"contents": "\r\n<p><span style=\"font-size: 12pt; font-family: georgia, palatino;\">Well, it might only be Wednesday but we can safely predict, unless there is an urgent appeal, that the front page of next issue of The Sunday Times will be dedicated to carrying three large unconditional apologies to Finance Minister Pravin Gordhan as well as former acting SARS commissioner, Ivan Pillay, and group executive, Johan van Loggerenberg, for implicating them in the establishment of an illegal and covert investigative unit at SARS.</span></p>\r\n<p><span style=\"font-family: georgia, palatino; font-size: 12pt;\"><span><span >In three damning findings released today Press Ombudsman Johan Retief found that the newspaper and its investigative team had been “inaccurate, misleading and unfair” in its coverage of the so-called “rogue” unit and has called on the paper to print prominent front page apologies as well as carry these on its website. It has also been ordered to retract the stories and editorials.</span></span></span></p>\r\n<p><span style=\"font-family: georgia, palatino; font-size: 12pt;\"><span><span >The Sunday Times has seven days to appeal the ruling. The ruling also vindicates former investigative journalist Pearlie Joubert, who broke ranks, providing an affidavit that stated that the source for the paper's reports was former Sunday Times editor Phylicia Oppelt's ex-husband, advocate Rudolf Mastenbroek, a SARS official. Joubert claimed the leaks appeared to be part of “an orchestrated campaign”. The Sunday Times stories, based on a draft KPMG report, which the paper claimed was “final”, led to the sacking of Pillay and Van Loggerenberg.</span></span></span></p>\r\n<p><span style=\"font-size: 12pt; font-family: georgia, palatino;\"><span><span><span><span style=\"\"><span >Retief, however, did not make a finding on this the complaint that The Sunday times “was </span></span></span></span></span><span><span><span><span style=\"\"><span >motivated by non-professional and personal considerations (conflict of interests)”.</span></span></span></span></span></span></p>\r\n<p><span style=\"font-family: georgia, palatino; font-size: 12pt;\"><span><span >While it is not certain what the consequences of this ruling will be, it is clear that current SARS commissioner, Tom Moyane, hand-picked by President Jacob Zuma to replace Pillay, will be feeling pressure.</span></span></span></p>\r\n<p><span style=\"font-family: georgia, palatino; font-size: 12pt;\"><span><span >In its ruling on the Pillay and Van Loggerenberg complaints the Ombudsman found that the Sunday Times had been in breach of several sections of the Press Code including the exercising of “care and consideration in matters involving dignity and reputation.”</span></span></span></p>\r\n<p><span style=\"font-size: 12pt; font-family: georgia, palatino;\"><span><span><span><span style=\"\"><span >In his finding on the Pillay matter, Retief ruled that the The Sunday Times “</span></span></span></span></span><span><span>should have provided Pillay with a copy of the summary of the KPMG report – without which it was unfair to expect him to comment meaningfully on that document. This was </span></span><span><span><span style=\"\">in breach of</span></span></span><span><span><b> </b></span></span><span><span>Section 2.5 of the Press Code”.</span></span></span></p>\r\n<p><span style=\"font-family: georgia, palatino; font-size: 12pt;\"><span>The newspaper, he added, had not been justified in presenting the findings of the KPMG report as the “true version of KPMG's final report at the time of publication.”</span></span></p>\r\n<p><span style=\"font-family: georgia, palatino; font-size: 12pt;\"><span>He found that editorial comment in the paper on the SARS saga was not based on facts that were “true or substantially true” and that it was not “fair comment”</span></span></p>\r\n<p><span style=\"font-size: 12pt; font-family: georgia, palatino;\"><span><span>With regard to Van Loggerenberg's complaint, the Ombudsman found that the newspaper should have provided him with “a copy of the summary of the KPMG report – without which it was unfair to expect him to comment meaningfully on that document. This was </span></span><span><span><span style=\"\">in breach of Section 2.5 of the Press Code</span></span></span><span><span> that says, 'A publication shall seek the views of the subject of critical reportage in advance of publication…' (The implication, of course, is that such a request should include all material aspects of the matter.)”</span></span></span></p>\r\n<p><span style=\"font-family: georgia, palatino; font-size: 12pt;\"><span>The paper was not justified in presenting the findings as “the true version of KPMG’s final report at the time of publication” said the Ombusman.</span></span></p>\r\n<p><span style=\"font-size: 12pt; font-family: georgia, palatino;\"><span><span>With regard to the paper's allegations of a brothel that had been set up on by the alleged unit to spy on ANC politicians, the Ombudsman found that this story “</span></span><span><span><span >was in a way rectifying earlier reports. In earlier reports the Sunday Times had linked Van Loggerenberg with the establishing of a brothel. In this story, subheaded 'SARS official denies running sex club...' Van Loggerenberg’s name was not mentioned. The Sunday Times should have, in accordance with Sect. 2.6, have corrected the fact that Van Loggerenberg did not run a brothel.” </span></span></span></span></p>\r\n<p><span style=\"font-size: 12pt; font-family: georgia, palatino;\"><span><span><span >Van Loggerenberg informed The Sunday Times and its owners Times Media Limited a month ago of his intentions to sue the media group. </span></span></span></span><span style=\"font-size: 10pt; font-family: georgia, palatino;\"><b><span >DM</span></b></span></p>",
