"contents": "<span style=\"font-weight: 400;\">A year remains before anti-nuclear activist Peter Becker’s term on the National Nuclear Regulator (NNR) board ends, and there is still no sign of him resuming his duties. Now, </span><span style=\"font-weight: 400;\">Mineral Resources and Energy Minister</span><span style=\"font-weight: 400;\"> Gwede Mantashe and the NNR have signalled they will petition the Supreme Court of Appeal (SCA), after the Western Cape high court last month, denied them the opportunity of leave to appeal. </span>\r\n\r\n<span style=\"font-weight: 400;\">Becker has been barred from the NNR board processes since his suspension, and subsequent dismissal from the board by Minister Mantashe in January last year.</span>\r\n\r\n<span style=\"font-weight: 400;\">The law firm Webber Wentzel is handling Becker’s case pro bono. This week, partner at the firm, Dario Milo confirmed to </span><i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\"> that the NNR and Minister Mantashe have both indicated through their attorneys that they will petition the SCA to get leave to appeal against the Western Cape high court judgment, which </span><a href=\"https://www.dailymaverick.co.za/article/2023-01-20-gwede-mantashe-axing-of-nuclear-watchdog-activist-peter-becker-was-unconstitutional-rules-court/\"><span style=\"font-weight: 400;\">found Becker’s axing from the NNR board was unlawful</span></a><span style=\"font-weight: 400;\">.</span><span style=\"font-weight: 400;\"> </span>\r\n\r\n<span style=\"font-weight: 400;\">Following the Western Cape high court judgment of January 2023, the Minister and the NNR initially filed applications in the same court for leave to appeal to the SCA. However, Western Cape high court Judge Babalwa Mantame stood by her initial ruling and, on 26 May, refused Mantashe and the NNR leave to appeal the matter. </span>\r\n\r\n<span style=\"font-weight: 400;\">Both respondents received a thorough dressing-down from Judge Mantame and were ordered to pay the costs of the application. </span>\r\n\r\n<b>Read in Daily Maverick:</b> <a href=\"https://www.dailymaverick.co.za/article/2023-05-28-court-castigates-gwede-mantashe-on-axing-of-anti-nuclear-activist-denies-leave-to-appeal/\"><span style=\"font-weight: 400;\">Court castigates Gwede Mantashe on axing of anti-nuclear activist, denies leave to appeal</span></a>\r\n\r\n<span style=\"font-weight: 400;\">Their leave to appeal application will need to be filed by 26 June. Milo said he has not yet received the application.</span>\r\n\r\n<span style=\"font-weight: 400;\">“If the SCA refuses leave to appeal, the Minister and the NNR could apply to the president of the SCA who may refer the case to the SCA for reconsideration, and therefore there is the possibility of an appeal to the Constitutional Court,” Milo said in a </span><a href=\"https://koebergalert.org/2023/06/14/nnr-court-case-heading-to-the-supreme-court/\"><span style=\"font-weight: 400;\">statement</span></a><span style=\"font-weight: 400;\"> by the Koeberg Alert Alliance (KAA), on Wednesday.</span>\r\n\r\n<span style=\"font-weight: 400;\">Becker was appointed to the NNR board in June 2021, to represent communities affected by nuclear activities. He was nominated by civil society organisations, including the KAA, the Southern African Faith Communities’ Environment Institute and the Pelindaba Working Group. </span>\r\n\r\n<span style=\"font-weight: 400;\">However, after only eight months into his three-year term, Becker was </span><a href=\"https://www.dailymaverick.co.za/article/2022-01-20-mantashe-boots-civil-society-representative-from-nuclear-regulator-just-as-contentious-koeberg-work-gets-nod/\"><span style=\"font-weight: 400;\">suspended from the board in January 2022</span></a><span style=\"font-weight: 400;\">, and later fired by Mantashe, who had alleged Becker was guilty of “misconduct” and was “conflicted” after he gave an interview in which he raised concerns about the use of nuclear power in South Africa, and after he convened a meeting with civil society organisations.