"contents": "<span style=\"font-weight: 400;\">During a hybrid hearing in the Western Cape high court on Thursday, Zandile Mafe’s senior counsel Dali Mpofu informed the court that they had accepted the findings of an independent psychiatric assessment undertaken by three State-appointed specialists.</span>\r\n\r\n<span style=\"font-weight: 400;\">This comes after Judge Nathan Erasmus disclosed the psychiatrists’ and psychologists’ </span><a href=\"https://www.dailymaverick.co.za/article/2023-07-13-zandile-mafe-admits-he-torched-parliament-in-court-rant/\"><span style=\"font-weight: 400;\">findings</span></a><span style=\"font-weight: 400;\"> and asked the defence and state to submit comments on how to proceed in the arson case.</span>\r\n\r\n<span style=\"font-weight: 400;\">This development comes after more than a year of heated arguments about the mental state of the accused in both the Cape Town Magistrate’s Court and the Western Cape high court.</span>\r\n\r\n<span style=\"font-weight: 400;\">Mafe’s case will now be handled under section 77 of the <a href=\"https://pmg.org.za/files/170607summary.pdf\">Criminal Procedure Act</a>, which refers to an accused who suffers from mental illness and may not be fit to stand trial as a result.</span>\r\n\r\n<span style=\"font-weight: 400;\">This means that no one will be held liable. </span>\r\n\r\n<span style=\"font-weight: 400;\">In October 2022, R2-billion was allocated for the repair and refurbishment of the Parliament buildings.</span>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-1425741\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/10/ED_357182.jpg\" alt=\"National Assembly fire\" width=\"720\" height=\"360\" /> <em>Firefighters battle the blaze that engulfed the National Assembly in Parliament on 3 January 2022 in Cape Town, South Africa. He is accused of <a href=\"https://www.dailymaverick.co.za/article/2022-08-15-state-seeks-second-medical-opinion-on-mental-health-of-alleged-parliament-arsonist-zandile-mafe/\">setting fire to the National Assembly building</a> in the early hours of 2 January 2022</li>\r\n \t<li>District surgeon Dr Zelda van Tonder <a href=\"https://www.dailymaverick.co.za/article/2022-01-11-parliament-arson-accused-says-theres-nothing-wrong-with-him-goes-on-hunger-strike-after-state-drops-schizophrenia-bomb/\">declared</a> that Mafe was suffering from paranoid schizophrenia.</li>\r\n \t<li>On 19 January 2022, the Western Cape high court Judge President John Hlophe <a href=\"https://www.dailymaverick.co.za/article/2022-01-19-judge-president-hlophe-referral-for-mental-observation-of-parliament-arson-suspect-zandile-mafe-grossly-irregular/\">set aside</a> the referral of Mafe for mental observation and granted an order that he be immediately released to a correctional facility.</li>\r\n \t<li>Cape Town Regional Court Magistrate Michelle Adams on 4 February <a href=\"https://www.dailymaverick.co.za/article/2022-02-04-south-african-court-denies-bail-to-accused-in-parliament-fire/\">denied bail to Mafe.</a></li>\r\n \t<li>Mafe was dealt another blow in his bid to be released when the Western Cape high court <a href=\"https://www.dailymaverick.co.za/article/2022-05-30-parliaments-alleged-arsonist-must-remain-behind-bars-high-court-rules/\">dismissed an appeal</a> to overturn a ruling denying him bail.</li>\r\n \t<li>Mafe <a href=\"https://www.dailymaverick.co.za/article/2023-02-10-parliament-arson-suspect-refuses-valkenberg-hospital-observation-demands-alternative-psychiatric-facility/\">said he was ready to be transferred </a>to another facility for mental evaluation, provided it is anywhere but Valkenberg Hospital.</li>\r\n \t<li>Mafe <a href=\"https://www.dailymaverick.co.za/article/2023-03-28-alleged-parliament-arsonist-finally-sent-to-eastern-cape-for-mental-evaluation/\">underwent a mental evaluation</a> at Fort England Psychiatric Hospital to determine whether he is mentally capable of comprehending the gravity of the charges against him, the crime he allegedly committed, and defending himself in court</li>\r\n \t<li>Judge Nathan Erasmus <a href=\"https://www.dailymaverick.co.za/article/2023-06-08-judge-bars-reporting-on-suspected-parliament-arsonist-zandile-mafes-psychiatric-assessment/\">barred reporting</a> on Mafe’s psychiatric assessment.</li>\r\n \t<li>Judge Nathan Erasmus <a href=\"https://www.dailymaverick.co.za/article/2023-07-13-zandile-mafe-admits-he-torched-parliament-in-court-rant/\">release the findings</a> by the psychiatrists and psychologist, which include:</li>\r\n</ol>\r\n<ul>\r\n \t<li>Zandile Mafe is unable to follow the court proceedings as to make a proper defence and/or;</li>\r\n \t<li>At the time of the commission of the offence the accused was unable to appreciate the wrongfulness of the act in question and to act in accordance with an appreciation of the wrongfulness of his act.