"contents": "<span style=\"font-weight: 400;\">This was revealed in the final report by the Independent Police Investigation Directorate (Ipid) into circumstances leading to the murder of Lieutenant-Colonel Charl Kinnear outside his home in Bishop Lavis in September 2020. The report has now been sent to Police Minister Bheki Cele.</span>\r\n\r\n<span style=\"font-weight: 400;\">Sitole needed, said Ipid executive director Jennifer Nthlaseng, to clarify certain questions that had been raised through the Kinnear investigation.</span>\r\n\r\n<span style=\"font-weight: 400;\">“For instance, his role as accounting officer and recipient of the Kinnear 59-page dossier; his action or inaction to the allegation contained in the said dossier; his perceived failures in addressing the removal of the Kinnear protection in 2019 and his leadership role in containing or addressing the factions within the Western Cape SAPS.”</span>\r\n\r\n<span style=\"font-weight: 400;\">The report also made the finding that retired Anti-Gang Unit head André Lincoln was “entirely responsible for the withdrawal of the late Colonel </span><a href=\"https://www.dailymaverick.co.za/article/2022-06-04-no-one-is-safe-widow-nicolette-kinnear-stares-down-a-system-that-failed-a-top-cop-husband-and-father/\"><span style=\"font-weight: 400;\">Kinnear’s protection”</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">It was the investigative team’s view that Lincoln’s conduct “was as much to blame for the sequelae of events”, as was that of a major general and a warrant officer, both of the Directorate for Priority Crime Investigation (DPCI).</span>\r\n\r\n<span style=\"font-weight: 400;\">However “Major Lincoln had unfortunately retired at the end of November 2021 before an recommendations </span><i><span style=\"font-weight: 400;\">[sic]</span></i><span style=\"font-weight: 400;\"> could be implemented” noted the report.</span>\r\n\r\n<span style=\"font-weight: 400;\">The Ipid report has also vindicated Kinnear, former Crime Intelligence head, Peter Jacobs and Western Cape detective boss, Jeremy Vearey’s long-standing attempt to flush out a “rogue unit” in the Western Cape Crime Intelligence Division.</span>\r\n\r\n<span style=\"font-weight: 400;\">With regard to Jacobs’ alleged role in Kinnear’s death, investigators “could not establish any wrongdoing by Lieutenant General Jacobs”. </span>\r\n\r\n<span style=\"font-weight: 400;\">The Ipid investigators found there was “sufficient evidence” that a rogue unit existed in Western Cape Crime Intelligence, reporting to Brigadier Hansia Hansraj. This unit had investigated Kinnear, Jacobs and Vearey.</span>\r\n\r\n<span style=\"font-weight: 400;\">The unit had not registered any of their investigations as they should have, and had carried, registered and inspected their own dockets.</span>\r\n\r\n<span style=\"font-weight: 400;\">The animosity created between SAPS members in the Crime Intelligence environment could have, noted the report, “created the perfect environment for underworld syndicates and figures such as Nafiz Modack to infiltrate SAPS and to monitor the movement of key role players including the use of state resources”.</span>\r\n\r\n<span style=\"font-weight: 400;\">The finding of the Ipid task team was that if “these rogue opportunities were allowed to continue, it has potential to subvert the entire Western Cape Police Service”.</span>\r\n\r\n<span style=\"font-weight: 400;\">It is clear from the report that the National Head of Investigations at the NPA stepped in with “specific directives for Ipid to attend to queries”. </span>\r\n\r\n<span style=\"font-weight: 400;\">This after the DPP in the Western Cape had declined in 2020 to prosecute dockets that Ipid had previously forwarded to the authority with regard to the rogue Crime Intelligence members.</span>\r\n\r\n<span style=\"font-weight: 400;\">“</span><span style=\"font-weight: 400;\">The queries stem from case dockets Parow CAS 395/04/2019 & Parow 396/04/2019 wherein a complainant is identified as Nafiz Modack.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Sitole, who has consistently refused to account to Ipid investigators for his role in the Kinnear tragedy despite the threat of </span><a href=\"https://www.dailymaverick.co.za/article/2022-01-26-ipid-registers-criminal-case-against-national-commissioner-sitole-for-dodging-questions-on-kinnear-assassin\"><span style=\"font-weight: 400;\">criminal charges for violating sections of the Ipid Act</span></a><span style=\"font-weight: 400;\">, has remained silent.</span>\r\n\r\n<span style=\"font-weight: 400;\">It was Sitole, alongside Cele, who had originally called for the Ipid investigation.</span>\r\n\r\n<span style=\"font-weight: 400;\">This after a public outcry and also because Kinnear was deeply involved in a high-profile investigation of a network of corrupt cops and their links to underworld figures in a gun-licensing racket.</span>\r\n\r\n<a href=\"https://www.dailymaverick.co.za/article/2022-06-06-plea-deal-links-alleged-gangster-nafiz-modack-to-hits-on-cape-town-figures/\"><span style=\"font-weight: 400;\">Modack</span></a><span style=\"font-weight: 400;\">, a Cape Town crime boss, has since been charged, with others, for planning and executing the assassination plot.</span>\r\n\r\n<span style=\"font-weight: 400;\">A </span><a href=\"https://www.dailymaverick.co.za/article/2021-11-12-saps-threw-charl-kinnear-to-the-wolves/\"><span style=\"font-weight: 400;\">preliminary report, </span></a><span style=\"font-weight: 400;\">which was obtained by </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\"> in November 2021, found damning evidence of </span><span style=\"font-weight: 400;\">deep investigative weaknesses, broken chains of command, insufficient experience among Anti-Gang Unit staff including its commander, Lincoln.</span>\r\n\r\n<span style=\"font-weight: 400;\">The final report by Ipid executive director Ntlaseng, dated 11 May, set out that a “second leg” of the investigation “</span><span style=\"font-weight: 400;\">not only confirmed the findings of the preliminary report but further established evidence that all members mentioned in the report undeniably committed acts of misconduct and some committed criminal offences”.</span><b> DM</b>\r\n\r\nRead our additional coverage on the report <a href=\"https://www.dailymaverick.co.za/article/2022-06-24-killing-charl-kinnear-could-collapse-critical-cop-gun-corruption-cases/\">here</a>, <a href=\"https://www.dailymaverick.co.za/article/2022-06-24-clear-and-present-danger-rogue-cop-unit-could-subvert-western-cape-police-service-unless-shut-down/\">here</a>, <a href=\"https://www.dailymaverick.co.za/article/2022-06-24-pinging-kinnear-hawks-head-godfrey-lebeya-failed-to-protect-national-security-and-the-top-detective/\">here</a> and <a href=\"https://www.dailymaverick.co.za/article/2022-06-24-disband-western-cape-anti-gang-unit-police-watchdog-recommends/\">here</a>.",
