa appears to be lower than the </span><a href=\"https://www.who.int/publications/i/item/9789240026643\"><span style=\"font-weight: 400;\">global average</span></a><span style=\"font-weight: 400;\">, it is still worrying.</span>\r\n\r\n<strong>Impact of law</strong>\r\n\r\n<span style=\"font-weight: 400;\">The impact of criminalising attempted suicide is multi-dimensional.</span>\r\n\r\n<span style=\"font-weight: 400;\">First, it turns a distressed human being into a criminal. Research has shown that about </span><a href=\"https://mhfaengland.org/mhfa-centre/research-and-evaluation/mental-health-statistics/;%20https://www.ncbi.nlm.nih.gov/pmc/articles/PMC6165520/\"><span style=\"font-weight: 400;\">90% of those who attempt suicide</span></a><span style=\"font-weight: 400;\"> have a mental health problem. A considerable proportion – 20.8% to 35.8% – of those would be suffering from depression.</span>\r\n\r\n<span style=\"font-weight: 400;\">Second, it may impel the person to attempt suicide again so as not to suffer the legal consequences.</span>\r\n\r\n<span style=\"font-weight: 400;\">Third, it distracts society from focusing on care and treatment. Instead, it directs resources towards punishment, which has not been shown to have any </span><a href=\"https://unitedgmh.org/suicide-decriminalisation\"><span style=\"font-weight: 400;\">significant deterrent effect</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<strong>Need to decriminalise suicide</strong>\r\n\r\n<span style=\"font-weight: 400;\">There are several good reasons to urgently decriminalise attempted suicide in Nigeria.</span>\r\n\r\n<span style=\"font-weight: 400;\">First, it is inconsistent to legally define as a crime the attempt of something that in itself is not a crime.</span>\r\n\r\n<span style=\"font-weight: 400;\">Second, the legal definition of an attempt </span><a href=\"https://www.lawhub.com.ng/law-of-attempt/\"><span style=\"font-weight: 400;\">comprises</span></a><span style=\"font-weight: 400;\"> intention, preparation and the actual attempt. Legal deterrents can only confront deteriorating mental well-being at the last stage – attempted suicide. Mental health assessments on the other hand could easily identify the earliest stages of suicidal ideation (intention) and preparation. In terms of effectiveness of deterrence, help is better than punishment. </span><a href=\"https://www.ajol.info//index.php/eamj/article/view/8983\"><span style=\"font-weight: 400;\">Research</span></a><span style=\"font-weight: 400;\"> has shown that most that attempt suicide would be suffering from mental disorders and it would be patently unjust to punish the sick instead of caring for them.</span>\r\n\r\n<span style=\"font-weight: 400;\">Finally, if attempted suicide wasn’t a crime, the associated stigma would be removed and people might feel more able to talk about it and obtain the help that they needed.</span>\r\n\r\n<strong>Suicide prevention</strong>\r\n\r\n<span style=\"font-weight: 400;\">The WHO has formulated steps that may be taken to </span><a href=\"https://apps.who.int/iris/bitstream/handle/10665/279765/9789241515016-eng.pdf?ua%3D1\"><span style=\"font-weight: 400;\">prevent suicide</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">First, governments must provide leadership in establishing policies. Parliament should decriminalise attempted suicide so that people can get care instead. The Lagos State government, </span><a href=\"https://laws.lawnigeria.com/2018/03/02/lagos-state-criminal-law/\"><span style=\"font-weight: 400;\">via its 2011 criminal law,</span></a><span style=\"font-weight: 400;\"> has already made a move by providing a hospitalisation order in cases of attempted suicide.</span>\r\n\r\n<span style=\"font-weight: 400;\">Governments must also develop and implement culturally appropriate and evidence-driven preventive interventions. It requires a vision with targets and a definite time frame.</span>\r\n\r\n<span style=\"font-weight: 400;\">Governments, as well as citizens, can play a part by reducing access to the various means of committing suicide. For example, it has been shown that </span><a href=\"http://www.biomedcentral.com/1471-2458/7/357\"><span style=\"font-weight: 400;\">30% of suicides</span></a><span style=\"font-weight: 400;\"> are achieved through the use of pesticides.</span>\r\n\r\n<span style=\"font-weight: 400;\">Young people also need to be helped to develop personal resilience: building life skills, improving self-esteem, developing problem-solving skills, embracing realistic optimism and even using spirituality.</span>\r\n\r\n<span style=\"font-weight: 400;\">The media should report suicide-related news responsibly, which will help to avoid “copycat suicides”. There are </span><a href=\"https://www.who.int/mental_health/prevention/suicide/resource_media.pdf\"><span style=\"font-weight: 400;\">media guidelines</span></a><span style=\"font-weight: 400;\"> for responsible suicide reportage.</span>\r\n\r\n<span style=\"font-weight: 400;\">At the family and individual level, it is crucial to </span><a href=\"https://www.sprc.org/settings/family-members-and-caregivers\"><span style=\"font-weight: 400;\">give and receive social support</span></a><span style=\"font-weight: 400;\"> (paying attention, active listening, sharing encouraging words) from one another.
