"contents": "<span style=\"font-weight: 400;\">Recently subpoenaed to provide a “record of proceedings” — the documents, evidence, arguments and other information relating to the dismissal of community representative Peter Becker from the board of the National Nuclear Regulator (NNR) in February this year — the Minister of Minerals and Energy, Gwede Mantashe, has thrown the book right back. </span>\r\n\r\nhttps://www.dailymaverick.co.za/article/2022-04-19-fired-national-nuclear-regulator-board-member-takes-minister-gwede-mantashe-to-court/\r\n\r\n<span style=\"font-weight: 400;\">Up to 30 documents have been submitted to the attorneys concerned, including emails and minutes of NNR board meetings, which until now have not been disclosed — not even to Outa, which attempted to access them via a Promotion of Access to Information Act submission.</span>\r\n\r\n<span style=\"font-weight: 400;\">Becker, a known anti-nuclear activist and member of the Koeberg Alert Alliance, was appointed to the board of the National Nuclear Regulator last June as its community representative and was thereby duty-bound to serve the interests of communities that may be affected by nuclear activities. </span>\r\n\r\n<span style=\"font-weight: 400;\">By February 2022, he had been fired for “misconduct”.</span>\r\n\r\n<span style=\"font-weight: 400;\">The board, it appears, could not tolerate Becker’s persistent questioning, requests for information and concerns about the licensing of Koeberg’s Long-Term Operation, coupled with his outspoken anti-nuclear stance. </span>\r\n\r\n<span style=\"font-weight: 400;\">Within weeks of Becker having joined the board, NNR chairperson Dr Thapelo Motshudi commissioned a legal opinion “to establish whether Mr Becker is conflicted or not, and if he is conflicted, propose measures in which such conflict may be managed”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Armed with the legal opinion, Motshudi wrote to Minister Gwede Mantashe in October explaining his concerns and requesting that he “act”. </span>\r\n\r\n<span style=\"font-weight: 400;\">“</span><span style=\"font-weight: 400;\">Mr Becker has inundated the NNR management with requests for NNR documents and information outside of the normal board process,” he wrote. “Mr Becker also wrote emails directly to me in my capacity as chairperson of the board requesting information.</span>\r\n\r\n<span style=\"font-weight: 400;\">“In addition, Mr Becker’s conduct has led to several complaints from the NNR management, some members of the board and also Eskom, the holder of a nuclear authorisation licence for the Koeberg Nuclear Power Station.” </span>\r\n\r\nhttps://www.dailymaverick.co.za/article/2022-05-18-nathi-mthethwas-final-monumental-red-flag/\r\n\r\n<span style=\"font-weight: 400;\">The coup de grâce, however, was the legal opinion — known as the MacRobert opinion. This </span><span style=\"font-weight: 400;\">found that “Becker’s conduct is not protecting or promoting the business interests of the NNR and preserving the NNR’s reputation or goodwill”.</span>\r\n\r\n<span style=\"font-weight: 400;\">Further, the opinion stated, his role as the spokesperson of the Koeberg Alert Alliance and the statements he made therein conflicted with his role as a board member of the NNR. </span>\r\n\r\n<span style=\"font-weight: 400;\">“In light of this conclusion, the NNR was advised to inform the Minister of the conduct of Mr Becker and request the Minister to act on it since the Minister is the competent authority that is responsible for appointment and removal of NNR board members.” </span>\r\n\r\n<span style=\"font-weight: 400;\">What transpired thereafter is detailed in the “decision memorandum” written by the director-general of the Department of Mineral Resources and Energy, advocate Thabo Mokoena, also submitted by Mantashe’s office.