"contents": "<span style=\"font-weight: 400;\">Non-profit organisations (NPOs) play an integral role in South African society, providing support, funding and expertise in areas ranging from social security to education, health to the environment. </span>\r\n\r\n<span style=\"font-weight: 400;\">Now, a group representing this key sector is petitioning for the withdrawal of the </span><a href=\"https://www.inyathelo.org.za/non-profit-amendment-bill-2021.html\"><span style=\"font-weight: 400;\">NPO Amendment Bill</span></a><span style=\"font-weight: 400;\">, citing concerns about how the proposed changes in the document will impact the operation of NPOs.</span>\r\n\r\n<span style=\"font-weight: 400;\">The </span><a href=\"https://www.inyathelo.org.za/important-information.html\"><span style=\"font-weight: 400;\">NPO Working Group</span></a><span style=\"font-weight: 400;\">, formed in late 2021 to assist with coordinating comments from the NPO sector about the amendments in the bill, </span><a href=\"https://awethu.amandla.mobi/petitions/have-your-say-tell-dsd-to-withdraw-the-draft-npo-amendment-bill?source=whatsapp-share-button&utm_source=whatsapp&share=59ad7bce-32c4-4747-a5ff-c623642e9934\"><span style=\"font-weight: 400;\">launched the petition</span></a><span style=\"font-weight: 400;\"> calling for the withdrawal of the proposal towards the end of May 2022.</span>\r\n\r\n<span style=\"font-weight: 400;\">The overriding sentiment among NPOs when it comes to the bill is “fear”, according to Nazeema Mohamed, chairperson of the NPO Working Group and executive director of </span><a href=\"https://www.inyathelo.org.za/\"><span style=\"font-weight: 400;\">Inyathelo</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">“[NPOs] have great concern that they will be deregistered because they wouldn’t be compliant,” she said. “We really don’t understand what the bill is meant to do, so… especially with smaller nonprofits, there’s concern that they haven’t had the space and capacity to engage the bill.”</span>\r\n\r\n<span style=\"font-weight: 400;\">The Working Group has previously advocated for an </span><a href=\"https://www.inyathelo.org.za/images/docs/Communique_2.pdf\"><span style=\"font-weight: 400;\">extension of the deadline</span></a><span style=\"font-weight: 400;\"> for comments on the bill, as the initial two-week period — ending on 31 October 2021 — left the NPO sector little time to respond. (Photo: Supplied)</p>\r\n<h4><b>The petition</b></h4>\r\n<span style=\"font-weight: 400;\">The petition proposes that the Department of Social Development (DSD) should engage in consultation with stakeholders in the NPO sector to redraft the current legislation and develop a “coherent NPO Policy Framework to meet the real challenges of the sector”.</span>\r\n\r\n<span style=\"font-weight: 400;\">“We, as civil society, do want to come alongside government with a solution,” emphasised Dee Moskoff, a member of the NPO Working Group and co-founder of Social Causes.</span>\r\n\r\n<span style=\"font-weight: 400;\">There has been consultation between the department and the NPO sector during the years leading up to the bill, according to Mohamed. She referenced two reports by the Human Sciences Research Council, commissioned by the National Development Agency, that looked at </span><a href=\"https://www.nda.org.za/assets/resources/CF824421-4FA0-41EE-AB69-4DB10CD0384A/CSORegulatoryFrameworks-ResearchReport.pdf\"><span style=\"font-weight: 400;\">regulatory frameworks requirements</span></a><span style=\"font-weight: 400;\"> and </span><a href=\"https://www.nda.org.za/assets/resources/CF824421-4FA0-41EE-AB69-4DB10CD0384A/CSOsCapacitiesandCapabilitiesresearchstudy.pdf\"><span style=\"font-weight: 400;\">capacity building</span></a><span style=\"font-weight: 400;\"> for the South African civil society sector, respectively.</span>\r\n\r\n<span style=\"font-weight: 400;\">“There’s been quite a bit of work and… a lot of consultation, but there’s been an inability to pull it all together,” said Mohamed. </span>\r\n\r\n<span style=\"font-weight: 400;\">“So, what we have is [an NPO] Directorate that hasn’t been given the capacity that it should have – that hasn’t been given the funding that it should have. </span>\r\n\r\n<span style=\"font-weight: 400;\">“They’re actually drowning in relation to the database and the number of registrations that are expected to take place.