</li>\r\n</ul>\r\n<span style=\"font-weight: 400;\">The matter is due back in court on 1 September, 2023. </span><b>DM</b>\r\n\r\n<p><img loading=\"lazy\" class=\"size-full wp-image-1425740\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/10/ED_356933.jpg\" alt=\"Parliament fire\" width=\"720\" height=\"360\" /> <em>Firefighters attempt to extinguish the blaze at Parliament in Cape Town on 3 January, 2022. "description": "Dali Mpofu is a South African lawyer, politician, and former businessman. He served in this position until 2019, when he was replaced by Floyd Shivambu.\r\n\r\nDali Mpofu is a controversial figure. He has been criticized for his handling of a Section 189 hearing as the representative of the suspended Public Protector, Busisiwe Mkhwebane. He has drawn criticism for his outspoken views on a range of issues.\r\n\r\nHowever, he is also a respected lawyer and politician. He is a skilled advocate and a formidable debater.\r\n\r\nMpofu is married to Mpumi Nxumalo. They have four children.",

He is accused of <a href=\"https://www.dailymaverick.co.za/article/2022-08-15-state-seeks-second-medical-opinion-on-mental-health-of-alleged-parliament-arsonist-zandile-mafe/\">setting fire to the National Assembly building</a> in the early hours of 2 January 2022</li>\r\n \t<li>District surgeon Dr Zelda van Tonder <a href=\"https://www.dailymaverick.co.za/article/2022-01-11-parliament-arson-accused-says-theres-nothing-wrong-with-him-goes-on-hunger-strike-after-state-drops-schizophrenia-bomb/\">declared</a> that Mafe was suffering from paranoid schizophrenia.</li>\r\n \t<li>On 19 January 2022, the Western Cape high court Judge President John Hlophe <a href=\"https://www.dailymaverick.co.za/article/2022-01-19-judge-president-hlophe-referral-for-mental-observation-of-parliament-arson-suspect-zandile-mafe-grossly-irregular/\">set aside</a> the referral of Mafe for mental observation and granted an order that he be immediately released to a correctional facility.</li>\r\n \t<li>Cape Town Regional Court Magistrate Michelle Adams on 4 February <a href=\"https://www.dailymaverick.co.za/article/2022-02-04-south-african-court-denies-bail-to-accused-in-parliament-fire/\">denied bail to Mafe.</a></li>\r\n \t<li>Mafe was dealt another blow in his bid to be released when the Western Cape high court <a href=\"https://www.dailymaverick.co.za/article/2022-05-30-parliaments-alleged-arsonist-must-remain-behind-bars-high-court-rules/\">dismissed an appeal</a> to overturn a ruling denying him bail.</li>\r\n \t<li>Mafe <a href=\"https://www.dailymaverick.co.za/article/2023-02-10-parliament-arson-suspect-refuses-valkenberg-hospital-observation-demands-alternative-psychiatric-facility/\">said he was ready to be transferred </a>to another facility for mental evaluation, provided it is anywhere but Valkenberg Hospital.</li>\r\n \t<li>Mafe <a href=\"https://www.dailymaverick.co.za/article/2023-03-28-alleged-parliament-arsonist-finally-sent-to-eastern-cape-for-mental-evaluation/\">underwent a mental evaluation</a> at Fort England Psychiatric Hospital to determine whether he is mentally capable of comprehending the gravity of the charges against him, the crime he allegedly committed, and defending himself in court</li>\r\n \t<li>Judge Nathan Erasmus <a href=\"https://www.dailymaverick.co.za/article/2023-06-08-judge-bars-reporting-on-suspected-parliament-arsonist-zandile-mafes-psychiatric-assessment/\">barred reporting</a> on Mafe’s psychiatric assessment.</li>\r\n \t<li>Judge Nathan Erasmus <a href=\"https://www.dailymaverick.co.za/article/2023-07-13-zandile-mafe-admits-he-torched-parliament-in-court-rant/\">release the findings</a> by the psychiatrists and psychologist, which include:</li>\r\n</ol>\r\n<ul>\r\n \t<li>Zandile Mafe is unable to follow the court proceedings as to make a proper defence and/or;</li>\r\n \t<li>At the time of the commission of the offence the accused was unable to appreciate the wrongfulness of the act in question and to act in accordance with an appreciation of the wrongfulness of his act.</li>\r\n</ul>\r\n<span style=\"font-weight: 400;\">The matter is due back in court on 1 September, 2023. </span><b>DM</b>\r\n\r\n[caption id=\"attachment_1425740\" align=\"alignnone\" width=\"720\"]<img class=\"size-full wp-image-1425740\" src=\"https://www.dailymaverick.co.za/wp-content/uploads/2022/10/ED_356933.jpg\" alt=\"Parliament fire\" width=\"720\" height=\"360\" /> <em>Firefighters attempt to extinguish the blaze at Parliament in Cape Town on 3 January, 2022.
