"contents": "<span style=\"font-weight: 400;\">The Office of the Credit</span> <span style=\"font-weight: 400;\">Ombud has hailed 2021 as the “year of recovery”, although there have been 27% more disputes than the previous year, with 69% settled in favour of consumers. </span>\r\n\r\n<span style=\"font-weight: 400;\">Credit Ombudsman Howard Gabriels says the pandemic had a devastating impact on consumers, where many individuals lost their jobs and families lost loved ones. </span>\r\n\r\n<span style=\"font-weight: 400;\">“Many credit consumers could no longer fulfil their obligations to make payments on loans. Credit providers faced challenges as they suffered massive cash flow crises and had to accommodate consumers with payment holidays and other measures of support.” </span>\r\n\r\n<span style=\"font-weight: 400;\">Lee Soobrathi, head of the Case Management Department at the Ombud’s Office, says the past year included a number of teachable moments, with difficult conversations around application of the National Credit Act. </span>\r\n\r\n<span style=\"font-weight: 400;\">“When consumers approach us, they are often bewildered, frustrated and angry, and we have to resolve complaints in a way that is fair and balanced to both parties,” he says. </span>\r\n\r\n<span style=\"font-weight: 400;\">Soobrathi says it is not uncommon to find consumers simply stop paying an account or debt because they are unhappy with the way that a creditor such as a bank has handled their complaint. </span>\r\n\r\n<span style=\"font-weight: 400;\">“There needs to be more education around the fact that you have to keep up your credit repayments, even if you have a query on your account or you have a dispute. </span>\r\n\r\n<span style=\"font-weight: 400;\">“Failing to make payments or paying late reflects negatively on your credit profile, which will ultimately impact your ability to access credit later,” he notes. </span>\r\n\r\n<span style=\"font-weight: 400;\">One of the main categories of disputes was statements of account, which includes allocation of payments, interest charges and unauthorised charges. </span>\r\n\r\n<span style=\"font-weight: 400;\">Consumers also often complained that account balances did not seem to be decreasing by much, despite regular repayments. Soobrathi said this pointed to a lack of understanding around the interest rates, fees and charges on the account. </span>\r\n<h4><b>Case studies </b></h4>\r\n<span style=\"font-weight: 400;\">Under the National Credit Act, there are prescribed periods for how long certain information remains on your credit profile. </span>\r\n\r\n<span style=\"font-weight: 400;\">In the first case, the complainant was unhappy that there was a judgment against him listed on his profile and he was unable to access any further credit because of this. He asked the Credit Ombudsman to order the removal of the judgment from his profile. </span>\r\n\r\n<span style=\"font-weight: 400;\">However, under the NCA, a judgment listing remains on your credit profile for five years and can only be removed if you settle the debt before the five-year period expires. </span>\r\n\r\nThe time limits for different information on your credit profile, as per the National Credit Act, are:\r\n<ul>\r\n \t<li>The details and results of any disputes lodged by you about information on your credit profile: <strong>18 months.</strong></li>\r\n \t<li>Enquiries made regarding your credit record, including the name of the person or company that made the enquiry: <strong>two years.</strong></li>\r\n \t<li>Payment profile – details of any credit provided to you, the payments received and whether any payments were late: <strong>five years.</strong></li>\r\n \t<li>Adverse classifications of your payment behaviour. This includes classifications such as “delinquent”, “defaulted, “slow-paying”, “absconded” or “not contactable”: <strong>one year.</strong></li>\r\n \t<li>Notice that you are undergoing debt counselling or restructuring: <strong>until your debt counsellor issues a clearance certificate</strong>.</li>\r\n \t<li>Civil court judgment – any judgment granted by a court in a civil dispute between individuals or companies (this includes default judgments): <strong>five years or until the judgment is withdrawn by a court or abandoned by the credit provider.</strong></li>\r\n \t<li>Administration order – an order granted by a civil court in which the management and disposal of the assets of an insolvent person are awarded to a person appointed by the court until the insolvent person has paid his or her debts:<strong> 10 years or until the order is withdrawn by the court.</strong></li>\r\n \t<li>Sequestration – a court appoints a trustee or administrator to take possession of your assets until your debts have been repaid or other claims have been met: <strong>10 years or until a rehabilitation order is granted.</strong></li>\r\n \t<li>Liquidation – a court places the property of a bankrupt person or company in the hands of a third party (trustee) to be divided among the creditors: <strong>no limit</strong>.</li>\r\n \t<li>Rehabilitation order – an order granted by a civil court that restores the financial standing or reputation of a person who was insolvent: <strong>five years</strong>.</li>\r\n</ul>\r\n<strong>Prescription of debt </strong>\r\n\r\nSoobrathi says the law of prescription and its application is often a very tricky subject that has caused much confusion over the years.\r\n\r\n<span style=\"font-weight: 400;\">In this case, the complainant said he had made no payments on an account, it had prescribed and should be closed. However, on investigation, the Ombud’s Office found that the consumer had been reversing the payments each month – days after the successful debit had gone through – resulting in multiple reversed debit orders. </span>\r\n\r\n<span style=\"font-weight: 400;\">In this case, the consumer was well aware that the account was due and payable and the Ombud found that his actions in reversing the debit orders did not render the account as prescribed. Prescription was not confirmed and the consumer was held liable for the account. </span>\r\n\r\n<span style=\"font-weight: 400;\">Generally, prescription is interrupted by acknowledgment, either in admitting to owing the debt or making a payment towards the debt, after which you will be held liable for further payment. </span><b>DM</b>",