</span>\r\n\r\n<span style=\"font-weight: 400;\">Becker </span><a href=\"https://www.dailymaverick.co.za/article/2022-04-19-fired-national-nuclear-regulator-board-member-takes-minister-gwede-mantashe-to-court/\"><span style=\"font-weight: 400;\">launched a court bid to challenge his axing</span></a><span style=\"font-weight: 400;\"> last April. </span>\r\n\r\n<span style=\"font-weight: 400;\">The reasons and decision of Mantashe to discharge Becker from his office as a director of the board, Judge Mantame ordered in January, were reviewed and set aside. However, Becker is currently being excluded from the NNR board and its processes as the court saga is set to continue. </span>\r\n\r\n<span style=\"font-weight: 400;\">He had hoped that the Western Cape high court’s judgement would be accepted by all parties concerned so that he could resume his duties on the board. </span>\r\n\r\n\"So far, I've been prevented from carrying out my duties on the board for over half of my three-year term. It's disappointing that this is now going to be extended while further steps are taken to attempt to have this matter heard by the SCA,\" said Becker.\r\n\r\n<span style=\"font-weight: 400;\">In the KAA statement, Mariette Liefferink, who was appointed as community representative on the NNR board in 2010, was concerned about there being no community representative on the board for the last 18 months. </span>\r\n\r\n<span style=\"font-weight: 400;\">“The lack of civil society representation on the Board of the NNR undermines the democratisation and independence of the NNR and deprives civil society of a voice in matters pertaining to nuclear waste management including the management of radioactive mine residue areas and nuclear safety,” said Liefferink.</span>\r\n\r\n<i><span style=\"font-weight: 400;\">Daily Maverick</span></i><span style=\"font-weight: 400;\"> contacted the Department of Mineral Resources and Energy (DMRE) on Monday, but did not receive a response to our queries by the time of publication. "description": "<span style=\"font-weight: 400\">Gwede Mantashe is a South African politician and the current Minister of Mineral Resources and Energy within the African National Congress (ANC). </span>\r\n\r\n<span style=\"font-weight: 400\">The portfolio was called the Ministry of Minerals and Energy until May 2009, when President Jacob Zuma split it into two separate portfolios under the Ministry of Mining (later the Ministry of Mineral Resources) and the Ministry of Energy. Ten years later, in May 2019, his successor President Cyril Ramaphosa reunited the portfolios as the Ministry of Mineral Resources and Energy. </span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe</span><span style=\"font-weight: 400\"> was born in 1955 in the Eastern Cape province, and began his working life at Western Deep Levels mine in 1975 as a Recreation Officer and, in the same year, moved to Prieska Copper Mines where he was Welfare Officer until 1982.</span>\r\n\r\n<span style=\"font-weight: 400\">He then joined Matla Colliery and co-founded the Witbank branch of the National Union of Mine Workers (NUM), becoming its Chairperson. He held the position of NUM Regional Secretary in 1985. Mantashe showcased his skills and leadership within the NUM, serving as the National Organiser from 1988 to 1993 and as the Regional Coordinator from 1993 to 1994.</span>\r\n\r\n<span style=\"font-weight: 400\">From 1994 to 1998, Mantashe held the role of Assistant General Secretary of the NUM and was later elected General Secretary in 1998.</span>\r\n\r\n<span style=\"font-weight: 400\">During his initial tenure in government, Mantashe served as a Councillor in the Ekurhuleni Municipality from 1995 to 1999. Notably, he made history by becoming the first trade unionist appointed to the Board of Directors of a Johannesburg Stock Exchange-listed company, Samancor.</span>\r\n\r\n<span style=\"font-weight: 400\">In May 2006, Mantashe stepped down as the General Secretary of the NUM and took on the role of Executive Director at the Development Bank of Southern Africa for a two-year period. He also chaired the Technical Working Group of the Joint Initiative for Priority Skills Acquisition.</span>\r\n\r\n<span style=\"font-weight: 400\">In 2007, Mantashe became the Chairperson of the South African Communist Party and a member of its Central Committee. He was elected Secretary-General of the African National Congress (ANC) at the party's 52nd National Conference in December 2007. Mantashe was re-elected to the same position in 2012. Additionally, at the ANC's 54th National Conference in 2017, he was elected as the National Chairperson.</span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe is a complex and controversial figure. He has been accused of being too close to the ANC's corrupt leadership, and of being a hardliner who is opposed to reform. </span>\r\n\r\n<span style=\"font-weight: 400\">His actions and statements have sparked controversy and allegations of protecting corruption, undermining democratic principles, and prioritising party loyalty over the interests of the country.</span>",