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Prior to the launch of the petition, the Working Group had reached out to the DSD about withdrawing the bill. </span>\r\n\r\n<span style=\"font-weight: 400;\">In a </span><a href=\"https://www.inyathelo.org.za/images/docs/Minister_Zulu_280422_4.pdf\"><span style=\"font-weight: 400;\">jointly submitted letter</span></a><span style=\"font-weight: 400;\"> to Minister of Social Development Lindiwe Zulu on 28 April 2022, the group detailed its misgivings about the proposal and requested that it be recalled.</span>\r\n\r\n<span style=\"font-weight: 400;\">“Though we understand and support the intention to cut red tape, improve efficiencies and create an enabling environment, in practice, however, the proposed changes are complex and often contradict such intentions,” said the letter.</span>\r\n\r\n<span style=\"font-weight: 400;\">The DSD has in turn requested that any such recommendations be submitted as comments on the bill. However, Mohamed expressed concern that many NPOs do not have the capacity to make submissions regarding the proposal, either because they are unaware of it or because they do not know how to engage with it.</span>\r\n\r\n<span style=\"font-weight: 400;\">“So, the petition is an easier route to have their voices heard,” she said.</span>\r\n\r\nhttps://www.dailymaverick.co.za/article/2022-06-02-why-ramaphosa-apparently-kept-mum-about-multimillion-dollar-robbery-at-his-farm/\r\n<h4><b>Key concerns</b></h4>\r\n<span style=\"font-weight: 400;\">In a </span><a href=\"https://www.inyathelo.org.za/images/docs/Communique_2.pdf\"><span style=\"font-weight: 400;\">letter</span></a><span style=\"font-weight: 400;\"> issued on 3 December 2021, the NPO Working Group shared the DSD’s intention to amend the NPO Act in two stages. </span>\r\n\r\n<span style=\"font-weight: 400;\">The first, represented by the </span><a href=\"https://www.dailymaverick.co.za/article/2022-04-13-the-npo-amendment-bill-is-a-mess-awash-with-inconsistencies-and-clumsy-provisions/\"><span style=\"font-weight: 400;\">NPO Amendment Bill</span></a><span style=\"font-weight: 400;\">, would involve largely administrative changes that would apply to less than 15% of the Act. </span>\r\n\r\n<span style=\"font-weight: 400;\">The second would be represented by a different bill with an accompanying policy document, allowing more substantive changes to the Act.</span>\r\n\r\n<span style=\"font-weight: 400;\">“We as the [NPO] sector felt that we wanted one phase. We said it would be better to actually first have the policy review, consultation on the policy, and then do the amendments,” said Mohamed. </span>\r\n\r\n<span style=\"font-weight: 400;\">“Why do one set of amendments and then do a policy review and then go back and do another set of amendments?”</span>\r\n\r\n<span style=\"font-weight: 400;\">She made the example of a proposal within the NPO Amendment Bill that would see the NPO Directorate renamed as the Office of the Registrar. While the Working Group is not against the change, they want it to be accompanied by substantive amendments that would improve the capacity of the body.</span>\r\n\r\n<span style=\"font-weight: 400;\">“We always wanted [the directorate] to be an independent body, separated from… government departments,” explained Ann Bown, an independent consultant on the NPO Working Group.</span>\r\n\r\n<span style=\"font-weight: 400;\">“The focus… should be on all nonprofits — education, sports, arts, culture, whatever, and it’s such a broad field… so, ideally, this regulator should become totally independent of any of the ministries.”</span>\r\n\r\n<span style=\"font-weight: 400;\">The change in the NPO Amendment Bill, however, is just a matter of nomenclature, said Mohamed. “We’re just seeing a changing name — we’re not seeing the substance.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Another problematic change put forward in the bill is the </span><a href=\"https://www.dailymaverick.co.za/opinionista/2021-10-20-controlling-the-purse-strings-proposed-new-law-on-non-profit-organisations-is-vague-and-confusing-we-need-clarity/\"><span style=\"font-weight: 400;\">compulsory registration requirement</span></a><span style=\"font-weight: 400;\"> for foreign NPOs, according to William Bird, member of the NPO Working Group and director of </span><a href=\"https://mediamonitoringafrica.org/\"><span style=\"font-weight: 400;\">Media Monitoring Africa</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">“In the bill, the way it’s framed, they don’t define what they mean by foreign entity,” said Bird. </span>\r\n\r\n<span style=\"font-weight: 400;\">“So, it’s just really poorly conceived and drafted, and the moment you have that, it means that the possibility for abuse is just enormous.”