</span>\r\n\r\n<span style=\"font-weight: 400;\">It noted that Becker was suspended from the board in January — just days before the regulator approved the extension-of-life project for Koeberg — and, following a legal challenge by Becker, was given the opportunity to make a written submission prior to the minister making a final decision in February. </span>\r\n\r\n<span style=\"font-weight: 400;\">Becker made his case, arguing that his anti-nuclear position was known ahead of his appointment; that his membership of the KAA was not a conflict; and that as a board member his stance was one of oversight — to gather sufficient documentary evidence to ensure that nuclear power, and Koeberg to be specific, adhered to robust safety standards.</span>\r\n\r\n<span style=\"font-weight: 400;\">That, he argues, is the job of the NNR. It is not, he says, to advocate for nuclear power. That is the job of the SA Nuclear Energy Corporation. </span>\r\n\r\n<span style=\"font-weight: 400;\">Counsel acting for Mantashe was not swayed by these arguments and maintained that the conflict of interest was “material and fundamental”, and recommended Becker be discharged.</span>\r\n\r\n<span style=\"font-weight: 400;\">Following another fortnight of legal back and forth, Becker was dismissed in February.</span>\r\n\r\n<span style=\"font-weight: 400;\">Becker’s lawyers are now work</span><span style=\"font-weight: 400;\">ing on a supplementary founding affidavit, based on the information received. "description": "<span style=\"font-weight: 400\">Gwede Mantashe is a South African politician and the current Minister of Mineral Resources and Energy within the African National Congress (ANC). </span>\r\n\r\n<span style=\"font-weight: 400\">The portfolio was called the Ministry of Minerals and Energy until May 2009, when President Jacob Zuma split it into two separate portfolios under the Ministry of Mining (later the Ministry of Mineral Resources) and the Ministry of Energy. Ten years later, in May 2019, his successor President Cyril Ramaphosa reunited the portfolios as the Ministry of Mineral Resources and Energy. </span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe</span><span style=\"font-weight: 400\"> was born in 1955 in the Eastern Cape province, and began his working life at Western Deep Levels mine in 1975 as a Recreation Officer and, in the same year, moved to Prieska Copper Mines where he was Welfare Officer until 1982.</span>\r\n\r\n<span style=\"font-weight: 400\">He then joined Matla Colliery and co-founded the Witbank branch of the National Union of Mine Workers (NUM), becoming its Chairperson. He held the position of NUM Regional Secretary in 1985. Mantashe showcased his skills and leadership within the NUM, serving as the National Organiser from 1988 to 1993 and as the Regional Coordinator from 1993 to 1994.</span>\r\n\r\n<span style=\"font-weight: 400\">From 1994 to 1998, Mantashe held the role of Assistant General Secretary of the NUM and was later elected General Secretary in 1998.</span>\r\n\r\n<span style=\"font-weight: 400\">During his initial tenure in government, Mantashe served as a Councillor in the Ekurhuleni Municipality from 1995 to 1999. Notably, he made history by becoming the first trade unionist appointed to the Board of Directors of a Johannesburg Stock Exchange-listed company, Samancor.</span>\r\n\r\n<span style=\"font-weight: 400\">In May 2006, Mantashe stepped down as the General Secretary of the NUM and took on the role of Executive Director at the Development Bank of Southern Africa for a two-year period. He also chaired the Technical Working Group of the Joint Initiative for Priority Skills Acquisition.</span>\r\n\r\n<span style=\"font-weight: 400\">In 2007, Mantashe became the Chairperson of the South African Communist Party and a member of its Central Committee. He was elected Secretary-General of the African National Congress (ANC) at the party's 52nd National Conference in December 2007. Mantashe was re-elected to the same position in 2012. Additionally, at the ANC's 54th National Conference in 2017, he was elected as the National Chairperson.</span>\r\n\r\n<span style=\"font-weight: 400\">Mantashe is a complex and controversial figure. He has been accused of being too close to the ANC's corrupt leadership, and of being a hardliner who is opposed to reform. </span>\r\n\r\n<span style=\"font-weight: 400\">His actions and statements have sparked controversy and allegations of protecting corruption, undermining democratic principles, and prioritising party loyalty over the interests of the country.</span>",