</span>\r\n\r\n<span style=\"font-weight: 400;\">The aim of the compulsory registration requirement — to better prevent money laundering and the financing of terrorist organisations through NPOs — will not be achieved, he said. </span>\r\n\r\n<span style=\"font-weight: 400;\">Registration alone will not provide government with the information it needs to identify and track illicit activities.</span>\r\n\r\n<span style=\"font-weight: 400;\">Moreover, such a requirement is unconstitutional, according to a Media Monitoring Africa memo from 13 April 2022. </span>\r\n\r\n<span style=\"font-weight: 400;\">International human rights law favours a notification procedure over a prior authorisation procedure when it comes to the establishment of NPOs and legal entities. Legal frameworks that mandate registration have the potential to violate the right to freedom of association.</span>\r\n\r\n<span style=\"font-weight: 400;\">Other issues with the NPO Amendment Bill identified in the NPO Working Group’s petition include:</span>\r\n<ul>\r\n \t<li>The poor drafting of the bill, which leaves it open to interpretation;</li>\r\n \t<li>The lack of precise alignment between the DSD’s stated intentions and the actual amendments;</li>\r\n \t<li>The proposed new structure for NPO boards, which requires additional deputies; and</li>\r\n \t<li>The proposed clean-up of the NPO database. Little clarity was provided as to the conditions under which organisations would be deregistered.</li>\r\n</ul>\r\n<i><span style=\"font-weight: 400;\">Maverick Citizen</span></i><span style=\"font-weight: 400;\"> reached out to the DSD regarding the NPO Working Group’s petition. Lumka Oliphant, spokesperson for the department, said: “In a democratic country like ours, the process of any legislative drafting or amendment has an element of gazetting in order to consider public comments. </span>\r\n\r\n<span style=\"font-weight: 400;\">“This process also affects the NPO Amendment Bill, where South Africans are given an opportunity to submit in writing their views on the proposed amendment… Public comments are open until 9 June 2022, where all views of the interest parties will be consolidated and processed.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Oliphant did not respond to questions about the specific concerns raised in the petition. </span><b>DM/MC</b>",

However, Mohamed expressed concern that many NPOs do not have the capacity to make submissions regarding the proposal, either because they are unaware of it or because they do not know how to engage with it.</span>\r\n\r\n<span style=\"font-weight: 400;\">“So, the petition is an easier route to have their voices heard,” she said.</span>\r\n\r\nhttps://www.dailymaverick.co.za/article/2022-06-02-why-ramaphosa-apparently-kept-mum-about-multimillion-dollar-robbery-at-his-farm/\r\n<h4><b>Key concerns</b></h4>\r\n<span style=\"font-weight: 400;\">In a </span><a href=\"https://www.inyathelo.org.za/images/docs/Communique_2.pdf\"><span style=\"font-weight: 400;\">letter</span></a><span style=\"font-weight: 400;\"> issued on 3 December 2021, the NPO Working Group shared the DSD’s intention to amend the NPO Act in two stages. </span>\r\n\r\n<span style=\"font-weight: 400;\">The first, represented by the </span><a href=\"https://www.dailymaverick.co.za/article/2022-04-13-the-npo-amendment-bill-is-a-mess-awash-with-inconsistencies-and-clumsy-provisions/\"><span style=\"font-weight: 400;\">NPO Amendment Bill</span></a><span style=\"font-weight: 400;\">, would involve largely administrative changes that would apply to less than 15% of the Act. </span>\r\n\r\n<span style=\"font-weight: 400;\">The second would be represented by a different bill with an accompanying policy document, allowing more substantive changes to the Act.</span>\r\n\r\n<span style=\"font-weight: 400;\">“We as the [NPO] sector felt that we wanted one phase. We said it would be better to actually first have the policy review, consultation on the policy, and then do the amendments,” said Mohamed. </span>\r\n\r\n<span style=\"font-weight: 400;\">“Why do one set of amendments and then do a policy review and then go back and do another set of amendments?”</span>\r\n\r\n<span style=\"font-weight: 400;\">She made the example of a proposal within the NPO Amendment Bill that would see the NPO Directorate renamed as the Office of the Registrar. While the Working Group is not against the change, they want it to be accompanied by substantive amendments that would improve the capacity of the body.</span>\r\n\r\n<span style=\"font-weight: 400;\">“We always wanted [the directorate] to be an independent body, separated from… government departments,” explained Ann Bown, an independent consultant on the NPO Working Group.</span>\r\n\r\n<span style=\"font-weight: 400;\">“The focus… should be on all nonprofits — education, sports, arts, culture, whatever, and it’s such a broad field… so, ideally, this regulator should become totally independent of any of the ministries.”</span>\r\n\r\n<span style=\"font-weight: 400;\">The change in the NPO Amendment Bill, however, is just a matter of nomenclature, said Mohamed. “We’re just seeing a changing name — we’re not seeing the substance.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Another problematic change put forward in the bill is the </span><a href=\"https://www.dailymaverick.co.za/opinionista/2021-10-20-controlling-the-purse-strings-proposed-new-law-on-non-profit-organisations-is-vague-and-confusing-we-need-clarity/\"><span style=\"font-weight: 400;\">compulsory registration requirement</span></a><span style=\"font-weight: 400;\"> for foreign NPOs, according to William Bird, member of the NPO Working Group and director of </span><a href=\"https://mediamonitoringafrica.org/\"><span style=\"font-weight: 400;\">Media Monitoring Africa</span></a><span style=\"font-weight: 400;\">.</span>\r\n\r\n<span style=\"font-weight: 400;\">“In the bill, the way it’s framed, they don’t define what they mean by foreign entity,” said Bird. </span>\r\n\r\n<span style=\"font-weight: 400;\">“So, it’s just really poorly conceived and drafted, and the moment you have that, it means that the possibility for abuse is just enormous.”</span>\r\n\r\n<span style=\"font-weight: 400;\">The aim of the compulsory registration requirement — to better prevent money laundering and the financing of terrorist organisations through NPOs — will not be achieved, he said. </span>\r\n\r\n<span style=\"font-weight: 400;\">Registration alone will not provide government with the information it needs to identify and track illicit activities.</span>\r\n\r\n<span style=\"font-weight: 400;\">Moreover, such a requirement is unconstitutional, according to a Media Monitoring Africa memo from 13 April 2022. </span>\r\n\r\n<span style=\"font-weight: 400;\">International human rights law favours a notification procedure over a prior authorisation procedure when it comes to the establishment of NPOs and legal entities. Legal frameworks that mandate registration have the potential to violate the right to freedom of association.</span>\r\n\r\n<span style=\"font-weight: 400;\">Other issues with the NPO Amendment Bill identified in the NPO Working Group’s petition include:</span>\r\n<ul>\r\n \t<li>The poor drafting of the bill, which leaves it open to interpretation;</li>\r\n \t<li>The lack of precise alignment between the DSD’s stated intentions and the actual amendments;</li>\r\n \t<li>The proposed new structure for NPO boards, which requires additional deputies; and</li>\r\n \t<li>The proposed clean-up of the NPO database. Little clarity was provided as to the conditions under which organisations would be deregistered.</li>\r\n</ul>\r\n<i><span style=\"font-weight: 400;\">Maverick Citizen</span></i><span style=\"font-weight: 400;\"> reached out to the DSD regarding the NPO Working Group’s petition. Lumka Oliphant, spokesperson for the department, said: “In a democratic country like ours, the process of any legislative drafting or amendment has an element of gazetting in order to consider public comments. </span>\r\n\r\n<span style=\"font-weight: 400;\">“This process also affects the NPO Amendment Bill, where South Africans are given an opportunity to submit in writing their views on the proposed amendment… Public comments are open until 9 June 2022, where all views of the interest parties will be consolidated and processed.”</span>\r\n\r\n<span style=\"font-weight: 400;\">Oliphant did not respond to questions about the specific concerns raised in the petition. </span><b>DM/MC</b>",
